learn that man make a complaint officer names i don't care welcome back to the lackluster channel today's story was submitted by a viewer named brandon who on december 19th of 2020 was traveling with his friend in mount olive north carolina uniformed officers of the mount olive police department conducted a traffic stop on their vehicle for allegedly not using the car's turn signal the video begins as officer david nance asks brandon the passenger for his identification even though he was not suspected of committing a crime he was a good job that the hell you are you as a joke man you can give me a driver's license identify in the state of north carolina wow yes i do no you don't he did not commit any kind whatsoever he's it still so i decided what he i didn't do anything what did i do i just told you you just heard something i did use it you turned around and following me from back there i saw you guys man i don't know what's going on man get out of the car get out of court if not give me a driver's license come on i don't have any driver's license give me your id card for what in the supreme court case of pennsylvania v mims the court held that the act of ordering a driver out of their car is a minimal intrusion to their fourth amendment rights and that there is a strong officer safety reason to give officers the freedom to remove occupants at their discretion in maryland v wilson the supreme court said that the mims rule applied to passengers and drivers claiming that officer safety justifies removing the passengers as well as the driver making it legal for an officer making a lawful traffic stop to order the driver and passengers out of the car pending the completion of the stop and because of people v gonzales passengers may be ordered to stay at the scene furthermore because of the ruling of arizona v johnson an officer may perform a pat-down of the driver and any passengers upon reasonable suspicion that they may be armed and dangerous so here because the officers alleged that the driver failed to use a turn signal the officers can lawfully order both the driver and brandon out of the vehicle however searching brandon and demanding his identification would not be lawful unless he is suspected of a crime which he is not i'm done get up let them do what they got to do man fresh chocolates you know that y'all know this wrong [Applause] [Music] oh [Music] nope that's wrong y'all know you're wrong he didn't do anything wrong y'all know the law you police officers y'all know the law he's a passenger he didn't do anything wrong he didn't commit any crimes you're messing with this guy [Music] they pulled them out my car and searching them for nothing bro [Music] [Music] [Music] you don't have to know that man he didn't do anything wrong no i got lawyers too you know you know that man work that man work every day officer nance has removed brandon from the vehicle put him in cuffs on his knees and bent him over the hood of his cruiser in an effort to identify him claiming that all he had to do was identify this is inherently false and is an egregious violation of brandon's fourth amendment rights but for some reason officer nance thinks it's okay for a state official to treat random citizens this way and aside from receiving his paycheck from american citizens tax dollars nothing about officer nance's behavior reflects american values or laws officers like nance are the reason that the american people have an issue with the current state of law enforcement today and as it turns out officer nance knows the driver and is now pointed out all this stuff going on in here man and y'all messing with people this guy know me he knows me what the can i do he knows me too and i don't understand why you're being like this man i don't understand you man [Music] what did i do because you try to follow me from back there man that's your mom brother how long have we known each other that's what i'm telling you man why are you doing this man all i did you know i was going home brother listen listen have i ever messed with you before no but you are now i don't know i didn't know that you were actually [Music] you went down williamson street and tried to turn and try to catch me coming home man i saw y'all man i know exactly where you live yeah i know your tactics and try to follow me so all you got to do is tell your boy why you're your passenger man you know i'm not doing anything wrong okay and i know who you are right so you know you saw me you said okay he's good he's going home do i know who he is it don't matter man i don't know i don't know who he is how do i know if he's not a fake officer he can identify himself but he's like i identified myself okay the driver asks why brandon had to identify himself and the officer's best response was this why do you have to identify himself man he is you have to learn that man not knowing who someone is is not a valid reason to assault and batter them nor is it reason enough to rummage through their personal effects to identify them but for some reason law enforcement officers in 2021 still think they can and should be allowed to access your information simply because you exist why do you have to identify yourself man you have to learn that man being a police officer man when you go to class you go to school for me it's [Music] right just like i asked you and he wanted to keep yelling okay all i asked him was give him his id or his driver's license or tell him his name that way i can identify who he is so i don't know if he's wondering or not how do i know he just didn't kill somebody do i know that well how do you what do you do i know that why should you know that what did he do wrong to make you think that he's he's a dry he's in there he's all right that's what did he be wrong how about anybody on the side of the street what did he do wrong to make you think that he killed somebody well he could be saying that nothing right i don't know if he had a warrant he's a possibility he would have worse than that tonight but he's a passion he didn't do anything wrong sir do you want to keep arguing i'm not allowed to go to the police department make a complaint officer nance i don't care it's not that easy man it's not that easy man and you know you're wrong man you know you're wrong bro make sure you turn that you know you're wrong hey man just be quiet [Music] okay i know linda okay i've dealt with it before they ever gave me one problem let me never get any problem i asked you politely to give you your driver's license for your id okay that's all i wanted to identify who you are and make sure you have no one do i know who you are so hey man can you let the man go man instead of just furthering it further and further no because that's how stuff happens man you got him there prolonging him just so he can get mad so y'all can lock him up you know you got him here for what he has no warrants why is he still here why is he still here he has no wants why is he still here man i'm just saying man y'all wrong man let the man go man he didn't do anything wrong man he didn't do anything wrong sir can we go home please as soon no you're the one talking man let the man go you see you pissing them off for nothing right now why we obstruction what we did anything we did nothing wrong obstruction of what and the way y'all interact with the community man like you always want to don't stop doing it stop doing stuff like this man doing what doing stuff like this all you should have done was just pulled me over got my license you know didn't mess with my passenger let me go man you know y'all doing stuff like this you make the community hate you man if i was a police officer i wouldn't give a damn who the passenger is you know if he didn't do nothing wrong man you know then you take them out my car and throw them in handcuffs you know that's not by law man you know that's not by law brandon is released and returns to the vehicle and officer nance tries desperately to explain why brandon had to be detained handcuffed and have his personal belongings searched you know that's not by law man you know it's not okay what's it it's not brother it's not did he find you take him out my car and put him in handcuffs man before he even knew who he was exactly you cannot do that you can't do that well if you don't think actually you can't do that hey i promise you you can't do that i can then go to the police department i'm not going to the police department i'm going further than that i'm going further than that and that's what i'm saying best of luck to me right and that's how y'all treat the community you drag people out their car and then you pull off and say best of luck that's what's going on in town on my dollar the driver did not receive a ticket for his alleged violation and both him and brandon were allowed to leave without further incident this encounter while simple and relatively unharmful is a perfect example of why there is a sharp disconnect between law enforcement and the people more and more often we are finding officers who know nothing about very basic law let alone civil rights and have an obvious disdain for the citizens they serve and the freedoms we are given at birth brandon has filed an official complaint with the department and has retained
