He didn't He didn't touch you or anything when he when he made that first movement? >> one minute from the stroke having anything to do with it. He says, "What?" Like he was frustrated with me. He says, "What?" >> But, he didn't touch you in that first movement. He didn't touch you, did he? Like when he first did the what, did you did he touch you? He didn't. >> He was like this. >> Okay. >> What? >> Okay. >> Like that. >> Right. And did did you hit him? >> I went like that. >> But, he And then that's when he grabbed your arm? >> I I I put my arm down and he grabbed my arm and started twisting and wouldn't let >> Okay. >> I was screaming. It was just that painful. >> Okay. Do you mind if I take some photos of that? >> I don't mind. >> Okay. >> He has to know that that's wrong. >> Right. >> Like, did he make contact with you when he went like this? When he was like, "What?" >> what, did he didn't touch He didn't hit you in that first It was just >> No. Like outburst and what? >> No, it was a what going >> towards you though, and you Okay. >> What? And then he put his arm back. >> Uh-huh. >> And then I I I'm trying to see now cuz I want [clears throat] to be What? I'm I'm just in shock. >> Right. >> You don't You don't do that to your mother. >> Um obviously this contact on your arm hurt you, didn't it? Were you in fear that he was going to hurt you further with the that first movement? >> he was going to break my arm cuz he wouldn't let go. >> So, you were worried that he was going to break your arm. >> You know. >> Okay. All right. Yeah, let me see your arm if you don't mind. Just Can you roll your sleeve up for me a little bit? >> I'm not going to accept that. And I'm the one So, I said, "You don't really have to get out of my house and go back to Georgia. You don't do that." >> Right. All right. >> But, I just brought him here 2 months ago to get him healthy. >> Right. And he's living with you right now? >> Yes. I'm wondering. I said, "You know what? You never put your hands on a senior again or your mother." >> Right. >> I don't know if this is going to go all into the system or what. >> All right. Sounds good. >> And I said, "Now that you're here, I've been taking you to church, you need to get into a stroke support group or something if there is something like that. >> so I'm going to talk to this officer over here real quick. I'm just going to go get his side of the story, hear what he has to say, okay? >> He says that cuz I do stick period. >> All right, dear. We'll be right back. Do you mind staying by with her for a little bit? >> Okay. >> Hey. >> How you doing? >> What's your name? >> Yusuf. >> Yusuf, do you mind if I get your ID? >> No problem. >> Thank you so much. Can you stand out here for me? I know it's a little warm, but >> Yusuf, I like that name. >> She's just arguing wants to argue about stuff. >> She was arguing with you? >> All the way. >> Okay. [clears throat] What was she arguing about? >> She don't like his fact that I'm on my phone all the time. >> Okay. >> That's what it was about. >> Okay. And then And then what happened while you guys were arguing today today about the phone? >> Um she hit me and then I >> She hit you? >> Yes. >> Okay. Um how did So what led up to her hitting you? >> Um mad about the phone. >> She was mad about the phone and then was there any anything else said or she just She like What did What happened? >> Um she did argue about the phone. >> Right. >> And then she hit me and then we came here. >> Okay, so she hit you as in you grabbed her arm as she she hit you. >> Yes. >> Okay. That's all that happened after that. You didn't say anything? >> No. >> See now everything is lining up. You know what I'm saying? Because even when you when we talk about her side of the story, she says that he made like an aggressive stance pretty much. It was an aggressive stance, right? But he did not touch her. No. He did not touch her. She went and pimp slapped him. You know what I'm saying? Straight She said she backhanded him SAID POW. She said, "I'm old school." GOT HIM TOGETHER. >> [laughter] >> GOT HIS ASS RIGHT, MAN. You know what I'm saying? >> [laughter] >> Factory reset. She said, "Get your ass up." >> [laughter] >> Now, that's all fun and games, but she hit him first. Okay? And I you know, being mad that he's on the phone doesn't warrant that, you know? Now, his side of the story, he not saying that he took an aggressive stance with her or whatever. But, either way it goes, if we just cut all the BS out, she made contact first, and then he reacted. She's done. >> At that point, she was already hysterical talking about you're going to jail. You're I'm going to take you to the police cuz of this >> Okay. >> That's why we're here. >> How did she hit you? You want me to ask him? She like backhanded you? Open fist, closed fist? >> Closed fist. >> Closed fist. >> Do you mind if I just pull your shirt back so I can [clears throat] see you, see if there's any marks or anything? >> No, there's no marks. >> There's no marks or anything? >> No. >> Can you pull just pull the collar just off the side of your shoulder a little bit if you don't mind? Okay. >> Yeah, I don't >> Okay, so it didn't leave any marks or anything? Okay. >> When you went what? >> What happened then? >> She hit me. >> Okay. You what? 50 >> 54. >> 54? Was it just one time or multiple times? >> one time. >> One time? >> And then I I grabbed her. >> Okay. Did you twist her arm or anything like that or just like grab? >> I grabbed her and and like just tried to get her to stop. >> Ultimately. >> Okay. All right, we're almost done there. Just >> So, what's You guys are so professional. >> We try to be. >> Yeah. >> Try to find all the details cuz we weren't [clears throat] here. >> Right. >> We weren't >> She not going to be laughing in a minute. >> Planet Fitness, so we have to find out >> I had just pulled up. We never got out. >> Okay. >> I just turned around and I said, "Okay, I live in the city of Buena Park." And I remembered it was here, that's why I came here. >> And what what kind of actions was he doing before you Was it just like What? Um What do you want? >> No, Lanette, it was a vicious, he you know, >> I I don't know. I wasn't there. >> no, what I'm saying was it was a vicious cuz he was tired of me saying get off the phone, get off the phone. Then I said, "You need to be paying attention." We were pulling up to Planet Fitness. would pulled into the parking lot, turn off my car almost, about to. We never did go in. We were going to uh exercise. >> So, what what I'm asking though is like how what motions exactly did he do? >> See, she don't know she don't know what to say, man. And and I, you know, when you're a regular civilian, you know, I guess you you you you're not going to know what to say or whatever. But what this officer looking at looking for right here is were you in fear, right? Were you in fear for your life, right? So, she should say something along the lines of If she's really trying to get this to work, right? Cuz this is not going in her favor at all. But what would be better is if she said something like, you know, hey, we've been hanging out all day or whatever, running errands, and, you know, I noticed that, you know, he he was on his phone all day, and, you know, I'm old-school. I'm not with the new electronics and all of this that and the third. I'm old-school, man. So, you know, I think he should be off of the phone and be in a be aware of what's going on, live in the moment type of situation. So, you know, we were arguing about this phone situation. And we were on our way to the gym. And we once we got there or whatever, we did get into argument about, um, you know, his excessive use of this cellular device. And, um, you know, he got agitated with me. It was just verbal, but he he did get agitated with me because I kept bringing up this phone situation. And as we were getting out of the car, he took an aggressive stance towards me, and he threatened me. He said that, "Hey, if you don't stop, I'm going to do X, Y, and Z, right?" And he took an aggressive stance, and it was almost to the point to where he kind of boxed me in. We were, you know, I I I really didn't really have anywhere to go and so I couldn't move and I had to get him out of my way or something something like that, right? >> She was in fear for her life. He boxed her in stuff like that. That's what he's looking for. But you not you don't know what to say. >> [laughter] >> So your ass is grass, man. >> Like did he >> [clears throat] >> did he make it look like he was going to backhand you or just frustrate you? >> I'm sitting this is me sitting over here. >> Mhm. >> This is him. >> Here, I'm you. You're him. >> And I said get off the phone. Get Oh, we we stopped. >> Yeah, I said can you get off the phone? HE GOES, "WHAT? WHAT?" LIKE THAT. >> MHM. >> MHM. >> Just like the hand motions. What do you >> No, like vicious. "What?" >> Like did he try to come at you? >> Well, it looked like he was coming at me. >> You mind if I consult with you one more time real quick and then I'll >> Sounds good. We'll do it. >> Just give us one second. >> Officers realize that Francina accidentally admitted to throwing the first hit and her son grabbed her arm only after probably to defend himself, which they find to be consistent on both sides of the story. So officers identify her as the primary aggressor. >> All right. >> Yep. >> Miss Francina >> You're done. >> Francina >> Francina, I apologize. Do you mind coming to the back of this patrol car here for me? >> Huh? >> Here, I'm just going to have you walk over here for me. >> Oh, okay. >> Right here? Yep, right here. Do you mind putting your hands on the front of the on the on the patrol car for me? Just the other way. Face the other way. Put your hands. >> Okay. >> All right. So I'm going to have you put your hands behind your back for me, okay? >> Do you do you have shoulder issues though? >> I have sometimes. >> Sometimes? >> What? >> Okay, I got a second set. >> So it'll be explained here in a second, okay? Is that too tight? >> No. >> Okay. >> Look at the time. >> Okay. So right now you're under arrest for battery domestic violence, okay? I've determined that you were the primary aggressor, that you did hit your son, okay? >> But he was a he >> But he didn't touch you to begin with. Okay, your the stories are consistent that that you hit him first, okay? So what's going to happen is you're going to go down to Flagler County inmate facility. You're going to be booked in, okay? >> For what? I've never done anything like this. >> I'm I'm aware, but unfortunately, we have to we've just I've determined that you're the primary aggressor in this, okay? You You called reporting domestic violence and and your story's added up that you hit him first, okay? >> Huh? >> Okay, so I'm going to have you walk back this way for me. I'm going to have >> Not only that, it cuz it's it's you know, you can hit somebody first, but it's it's it's got to be in the right situation, you know? She's not She didn't it wasn't life or death. She wasn't cornered. She wasn't threat You know, it it was She didn't say it right. She didn't She didn't get her story together, man. >> Have you come back to the car? >> purse? >> Uh we'll come and get it. We'll come and get it, but I need you to come with >> pull a fast one. >> My purse is in the car. I mean >> We'll determine. Let's go this way. >> What? Domestic violence? >> Yes, ma'am. >> [laughter] >> Francine was transported to Flagler County charged with domestic battery and was released from jail the day after.
