What business do you have here? >> That ain't none of your business. Say difference between you and me. I'm a citizen. You a cop. What do you think you doing? Put your face around your back. Put your trespassing. >> Hold on. You said messing with these folks. >> Welcome back. >> I'm messing with you >> to the Lackluster channel. In late August of 2025, a viewer named Ru stopped by his local Walmart to have lunch with his wife on break. Out in the lot, he spotted a familiar Prince George police cruiser. It's the same car he's seen posted up there for months with an officer inside who appeared to be sleeping. He's asked himself the same question a dozen times. Why are city resources parked as a permanent guard at a private business this time with a few minutes to spare? Curiosity one. What's up, Bob? >> What's up, Bob? Man, >> what you got going on? >> Just chilling in the parking lot. >> Just chilling? >> Yeah. >> You ain't patrolling? No security, no nothing like that. Uh, so they have us doing overtime assignment here. So >> overtime assignment >> kind of assignment right there. >> You need anything? >> Yeah. I'm just making sure you're doing what you're supposed to do. >> Yep. I'm here protecting the folks in this building. So if you need anything, just just let me know, boss man. All right. >> Yeah. So we ain't violating no 15.2-1712. Barb, >> I'm doing what now? >> Huh? >> Section 15.2-1712. 2-1712 lets cities authorize officers to work offduty jobs that require real police powers like detaining or arresting someone. It's a carveout that allows local governments or chiefs to set the house rules for the jobs. On paper, it helps with staffing large events or keeping order at busy venues without pulling onduty resources. But the same setup invites conflicts of interest. When a sworn officer is being paid by a private company, the incentives can tilt. The officer is supposed to act as a neutral public servant, but often acts as private security for the person signing the check instead. The badge carries government power. This section makes it easy to rent it out to the highest bidder. >> We're doing what now? >> We ain't violating no 15.2-1712. I'm I'm going to look it up just make sure I'm giving you the right number. >> Look, man. I'm just sitting here. working his overtime assignment protecting the people in this building. >> So you ain't on the clock. >> If you need if you need anything, let me know. >> Yeah, I need to know what you doing cuz money. >> So I work in this overtown assignment and it's a private property. >> This property belongs to these folks. >> Yeah. >> Okay. So again, >> do you need help or do you need assistance? >> No, I got business here. >> What business do you have here? >> That ain't none of your business. >> Okay. For some reason, that line caused officer Nolan to exit his cruiser and put his hands on Raheem. >> See the difference between you and me. I'm a stand you a cop. What do you think you doing? Rhind your back. Put you trespassing. >> Hold on. My whole lady working there. I'm recording you, by the way. Charlie, give me another unit, please. You don't want to come. Damn, bro. Damn. Damn, bro. Hold on. Let me turn my camera off. Fortunately, Ru had activated two cameras prior to approaching the officer. >> See the difference between you and me. I'm a citizen. You a cop. What you think you doing? Put your behind your back. Put you trespassing. >> Hold on, [ __ ] My whole lady work in there. I'm recording you, by the way. >> Charlie, give me another unit, please. >> You don't want to talk? Damn, bro. Damn. Damn, bro. Hold on. Let me turn my camera off. Oh my god. Hey, see I came up here peaceful. >> Now I'm going ask you this as a man. You uh want to go in there? They about to go on break in 15 minutes. Right. >> I don't care. >> I'm here to protect these people. Why are you here? Why you doing all this? >> You want to know why I'm here? I'm meeting my old lady for a lunch break. >> You mean your old lady for a lunch break? Why not mean your old lady for lunch break? Why are you over here messing with these folks? cuz I got time before her lunch break. >> I got one to change. >> You said messing with these folks. I'm messing with you. >> All right. Okay. That's about it. >> So, you want to see if she in there and bought us on lunch break? I know what time she's going on lunch break. You get off at 12, maybe. >> Okay. So, why are you doing all this? Cuz you're breaking the law. >> Why you trespass on this property? >> I just told you I'm meeting my old lady for a lunch break. What's up? >> Why are you trespassing this properties? What's up, bro? I just told you I'm meeting my old lady for a lunch break. >> Okay, that's fine. >> So, when she come out, you going to take these off? >> Absolutely not. >> Why not? >> When you get here, I'm going to talk to uh the property manager here and see what they want to do. >> Oh, I would strongly not do that. >> Yep. >> Cuz that that might go as uh what they call uh um >> you know when you file a suit against a company and then uh you do something to violate some [ __ ] >> Yeah. Okay, that's fine. All right. So, what you arresting me for? Cuz I ain't been trespassed from here. So, you got to give me a trespass. >> Right now, you're being detained. So, >> you didn't tell me to leave. >> All right. We're We're not We're not >> You didn't even go there. So, come on. Play your car. Hey, bro. You see that? You >> I see this. Okay, that's fine. >> You taking my Damn, bro. You look aggressive. You breaking my [ __ ] dude. We're not playing these games, dog. I don't know what you're doing or what's your business here, >> but you're disturbing these folks trying to work. >> I'm talking to you. >> I want to you then I'm broke. >> Hey, these handcuffs kind of twisted up, too. By the way, my guy, >> I'm sorry. Well, I I'll tell you what. How about if you come over here and sit still where you need me to go? >> And then I will adjust them so they're both comfortable. Precisely. You really got too large hurt. >> All right. Like I said, man, they're trying to work over time. >> And since we since I'm being the nice one here, since I ain't being the [ __ ] I got a lighter in my pocket, right? Shake your gut. You might want to take that out. >> Okay. This It's right there. You see the little nude right there? >> Right there. >> Okay. >> No problem. What's your name, boss, man? I ain't talking cuz I ain't trying. >> What's your girlfriend name? >> She ain't girlfriend. >> Okay. >> Are you going through? >> Oh my god. Exactly. I >> thought you was [ __ ] up. >> I hate to see you for least video. >> Three more officers arrive in response to the call for backup from the offduty officer working Walmart security. Officer Nolan never activated his body cam, so we don't hear much of his side of the story. But we do catch some of the conversation the arriving officers have with Raheem during a 30-minute detainment to investigate what happened that required three onduty patrolmen to respond. >> Man, I he want to say I'm telling me I'm trespass. >> He ain't do none of that. >> Early into the detainment, Ruhim's wife arrives on her break. She confirms that Rahu was there to meet with her. But even if he hadn't made plans to see her, the lawfulness of the detention is highly questionable. >> He [ __ ] up. >> What did I miss? >> He [ __ ] up. >> You know him. What is he? >> Don't give him too much info. Don't give him [ __ ] That's your camera. Hey, [ __ ] You got all my [ __ ] back. Oh, you recording them? >> Yeah. >> Oh, okay. You ain't like that [ __ ] You want to be the first man in all of this? >> I ain't I'm a lot. I'm more fishing than the first person. >> You said fishing back. What you fishing for? >> I fish forever. Huh? What? Bass, scratches, pipes, bro. Check me out. Dream fishing. >> Under Virginia law and throughout most of the country, localities can adopt ordinances that designate the police as the quote person lawfully in charge. This is often done using a form so officers can issue trespass warnings and arrest unwanted persons without the owner present. And when offduty officers work overtime and have been designated as an agent for the property, it is common to see them use their police powers to enforce private policy without having to turn on a body cam. >> How y'all get a contract with private business? Do y'all the city police? What? How you whatever? So I'll just clarify. We have jurisdiction over the higher county. There are grass in this county. The only difference is there are minute crimes that began in due for so private property would not welcome by the would welcome by the owner through the contract. Therefore, every single crime on this property minus, you know, trapped. Yeah. So my goal is to cool everyone down only because I feel that uh when we're amped up, frustrated, annoyed or anything like that, we start listening to respond. We started listening. So understand, and I'm not saying that you will misunderstanding. I'm simply saying that um there's a possibility that we as the police and you were not understanding each other. I can reach some type of understanding as to how this works. >> We did. I mean, honestly, I'll go home and learn more. >> And I feel that. I told you if there's a process, follow that process all the way. >> Over there. I'm coming to you. If they doing something [ __ ] up and >> and I like I said, I can respect that. That's your right. If you feel you've been done any justice, absolutely follow that process. >> I'm bad, man. So, complaints can be filed online. Uh there'll be uh email that you can access on police. I don't know what off but it's easy access for any if not you should all ask for the supervisor I don't recommend doing it's not because you let it go what you already said the crime so I wouldn't complain but can't the people complain other people like ter got out the car got under arrest we we can do dension based off of an investigational attack. >> Is it the cops cuff coming off? No, >> they ain't break no law. >> You ain't tell pass. You ain't tell me to get off property. >> No [ __ ] >> Yeah. I don't know. None of us know what happened before. I pointed her out. She said that I'm her husband. Ain't no hard for facing it. >> Well, I know you're her husband, but you don't know what's going on in the bathroom. You know, you have to put the information back, >> not you and her particularly, but as police, you have to be impartial when we arrive on certain, right? We have to understand that there could be things we don't know about. Uh um so as a whole, we deal with situations between husband and wife as if um respectfully they're not as right off the >> We make sure she feels safe, you feel safe, everything is is good. Um, so that's where where we are at. I don't, like I said, I don't know exactly what happened. I don't I do the state park. You really want different. She walked out. I was going to walk away. You pretty much did it. And you jumped off the cop. >> Outstanding. >> Right there. The door opening guy. However, >> after being detained in handcuffs for 30 minutes, officer Nelin returns. >> All right, Mr. Barnes. Let me get you out these steps. >> All right. >> All right. >> You going to be cool? >> Yes. >> All right. >> All right. Just chill. We'll get it off and >> All right. Cuz I'm going take these off and I'm going to explain something to you. All right. >> All right. >> I'm smart. So manager here. She have decided to not press charges get used to trespassing. Okay. >> Right. >> All right. So, but based on that, instead of pressing charges is you for trespassing, what you would like to do is put a trespass, you know, on. So, basically, >> you're being banned from the property. Okay. So, if you set foot on this property again, then you'll be charged with press. >> All right. Easy enough. So, just don't set foot on this property and you're you won't be uh won't be arrested for process. >> All right. >> All right. You got a car? >> Oh, absolutely. Hold on. Watch that [ __ ] >> How did your girlfriend get [ __ ] man? >> Hey, [ __ ] He had me a handcuff. We going to watch the video, bro. >> We'll talk about it when we get home. >> Light up. >> Ain't no time to worry. [Music] >> All right. >> Name. What your last name? >> That is my last name. What's the first name? Don't worry about it. I didn't know that. You don't You don't need it. You're lucky you're doing that. Like I said, you're not being charged for trespassing. If you come back again, you will be charged. >> All right, I got you, bro. >> I see you in court, my >> Officer Nolan, who still has less than 2 years on the job, has yet to grasp the foundational principles of his own employment. He detained a man for alleged trespassing in the parking lot of a Walmart that was open for business. His justification that Ruim had been asking him questions. During the exchange, Nolan lost his temper for seemingly no reason and abused his authority by handcuffing Ruhim. Apparently, because he was annoyed, there was no reasonable suspicion to justify detaining, handcuffing, or rifling through Ruhim's personal belongings in search of identification. To make matters worse, the rookie cop wasn't even on duty at the time. Yet he still acted under color of law, exceeding the constitutional limits of his authority and effectively arresting Ruhim without cause. Ruhim was ultimately let go with nothing more than a trespass warning. All because he asked a rookie cop a few simple questions. It shouldn't be too much to expect that departments ensure their officers understand when and when not to use their police powers before letting them moonlight for private businesses. But as always, I'm curious to know what you think. Let me know in the comment section. And if you have a video you'd like to see reviewed, you can submit it using the links below. [Music]
