whoa simple battery welcome back to the lackluster channel today's story features rogue nation and news now south florida who on august 4th of 2020 were out to conduct an audit at the where state prison in georgia when they got close to the prison it appeared as though the road didn't continue through and multiple cars lined to the street with no intention of entering the prison grounds they decided to turn back and used a driveway to change their direction shortly after they pulled over to check their map and find a new route when trooper mclean of the georgia state patrol pulled up behind them to check on them because the driveway they used was the warden's residence hi yeah we were just i was checking out something out of the map okay all right you do realize you stopped there back there yeah we thought we thought we could get through and then we saw we couldn't so we turned around all right you got your driver's license with you i do is it didn't i getting pulled over for something well you pulled into the water's driveway back there to turn around yeah and we're trying to figure out what you were doing we're trying to identify it is that illegal is my id going to tell you what i'm doing well we're idea we're trying to identify okay for what please have your driver's license is that a lawful order yes sir what infraction do you believe over here on the road and i checked that because i was going to look at the map i didn't want to get on my cellular device well that's good while i was driving well that's good i appreciate it i have my driver's license with me but i'm not certain i'm required to give it can you state some sort of statute or yes sir some sort of infraction anytime you're requested by law enforcement to provide drivers remember that news now south florida had not violated any traffic laws and was legally parked on the side of the road during a lawful traffic stop where an officer pulls you over and has reasonable suspicion or even probable cause to do so drivers are required to provide their driver's license vehicle registration and insurance absent of a crime or violation of the vehicle code identifying the men would have to be a consensual act if you've committed some sort of attraction or crime back there isn't that illegal was that illegal and you pulled in so we're trying to figure out what was that we were trying to figure out i understand that we're trying to figure out what you're doing you're not to figure out what i'm doing please you're the law enforcement and that we're trying to figure out that's suspicious so we're just trying to figure out what you were doing there's one of yours is one of these cards you're supervising yes sir it is i'd like to talk to you somebody talk to me right now do you have any driver's license i'm not i don't think i'm required to give you my driver's license and i'd like to talk to your supervisor to find out yes sir mate please you may please get yours i i don't believe you're giving me a lawful command sir yes yes i am for what purpose do you need my id what what crime do you or ordinance do you suspect me to have broke because it was suspicious of you suspicious is there a misdemeanor or is that a felony this way is that a misdemeanor or a felony that's articulable reasonable suspicion that you were doing something that you were loitering or something like that do you have to you have evidence that i was loitering so you pulled in back there did you not i turned around yeah because i saw that i couldn't get through you couldn't get dude the road was open i don't know i saw it looked like there was checkpoints for getting into the prison or something so we turned around because we didn't think we could get there as you can see from our plate we're not from here so yeah i understand that do you have your driver's license yeah i don't i'm telling you am i lawfully required to give you my id what what for what purposes am i lawfully required just explain to you sir suspicion isn't a crime and i didn't drink anywhere suspicion yes of a crime suspicion that you turn around can i just talk to the supervisor that's back there oh sorry i need your driver's license i'm done answering questions the trooper conflates what he believes is suspicious with the legal term reasonable articulable suspicion without an alleged to make it lawful all i'm trying to do what what law do you think i broke to pull me over for it you were down there you pulled up yes i didn't know what you were doing right i turned around i told you that's the water's resonating i turned it properly i don't know who's in line property so i came out on your public property it's state property property then that's state property okay is it illegal to turn around on this project well it's it's it's article reasonably suspicious that you're performing something illegal there while you're doing something there when we have other things going on so if i can i don't know i'm not from okay and that's fine all i have to do is identify you we can get you on your way how is identifying me going to tell you what i was doing well we're making sure that you're not a wonder person you're somebody that that's going to go down harm to the warden or something the id is not going to tell you that one little request for your supervisor right now well that's fine formally making a request right now i'm making a formal request that you provide your driver's license but it's not a lawful request correct it is a lawful worker for what reason do i know what what is the statute 35.36 11 35 36 11 which is your statute id it says that if you've committed a crime if you have that in the commission of crimes in georgia the consideration to arrest for failure to identify arises in the context of loitering or prowling the official code of georgia title 16 chapter 11. subsection 36 defines loitering and is likely why the officer mentions loitering early into the encounter that you were loitering or something like that do you have to you have evidence that i was lawyering but even the officer admits that all the men did was pull in back out and continue driving in the opposite direction not to mention the residence in question has a very long driveway and there are no signs or anything else to indicate that the home was special in any way had it not been for the trooper identifying the residents no one would have known anything about it what the officer thinks an id will prove is still unknown but his desire to obtain it continues to grow as his supervisor arrives on scene i'm i'm trying to get identified and i don't think i need to step back here for what reasons what did he explain he explained that i turned around in someone's driveway yes i did i don't know who driving listen you answered your question i'm telling you exactly what i mean is it unlawful to turn around in a driveway go ahead i don't know i'm from you can see i'm from florida so this is what's going on last week but you're going to step out here and we're going to try to identify well how is stepping out going to make me identify because you haven't cooperated i asked you so i'm going to ask you sir your supervisor correct doesn't matter but but is this a lawful request for my id that's correct can you tell me what lawful statute of so i'm going to identify myself but i don't find myself but i am going to make sure to follow through with this because i don't believe in you by all means okay sir so i'm not telling you i'm not telling you so you're right just for the record you're identifying me right now for what purpose like i told you because you're suspicious because i'm suspicious you turned around you don't know everything that has happened i don't know anything that's happening i'm going to explain it to you once i'm able to identify okay so so you are identifying me for suspicious behavior yes sir and that's not a misdemeanor nor a felony this isn't going to tell you what i'm doing but so just for the record i have not made a traffic interaction correct sir is that correct you pulled into the world did i make a traffic infraction yes or no sir you pulled in to a driveway that does not belong to you right yes you don't know who it belongs to correct that was all right coming down here i've informed you what i initially informed you when i asked for your driver's license you asked for the reason i informed you who's right who's the driveway which is under threat of am i going to get arrested if i don't give you my license sir you can be charged i'm just asking for your driver am i going to be arrested if i don't give you asking for your driver's license yes sir you're going to be arrested if you're asking for it i'm going to say no if you're requesting it requiring it by law i am required under the threat of arrest and i will i am requiring it by law yes sir okay so i am going to get arrested if i don't id myself there is state law that says when you were requested yes or no yes if you're required by law enforcement you must provide your product all right if trooper forcefully rips his id from his hand rogue nation goes live and continues to record the interaction from the vehicle all right i'll take care of that later that's my civil rights [Music] hey guys what's up so what we got here is we're driving down the road there's a prison at the end of the road we decide to turn into the driveway to turn around we get three cops behind us for suspicious activity pull us over i didn't know what to do pull him out of the car to idm because of suspicious activity no i i know you're good you're lawful i know that you don't have any warrants on i know that you're not on some terrorist watchers is this consensual done you're done please all right you could have you could have been going all right there you have it guys we can park in there though what do you want to do um we could sit here in the detention center right there he very specifically said i was arrested if i didn't get out and give id that's right for suspicious articulable suspicion of suspicion i did everything identified you're supposed to identify me yes sir you pulled into the water you hear that guys he pulled into the warden's driveway in georgia that's a crime hey let me ask this there were things that occurred i told you that hey is this street public all the way down through the prison yes sir you can't get off on either part of the print of the drive there but you can drive right through i can walk through too right on the roadway i wouldn't advise walking on the roadway here's what i'm gonna tell you okay on the side of the road though it's fine on the side of the road once you get off the road and become friends of property that's okay that's state property that's fine there's a public easement what's up once you get to the gate you can't it's it's the tdc okay okay we'll take it up the rest of the video is difficult to watch and hear but consists of the two men driving back to the prison to show what they did including using an adjacent driveway to turn around throughout the video the troopers refer to quote other things going on reasonably suspicious that you're performing something illegal there and while you're doing something there when we have other things going on they are likely talking about a prison riot that occurred three days prior in which hundreds of inmates took over the facility leading to a riot that left multiple inmates and guards injured big surprise that the riots were sparked by a constitutional crisis including inhumane conditions such as limited access to showers toilets not working and no running water records also indicate that the prison was being operated with about half the officers it needed why that event rose suspicions of two men conducting a u-turn is unknown but after the
