It's what every free man wants to hear from another American. You're not under arrest, I'm just holding you against your will. >> You're not You're not under arrest. You're being detained because you're acting hostile towards me. >> And what exactly does the officer mean by acting hostile? Well, it's all about a well-deserved one-finger salute. And it's not against the law to flip off the police, but it should be. >> It's not really against the law to flip off the police like it should be. >> And the initial cop who was flipped off, well, let's just say it really, really bothered him. I mean, really, really bothered him. I mean, this guy could not stop telling his harrowing, tragic tale to all who would listen. >> I'm a next time I I wave at you, man, you can you can wave with all your hands, man, all your fingers instead of just your your middle finger. >> Oh, this one? >> Yeah, that one. >> That's freedom of speech, dude. >> I'll tell you what, act like this, I'll just take you to jail for disorderly conduct. >> to know what? You got a civil suit on your hands, >> Go to jail. >> I simply waved at you. All I did was I waved at you as a nice gesture. And then you turn around and flip me off. >> You're putting your hands in my face. >> I waved as a nice gesture. I waved at you and you flipped me off. Is there some kind of issue? I sit there and I wave at him and his wife as they're walking. He turns around and flips me off. >> Sounds like an easily and deeply scarred, unstable individual. Hey, I got a great idea. Let's give him a uniform, a badge, a gun, and a whole bunch of authority. What could possibly go wrong? On May 14th, 2019, in the village of Carey, Ohio, Kiryon Smith was strolling on a public sidewalk with his family. They were enjoying their day when all of a sudden, the Feelings Police decided to make a grand entrance in the form of Officer Snyder from the Carey Police Department. Personally, I think they should change their name to the Karen Police Department. And you'll see why in a minute when a whole gaggle of uniform Karens start swarming the scene for this finger-waving criminal. Let's take a look at this together and we'll make some comments along the way. >> What's up, man? >> Hey, it's cool. It's cool. You can You can record me cuz I'm recording you, too. I'm actually I'm going to I waved at you, man. You can You can wave with all your hands, man. All your fingers instead of just your your middle finger. >> Oh, this one? >> Yeah, that one. >> This >> Act like this, I'll just take you to jail for disorderly conduct, persistent disorderly conduct. >> I believe this. >> So, continue to walk and don't say a word. Don't say a word. I'm going to take you to jail if you continue. Continue walking. >> to know a civil suit on your hands, You better go. >> Continue walking. >> Y'all need to send a sergeant down here, right now. >> Continue walking. >> Call your sergeant. >> Continue walking. >> Call your sergeant. >> 4207, send me another unit down here. >> You are harassing my You are harassing my wife and you're going to sit here and harass me like this. >> Uh we need backup. Somebody's over here hurting my feelings. I mean, you need to run code three right now, man. >> I simply waved at you. And I went like this. I'm a grown man. >> I didn't even hold my hands up. >> Look. All I did was I waved at you as a nice gesture to you and your wife as you were walking, okay? And then you turn around flip me off. >> You're following me. >> Okay? So, I I stopped to ask you what what your problem is. >> Is that a crime? >> It's disorderly conduct. >> not. >> It is. >> Did I Did I offend you in some >> Yeah, there's other people walking around. Look at these people, these kids. >> These kids that I seen you yell at me? >> Yeah, because I simply stopped No, you're You're You're not free to leave. You're not free to go. You're You're going to stay right here. >> This is wild. This guy's got his feelings so freaking hurt, he can't even see straight. Is he actually going to put his hands on another man because his feelings were hurt because this guy flipped him off? Is there no awareness of what the First Amendment says and you have freedom of speech and shooting a bird is just like you yelling F U to the cops or having on a shirt F the draft in a courthouse? Isn't this cop's actions validating why this guy flipped him off in the first place? People flip you guys off cuz you're constantly earning the hate. >> You're You're going to stay right here. As a matter of fact, will you take the dog, please? >> No, he doesn't >> take the dog? >> I'm not sure. He didn't really well with anybody. >> What was the disturbance? Okay. >> Are you serious, dude? >> Yep. Go ahead. You're not You're not under arrest. You're being detained because you're at >> Wow. >> You want another unit down here, so I'm going to send you another unit. My chief's actually going to come down here. >> know my lawyer was being called right after this. >> Okay. >> My family attorney >> You're You're not under arrest. Okay? >> I am being detained. >> You You are being detained. >> That means I am under arrest. >> No, you're not. >> May I ask the crime I committed? >> two different things, okay? >> crime I committed? >> Come on over here. >> I hate the word games they play cuz under arrest or detainment, in either case, you're not free to go. You're being held against your will. >> Don't touch me, sir, please. >> Okay, well >> You say I'm not under arrest. >> You're You're detained. >> Okay, this dude's illegally arresting me right now. >> You're not under arrest. >> with my kid. >> You're not under arrest. >> with my dog and he's arresting me because I was walking with my dog. >> You're not under arrest. >> Swear to god, have nothing on me or nothing. >> You're not under arrest. >> I'm really getting put in the back of >> 421, I got one detained. Come on over here. >> Your question. Getting arrested here for nothing. >> That's fine, I'm out of here. >> My girl and my dog are over here. >> You're not under arrest. >> handcuffs on me then? >> Because you're being detained. Cuz you You're refusing to identify yourself. >> You never asked me to identify me. >> Your cameras are on, ain't it? >> Yep. >> My cameras are on. Everybody's cameras are on. >> When did you I need you I need your identification. Okay. What's your name? >> Yeah, the cop never asked for his ID. I don't know why during this video there are a couple of areas where there's no audio, but the cop Officer Snyder never asked Mr. Smith for his ID and he's going to lie about it when the other cops arrive on the scene. >> Go and kick your feet in. Kick your feet in. Yep, this is my lieutenant. You can talk to him. >> I was walking here. >> No, I want to talk to my All right, LT. So, I'm sitting here at the stop sign, right? I'm just watching the stop sign. As this guy and his wife and kid uh walk past. I wave as a nice gesture. So, he turned I come back here. I was like, "Hey man, what's your problem?" He goes I go, "Why'd you just I waved at you and you flipped me off. Is there some kind of issue?" And his wife has been cooperative, haven't had any issues with his wife or his kid or anything like that. I said, "Man, what's your issue?" And he goes, he starts cussing at me. I said, "Hey man, you can't and there's more people >> That was more dead space right there. >> People and other kids and stuff walking around here. So, he refused to identify himself. I said, "Hey, you got an ID on you?" He goes, "I ain't got to identify you." So, due to his hostile and turbulent behavior, I put him in handcuffs. >> So, he just lied to him cuz he didn't ask Mr. Smith for his ID when he arrested him. And this lieutenant should be like, "Wait, that's the whole story right there? Who did he victimize? Who's the verified complainant? What did he do that was even illegal, let alone unconstitutional? Sounds like he was taking full advantage of expressing himself and his disdain for government. You have no right to arrest him. As a matter of fact, you arresting him means you, Mr. uniformed Officer Snyder, committed a felony. If Mr. Smith did to somebody else what you just did to Mr. Smith, we would view that as a crime worthy of taking someone to jail. Right, exactly. So, that's why he's in the back seat of my car. Yep, exactly. So, that's why he's in the back seat of my car. He's still refusing to identify himself. So. Hey chief, I'm sitting here at the stop sign like when you passed me a little bit ago. Uh, gentleman walks >> So, he just spoke to his lieutenant. Now, he's talking to his police chief. Let's see if the police chief has his head screwed on straight. >> passed me and I sit there and I wave at him and his wife as they're walking with a they got a kid in a stroller and a dog, okay? He turns around and flips me off. So, I flip around and [clears throat] I come back and I was like, "Hey man, what's your what's your problem?" I said, "I I waved at you and your wife as a kind gesture and you flipped me off. Is there some kind of problem?" And then he starts like he starts getting loud and stuff like that. I said, "Hey, you can't act like that, man. There's a >> More dead space. Here we go. >> I'll falsify I'm being harassed and this guy's going to arrest me. I said, "You're not under arrest, you're being detained." So, he starts cussing and I got other kids and families and stuff walking out of the church. I don't know who it is. He's refusing to identify himself. >> This police chief should start laughing his ass off. You're telling me you got a guy torture cuffed and confined in the back of your patrol vehicle because he flipped you off and you got your feelings hurt, you That's what the police chief I can't believe I hired you. You're a poor example of what an American should be. You're supposed to be protecting and serving those rights, not trampling those rights. >> Disorderly conduct? Oh, she's being fine. >> What did she say is? >> Uh, she hasn't she hasn't told me that. I've been dealing with him, so. So, disorderly conduct. >> Yeah, Philadelphia PD wanted to take him. >> Give me a freaking freaking break. Oh my gosh. >> Yep. >> You don't think it's against the law. You said it wasn't against the law. right, ma'am. What What is his name? Okay. Okay, I understand. >> I like what she said, "I don't want to disrespect him." Like I said, I I waved at you guys. You waved at me, he flipped me off, okay? >> What's going to happen if I give him his name? Nothing? >> Okay, here here's the situation. Let me just explain it to you, okay? So, like you know, I waved at you and you and your family, okay? Because I'm I'm just out here trying to, you know, community policing, okay? >> You know, ma'am, some of that good old community policing where if I wave at somebody and they don't wave back, but they give me the finger, I can get on my taxpayer-funded patrol vehicle and put my hands on your husband, slap him in torture cuffs, and now I'm considering kidnapping him and throwing him into a cage. That's American community policing. Don't you love it? And they really wonder why people flip them off. >> So, when I see you guys, I want to wave at you and acknowledge it, okay? He flips me off, which, I mean, he can do what he whatever he wants. I come around here to make contact with >> Apparently, he can do whatever he wants without you jumping out of the vehicle and threatening him. >> with him to say, "Hey, man, what's your problem?" And then all of a sudden, he you heard how he started to get loud, right? Okay? I got other families, okay? You can't You can't disturb other other families and things like that cuz once you start doing that, now it's a disorderly conduct, okay? So, either he just identifies himself, I write him a disorderly conduct ticket, and it's done and over with, and he goes on his way, or he refuses to identify himself, I have to take him in at that point. >> More dead air in the video. >> Kieran Smith, okay. All right, thank you, ma'am. >> Did you give the police officer >> She shouldn't have given his name, not at all. Keep your mouth shut when you're around cops. >> Potentially. I'll have a You got to run real quick. 421. Will you uh run Kyrian Smith for me, please? >> Now there's a record in the database for Kyrian Smith who has done nothing wrong. No criminal, no crime, no verified complaint. >> All right, I'm sorry it turned into this, okay? I I simply waving at you. I mean, if he doesn't like the police >> No, you're not sorry it turned into this, you caused this to happen, Officer Snyder. >> He said it's fine, he's entitled to that, okay? Well, like I said, I turned around and see if what the problem is. I don't understand why I go out of my way to be nice to you guys and he goes out of his way to flip me off and then cause a disturbance. >> More dead air. >> Make any sense to me whatsoever. >> He didn't flip him off. >> I didn't, it's what he did. >> He's claiming that he raised his hand to wave at you. >> No, it was it was clearly that he flipped me off and then like I said, I just pulled up next to him to say, "Hey, man, is there some kind of issue?" I I waved at you and your family and then he wanted to get hostile with me, refused to identify himself and at that point now he's loud and causing a scene to other people. Well, >> like I said, it's not really against the law to flip off the police like it should be, but >> Right. >> but it raised alarm. >> It's not against the law to flip off police, but according to this tyrant, it should be. And it is cause for alarm, so armed men can pile out of a car and dog pile a guy and put him in torture cuffs in front of his wife and child. >> I'm just going to write him a ticket for disorderly conduct and get him on his way since she identified him for me. Anything back on that 200? >> And that is where the video ends. So Kyron Smith was cited for disorderly conduct and released. And after release, he immediately went to file a formal complaint against Officer Snyder at the Cary Police Department. This happened in 2019 and as of today, there's no confirmed settlement or final court judgment on this case. So yes, the Cary Police Department should change its name to the Karen Police Department because we got a whole lot of heroes and warriors over there who have very thin skins.
