And then I didn't see them crossing and then like mostly you know it's just like cuz I guess they were running. I don't I honestly don't know. Okay. But I feel like they were running. You feel me? Did you you out of the tag? Yeah. [Music] You ready? [Applause] Please, please, please. We got to focus on her and whatever else is going on. The focus is on her now on her. All right. All right. You was with her. He was literally with her. I was my I'm sleeping over my friend's house. anymore, but I was waiting for her to unlock the door and she's coming out downstairs and I'm waiting and the whole thing this I don't know this girl, she was like by kind of right here and she flew and I ran I ran all the way over here and I asked her if she was okay. All right. And the girl, wait, I'm sorry. The girl that told that we hit her, she was like, "I am a little lit. Like, I am a little drunk. I'm not that drunk. All right, we're gonna um Yeah, let's get these forward facing lights off. Forward facing lights off. Yeah. Yeah. R E S P A N Okay. Can you come over here and talk to me for a second? Of course. So, how how much have you had to drink tonight? Um, I had like three white claws. Three White Claws. Okay. How long ago? like a couple hours ago, honestly. Yeah, cuz I sobered up cuz I have to drive. So, I was like, I'm not going to get too drunk and drive. All right. But like I know what happened. You think that you're okay to You think you're you're sober enough to operate in our vehicle? Yeah. I live literally right there. All right. So, uh I'm going to run you through a couple tests, make sure that you're okay to drive. Of course. Yeah. Let's uh we'll get away a little bit from the crowd. And uh so what uh what's your highest level of education? High school. High school. Okay. So you have a pretty good understanding of numbers, right? Accounting, the English language, stuff like that. Okay. So can you just do me a favor? Can you count down from 52 to 39? From 52 to 39. Do you understand? Can I count on my fingers? No. No. No. 52 51 50 Wait. 52 51 50 49 48 47 46 45 44 43 42 41 40 39 38 37 36 34 35 Wait. Okay. 35 36 All right. So, don't [ __ ] arrest me, brother. I'm sorry. I'm so sorry. Okay. All right. So, I'm going to test your eyes. So, just Hey, hey, real quick. Just since we have these emergencies now, if you turn her around and she's looking this way, she won't be looking towards the light. It's gonna be better for you and for the All right. So, I'm just gonna test your eyes. Okay. All right. You don't have to look at my light. Just stand like this. Your hands at your sides. So, do you have any issues with your sight? Anything like that? I have contacts in. You have contacts in. Okay. All right. So, what I want you to do is I want you to just focus on the tip of my finger. Oh, tip of my finger. Right. Don't move your head. I'm going to move my finger around. Don't move your head. Just follow my finger with your eyes and your eyes only. Do you understand? Yeah. Okay. [Music] [Music] [Applause] [Music] Can you just kind of straighten your head out a little bit? Sorry, I have Oh, okay. All right. I'm so sorry. It's okay. Keep your head still. All right. [Applause] [Music] Oh my god. [Music] No, I know. That's awesome. [Music] here. Just wipe the hair out of your face. Yeah. I was about to tell you. It's all right. Okay. So, just look straight at me, right? And then just put your head just down a little bit. Yeah. And then just look at this finger again. Ready? Okay. All right. So, the next test that I'm going to run you through is the walk and turn test. You're wearing heels, are you? What is that? I don't I've never before. So, these are field sobriety tests to make sure that you're okay to drive. Okay. Um, all right. Do you have you have any pre-existing injuries? Anything other than the scoliosis? Okay. All right. So, what I want you to do is I want you to just imagine that there's a straight line right out in front of you. Right. I can put this here. Yeah. If there's just a straight line cuz that's going to move. That's your shadow. Just let me know when you So what I want you to do is I want you to put your left foot on that imaginary line with your right foot in front of it and keep your hands down at your sides. Okay? And remain in this position. Just move your move your foot in front of your No, no, no. Just left foot on the line, right? Mhm. And then your right foot in front of it. Just heel to toe like that. Right. And then put your hands on your side. Your left foot right foot. Yep. Left foot with your right foot in front of it. Yep. Just like that. Hands on your side. Stay in this position. Do not move until I finish my instructions. You understand? Okay. Hands down on your side. Okay. So, when I tell you to begin, I want you to take nine heel to toe steps down the line. When you get to the end, I want you to turn around, take nine heel to toe steps back. All right. So, I'll demonstrate for you. All right. Left foot on the line, right foot in front, hands down like this. You go one, two, three, so forth till nine. Keep that last foot on the ground. and take a series of small steps. Turn around and continue nine heel to toe steps back. Just let me know when I'm on I'm on nine. Well, I want don't don't start until I tell you to begin. Okay. Sorry. All right. So, okay. So, um when I tell you to begin, take nine heel toe steps down. Turn around. Nine heel toe steps back. All right. Look at your feet the entire time. Once you start, do not finish. Or I'm sorry. Once you start, don't stop. Just keep going. Okay. Uh and count each step out loud. Okay. All right. Do you have any questions? So left for left foot is one and then the first step is one. Yeah. Okay. Okay. Can I go now? You may begin the test. Keep going. What? Nine down and then nine heel to toe steps down. Okay. All right. So, the last test that we're going to do is um the one leg stand, right? So, I want you to keep your Just let me know where to go. Yep. Keep your feet together, hands down at your sides. Okay. When I tell you to begin, When I tell you to begin, pick one leg up off the ground. Either leg. All right. Approximately 6 in off the ground. All right. With with your foot parallel. Okay. So, like this. 6 in off the ground. This. Yep. Keep your legs straight. Just stay in the the starting position until I tell you to begin. Okay. All right. Keep your legs straight. I want you to count each second out loud. 1 1 2 1 100 1 3 I could do one Mississippi. Is that good? You could do one Mississippi. One Mississippi, two Mississippi. That's what I'm saying. Do that and uh don't and just keep going until I tell you to stop. So, with this test, you got to keep your foot parallel to the ground, your legs straight. I want you to look at your toes and you need to count each second out loud. Okay? How many seconds? Just keep going until I tell you to stop. Okay? So, do not start until I tell you to begin the test. I'm just going to get my uh my timer here ready. You just let me know. Okay. All right. You may begin the test. The left foot, right? Either foot. Okay. Keep your feet down at your sides. Your arms down at your side. Want me to go like this? Count each step second out loud. each second out loud. Seven Mississippi, 8 Mississippi, 9 Mississippi, 10 Mississippi, 11 Mississippi, 12 Mississippi, 13 Mississippi, 14 Mississippi, 16 Mississippi, 15 Mississippi. I'm sorry. Did I fail? I'm so sorry. Did I [ __ ] fail? Well, you keep going just cuz I don't I don't I'm not lit. That's a thing. Like Okay. Well, based on my training and experience, I do believe that you are under the influence and it's it's not safe for you to be driving. So, we are going to place you under arrest for DWI. Okay. Really? Yep. If you just put your hands behind your back. Okay. Can my sister come pick up my car? We're going to we're going to have to impound it, but uh you're just have have to call for somebody to come pick you up. Okay. We'll go over everything when we get back to headquarters. Okay. So 10 11 [Applause] what? straw. So anyway, only thing I have is elderly. All right, do do with her. She's good to go. Take her throw her in a car. Yeah. What is it? Just get your seat belt off. Oh, [ __ ] There you go. Phone's right here. I'm keeping it with you. Okay. Do you have um her ID? Uh yes. Okay. Did you guys witness this? I'm sorry. What? Did you guys witness this? They got the info already. you officer took your Yes, they already did. So, all right. Well, I'm sorry this had to happen, but it's okay. I saw. All right. All right. Good night, ladies. Thank you so much for your help. Hi. Thank you. Oh, I just want to make sure I um Officer Lombardi, what? You're the only uh No, sir. No, I am. I can do Oh, you're Hifi. Okay, wonderful. All right, we'll see you guys down there. You're doing the 1011, right? Yeah. I assumed I was doing everything. So, yeah. Like if that if that was the case, like since he's not certified in HGN, you could do the HGN, but then he would, if he was going to be the arresting officer, you would want to do want him to do it. Release the cuff from your hand. Just push. Come here. Just while they're doing that first. What we have to do is just go. I got a bag right here. Yeah. I just want to explain to him. Not a problem. We'll have you out of here within the hour. This is like the [Applause] anything that but it's going to be under my fine another charge for refusal. So um this is the same piece of paper. Then after that warning make me primary for this 450. And if you haven't started the pack yet, just put everything in my RMS. This is for me. I'm the test operator. So anytime you do this, there's a 20 minute observation period, right? So during that 20 minute observation period um she can't or take anything to allow roll mouth alcohol to dissipate. If there's any alcohol left in the mouth it will go away within 20. All right Jessica All right. You've been arrested for driving while intoxicated. uh NJ code 394-50. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. Uh a record of the taking of breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have a period or after you've provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection make independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation for up to 20 years, a fine of up to $2,000, installation of an ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to the penalties opposed by the court for any other offense in which you've been found guilty. Uh you have no legal right to have an attorney, physician or anyone else present for the purpose of taking of breath samples. Um you have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with the refusal to submit to breath testing. I repeat, the law requires you to submit breath samples or I'm sorry, I repeat, the law requires you to submit samples of your breath for testing. Will you submit the samples of your breath? Wait, what do I Yes or Yeah. Yeah. Okay. Okay. I'm sorry. I don't know. It's okay. [Applause] [Music] She did. Yes. Right. Yes. So, uh this I'm officer Ser. Uh I'm going to be assisting with um the actual taking of the breast samples. So, um there's a couple things we got to do. We have to wait 20 minutes before I can operate this machine uh or this instrument. So, the first thing I got to do is just make sure you have nothing in your mouth. So, just do me a favor. Open your mouth wide. Okay. Can you take that? Are you able to take that tongue ring out? Yeah, I can. Okay. Can you do that for me? I'll even get like a little bag. Yeah, if you can, I'll get a bag or something for your I'll get a bag. You can just throw it right in here. Yeah. Just uh Take your time. Sorry. It's all good. It's all good. Can I? Yeah. Yeah, you can put them both in there like that. And then, yeah, once we're done with it or once you leave here, which again, like Officer Grow said, should be under an hour. Um, you know, you can throw right back in. So, I'm just going to put your property bag here. So, just again, open your mouth real wide for me. Okay. Lift up your tongue. Okay, looks good. So just um during this 20 minute period just don't touch your mouth anything like that. Put your hands mouth don't put anything in your mouth anything like that. We good? Yeah. All right. Awesome. So I have to grab this. So, um, again, what we're doing is just like I said, we just have to, one of us, any of us just has to keep eyes on her. Just make sure, you know, nothing in the mouth, no hands in the mouth, no burping, regurgitate, you know, spitting up, regurgitating, anything like that. Um, what's your date of birth? went upstairs. Yes, no problem. already using that. Oh, that the packet. Yeah, someone Oh, wait, wait. Is that the Oh, yeah. Yeah, he already wrote the name. All right, that's what [Music] All right. So, um, don't mind me. I'm just training him. So, good. So, um, so for now during this observation period, we're good to, you know, we have our cameras on, our radios, and all that stuff. When we do the testing, all this stuff has to be removed from the room. And that includes smart watches. That includes like uh like if you have a key fob, phones, if you have a key fob. And uh you know the law says we can we're allowed to have our body cameras off for testing because there's cameras in here that don't emit like a wireless signal. So, all you have to do when it uh comes time is um just literally take all any of your electronics off and then you put them right outside the door around the corner here. Okay. And then we have to do the same with just her phone. Um you don't have like a smartwatch on, nothing like that. So, uh yeah, just anything like that. Body cameras all have to be removed. Um check the her mouth. Uh she took her tongue ring out. So, like I if hypothetically they have mouth piercings that they're unable to remove, like we want them removed, but if they're just like they're unable to be removed for whatever reason, you just have to document it. Uh well, but um so this is good. And then um once we're a little closer to the time um what's it called? I'm going to start up the machine. So uh officer Grow when you have to have the actual summons for 450 to be able to plug the summons number into the machine. Excuse me. Into the machine here. Um, so he's doing that and then uh I'll have Did you have your driver's license on you? I did, but I somebody No problem. No problem. As long as he brings it back down to me, I just got to plug this stuff in there. So once it comes time, okay, I just like I was explaining to them, I'm going to boot this machine up. Um, what all I need from you is two strong breath samples. So, um, it's kind of like blowing up a balloon. Like, you're going to take in a super big deep breath, okay? And then just a long steady continuous breath like And it's it's going to be I have these little mouth pieces here. They're all nice and sealed up. So, I'm going to give you a fresh mouthpiece each each time. Um, I've done this myself. It doesn't take a Lance Armstrong or like elite athletes lungs to be able to fill this thing up to get a proper sample. Okay? Once we get those two samples from you, we can start making phone calls to pick you up. So, I don't know if they explained to you, anytime anyone gets arrested for DUI, we can't just release you on your own. You have to call like a friend, family member. They explained to me when I was over there cuz like I live like my like where I live is lally right like that street right there. So I was like can I jump my car with? They're like no. So I'm like okay that's Yeah. So um as soon as we're like I said as soon as we're done with this testing we'll get you on the phone. You can use your phone. Make some phone calls. Get someone to pick you up. Just keep in mind uh again part of the law I again I don't know if they explained this to you on scene. Someone has to take responsibility for you. Oh okay. So yeah, they're going to have to sign something saying like, you know, god forbid you went and crashed again that they'd be responsible. So as long as it's someone that's you will well enough that's going to be like, oh yeah, I got her. You know what? Is there any way I can use the bathroom or not yet or until after? So we I can let you use the bathroom, but then I got to start the the time over. Um, if you can wait, that's fine. If you need to use the bathroom, we can I can let you use the bathroom and I just got to start the the time over. So I do, but like how long how long? So So I just So like if if it's a short I'll let you know. So we have Stand by one second. We are uh we're only 7 minutes into so we have 13 more minutes till I can start the test. Can I use the bathroom before? All right. Yeah. Yeah. It's all right. No problem. No, no, it's all good. So, just so you know, like that that's the thing. We can let her go to the bathroom. We just got to start the the time over and it's not a big deal. You're only Yep. just uh sorry you want to one of you just want to take her over there. Um it's all good. It's all good. So that's really my fault at the end of the day. It's it's a good idea to just Yeah. Yeah. Just uh go steal. You're going to stand outside the cell. Obviously not watching her, but um just let her use the cell. So yeah. Having an issue in reference to his need. I should. Yeah. It's always good. I I guess I I forgot, but just to be like, "Hey, before we start this period, do you need to go to the bathroom? Do you need to do anything?" All better. Sorry, that was my bad. I probably should have asked you before. Just need to check your mouth again. Standard. All right. Good. Good. Okay. So we are gonna start this 221 73 quick this 0254. So, in 20 minutes, we'll get these tests. As long as we get two good ones real quick, we'll get you try and get you on your way. All right. Just don't burp. Don't touch your mouth. Well, yeah. Just sit here. And uh I'm not trying to be weird when we're watching you, but we we have to. It's literally required. So, I know it's Yeah, I know it's going to it might feel like we're being creepy or anything. I might feel self-conscious, but but I know you guys what like what you have to do. It's all good. So you you live in Morristown? I do. Okay. I live right down the street like where where happened? Oh, Lyndon. Oh, yeah. Right on. Okay. Yeah, I just saw that. So I'm like [ __ ] [ __ ] I'm like right there. What was there? Like a party or something over there? I think they were um they were coming back from Latin. So, I think they were they might have gone to like their friend's house and then they just So, I'm like, damn. Just need Yeah. So, just as long as one of you is keep an eye on her while I do some of this stuff. We'll be good. [Applause] 224 Mhm. Uh, Bri, where do you got the iron armor for the 450? 450 iron hammer. Yes. All right. 23. Yep. 691. 691. Thanks. Appreciate that. Um, you mind if I uh go through these Miranda questions? Yeah, go ahead. Okay. All right. I'm going to read you your Miranda rights. Sure. You've heard of them before? Yeah. Okay. Uh before we ask any questions, you must understand your rights. You have the right to remain silent and refuse to answer any questions. You have uh anything you say can be used against you in a court of law. You have the right to consult with an attorney at any time or have or her present uh before or during questioning. If you cannot afford an attorney, one would be provided to you if you so desire prior to any questioning. The decision to wave these rights is not final. You may withdraw waiver before or during questioning. Do you understand those your rights? Yeah. So, basically, you don't have to talk to us when we ask you these questions. You have a lawyer. Um, and this just uh Yeah. Just keep an eye. We're going to start dumping our equipment. So, uh, what do you do for work? I work at a restaurant. Oh, okay. What, uh, what restaurant? Uh, town. Oh, you work at town. Yeah. Yeah. Okay. I'm like in the kitchen. So, are you a cook or? Yeah. Okay. Are you sick? No, I don't think so. Now, are you under the care of a doctor? Mm-m. Are you taking any medicine? Do you have diabetes? Are you injured? No. Just remember that we did give you your Miranda warning, right? You don't have to answer any of our questions. All right. Um, so tonight, what uh what kind of alcoholic drinks have you had? I like doing white claws. White Claws. Okay. Like regular size cans. Okay. [Music] Where at? Uh um uh whiskey and pressure, but I call it French. Oh, okay. Yeah. [Music] Uh, and what was the time between each drink? It was like [Music] 30 minutes after each drink and then like the last drink that I had that was done for the night cuz I had to drive. Okay. All right. What time was your first drink? like 10. Okay. Yeah. A.M. or P.M. P.M. I don't drink in the mornings. It's weird. All right. And do you remember what time uh you had your last drink? Like, if I remember right, it was like 12ish. Okay. Yeah. Cuz last call was like at 1 oneish and then after that last one I was like I got to drive. What time did you finish eating? What time did I finish eating? Yeah. So we we have these questions lined up that we ask like at 8. At 8. Okay. What' you eat? A burrito. Chicken burrito if you want to be exact. Where at? Matcha. Nacho. Nice. Good choice. You guys love matcha. You guys should have had a Columbia chorizo burrito. I've had her. It's good, right? I do the Colombian chorizo breakfast burrito. Really? But what does that come with? Like Well, it's like the same thing as a Colombian Torres just with the egg in it. Yeah. That's what I do. I always get the egg like in the afternoon cuz it's the best. I don't know. Have Have you had the Midtown breakfast burrito? No, I've had the Danny O burrito. Have you heard like the the big one? It has like chicken, beef, chorizo, and then like the rice, beans. What is it called? Danny O. Oh, yeah. Yeah, I have had that. It's like the biggest It's the biggest burrito they have. I My dad would always get me that. Sorry. Go ahead. Can you tell? Do you know what street that we stopped on? Huh? Do you know what street we stopped you on? That was honestly Hazel. Liberty, I think. I Wait. Yeah, Liberty. Cuz Liberty Hazel. Yeah. Do you know what town you're in? [Music] Were you the driver of the vehicle that was stopped by police? It's definitely us. [Music] So, uh, the way that DWIS work is, um, we do we impound your car. It's our policy. Um, that's like state policy. Um, and then we have to turn you over to somebody um, to take responsibility for you. So, do you have anybody in mind that you'd be able to call and come pick you up? I could phone. That's only All right, we'll get to that. Okay. They just make some phone calls so we come pick you up. They sign off and you want to dump your if you're going to hang out for the test and you want to just dump your your all your electronics. You guys want me here? Yeah, we don't need you here. Dude, I'm sure you got paperwork to do. So, if you want to go take care of that. Thanks. As long as you're good, you're good, right? Okay. And uh we can hang here if you want to turn off your electronics. Double that. Grab your uh body camera tip because we can uh turn off for that. We already did mine and everything on that. You got to do stop two for testing. Couple more. [Music] [Music]
