On today's body cam, we're checking out abusive mom thinks police will take her side. >> She started cussing and screaming in my face, so I pushed her. >> A worried grandmother called police to remove her granddaughter from the house after the girl allegedly attacked her mother. But when officers arrived, they realized the story was much more complicated than it first seemed. >> Hi. >> Hi, I'm here to check on >> Yeah. >> Can you tell me what's going on? >> Well, if I'm honest and my So, she's my kid. We've been fighting really bad. I think she's experimenting with >> Uh-huh. >> And that's where her like outbursts are coming from. She started cussing and screaming in my face, so I pushed her. I did want to hit her, like punch her, and when I punch went to punch her, she ducked her head and the corner of my knuckle did catch her eye. I know I shouldn't have done it, and I know my probably just myself being honest with you, but we're mother and daughter. I'm all she has. I'm her only legal guardian, so I don't know why her grandpa called you thinking that she has a [snorts] say so. She's not a legal Her Her son is not her dad in any way, shape, or form. So, she has no business getting involved. They won't take her when we fight like this unless I turn her over to the state so they can get a paycheck for being a foster parent. >> Um so, I don't want to I'm going to have another guy come here so that we can split you guys up and talk to you guys separately. Uh just so that nobody feels intimidated to not want to tell me things. So, um I'm going to wait for the other guy to get here and then I'll talk to you if that's okay. Uh if if you'd like to wait in the room and then I'll have mom get you whenever >> [snorts] >> That's fine. Or if you want to wait in here, that's fine, too, okay? But it it's okay for me to talk to her? >> I mean, I want to be present. >> Okay, well, I was I was just trying to separate you guys. >> We don't I mean, we've been fine for we We do this every other day. [snorts] This isn't every >> That's not a good thing. Okay. Um yeah. I You know, I grew up with spankings. You know, spankings, you know, I'm a '90s baby, okay? It is what it is, okay? But there's a difference between a spanking when you know you're not doing something right and your mom trying to punch you in the face. Now, that's a completely different ballgame. She said, "When I went to go punch her, she slipped and I hit her eye or something like that or nipped her eye." You tried to punch your daughter? Like, wait, hold on. Hold on. Time out. Flag on the play. Flagrant foul. Like, wait. That's not a spanking. Okay? That's not a you know, uh uh a a pat on the backside or let me grab my belt, you know, on the backside or something. You tried to knuckle up and knock her cold out, man. And then you're going to sit here and say that this happens every other day? That's not a good sign. I would not be telling the cops that, okay? >> every day occurs with us. And I just don't feel comfortable I don't feel comfortable She's 15. I don't think that Hang on. What do I do? Do I let her talk to him by Can you call somebody? Like, what do I do? >> Okay, uh she doesn't want me to talk to you separately, so can you just tell me what's going on or what happened? >> Mhm. >> But do I let them talk to her by herself? >> Just I was talking to her and I got mad and I cursed at her and I and then she got mad at me and we were just arguing and screaming and then she got up and she pushed me on the couch. >> [snorts] >> And then I went to my room and we were still arguing. >> And they have to be in the room because she's a child. >> in their room because we're still arguing and she pushed me. >> How can they talk to her like I don't understand the present in my home here? She's a child. >> What's happening, man? She scratched me, too. >> Okay. >> If my friends were here, but they left you again. >> No, he's not my dad. >> to do my nails for hours, so they're proof that I can do that. >> Who's your dad, dude? >> Okay. >> And yeah, when I tell you most of like my family Most of like my family on her side is in Michigan right now, [laughter] and then my dad is in Indiana and my niece is at home. >> I'm trying to take some pictures of your mom. >> He is my dad. >> No, he's not. >> Yes, he's my dad. >> look at me. >> But I would have to turn her over to the state. I'm all she has. The guy that she calls dad is in no way, shape, or form her legal guardian at all. Has no rights to her whatsoever. As a matter of fact, >> [snorts] >> I text him, "It's I don't know if you're a Marion native and know him or not. >> I've heard your name. >> I said, "I called the police department. They said I can do a walkout and turn her into them, and she will become a ward of the state. You have 15 minutes to tell me what to do, or that's what I'm doing, cuz I can't keep living like this." And he said, "You're the boss." >> Yeah. You're the boss, man. >> Meaning I'm the boss. I make the decision. If I want to turn her over to the state, I turn her over to the state. He's not leaving Indiana to come get her. >> And that's her dad? >> That No, that's who she calls dad. She doesn't have a dad. She She has a sperm donor. >> Everybody's got a dad. >> Right, she has a sperm donor. He has never been in her life, ever, since she was 2 or 3 years old. The guy that I got with after him is who she calls dad, but he has no legal anything over her. Nothing. I'm her only guardian. >> Okay. >> Legal guardian, parent, whatever you guys call it. >> I got you. Can you tell me what you told the dispatchers about like what you were wanting to do? >> Well, I told them I was like, "Can you guys do anything for like my daughter? She's cussing at me, acting out, like acting all ridiculous, not listening to me, has zero respect for me. Like, can you guys come get her? Like, her grandma won't come get her. Nobody will come get her. Like, can you guys come get her and do something with her?" I didn't I don't know how that works. And the dispatcher was like, "Honestly, I'm not sure. Somebody sitting next to her, a guy, was like, is that the mom? Is that the guardian? She's like, yeah. And he's like, she can do a lockout where we we take like she can bring her to us and she'll become a ward of the state. >> Mhm. >> And that it's called like a something lockout. >> lockout. >> Yeah, and I was like, okay. And they're like, is that what you want to do? And I was like, well, I don't know. If I can get her dad or her grandma, I know it's confusing cuz I keep saying that. If I can get her Vicky to come get her, then >> And how far are these two away from her? >> [snorts] >> That's his girlfriend. >> And then his him and his mom both you can open the doors to you. >> Um so, his mom could come get her, but his mom won't come get her to go stay there or live there unless I turn her over to the state so she can be her foster parent. And I'm not doing that. >> Okay. >> It's a fight. Like, I understand what I did. >> So, >> I got >> who who can get here the quickest? >> Nobody. My [clears throat] parents don't care and they're nothing. They're sorry. My parents don't care and they're in Michigan. His mom will not come get her unless I turn her over to the state so she can claim her as a foster child and get a check a paycheck. >> Where is his mom? >> Calico Road. I think it's Spring Garden subdivision. >> Would you be willing for her to watch her? >> No. >> No? Okay. So, what's going to happen is my sergeant here >> So, she going go she going go to the state. >> is going to take her to the police department for me. >> What's going to happen to her? >> You're going to jail. >> No! This is so >> So, >> This is getting down here now. My mother and daughter, they fight. Like, >> It's it's still domestic battery. You punched her in the face. >> I did not mean to punch her though. But she does that's how she made connectivity with my feet. Like, I was never aiming to punch her. >> Okay. Hey, >> What do you mean you wasn't aiming to punch her? For that to even happen and for her to whatever duck or whatever happened, you had your fist balled or whatever you was trying to slap her and it ended up hitting her. If your hands were down, then that would have never even happened, right? You would have never even made contact with her. This is just This is nasty work, man. This is nasty work. I get it, you know, you got a you got a child that's acting out and stuff like that, but yo, you got to do something and then you It's like it's trickling down from generation to generation. Your parents ain't give a crap about you, right? That's what she says. So, she's out running the streets. She get with a dude that The guy ain't worth a damn cuz he's not in this child's life. So, she gets with another guy and he steps in. I get you know, he play the stepdaddy role or whatever, but he ain't the dad. Like he I He's not. And then the closest person I can come is who she calls grandma, who's right around the corner, right down the road, whatever. Can Well, can she watch him? No, I don't want her to. Well, so [ __ ] >> I'm going to hang up the phone. I'm going to hang up the phone so that I can take her out. >> Don't hang up. >> All right, let's go. >> And what's going to happen to her though? >> She's going to go with us and we're going to call DCFS. >> No, she doesn't want to do that either. >> Hey, let's get your shoes and let's >> Well, you should have you should have the grandma come and come and watch her then. Now you worried about what's going to happen to her. >> Let's move on. >> I don't want to We've been together for 15, 16 years. I don't want to I would kid. >> How long am I going to be in there? >> Till tomorrow. >> I have to stay overnight? >> It's domestic violence. You have to stay overnight. Do you Do you want it or not? >> to me and didn't get arrested. >> Well, I'm not that kind of cop. Do you want the phone or not? >> I really can't put underwear or a bra on? You're going to make me >> I don't I don't have a female here to watch you. >> I If I don't care if you see me naked. >> I'm not I'm not >> I don't want to go to jail without underwear or a bra. >> You can get them to take them to you anyway. >> That's disgusting. >> If I had a female here, I'd be more than willing, but I don't have a female here. >> That is so gross. hates his mom. God, I hope she's not good. Can it be on the record like your body camera did or something that I don't want her talking to anybody without me present? I'm her only legal guardian. I don't want her talking to anyone. >> What do you mean anyway? >> Like I don't want her talking to a guardian ad litem anybody unless I am present. >> Okay. I already got her statement on my body cam. >> Yeah, that's fine, but I don't want her talking to anybody at the police department. I don't want her going to his mom. I don't want any of that. >> Okay. There's a camera right above your face if you look up that just caught what you just said. It's recording, okay? >> Okay, perfect. Will they for sure take her from me now? >> Ma'am, I To be 100% honest with you, I have no idea how that side of this works. I I don't even have the I don't want to tell you an answer because it would be untruthful cuz I don't know. The only thing I know is there's no guardian close and the the crime of domestic battery has occurred. The state of Illinois does not give me any decision-making in what to do with that. I have to take you to jail because you admitted to it on the body camera. I There is nothing I can do whatsoever. >> I Because I feel like being honest is the right thing to do. >> It absolutely is the right thing to do, but in domestic violence, because there's so many domestic violence that turn horrible, you know, [snorts] >> My wife tried to kill me, and the county said, "What did you do to deserve it?" >> You called her a liar. You deserved it. >> So, you should know where I'm coming from, where I have I >> Yeah, I get it. And I feel like [ __ ] that I did it, but that's why I was honest about it, because I'm like, this is not like I know it's not okay, and I don't want to put my hands on her. I don't want her putting her hands on me, which is why I think she's on because she used to never act like this, ever. >> Oh, I understand that. >> And then she started running around with people who have parents who are on And when I'm working two and three jobs to make ends meet, I can't keep tabs on her all the time. I know I should, she's my kid, but I can only tell her you're not allowed there so many times before they all start hanging out at the park, and like I can't I have to work two and three jobs. I can't sit at home every night and make sure she's not hanging out with >> No, I get it. And you know, I commend you for working three jobs. It's just whenever And if you read the statute, it is a must to arrest charge. I do not have a choice. There's There's nothing >> make sense to me because my wife literally tried to kill me. >> I I can't answer for what Slaton County did, ma'am. I I I'm truly sorry that you were justice was not served for you, but with me, I follow the law. That's my job. That's what they pay me to do. And unfortunately, that's that it is what it is. There's There's nothing I can do in this situation. Uh >> Can you please not put my picture on that stupid app? Because I do not need to lose any of my jobs. >> Uh you can ask the jail staff. I don't know if they have anything that they can do. That I That That has nothing to do with >> It's crazy how with the times that we living in, everyone's worried about social media and getting their face their face plastered on Facebook or whatever, right? But listen, that body cam is coming out, man. Somebody heard about this, and they putting for that body cam, man. So, you all on YouTube, man. You can forget about that post. You on YouTube. >> I I don't work at the jail. Hey, just Hey, step up here. Step up here. Get some air. Step up here. Come on. Hey, breathe. Breathe. In through your nose, out through your mouth. In through your nose, out through your mouth. In through your nose. >> [clears throat] >> Come on. Come >> I don't want to lose my kid over two like this [ __ ] >> Ah, come on, man. We ain't trying to hear that. You wasn't trying to You wasn't doing all of that when you was trying to Mike Tyson your kid, man. >> It happens every day and his mom just acts like she wants to make a phone call today. >> Hey, I'm going to >> Normally it's her beating my and I just take it because I'm the mom. >> After interviewing everyone involved, officers arrested the mother for domestic battery. The teenage girl was released to her grandmother after DCFS responded to the scene. >> Looking for answers as the world goes by. [music] What's in the reality? The squeeze.
