welcome back to the lackluster channel in June of 2023 Franklin Police dispatchers received a 9-1-1 call from a local gas station the first Oddity was the caller's request for a specific officer the caller continued to report that two young men were being loud in the parking lot but admitted that they had left after being told to do so remember we asked when we um the caller continues to tell about the foul words the men used but then makes an admission that the sergeant he asked for is a good friend of his I know where the car stays at dude because they like to run their mouth a lot so I'm pretty sure I have a pretty good indication where they're parked at now the man calls back a second time with new claims that the men drove by the gas station playing loud music and flipping him off and then parking at another property down the street hey I was just on the phone is there any way you can tell him that this car just literally parked up here he then claims that they had turned off the music and that he couldn't even see them anymore um I'm not sure if the car is still parked over there because like they just turned up their headlights and turn the music down all right the department then put out Ebola or be on Lookout on behalf of the Sergeant's good friend Caleb from black Lexus to juvenile white males if you can get a stop on them or if you can locate them please several officers were assigned to find the men who said mean things and waved a finger at the officer's good friend as they left the location they were asked to leave and eventually officer brown spotted two men fitting the description but on foot just a couple blocks away what's going on dude what are you guys doing okay you want to hang out here for a second block because I want to talk to you for a second well I don't know where you coming from I don't committed let's see okay so we're investigating a possible crime at twice Daily's okay where you guys coming from yeah officer brown detains one of the men in handcuffs and alleges that he is investigating a crime but up to this point no crime had been committed the only information given was that they had left when they were told to played music and flipped off police officer's friend didn't take your hands up thank you awake my sergeant show somewhere to go I'm always in a hurry up I got the 4.60 why are you being contained that's a great question what's the issue here to go okay but right now we have a call for service again you're not going to tell me how to do my job in my life well you're not doing it right because I come in no confidence I don't ask questions okay good for you well when you're in the old you're talking about adult things but right now okay it's not a question sustain me he wants way too much always wrong to know my rights I guess I'm not questioning them explaining things but you're gonna be a wise guy I don't really care I guess knowing your rights to be wise knowing your rights is wise but the officer attempts to belittle the cuffed individual as sergeant Phillips good friend of the gas station clerk arrives on scene where's your car you honest questions how old are you honest question [Music] perfect how old are you all right there you go what Where You Are yeah you look like you're under age so if I told you if I was 21 then you'd be okay then I ask for your ID but what kind of have we committed I just answered that not a stop in ID State yeah Tennessee's gonna stop you can't go to someone and say oh you just look at certain way after being detained for five minutes Sergeant Phillips arrests the men for curfew in Franklin Tennessee it is unlawful for any minor 17 or younger to be in public between 11 and 5 Monday through Thursday and 12-5 on weekends however valid exceptions include lawful employment which is later claimed by one of the men despite the fact that both are older than the ages the code applies to moreover exercising First Amendment rights protected by the United States Constitution such as the free exercise of religion freedom of speech and the right of assembly are also listed exceptions under the code what qualifies as assembly is not listed but based on multiple legal definitions the mere Union of any number of persons in a lawful Place apply eyes probable cause is also required to make an arrest as sergeant Phillips has done here despite the lack of a single fact connecting them into a crime if you strike out all of the above it still only appears that the attempted enforcement of this curfew violation was simply because the caller is quote really good friends with the late arriving arresting and supervising officers [Music] oh it's powerful okay good for you you can answer my juvenile if you're under under the age of 18. there you go under arrest we're under arrest for being suspiciously under arrest [Music] you tell me street lawyer are we being contained yes the officers checked the men's ID and find that they are both of legal age which is when the handcuffs should have been removed and the men set free with an apology from the officers guess we don't live in America no more it's a pure tyrannical state what are we doing here officers what are we doing here bullets you know we're the ones that are in charge right now because that's all I'm asking yeah wasted my time take a seat pick a seat man let's go have a seat next to your friend right here yes and what I'm here you do realize that while you two guys are screwing around wasting our goddamn time I'm not doing nothing you came up to us we was minding our own business I just got off a long shift and I'm trying to go for a walk okay so go home and stop bothering people because well you're not because your car is illegally parked on somebody's private property is closed because you were just hitting in your car you understand how easy this would have been answered my questions in the first place that's the thing though I live in America I don't I don't have to bow down to everything you'll say I'm gonna do whatever you said no loss I'll go see if they want them trespassed from your store Sergeant Phillips now leaves to speak with his good friend about trespassing the men while the other officers lecture and belittle them are we free to go [Music] this is a free country and I figure I could walk on public roads I didn't know that'd be an issue it is when you commit crimes part of this but harassing who not a gas station employee when okay what evidence you have okay exactly that's what I thought oh yeah okay right now hey bro I don't know if like you don't have like the property Authority at home so like you like paint that up inside and then you throw in a uniform and you walk around no you don't know nothing about me I don't but so far I don't like video I don't like you either I wasn't bother you you came up on me we got a call for service yes it does gives us maybe you need to do a little bit about your mouth I ain't commit no crime anyone calling to say anything that don't mean nothing in the case of Illinois V Gates the Supreme Court established that they should apply a totality of the circumstances test to determine if an anonymous tip is reliable enough to provide probable cause for an arrest warrant given that the sergeant knew the 9-1-1 caller it would likely suffice but again no crime had been reported the real crime is that you're wearing this match with socks and the fact that you could have been rambling Here For Less now the real problem is that you came over here my time and you violate my rights the public pays for us to service them and when YouTubers well it is little so hey bro that might be what she says to you but I know what she said you know they make like 60 to 100K a year at Costco if you're there for a while money's not the point the point is that we're here to the public fire department's going to do a call right now yeah the sidewalk is not illegal is that not an adult decision to make as adults we don't have the decision to make the walk on the sidewalk foreign state right now since me and handcuffs are walking on the side of the road I want to answer questions but you got to I don't answer questions okay so you're violating your rice and you and you uh not not following policies that would work correct that's what I sound like very incorrect but okay meanwhile Sergeant Phillips meets with someone at the gas station his good pal didn't appear to be around some trespassing from here okay if they're harassing y'all they're up here they're Street lawyers and don't understand why we're getting out with them and why they have to ID themselves and they just parked at the business back here that's closed and yeah I was in the bathroom Tyler told me they've been here for about an hour so I went over there and I taught them they need to get their gas this isn't a hangout spot I need to leave and they started calling up seat names fair enough I figured when I was up here heating up my food they spend about 5-10 minutes on the candy aisle so I figured they're either trying to buy beer or trying to buy smoke somewhere in Old mode they look like they're about 16. they weren't getting it into it all righty he then tracked down their vehicle to look inside it as a final attempt to find something he could hem them up on unable to find anything he returns to the scene we'll cut you out of here because we now know that you're not out after curfew but you are banned from the dailies uh silver Horizon the clerk that's the reason we got out with you as well because he asked you to leave and you gave him a bunch of lip and stuff like that any other questions Phillips 925 the two were finally set free from their unlawful arrest all right you have a good night all right dismissed foreign [Music] [Music] though there appears to be several civil rights violations here the hard truth is that nothing will likely happen despite having been told that they were arrested and held in cuffs for nearly 30 minutes damages would be difficult to prove and a lawyer would be even harder to find to handle this besides even if you did find one and paid them out of pocket the officers are shielded by qualified immunity and indemnification meaning the only people that would be punished would be the taxpayers as always
