First of all, HE'S GOT MORE ISSUES THAN me and he TOLD ME TO RESPOND. >> OH MY GOD. >> I WANT TO START this video by saying if you're under the influence and you get behind the wheel of a two-ton machine, you are an idiot. I've got zero respect for this guy if he was driving drunk. And if this kid was under the influence while he was driving, he's a fool. You don't get to jeopardize the lives of the innocent because you're too stupid to take care of your own. And while I'm not one of those people who rejoices when America's oppressors are harmed, I can definitely see why some do rejoice. And that's what happens in this video. Two cops and two firefighters are struck and seriously injured in a crazy roadside crash. And when I personally see tragedies like this, I can't help but think that out of commission power trippers won't be able to end the life of another Philando Castile, Daniel Shaver, James Boyd, Johnny Hurley, or Kelly Thomas. They'll be unable to attack and harm elderly people like 73-year-old Karen Garner, 73-year-old Francisco Serna, 75-year-old Amelia Baca, 74-year-old Ruby Jones, or 95-year-old Clare Nowland. No longer will they be able to break into your home, shoot your dog, or taze you for speeding. Okay, it's December 7th, 2023 on westbound Interstate 76 near Sable Boulevard in the Commerce City, Adams County area of Colorado near Brighton. Reportedly intoxicated 33-year-old Elliott crashes his vehicle into a guardrail. Officers and firefighters were on the scene investigating the crash when 24-year-old Benjamin Winters of Brighton, who was also reportedly impaired, drove around a fire truck blocking the left shoulder, re-entered the roadway, and struck first responders. Two Commerce City officers and two South Adams County firefighters were hit and seriously injured. Let's go through this video together and I'll make some comments along the way. >> How's it going? You the driver? What's going on? What happened? >> I was in the left lane, doing the speed limit, and I started spinning out and went over the median. >> Which way were you driving? >> That way. >> You were driving that way? >> Yes. >> Okay. And then you got clipped and you came over the median? >> Yeah. >> All right, cool. >> No, rolled, but I spun out. >> Okay. >> Eight. >> All right. Do you know what kind of car clipped you? >> A sedan. >> A sedan? Where were you coming from? >> Okay. >> Okay. >> I was coming from up Brighton. >> What were you doing in Brighton? >> I was seeing my parents. >> Cool. And where were you driving to? >> To the mountains. >> So you're going that way? >> Yes. >> All right, Brighton's up there. >> Yep. >> So you were not going You're driving from Brighton. >> Brighton's that way. >> That's not I just came from Brighton. >> All of North Brighton. >> No, no, north is that way. That's south. >> Well, I might be out of my shorts because >> Any alcohol today? >> No. >> No alcohol? When's the last time you drank anything? >> Two days ago. >> Two days ago? When's the last time you smoked anything? >> I don't smoke. >> You don't smoke anything? No. Okay. Would you mind doing any voluntary roadside to make sure you're okay to be driving a vehicle? >> It's never a good idea to talk to police, period. >> Sorry? Do you want to do any voluntary roadside to make sure you're okay to be driving a vehicle? >> Sure. >> Okay. >> Well, honestly, I I thought I was going this way, but I spun out. >> Okay. >> And I spun around. >> Makes sense. >> It's an icy crash. I don't know a lot of them. >> You're in really good shape for what you just went through. >> Thank you. >> feeling? >> Lucky. >> You are lucky. Cuz a casing went >> A bullet. >> A casing. >> A bullet. >> Where are you? >> I'm in Palm City. >> Cool. What's today? >> Today is Thursday. >> Thursday. >> About 11:00. >> And yeah, okay. And who's the president? >> Biden. >> Do you have a cat or a mouse or a cat or a dog? >> Mouse. >> I don't see any other animals. >> There's a bullet >> All right. I know. >> So, I'm going to pat you down really quick, all right? Do you have any weapons or anything on you? >> Hold on. Hold on. >> Go ahead and put your hands on top of your head. >> Knife. >> Just a knife? >> Yeah. >> All right. >> I do not consent to a search, officer. >> My partner found a bullet in your car. Do you have a gun in the car at all? >> Yeah. >> All right, you can relax. I'm just going to hold on to the knife right now, all right? Just put it right here. >> All right. >> So, we got our partners shutting down the highway up there. You want to keep it shut down for a bit? >> I think we can probably open up the right shoulder as long as kind of max and that one can move over just the side here. >> I already called for a tow truck so they're on their way. >> Okay. And then we already called the tow on our way, so. >> So, what you do is going to put your feet together, heels touching, toes touching, right on that yellow line. >> So, we're here right now. >> Voluntary road side that you agreed to do. >> I agreed to do it except my eyes. >> No, you agreed to do voluntary road side. They're over there. Do you not want to do voluntary road side anymore? >> Sure. >> So, what I >> You can always revoke consent. There's two things you never want to do. You never want to talk to cops per any lawyer worth his salt out there, and you never want to take a field sobriety test. Why? Roadside field sobriety tests are designed to make you fail. You need to know your rights. >> What I want you to do is take your right foot and put it in front of your left foot touching heel to toe. Nine heel toe up, small steps, turn yourself around, nine heel toe steps down. It's going to look just like this. I'm going to demonstrate. >> Why do you ask me to do this right here or whatever? >> Because you said you were WILLING TO DO VOLUNTARY ROADSIDE. >> I never asked you that. >> I did. Do you not want to do voluntary roadside anymore? Do you not want to do voluntary roadside anymore? >> Sir. >> Yes or no, that's all I need. >> What happens if I say no? What happens? >> Well, we're going to have to come to a conclusion. I need a conclusion of this whole thing. >> What's the conclusion? >> Okay, do you want to do voluntary roadside or not? Yes or no? >> I was sitting here asking >> Do you want I'm I'm done talking about this. Do you want to do voluntary roadside or not? Cuz if I have to ask one more time, I'm going to take it as a refusal. >> What does that mean? >> That you're going to be placed You're going to be placed under arrest. You're placed under arrest for DUI. You can try to argue in court all you want that say you didn't do voluntary roadside and you used free weight, but I have it on body cam that you agreed to do voluntary roadside. >> I have a right to do All right. >> You have a right right now to be arrested. >> If you ever consent, which you shouldn't, but if you ever accidentally do, you can always revoke consent. Even if the cop says you can't, well, you really can. >> You have a right right now to be arrested. That's what your right is. >> Well, you never asked me to. >> Well, that's for you to argue with the court, not with me right now. You're right now under arrest. So, under Colorado's express consent, if you are suspected or arrested for impaired driving, you have already given your implied express consent that you would perform a blood test or breath test of your choice. DO YOU WANT TO >> NOW, I KNOW THEY DID A SLOW-MO ON THAT. LET'S go hyper slow-mo, and let's do just frame by frame. You have these two first responders standing right here. This is where the action takes place. Here are the headlights of the oncoming vehicle. They said that he was super high, and he was engaging in distracted driving, texting while he was driving. So, let's take this one frame at a time. This officer passes the vehicle first right and it's a truck. The truck first strikes the first responders, the paramedics, fire department, and that one guy's body goes into this first male officer's body, who then catapults into the female officer's body. The truck passes along with the bodies. Take a look at it from this angle right here. Caught them completely unaware as the truck passes. IT REALLY IS HORRIFIC. >> 501, HE'S GOT MORE INJURIES at scene. I need CODE THREE RESPONSE. >> OH MY GOD. >> 501, we just had a vehicle go right through all the patrol vehicles and hit OUR HIT FIREFIGHTERS. >> HEY. >> STAY >> IN THE CAR. STAY IN THE CAR. STAY IN THE CAR. >> OH MY GOD. OH, JUST STAY sitting down. Stay down. Stay down. Stay down. Stay down. Just stay down. Just stay down. STAY THERE. STAY THERE. YOU GOOD? YOU GOOD? BREATHE, ALL RIGHT? BREATHE. Stay down. Stay down. COME ON. STAY WITH US. STAY WITH US. STAY WITH US. HEY, KEVIN. HEY, KEVIN. ARE YOU ALL RIGHT? HEY. Stay with us. Stay with us. Get these two away from You good? Hey, let's get these over here. You all right? You feeling good, buddy? Kevin, YOU ALL RIGHT? >> [laughter] >> IT IS NOT a good idea to move him. >> Can we move the fire truck the truck even more? >> Yes. >> Thank you. >> Just keep doing that. Get her out of here. >> I don't understand the logic there. It looks like that cop drug the other injured cop into the middle of the street on the other side of the roadside near that barrier on the left-hand side. >> We need to isolate this person here. >> And the street is not blocked off. >> Just stay with us. Take that person over here. >> Okay, you want me to drive? I thought he said don't move him at all. Okay. Buddy, you ready? >> Yeah. >> Hold on to your body cam. >> I got you, all right? >> You good, buddy? I got you. Hey, you all right? Hold on to each other, all right? Watch after him. Watch after her. Got it? >> Hey. hey Cooper, go deal with him. I'll be fine. Cooper, go deal with him. I'll be fine. >> 531, we're shutting down the whole highway. >> Who is this? >> Driving the truck. >> Get up. Get up. Get up. >> I'm trying. I'm trying. >> Stop reaching. You're only being detained right now, all right? >> Okay. >> You're okay. >> Where's Arnie? Can you guys stay with him? >> Yeah, we got you. We got you. We got you. >> What we got over here, girl? >> I'm okay. I'm okay. >> Are you okay, buddy? >> It's just >> Is your swallow okay? >> Yeah, I can I can swallow. >> Are you breathing okay? >> Yeah. >> Do we need to get this vest off of you? >> No. [laughter] >> Okay, dude. >> Yeah, it's just It but I'm I'm fine. >> All right, guys, we're going to get you through this, all right? You just hang tight. >> I'm fine. Just help me. >> Yep. Yeah. >> I think I just got struck pretty hard by the car. >> Yeah, I felt that cuz You blocked me. Thank you. >> You're welcome. Already creating a hero where there is no hero. He blocked me. No, he was already standing there. He He have a choice. He was caught just as much by surprise as you were. It's not like he heroically jumped in the way as he pushed you out of the way. >> I feel bad >> [clears throat] >> cuz he blocked me. Thank you. >> You're welcome. >> You okay? >> Yeah. Yeah. I love you, Gus. >> Sorry. You okay? >> He is not okay. >> You okay? >> Yeah. Yeah, we're okay. >> This tree brush scared me the most. >> I'm sorry. I'm glad you're okay. I'm sorry. I'm sorry. I'm sorry. >> You're good. >> Where is it? >> You're good. Take that. We're going to go to the other side. >> Yes, sir. >> Are you okay? Do you have any injuries? >> Man, glass went everywhere. >> Yep. >> I got in a wreck and then that happened. I don't know. >> They're blocking it all off. Block it all off. They're blocking it all off. >> That was Gucci. >> STAY WITH THEM. >> YOU ALL RIGHT? >> YEAH. >> OKAY. I'M GOOD. >> UM MY GUY needs to be put in a car. That's a DUI. I hit a sir. Look, whatever. >> Don't drop him. I got this side. >> What happened? >> I got him. >> He got hit by a car. >> I got it. >> Keep going. >> I got it. Highway speed. >> Where was my phone? >> I have it. >> You worried about your phone right now? >> You know, I'm not worried about my phone right now. >> I'm just going to read this to you, okay? >> Go ahead, sir. >> You have the right to remain silent. >> Yes, sir. >> Anything you say can and will be used against you in a court of law. With those rights in mind, do you wish to talk to me now without a lawyer? >> No, sir. >> Okay. What's your name? >> Uh Benjamin >> All right, it's okay. >> You may have just killed me. >> Hey, I did it. Go. Got the thin blue line gang sign of tyranny on his wrist, I see. So, you are in custody right now, okay? Do you want to ride with him in the same ambulance? >> I've got it. No, it's okay. I want to go with them. I've got it. I've got it. >> I mean, I can see how some people would say, well, with this kind of thing going on right now, more pets will be safe. Elderly people will be safe. At least one more person safe. You know, the Philando Castiles, the Daniel Shavers, the James Boyds, the Kelly Thomas, the Breonna Taylors. Members of society will be at least one more person safe from an individual who's apt to use his power and authority to say dislocate the shoulder of a 73-year-old Karen Garner, or end the life of Peanut the Squirrel, or Hee Haw the Donkey. >> It's okay. I've got it. I'm I'll go with him, okay? I'll go with him. Okay, I've got it. >> Are you Are you hit, too? >> Yeah. >> I'm fine. >> Okay. >> Hey. >> Hey, okay. Okay. Okay. Okay. >> You want to walk? >> Uh I I've got it. I'll go with him. >> Okay. >> I'm going to bring the stretcher close to you. Just stay right here. Okay. I'm good. >> This is suspect for this? >> For the dis- Tacoma. Yeah, for the accident that happened with all the firefighters. >> What? For who? Where's the guy for the hit and run cops and everything? >> So, that's him. He is He is the suspect that went through the fire truck. >> Everybody else? >> They're fine. >> Okay. >> Okay. >> So >> Hold on. Is the other guy in custody here? >> Yeah, so I had I had Ron take our actual custody that made this whole accident. >> Yeah. >> Is everybody else got a motor? The next ambulance is coming in, okay? So just stay right here. >> Do we have any non-police or fire >> No, so that's just uh Buckner Cabin near the only one that got injured from my side. The firefighter already got I think he's already got loaded up. >> Okay, how bad was he? >> He is pretty bad. >> Are you hurt? >> I'm looking at the police report. I'm hurt but I'm alive. This is so hard to deal with for the rest of my life. >> It's just like a guy who just got done endangering a whole lot of other lives to be primarily focused on his own life and future. >> This is so hard to deal with for the rest of my life. >> I got a bed over here for you, man. >> Can you help me get out of the car? >> I'm going to get you out of the car. >> Do you think you guys got this situation? >> Yeah. >> Yeah. Hold on. >> Hold on, Jack. >> I don't want you to do anything for I'll help you out, man. I'll pick you up. I'm going to pick >> Hey, brother. >> Tense your arm. Ready? >> I'm going to help you. >> Sir, if I push in, do you feel any pain? >> Fire department or you got a >> I was >> I think he was in the car. He ain't quick. Hold on. >> And I'm going with you. >> Check your >> I really got to get a good doc. >> Where's the other half of the sheet? >> You don't have to walk. Let's go to the field. >> Do you want to get on Do you want to wait for the stretcher? >> Yeah, yeah, please do. We're standing right about here. here. >> Okay. >> And we were just He was standing right here. >> Mhm. >> And I look up and here comes a vehicle around the front of the engine and they turned toward us. And I said I tried to grab him, but I backed away. He hit and I watched my friend get thrown through the air and land over there and then he barreled into the police who were standing by the other police car. >> that one of the officers didn't get hit. Pretty much all of them. >> The trooper said his body camera probably caught the whole thing. >> [laughter] >> for coming at you guys like that. I had no idea. You know who we are. We just We try to We get here and we have to figure out what's going on and >> I understand. >> I know he was pretty upset. >> Officer Buckner, with the thin blue line covering her badge, walked away with minor injuries. Officer Cabane sustained more serious injuries, but he was discharged from the hospital shortly after. Firefighter Ryan got the lion's share of the injuries and he had two excruciating years of rehabilitation. After that 2 years, he went back to work. Elliot's blood alcohol content was 0.172, more than twice the legal limit, and he was charged with DUI and careless driving. Benjamin was charged with two counts of vehicular assault and three counts of third-degree assault of a first responder. He was sentenced to 4 years in prison, followed by 3 years of probation.
