where does my dislike of law enforcement come from you would consider search your car nope I knew that was coming I wouldn't tell you anything like that why not because my life ain't none of your business you're gonna stop talking so I can talk I don't ever tell me how to use my freedom speech welcome back to the lackluster channel on the 11th of February 2023 a viewer named Patrick was driving down Needham Road in Porter Texas when he noticed officer K part of the Montgomery County Constable Precinct 4 driving in the opposite direction as the officer passed Patrick lifted his middle finger to the officer just flip that cough off and he did not like that the officer immediately conducted a U-turn and initiated a traffic stop how's it going is there a problem what would you think that well for one when he drove by me he flipped me off two um also he didn't signal within 100 feet of your turn right there oh why are you lying oh I'm not actually it's on my dash cam okay I'm not sure take it in front of a judge you can take it proves that I did use it you're gonna apologize no you can use your signal okay you did use your signal but you did not signal within 100 feet of your turn yeah okay I'm not gonna stay here and debate it it might have been like 90 feet or something like that but okay so then you're admitting to not within 100 people no I said it might have been but any reasonable person would have said that was about 100 feet okay all right I have a place whatever you say Bud the officer announces that his initial concern was the waving of a middle finger and then changes his story to say that Patrick failed to continuously signal for the last 100 feet of movement prior to his turn the officer also claims that this is caught on dash cam footage however despite my records request with the Montgomery County Constable Precinct 4 records Clerk the dash cam has not been made available so where are you heading uh choose not to share that today where are you coming from she's not share that today so um I've got can I also get your name badge number Sergeant hook you up there you go yeah the officer takes Patrick's information and returns three minutes later I say your last name sorry how do you say your last name okay come talk to me for a minute okay oh come talk to you come talk to you about what back here you have any weapons on you or anything like that no nothing like that uh attention down real quick oh wait I actually have my pocket knife in my pocket go for it you said you're nice in your pocket yeah in my left pocket go for it let me ask you a question man yeah how's it going so where does the um where does my dislike of law enforcement come from so yes I did observe a traffic violation but I don't think you did okay okay well you're you're free to not believe me right it doesn't really matter sure okay so but I am genuinely curious freedom of speech why not I didn't ask or I didn't ask you you know or tell you you're not allowed to I'm just doing oh I know I'm not high I know I'm allowed to uh well I don't know man like I'm not going to tell you anything like that I'm not going to tell you anything about my personal life okay you're gonna responding all right that's all you think about that yeah sure why not on a need to know basis and you don't need to know I'm gonna need a new basis and we don't need to ask everybody that I deal with I'm sure you do because I like to know who I'm doing right sure okay but I don't have to give you any of that information so I choose not to so fair enough if you have anything illegal in the car nope okay do you have any weapons in the car nope then we can send to search your car nope I knew that was coming all right what's up Patrick denies the officer's consent to search his vehicle and without consent in order to search a car an officer needs probable cause that you have committed some crime other than the traffic violation but in this case there is no probable cause and it appears as though the officer extends the stop needlessly to wait for a K-9 unit in the Supreme Court case of Rodriguez V United States the Court held that unless police have Reasonable Suspicion of a crime it is an unconstitutional seizure for them to extend a legal traffic stop in order to conduct a dog sniff a Freer sniff at a traffic stop is considered a search within the Fourth Amendment and that requires probable cause but the police cannot use a drug dog to obtain that probable cause unless they already have Reasonable Suspicion the officer's authority to hold you up at your vehicle ends once their tasks tied to the traffic stop are or reasonably should have been finished and now nearly 10 minutes later a K-9 unit arrives I believe my partner's already talked to you a little bit um are you going to give us search your vehicle no no okay all right that being the case I have a certified non-conscious texture Canada okay I'm going to walk around for a pre or some of the vehicles there anything you want to make him aware of right now not at all okay go ahead step back over here on the faster side of my partner's car ah the canine Officer runs a free air Sniff and returns with nothing and then erroneously tries to tie waving a middle finger at an officer to a road rage incident so just saw everybody knowing somewhere around my partner 2020 okay yeah so my dog's certified Ricardo healers to the president's owner of methamphetamine heroin ecstasy cocaine and marijuana okay fun he didn't alert to your vehicle or anything like that just to let you know I said I always give everybody the common courtesy whenever I run my dog and stuff okay do you use any kind of Narcotics on a daily basis I don't care for you all right it's on you don't like that if I did or didn't I wouldn't tell you anything marijuana I wouldn't tell you anything like that why not because my life ain't none of your business oh okay well most people normally do you know most people are stupid okay all right have a good day you do the same uh once again you think all that was necessary over one raised middle finger awesome oh he didn't say anything about me flipping him off and then coming up with a traffic violation [Music] I would consider that just freedom of speech it can really oh really okay well I'd I'd love to see that charging Court oh you don't think so maybe you want to get with your partner afterwards and and talk to him about his ego I don't think I think we both know that's not true you don't care so why us taxpayers pay you and your your partner's got a little bit of an ego on them can't handle being flipped off but you don't care I guess we're doing the taxpayer out so absolutely to get some self-employed because I pay taxes too that's awesome I love being an entrepreneur well you see the interesting thing is that you're still paid by the taxpayers so I pay myself then yeah in a little bit of a way yeah but mostly it's just us so let me explain this to you so you can obviously get wherever you want to go yeah sure so you're getting a citation for filling the signal distance before term oh we will definitely be taking that to court awesome I'll see you there uh don't ever tell me how to use my freedom speech okay well then I'll just talk over you since you that's fine you have that right okay that's how much you put your phone over here you're gonna put your phone over here so the court can contact you okay some changes really coordinate you're gonna sign right here above my name you asked for my name there it is yep your owner before the 13th of March at 10 A.M judge Dunn's office there's the address a couple of phone numbers another mission Guild just wrong stick here yeah sure uh I'll sign that I ain't putting my phone number anywhere okay so if you if a court date changes and they can't contact you I guess this is my problem isn't it you're right it is yeah so you're gonna sign right here [Music] there you go see you in court see you in court I hope I see you in court hey you do the same thank you Patrick was released with his citation though he tells me that he plans to contest the ticket and I will keep waiting for the Constable's office to furnish my records request Patrick maintains that while he may be just stupid and poor he has spent his life as a law-abiding citizen and a good man but despite maintaining his life on a straight narrow path his interactions with law enforcement have ranged from completely unprofessional to scary and dangerous as such he vows to continue flipping Montgomery County cops off and documenting the results because in his words if I'm drawing negative attention to myself here by being a law-abiding citizen then that's a problem let me know
