By the way, this father was there to report that his child is missing. Now, this situation centers on the disappearance of Craig Courtestain, a 2-year-old child from Main, Arkansas. And a viral video documenting an interaction between his father and the Main, Arkansas Police Department has pissed a lot of people off and rightly so. >> Oh, [ __ ] >> This is the missing child, Craig Bailey Courtestain. He's about 2 years old. The child's father, who holds primary legal custody, reported that the mother failed to appear for a court-ordered custody exchange. This is the Main, Arkansas Police Department surveillance footage of that father trying to make the initial missing person's report. >> Hi there. Yeah, I called earlier about my son's mother missing our custody exchange. I was calling to follow up on that and file a police report. Okay. Hi there. How are you? Good at all? >> What's going on? >> Uh she said you were the officer who winged it a welfare >> I don't have a clue what you're talking about. >> All right. Sorry. I'm the one that's here, so I'm I was supposed to receive my son at 8:00 this morning. His mother never showed up for our custody exchange. I called here to do a welfare or I called here to report that. She said either we're sending an officer over to their home to check. I haven't heard anything. >> Okay. Yeah, my partner did go by there, but couldn't contact nobody. >> Is their truck there in the parking lot? >> I don't know anything about I didn't I didn't I don't know about >> Now, I'm here to file a police report for kidnapping and interference with child custody. >> Okay. So, I can go and get it and bring it back, but you guys made a photocopy of it a week ago. >> Who is "you guys"? >> Me and the police department. >> What specifically, which person? >> Officer Newman. >> Officer Newman has a copy of it. >> In association with the police report that was filed about a week ago. So, me and the police department have >> What was that What was that report for? >> Uh that was harassment against Janair Coburn for approaching us at church. >> Okay, I can look that up, but we do not take reports for parental custody. >> You don't take reports for felonies? >> No. Not for that. >> I mean, the police department doesn't take police reports against parental custody cases? >> So, why is there Why is there a felony? >> Interference with child custody is a felony. >> That's not a felony. >> That's something you need to take up with your attorney. >> Person commits the offense of interference with custody with without lawful authority he or she knowingly takes etc. Interference of custody is a class D felony. This is on justia.com. This is a This is Arkansas statute. >> Okay, so you're looking at the wrong thing then. That's not what we go by. >> You don't go by the Arkansas state statute? >> We do. But that's not >> AR code statute 5-26-402 >> I don't know what that >> Well, let's look it up. You look it up. I am looking it up. Arkansas >> Hey, don't raise your voice to me. >> Don't raise your voice to me. >> You don't raise your [ __ ] voice to me. >> Don't raise your voice to me. >> Don't start no [ __ ] >> Excuse me? >> You heard me. >> I'm here to report >> I don't CARE WHAT YOU YOU START YELLING, we're done. >> You're yelling at me. >> Yeah, because you started >> I don't think so. We've got cameras up here. >> Yes, we do. >> Yeah. So, I'm here to report >> I'm telling you're not taking that report. >> You're not taking the report at all. My child is missing. >> Missing from where? >> From my custody. >> And you're custody? Yes, you have custody of the child. >> Yes, I do. >> Do you have your paperwork? >> Do you have a copy of it? >> Yes, I can go get it and bring it back. >> You better go and bring it back. >> You have a copy of it here. >> I'll go look. >> Please do. I will wait for you. >> You better have a different attitude when I come back. >> How about you have a different attitude? The child is near as yelling. You was the one to start yelling. Now, we have it on footage. >> Yes, we do. >> Yeah. Both of us are wrong. What did you say? >> I said there's no law for people to act like that. >> I'm here to report a felony. You can get the supervisor, too, while you're at it. Could I please get a copy of the FOIA request form while we're at it? You're Todd Cannon, correct? Are you Todd Cannon? Yeah, did you hear all that? Okay, well, I'm here to make a report for kidnapping and interference with child custody. It's a felony in the state of Arkansas. Your officer is just shouting at me for trying to do that. Would you like to come out and take my report? Thank you. I'd appreciate that. I'll give this FOIA request. So I'm missing my son. Do you have any idea if they're working on that? >> I don't know, man. I work for state police. I don't know what I'm doing. >> I made a report with you guys. They're refusing to take this right now. >> You'll have to do that through the courts. >> Okay. Thank you. >> [clears throat] >> What's going on? >> My son is missing. I'm trying to file a report for interference with child custody and kidnapping. >> It The criminal statute would be interference with child visitation. >> My custody visitation. >> All right. But there is enough defenses in the statute that gives her an out for the criminal issue of it. You need to report it to your attorney and let him know what's going on or him or her. >> No, this is a felony. Why can't I report it? >> Class C misdemeanor even if I could prove that she >> I'm looking at the statute online that says it's a Class C felony. >> What is your child's name? I have the statute book. >> Can I see the statute book? >> I can show you the >> Yeah, let's pull it up. I'm still waiting on that FOIA request form as well. >> But actually your attorney needs to show you the statute. >> Good job. >> I'm going to make a public records request. I'll make a public records request for statutes and also for the camera footage for the interaction I had with Officer Maness a second ago. So >> Okay, that's fine. >> my child is missing. I'm trying to report a child missing. >> It [clears throat] sends a letter of proof email or mail. >> I'm here in person. I'll do it. I'll do it here as I've done in the past. But I'm trying to report instance, Can we not get that taken care of immediately? Seems like a I mean, do you get What's the deal? >> Have you talked to your attorney about it? >> A child is missing. >> Have you talked to your >> Yes, I have. >> Okay. >> Are you guys aiding and abetting this child kidnapping at this point? Cuz >> I don't know why you want to be an [ __ ] My child is missing. >> is missing. Don't call me an [ __ ] cuz you guys don't want to do anything. >> The very first interaction you've been treating me like this. >> That's not true. Our first interaction was very cordial and everything was fine. No, that's not true. >> You called me over to talk to you. I did. >> My child is missing. You guys don't want to do anything. >> A video interview with you, like we're doing now. [laughter] >> talking about now? >> Huh? >> What are you talking about now? I'm trying to report a missing child. Let's get that taken care of. >> record me to ask me uh >> No, I'm trying to report a missing child. Let's get >> Are you recording me? >> Yeah. >> Okay. >> I'm trying to report a missing child. Let's get that done. >> And I've told you the statute. We've talked to both sides. We've talked to >> You spoke to her today? >> And we >> I was told that you haven't been able to contact her today. So, which one is it? Has Nina P B made contact with my son's mother today? >> You need to go talk to your attorney. >> Has Nina P B made contact with my son's mother today? We're talking about a missing child. What are you guys doing? Officer Gillian, anything? Are you guys refusing services at this point? Do I need to call 911 about this? Chief Stewart, what's happening here? I need to make a report for my missing child. No, the other officer is gone. I mean, do I need to call 911? How do we get this officially documented? We've got four officers now who are refusing to take a report of a missing child. My attorney is in law enforcement. We're talking about a missing child. You guys don't deal with missing children? What's My attorneys and law enforcement. A law has been broken here. A child has been kidnapped and is missing. And you guys don't want to do anything about it. [clears throat] Where's my child? He's not in my custody where he is legally ordered to be at this time. >> [clears throat] >> And none of these officers are going to come and assist me. Sorry. Are you serious? Hi there. Yes, my son's been missing for over 24 hours now, so I'd like to file the missing person's report. Can you by any chance could you print out a statute for me so that I know I have the correct uh statute that I'm referencing? 526-503. I think it's a class C felony. That's what my records have written on them. Thanks. Yeah, if you could look that up for me. >> Have you started your statement? >> I tried to fill one of these out with some guys yesterday. >> Well, there wasn't a an issue yesterday. >> Well, sure there was. >> No, there was not. >> What makes you say that? >> Because what Because everything you're involved in so sorry, it's a civil matter. It's not criminal. >> So, she's looking up the statute for me, but I'm understanding that 526-503 A person commits the offense of interference with custody if without lawful authority he or she knowingly takes, entices, or keeps That would be the important part. or aids or entices or otherwise, but there's another Just a moment, please. There's another statute also Just a Just a moment, please. Let me finish. or induces a person to take, entice, or keep a minor from [clears throat] the custody of which in four any other lawful custodian. That would be me. >> Okay. >> And interference with custody is a Class D felony. >> There's also a statute that says she does not have to release that child to you if she is in fear of some danger to that child. >> And she gave that statement to the police? Did she call DHS? Is there any evidence to suggest that she actually fears that? Cuz we have multiple unsubstantiated DHS claims. >> That's what That's what she she said here. That's what she told our office. >> But there's no evidence. That's just hearsay. So >> not hearsay. If you told that one of my officers that. >> Which officer? >> Why don't you just make it simple and go to your attorney? Have your attorney >> Why don't you guys want to make it simple and enforce judge's orders? >> Why don't you leave my office? >> This is a public area. >> Leave my office. I'm in charge of this office. I am the police chief, and I'm telling you to leave. >> This is a public area, and I'm seeking services. I'm seeking lawful business. >> We've already handled >> I'm being trespassed. >> You need to leave. You need to leave. >> I'm being trespassed? You need to leave. What will happen if I do not leave? >> Then I will have you arrested. >> Thank you. I will leave that. I'm still waiting on the document from her to see >> Okay. >> if that meets >> The father alleges that the mother took the child without authorization, potentially fleeing the area or crossing state lines, which constitutes interference with custody and potential parent kidnapping. And this is what happened to that father when he tried to present this information to Sergeant Edward E. Price Jr. from the Mena Police Department. >> I do all of this to raise awareness about my missing son, Craig Corristan. If you know anything or see him, his mother Sterling Mariah Cova Freeman, or his grandmother Tamara Cova, who also goes by Tay or TK, please contact your local law enforcement or me directly via the email in the comments below. I love you, son. >> This is my custody order. >> Uh-huh. >> Section 8 directs >> Yeah, we got copy of it. >> Okay. So, you're aware that Judge Ryner has ordered you guys to assist me in the enforcement of this order? >> You have Do you know where he lives, Dalton? >> No where the child is at. >> Got you. So, it's my understanding that Mena Police Department knows where the child is. >> Not my understanding. >> So, Mena Police Department >> is not knowing where the child is located. We don't know if the child is in the next city over or in the country or >> So, we can agree that the that according to Mena PD, my son's location is unknown. >> That's correct. >> Okay. His location is unknown to me as well. So, I'm asking that you open a missing person's report and enter him into the database. >> I think I already you already talked to Chief Stewart and >> I'm talking to you right now because my son has not a missing person's report has not been opened. My son is not in the database >> for >> missing children. >> Right. >> And I would like to do that. So. >> Under what grounds? >> My son is missing. >> Okay. >> So, I'm >> Who says your son's missing? >> I'm saying my son is missing. >> You say your son's a >> The sole guardian, the sole custodial parent. >> That just recently happened. >> Doesn't matter. I'm asking you to open a missing person's report. >> Did the Was the child taken from your custody? >> Doesn't matter. My son is missing. I'm asking you to open a missing person's report and I'm and I'm telling you this because the National Center for Missing and Exploited Children has a detective on standby. Ready to start searching for my son. As well as lots of other resources from the NCMEC and the Morgan Nick Foundation ready to help search for my son. These are resources that I am entitled to as the parent of a missing So they can't do anything until Mena Police Department enters my son's name into the database as missing and opens a missing person's report. So I'm asking you to do that. >> I don't have the grounds to do it. >> You as a Mena Police Department This is the criteria. Which part of the criteria is not being met? >> Well, he's not a runaway obviously. There's no unusual circumstances. >> This part right here. The definition of missing child. [music] Which part of >> Yeah, but it takes every bit of this. >> Yeah, which part of those four definitions of missing child is not met? >> [music] >> Well, he's a resident of the state of Arkansas cuz I don't live here no more. >> He lives with me. >> How does he live with you? How do you have him in your custody? >> This is the custody order declaring that he is in my custody and that he >> Well, he's not in your custody cuz you don't have him. >> Cuz he's missing. This says he's my I am the custodian of >> Okay, you have that right there, but do you have him in your custody at that time? >> Are you refusing to do this? >> I am. Yeah, yeah, the answer to one of officer questions >> Because I'm going I'm I'm You done been told to come back and see the chief and stuff on Friday. >> understand Do you understand that this has gone well beyond you refusing to help Don't interrupt me. Don't interrupt me. Do you understand that this has gone well beyond Mena PD refusing to do their jobs and now you are actively preventing me from accessing resources to help find my son. >> I'm not preventing you from accessing >> Yes, you are. You're refusing to file a missing >> anything from us. >> I'm requesting that you open a missing person's report. >> Do you know what comes next? >> Well, I have to go get a writ of habeas corpus to order you guys to open a missing person's report. >> Well, we don't take that from >> understand what the Do you Do you not understand what the 14th Amendment is? >> Yeah, I know exactly what it >> What is >> You tell me. You said you know >> You said you know what it is. Do you know what it is? >> It doesn't matter. >> It's not my job to educate law enforcement. Do you know what the 14th Amendment is of the Constitution of the United States? >> Maybe I do, maybe I don't. >> said no, you're shaking your head. >> I said maybe I do, maybe I don't. >> You should. You swore an oath to the Constitution, didn't you? >> Constitution of the state of Arkansas. >> You didn't take an oath >> and the Constitution of the United States, yes. >> Right. But you don't know what the 14th Amendment is? >> Not right off the Not word for word. >> Okay. It It guarantees me to do to >> Then do what you need to do, Bryce. >> It guarantees me to equal protection under the which you are refusing to give me. >> I'm not giving it. >> Did you just say thank you because he's answered your question? >> Yes. >> Do you understand that qualified immunity does not protect you from >> what You You know what your problem is? You ain't never been told a day in your life no. >> I'm being told I've been told no quite a bit. >> and you're throwing a temper tantrum right now. >> My temper tantrum? >> Yeah. >> You get Are we getting this right? You think it's a temper tantrum that my son is missing and Mena Police Department >> Because you have been already been told what you're supposed to do. You've been told. You've >> You've been told what you're supposed to do. >> You've got judges orders here, Bryce. >> Buddy. >> They ain't no judges orders to me. That says to assist you in to >> to pick up the child. >> in enforcement of this order. >> That's the and that you That is the means to pick up the child. >> No. It is with in enforcement of this order. >> at or we know where the child's at, I'm to go with you and assist you in removing said child. >> agree that the location of my child is completely unknown. We've agreed that the location of my child is unknown. Right. Meaning he meets the definition of missing child under Mena policy and procedures. >> This here, this whole thing, I want you to understand this. Policy and procedure is not a law. >> Oh, I understand it. Okay, it can be burned today and rewritten tomorrow. >> Are you suggesting that the policies and procedures of the Mena Police Department don't mean anything? >> They they do mean something. They mean something to us. >> Clearly not. You're not following it. >> I'm being told Whatever I'm being told, I'm being told like you've already put stated all over social media and everything else. I'm under acting under the advisement of my chief. He has told you to come back Monday or Tuesday after he has followed through with everything. >> Yes, he did. I just watched the video on it this morning. >> No, he didn't. We've got the video of the last thing that I said to Chief Stuart. Don't interrupt me. The last thing that I said to Chief Stuart is, are you ignoring a missing child? And his response was, I'm ignoring it, as he walked out that door. >> But before that, he also told you to come back Monday or Tuesday. Yes, he did. He said after he talked to to uh the prosecutor over there and find out this, that, and the other, cuz I was not privy to that other than what I seen on the video. That you could come back Monday or Tuesday after he talked to them and that y'all would he would find out what information he needed to do and go from there. >> It was It was either that or early next early in the week. >> He said early in the week, but I'm I'm saying Monday or Tuesday to be That's the earliest thing. >> What that question you asked earlier, when you asked Ross if uh Drake was taken from his custody. >> Mhm. >> So, the answer to that would be back in November that yes, he was taken from his custody because he was supposed to be delivered >> He was He wasn't taken from his custody. He just wasn't delivered to him. >> Yeah, so being kept So, being kept from any person entitled by law or court order his custody was prevented. >> Well, it wasn't He wasn't in his custody. >> He was being held in his custody, kept from >> kept from >> It's written here, too. >> That That sounds about as wrong as uh uh as it can be. And this whole thing has has >> Let's get back to the fact that there is exactly one person that this child is supposed to be with, and that's me. >> Okay. >> And he's not. Because he is missing and his location is unknown. All right. So, let's open the missing person's report and get him in the database. >> Let's come back and see Chief Stewart. >> Why are you delaying? >> Because I was told to. >> By who? >> This is the same thing we talked about the other day. >> Just answer the question, man. Who told you not to put >> Chief Stewart said he was handling the situation. >> That's not what I asked you. Who told you not to enter my son into the missing >> word for word, but but >> We're not talking about word for word. You told me that you were told not to do this. Did Chief Stewart tell you not to report my son as missing and enter him into the missing person's report? >> said he does not meet the criteria to be missing. >> Despite the fact that me, the only person this child is supposed to be with, does not know where he is. >> That's correct. >> How does he not meet the criteria? >> I'm not going to say anything to you. >> incapable of reading? >> I've already told you my answer. >> No, we're not done. No, we're not done. No, we're not. Thank you. Just to be clear, you're refusing emergency services. >> Yes, I am. >> We got that. You're refusing emergency services. Excuse me? >> There's no emergency on your apartment. There's no emergency on >> Missing children aren't emergencies? >> Not when they're not missing. >> Where is he, then? You You said he >> The child might be at home. You'll go to jail. >> For what? >> If the child might be at home, you will go to jail after you go to trial. You step back. I'm leaving. You step back. I'm not deaf. Step back. Step back. >> What? >> Come on. Step back. >> This is what you said you were going to do. >> Oh, [ __ ] I told him to step back. >> Yeah, but you didn't have to do that. That wasn't necessary. >> Thank you very much, Officer Price. >> Good. >> That was not necessary. And this is not necessary. No, you're not. There was no threat imminent to the officer and I think he hit his head on the way >> Well, teach him to >> He hit his head. Yeah, I don't know if he can. He hit his head. He should treat him as an injured and be taking him at this point. And that was not necessary. >> Oh my god, are you calling the ambulance? >> Lay him down. Lay him down, Officer. >> He needs to stay up so he don't throw up. >> Okay. >> This officer put >> Sorry, Officer Price. That was not necessary. >> He's quick. >> Get my knee behind him. >> He's fine. >> Gentlemen, that was >> You need to step back. >> Okay. How far back? >> Not a 15 ft. >> 1 2 3 4 5 I don't know if you can do that. That was not necessary. Serve officer. Yes, Officer Price. I got you, man. I'm good. >> Make sure he's okay. I can't see. >> Just remember for everybody to get >> I can't see. I need medical. I need medical. I need medical. My eyes. My eyes. My eyes. Please let me wipe it. Can we flush it? Can we flush it? >> Call the A&E. >> Yes, sir. >> Yes. >> Sir, can we flush it? Please flush it. >> I don't have nothing on me, boss. >> Okay. Okay. >> Can you use a handkerchief or anything? Does that help? >> It's not going to help. When the paramedics get here, they'll be able to flush his eye. >> Whatever it runs to, it's going to burn it, too. >> It's totally uncomfortable. >> Please, can I wipe it? Please, just let me >> It's going to make it worse if you wipe it. Just sit up. >> Please close. Please flush it. Please, anything. >> Okay. Do you think pouring water in it will help? Water helps. Do we have any water out here? >> I don't have any water. >> I got it. >> You guys got water? >> You got any more? >> Please, just flush it. Please flush it. Please hurry. Please hurry. Check the the passenger side door. Please hurry. He's got a He's got a water bottle. >> He's got his bottles and stuff.
