Because there's a complaint going on, they legitimately have to see your ID. >> Because there is a complaint that's going on. Okay, we do need to ID everybody that's involved. >> Survey says, that was a lie. If you haven't committed a crime, saying, "I have to have your ID." is an attempt to deprive you of your right to anonymity, which is a crime in and of itself. And legally, you can say no. >> I have to have your ID, okay? >> Nope, she doesn't have to have your ID. Even when she falsely claims that there's a suspicion of a crime. >> Am I suspected of of a crime? >> There is a suspicion of the crime. >> Uh ma'am, there's no such thing as suspicion, just like there's no such thing as neural firing within your cerebral cortex. >> I know for a fact I don't have to give you ID or tell you who I am. I don't have to cooperate with your investigation. I have the right to remain silent. >> Now, whether or not Mackinac Police Department Officer E. Cronk has active brain cells is irrelevant. What she doesn't have is probable cause that a crime has been committed by a man filming in public. And what this man doesn't have is a right to put his hands on someone filming in public. It's always been amazing to me how willing some people are to put their hands on other people as those other people are expressing and exercising their rights. And this is what we have today. We're going to take a look at this and we're going to make some comments along the way. >> Hey, what's up, my friends? How you doing? >> Pretty good. How are you? >> All right. Why you taking pictures? >> What do you mean taking pictures? Why not? >> Why yes. >> Why not? >> Why yes. Who are you? >> Who are you? >> I'm the owner. >> Oh, that's nice. >> Yeah, thank you. >> Yeah. Okay. >> Okay. >> Why are you taking a picture of my store? >> Why not? >> Why yes. >> What do you mean yes? >> All right, please turn it off. >> No. >> Don't take pictures of me. >> No, I'm taking pictures of you, bud. >> Because I'm going to break this. >> Dude, you touch my stuff, I'll [ __ ] [ __ ] something up. >> You're going to me? >> I will hurt you. >> Come on. >> Touch me and my stuff, and you will get hurt. >> to me. >> I'm going to tell you that right now. >> very, very nice. >> your hands to yourself, old man. >> [ __ ] >> and then Understand that? >> Don't take pictures of my store. >> Understand that? >> Now, you want me to punch you? >> You punch me, that's your It's not mine. >> You want to try me? >> I want to let you know, this is a stand your ground state. You touch me, I will you up. >> I know. >> Understand that. >> Man, you're going Come on. >> Touch me. >> Come on, man. >> Do it. Come on. Do it. Get some. Get some. Get some, old man. >> Come on. >> Get it, old man. >> Punch me. Come on, punch me. >> Get it, old man. >> You want me to break your face? >> You ain't breaking [ __ ] >> You want to try me? >> You better get back, old man, before you hurt yourself. >> Yeah. Listen, listen. piece of garbage. I'll >> You and your buddy >> You want to a piece of >> You piece of [ __ ] >> YOU WANT TO GET BACK? OH, YOU THOUGHT you got back up here? >> I'll cut OUT YOUR [ __ ] >> YOU. >> DON'T TOUCH ME. >> GET BACK. DON'T touch him. I'm going to [ __ ] I'LL [ __ ] >> YOU AIN'T KILLING [ __ ] >> All right. >> Get back. >> I'll break your arm. >> You better get control of your own friend here before he gets hurt. I'm showing restraint. >> I'll break your arm. I think I'll break >> Go. >> I'll kill them. >> I'll [ __ ] kill my friend. >> I'll break your arm. Get the Yes, get the >> Get out of here. Kick rocks. Right there, they're watching it, too. They're videoing. >> Get the [ __ ] out of here, you stupid [ __ ] I'll break your arm. >> Uh, let me >> just stop and say you got to be a real control freak to want to stop somebody from recording on a public sidewalk. Where does this idea come from? And why do people freak out when there's one additional camera in our society? There are cameras all over banks, department stores, there are drones in the sky, there are satellites recording everywhere, the Google car is constantly making its way around the United States. Everybody's got a cell phone, so why do people freak out when there's one extra camera on the scene? And if you don't want to be on camera, the last thing you want to do is get into the face of somebody who's recording. >> Come on, punch me. I'm telling you, stay away. >> Come on, punch me. >> Stay away from me. >> Come on, touch me. >> Call the police. Call the police. >> I ALREADY CALLED THEM. THEY'RE ON THEIR WAY. I ALREADY called them. They'll be here in a minute. >> The police are The policemen with guns are on the way to save me from a guy with a camera. Oh, great. This is wonderful. Hold me back, bro. Hold me back, bro. >> He's a crazy nut. Taking picture all the time from his store and my store. >> Okay. What? Is there a fight going on here? >> No, not yet. >> Okay. Well, we don't want a fight, so what's going on here? >> I think the guy is annoying and spying on my business. Taking picture of everything inside. >> Okay. Do you have an idea, sir? >> Yes, I do. >> Okay, read that for me. Thank >> Asking asking everybody for the ID right off the bat. >> Sir, I'm a vet. >> Good. So, you're taking photos, I gather. >> out here getting some video today. >> There's nothing wrong with that, right? Nothing wrong with that. Did you have permission to take photos inside the store? >> I was never in the store. >> You want >> No. >> Okay. >> I was taking video from out here. He come out yelling, "No, don't picture." >> Okay. >> And I was like, "Whatever, dude, you know?" >> Okay. >> No. >> Okay. >> And then he got mad and shut door and then he pinned that up and then this dude showed up over here and then he used to claims he's the owner. So he got all hyper aggressive and stuff and then he took a couple swings at me and uh just, you know, stiff arm keep the guy away. >> Okay. >> Held my camera like this cuz he threatened to take my camera. >> Okay. >> Other dude threatened to kill me and then he took a few swings at me and stuff and I just, you know, basically stood my ground. You know what I'm saying? You know, in a in a defensive >> Cuz you're putting your hands on him at all? >> Fears, no. >> No, so you never touched him or anything. >> No. >> Give me your ID on this, sir. >> Yeah, no, I don't have >> I I do have to have it cuz this is an investigation now because there were physical that kind of thing going on. So that's why I have to have your ID, okay? >> I have to have your ID because somebody else committed a crime against you. Tell me how that comes close to making sense. I have to have that ID. It is like everybody always says, it's like a drug to these people. I've got to have that ID. It's a lie. They don't have to have your ID if they don't suspect that you committed a crime. She already heard the story, the guy has it on film, so he has all the evidence he needs to protect himself. The aggressor was the guy who didn't want to be recorded. >> Am I suspected of of a crime? >> There is a suspicion of the crime because you >> Am I suspected of a crime? >> Yes, you are. >> Okay, then I'm going to invoke my my right to remain silent. I'm going to let you know right now everything that just happened was live on YouTube and I'm live on YouTube right now. >> Okay, I don't have a problem with that, sir. Not at all. Like I said, I'm I'm video taping, too, all right? So but this is an investigation, so I do have to have your >> Investigate away, but you don't need my ID for that. >> You would think a key element in the investigation, if you actually want to conclude what actually happened, is to have this guy roll back his footage. He has everything on tape. >> You need your >> No, you don't. >> part of an investigation, so >> No, you don't. All you have to do is If you want my ID, I will give it under threat of duress and arrest. That's it. Cuz I know for a fact I don't have to give you ID or tell you who I am. I don't have to cooperate with your investigation. >> Okay. >> I have the right to remain silent. This >> And that's how you stand your ground against a tyrant who's literally this this woman, this redhead, is trying to deprive this man of his rights under the color of I got to have your ID because that's what we do. That's our policy. Those are our protocols. >> I know for a fact I don't have to give you ID or tell you who I am. I don't have to cooperate with your investigation. >> Okay. >> I have the right to remain silent. This guy the other guy in shorts, he took a few swings at me. He attacked me, him and his buddy. And that's that. And I've got it all on video. Three different cameras. >> All right. >> So, they're the aggressors. The guy in the shorts is the attacker. He attacked me. All right. Um I think it's these folks right down here. They watched it and videoed it, too, if I remember correctly. It was kind of hard cuz I'm keeping an eye on two guys that are coming at me. >> Okay. >> While I'm constantly, you know what I mean? Keep your hands to yourself. I have my hands are full. I can't fight nobody. >> Well, I mean, you can understand and and I'm not making excuse for anybody. I'm just saying that, you know, with that being videotaped, could you understand >> I don't understand because this is my right to free press and I don't understand people not liking that. >> So, I'm I'm not making excuses for anybody as she attempts to make an excuse for somebody. >> I don't understand that. I did nothing illegal, did nothing wrong. I'm a tourist here taking video. Him and his buddy attacked me. >> Okay. Hey, I'm Sergeant Edwards, Mackinac City Police. >> Yeah, nice to meet you. >> All right. So, I kind of heard what you told my partner. I got both sides of the story, okay? Because there is a complaint that's going on. Okay, we do need to ID everybody that's involved. At least You don't have to give me your ID, that's fine, but I just need your name. >> No. >> Okay. >> I'm going to invoke my right to remain silent. You want my identification, I'll give it under threat of arrest and duress. >> Okay. >> it at this point. I've done nothing wrong. >> Okay. >> I haven't broken the law and I know and I know I'm not required to give out ID unless I broke the law. >> Okay. All right. Well, and I'll let you think that. But if there hear me out, but if there is a problem, we do need to start IDing everybody. >> You see where we're coming from. >> No, I don't because I have the right to be secure in my person's papers and effects and my identity and I haven't broke the law. I know under the Fourth Amendment right now I don't have to give the ID. >> Who was it? These people down here, Luis? >> Yeah, I think it was them. They watched. Him and his buddy were the aggressors attacking me. Where'd the guy in shorts go? He was the one swinging on me. You know, maybe it wasn't them. It's hard to remember. I'd have to go back and look at everything. >> You can record. That's fine. >> Yeah, I know. I got her badge number earlier. It's badge seven. Right there, that guy's violent. I'm going to try to get her card and the incident number. That's what I'm going to do here real quick and then I'll wait for them to roll out. He's got the thin blue line bracelet on. When you get a second, can I get like your card with the incident number or something on it, please? >> All right, sir. Here's the plate number with my name and my sergeant's >> All right, that's where this video ends, but this sergeant, Sergeant Edwards, also tries to deprive this cameraman of his rights under the color of "No, we got to have your ID. We got to take a report. This is the policy. This is what we do. You have to do it. You don't have another choice. There are no options." These are lies and I'm pretty sure these cops know that's a lie. They just want to exert their authority and power over you. They want to make their life easier. They want to make their job easier and if they have to trample your rights to do it, hey, that's what they're going to do. This guy stood his ground. A+ for him. F for the nervous Nellie that didn't want a shop recorded and an F for the Mackinac Police Department goons who wanted to deprive another cameraman of his rights under the color of "We have to have ID."
