This is Tupelo, Mississippi, police officer D. Dean. Apparently, Mr. Dean likes to put his hands on other men for no reason. >> Get out of here. Do me. Come over here and talk to me. >> whoa. Why you Why you going to touch me? >> And it may not happen today or tomorrow, but he's about to learn a valuable and expensive lesson. On second thought, maybe he won't learn the lesson, but the tax cattle who has to cough up the cash for the incoming lawsuit he just cost them will. And hey, all you detractors out there, say whatever you want about this young man. In the face of utter tyranny, he's got balls and he's not afraid to sling them around. He slings them around when he's cuffed. >> Am I being arrested or detained? >> You're being arrested. >> Oh, okay. >> He'll sling them around when he's held captive in the back of a patrol cruiser. >> Wish you were a little more educated. Wish you did a little bit more of an investigation. >> Well, when you invoke your fifth member right there, there's no way to do an investigation, buddy, cuz you're not talking. >> Well, you should have done your investigation and see which property I was on cuz I already did. I already checked the GIS before I got here. We'll see how this one plays out. >> And he even displays testicular fortitude and asserts his authoritative rights while chained to a bench in a cruddy Tupelo, Mississippi, police station. >> What's the statute for criminal loitering? >> Being anywhere that you can't give >> the statute like the statute number. >> I don't have it with me right now. >> You don't have it You left that part blank on the arrest sheet. You left that part blank. >> Yes, there's not a place >> number? >> There's not a place for it on there. >> There isn't a statute number for criminal loitering. >> With torture cuffs ratcheted down tight on his wrists, he doesn't even stop schooling the tyrant who arrested him. >> Do you actually believe I have to give you a reason why I'm standing on public sidewalk? Looks like you guys needed this. Looks like you guys need some training. >> And the kicker is the Tupelo Mississippi Police Department helps him sell his merch. Let's take a look at what appears to be the perfect example of American law enforcement tyranny exacted on an innocent person in a public place in Tupelo, Mississippi. >> How's it going? >> Good. What's you guys out here doing? >> What's up? >> What you doing? >> We're filming here. This woman can't even get in the store because they won't leave him alone. >> What you out here doing, man? >> What am I doing? >> Yeah, come over here and talk to me. >> Come over here and talk to me. >> woah. Why you Why are you going to touch me? Why What's What's going on? >> Come over here and talk to me. You're on private property. >> going to go over there. >> You're on private property. >> Hands on, clearly unconstitutional. >> property, okay? >> Do not tell me what you're not going to do. >> Apparently, I'm on private property. >> Put this down. >> Yeah. >> Put your hands up. Do you have any weapons on you? >> Nope. >> You mind if I pat you down and check? >> Yeah, I do. >> Okay. Why are you out here? >> search and seizure. >> Why are you out here? >> I'm invoking my Fifth Amendment rights, sir. >> Do you realize that you've been asked to leave this property? You want to give me a reason why you're here? >> Where you took me from was public property. I'm going to I'm going to invoke my Fifth Amendment rights past that. >> Okay. You're being arrested for criminal loitering. >> Criminal loitering? >> You can't give me a reason why you're out here? >> Sir, you're not allowed to film in a >> Give me just 1 second. >> I would check the GIS and make sure that I was on their property. >> By the way, and this holds true whether you're in Tupelo, Mississippi or virtually anywhere else in the United States, if you are lawfully filming in a public place without committing a crime or interfering with police activity, you do not have to tell an officer the reason you're there. Every law enforcement agent should know this. Besides, they took an oath to defend and protect the Constitution. That's every single freedom outlined in the Bill of Rights against all enemies, foreign and domestic. If anybody disagrees with that, I want to know about it and why. >> Well, I was filming you on public property before you did this, but Am I being arrested or detained? >> You're being arrested. >> Oh, okay. >> You want to identify yourself? >> I'm going to invoke my Fifth Amendment right to stay silent. >> When we get to the jail, you'll be booked in and if you refuse to identify yourself, you'll be held at the jail until you do. >> Sounds good. >> What you got? >> John is totally not rattled and I think that alone rattles this cop. Now, the voice of a very weak member of the public. >> All the disrespect you got on that phone to me, I want it took off. That you invaded in my privacy. >> He's got a right to video. >> I was coming right up through here and I turned my signal on. >> He's got the right to video, sir, which is exactly what he was doing when Officer Dean walked up. He was videoing and yet he got arrested as he was exercising his constitutionally protected right. If this guy has a problem with being recorded, then he should go to the local police station and ask to have all the Flock safety cameras removed. >> He's got a right to video. >> And he turned and he filmed me from all the way up to you got here. And he's done a bunch bunch of smart smart smart remarks and stuff and I told him quit filming me and he said, "I'll do what I want to do. You don't tell me what I do. I do what I want to do." He's He's a smart aleck. You said You heard him. He is something else. Smart aleck to you, too. >> Yep, he's going to jail. We're going to get him out of here. >> Can you? >> I can't do anything. I can't do anything with this guy. >> have it. I can. >> No, sir. >> Just wait till this guy's buddies at the VFW post get a hold of this video. He will never hear the end of it. Well, here comes snowflake Sam again. Damn it. >> I'm getting him out of here. >> Can you? >> I can't do anything. I can't do anything with this guy. >> have it. I can. >> No, sir. >> I can do it. I know how. >> Appreciate you being professional with my stuff. Just wish you were a little more educated. Wish you did a little bit more of an investigation. >> You're right. >> Well, when you invoke your Fifth Amendment right, there is no way to do an investigation, buddy, cuz you're not talking. Well, you should have done your investigation and see which property I was on cuz I already did. I already checked the GIS before I got here. >> I'm glad you did. Yes, sir. I just need my 2,000 too. >> I don't care if you're on public private property. If you don't can't give me a reason for you to be there, then you're loitering. >> Really? >> On public property, I have to have a reason to exist on public property? >> If you're staying on public property, then you're >> I have to have a reason to exist on public property? Is that what you're saying? >> Yes. >> Uh-huh. Okay. >> If you're protesting something, >> I'm not No. No. You You gave the reason yourself. I didn't give you a reason for anything. I invoked my rights, so we'll see how this one plays out. Can you not vape in here? I'm allergic to tobacco. Nice. This is the respect level from these guys right there. >> They don't care about the public. They don't care about you. What I like about what's going on with Johnny here is he's got his emotions completely under control. It's almost like he enjoys this ride because he knows what's going to happen. He knows he's in the right. This is an example of being cool, calm, collected in every single one of your thoughts, every single one of your emotions, everything is under control. >> I was here right here on the thing. Can I just get your name and badge number for the record? >> I don't want my name >> I'll be on your arrest report. You still going to refuse to identify yourself? >> No, I'll I'll identify. >> Okay. What's your name? >> John Medaglia. >> Spell it. Spell the last name for you. It's a m e d a g l i a >> John spelled the traditional way, j o h n. >> m e d a g l i a >> Sup? How's it going? >> I'm made. >> Some of us just try to exist. Well, you can't leave that for disturbing the peace. And loitering around businesses causing concern and suspicion. It's against the law. >> Wow. >> What's your date of birth, then? >> March 17th, 2002. >> Good. Tattoos on both arms, anywhere else? >> Yeah, on my chest. >> Okay. Am I right? >> No, 11. Do you need me to 1099 the number? >> Nothing gang, anything? >> How tall are you? >> 5 10 and a half. >> How much do you weigh? >> 145. >> So, girls 5'1? >> 5'1. >> How much do you weigh? How much do you weigh? >> Sorry? >> How much do you weigh? >> 160. >> All right, 11. No records in Mississippi or Massachusetts. >> No records? >> I'm good. So, is that a fake name? >> No. >> You're not in our system anyway? >> I don't get found guilty of anything. >> Do you have a driver's license? >> I do have a driver's license. >> Then you should be in the system. >> There I have a driver's license. I didn't give you any of that information. If you'd like me to have my driver's license dropped off here at the entrance of the jail, I could have that done if that makes it easier easier to identify myself, but I don't see there there's going to be no different information on my driver's license. >> We're already in too deep here, both of us, my friend. So, no turning back now. >> Oh, we're not going back anywhere. Is your vehicle secured? Did you get dropped off over there or is it somewhere over there nearby? >> going to answer any questions. >> What's the what's the statute for criminal loitering? >> Being anywhere that you can't give >> the statute like the statute number. >> I don't have it with me right now. >> You don't have it You You left that part blank on the arrest >> [clears throat] >> sheet? >> You left that part blank. >> Yeah, there's not a >> number? >> There's not a spot to put the court on there. >> There isn't a statute number for criminal loitering. >> There is a statute number. >> So, what is it? >> It'll be in the affidavit. >> He's chastising the cop as the cop pretends to do his job. He probably put John's name in the system wrong, that's why nothing was coming back. One thing I want you to understand about the psychological makeup of cops is they cannot stand it when they encounter an informed public and a confident public. And the double whammy of a confidently informed public really drives them crazy and unsettles them. And that's what's going on here. When he initially got arrested, sitting arrested and handcuffed in a patrol car, and now in the police station, he has not wavered, he has not budged, he's stone-faced, he has the wherewithal, the presence of mind, the knowledge, and he's going to hold these cops accountable. And correct me if I'm wrong, it just seems like he's operating on beast mode level 11 here. >> Criminal warning and disorderly conduct are the two things you're being charged with. >> [snorts] >> Disorderly conduct is what >> What's the statute for disorderly conduct? >> It'll be in the You'll have an affidavit. >> You don't have it written right there? >> I just told you there's not a place for statutes on this report. >> Okay. >> You want a lot of information, but you don't want to give any information. >> I gave you all my information. >> By the way, there's plenty of room for statutes on reports. Plenty of room. >> Except for anything about other than your personal information. You said you were refusing to answer any questions. >> Do you actually believe I have to give you a reason why I'm standing on a public sidewalk? >> Oh, 100%. >> Okay. >> Yeah. >> Looks like you guys needed this. Looks like you guys need some training. >> Putting it all on the record, man. He knows he's being recorded, getting all of this stuff on audio, making it nice and easy for his attorney, putting it in a nice fancy package, and putting a bow on it. >> I'm I'm glad you're here, friends. >> Yeah, I'm serving every day. >> We'll see how real that statement is. Are you going to check the GIS map now and see how many feet of public easement I have to see if you were even close to being right? >> I just had a man run by electronics that four blocks >> So, I'm going to have to write you a ticket now. >> are shooting everyone. His license is the only call we received like that. >> Shooting everyone. >> No exaggeration cowboys at the Tupelo, Mississippi Police Department. >> And so, SB 2203 2330-2025 prohibits lingering or prowling in public places under circumstances that warrant warrant Requires police to give a chance to explain presence or conduct before arrest. Which I did. You refused. Cities can have specific rules which people [music] are doing such as being loud in any business parking lots or creating disturbances. Which is what the disorderly conduct was, creating a disturbance for a business. >> Mhm. >> Sounds good? >> And that's public places, not private places. So, regardless of what GA shows you. >> Do you remember how the conversation actually went? >> Yeah, it's all video and audio recorded. >> I know that, but do you remember? You do? How did you start when you came up to me? >> I told you who I was and asked you why you were there. What you were doing. >> Yeah. And then what? >> I'm invoking my >> And then you started And then you started grabbing >> Don't touch me. >> And then you started grabbing for me, instantly. You didn't give anybody a chance to explain themselves. >> It's clear on there what you said. I'm invoking my fifth amendment >> Right. I'm not going to answer any questions because you said I was already under arrest. >> No, I didn't put you under arrest then. >> You did. >> Okay. What are you out here doing, man? >> What am I doing? >> Yeah, come over here and talk to me. Come over here and talk to me. >> whoa, why are you Why are you going to touch me? Why What's What's going on? >> Come over here and talk to me. You're on private property. >> I'm not going to go over there. >> He was given no chance before the officer went hands-on. >> private property. >> Okay. >> Do not tell me what you're not going to do. Do you have any weapons on you? >> Nope. >> You mind if I pat you down, sir? >> Yeah, I do. >> Okay. Why are you out of here? >> search and seizure. >> [clears throat] >> Why are you out of here? >> I'm invoking my fifth amendment rights, sir. >> You want to give me a reason why you're here? >> Where you took me from was public property. I'm going to I'm going to invoke my fifth amendment rights, fast, sir. >> Okay. You're being arrested for criminal ordering. >> Criminal ordering? >> [snorts] >> I was either under arrest or I was detained by your hands and being brought to your car on the on the private property. Is that where you were trying to bring me? So, it's either an arrest or a detainment. So. >> You were detained before you got out of the car. >> There you go. >> Bingo. >> Bingo. There it is. No purpose or mission statement or anything. And you didn't even ask for one. That's the That's the funniest part because I'm the I'm the single person in this In this industry, I'm the only person that actually gives a real reason. I'm the only person. And you didn't even ask for it. >> invoke my fifth amendment right, you grabbed for That is >> You did not. You did You did not. >> You did not. I'm I'm Like Like you would say, I'm not going to argue and go back and forth here and argue semantics here. >> He's letting his opponent dig his own hole. And at this point, the officer just went to the hardware store and got a backhoe and he is digging feverishly. Matter of fact, he's halfway to China by now. >> So, I won't argue it in front of >> walked up to you and said, "I'm Officer Dean, what are you doing out here?" and discuss the situation, and you said, "I invoke my fifth amendment." So, you don't have any vision statement. You just wander around with a video camera. >> You have no purpose. And what you're doing is a I didn't say that. That's what you're saying. >> Okay. Sorry it took a minute. I was walking that other fellow back to the back there. Police, stand up, face the police. Turn around, face the wall. I know he probably already patted you down, but we got to do is come in here to my car. You're a pretty big guy. I'm not going to try anything. Don't worry. >> Well, I I go through the same spiel with everybody. One, it keeps me in good practice and two, it it lets them know kind of what to expect. So, >> Johnny has committed no crime and now the Tupelo, Mississippi Police Department is subjecting him to a humiliation ritual. >> I appreciate you being cool. >> Oh, yeah. Well, like I tell everybody else that comes in here, my behavior is kind of a reflection of their environment. Yeah, couldn't agree a syllable more. I'm not trying to No, that's not the problem. The key it just got stuck. I don't want to mess with your cuffs or mess them up or anything, but let's I'm taking too much time. I don't got much space. Well, we're not trying to fight. I'm trying to get the key out of it. All right. I might need to get a new key. There might be something off with this one cuz I just had an issue with that fellow I got in. Put this item on the wall in front of you and that could have come along. That guy I just searched in that had the shackles, it had a little bit of difficulty I opening up one of the shackles. I thought I think I got to get a new key then. All right, man. Best of luck to you. >> Thanks. Thanks. >> I know you probably don't want to hear this and you probably heard it before, but something like that from an officer's standpoint, when we're getting multiple calls about you and I come out there and try to make contact with you and you're immediately standoffish, if you just say, "Hey, this is my name. This is why I'm here." >> Just just mull it over in your head. If I came up to you and just acted like you did, you'd be defensive, too. >> Okay. Again, I'm trying to help you out. Cuz if you get out and do the same thing over again, the same thing's going to happen. >> I see. >> All right. Here's a pair of slides for you. >> Appreciate that. Sorry. >> And someone step in this way. >> All right, Mr. Dean. We'll see you later. >> Take care. >> And that, my friends, is the proverbial icing on the cake. He looked into the eyes of tyranny and he didn't back down. Leave your thoughts about this in the comments section below.
