You guys are so awesome. You're being stopped for spectating or racing or burning out. You're being cited for this. >> I'm I'm being what? >> You're being detained. I need your driver's license, please, for citing for spectating or racing or burning out. >> So, it's illegal to watch? >> Yes, sir. >> Oh, somebody's about to get fined or arrested or both. For what crime? For filming cars leaving a car show. Don't you ever let us catch you doing that. Just in case there are any stragglers out there, cuz we don't want any stragglers who still don't understand this isn't the land of the free home of the brave, but rather the land of the fee home of the slave. Do you really want to see how oppressive and tyrannical Florida deputies are? What if I told you that in Florida, you can be arrested or fined or imprisoned or all three simply for filming cars in the street? It's Florida State Statute 316.191. And we'll get to that in a minute. Basically, if a car owner that you don't even know does a burnout in the middle of the street, you can be treated as an accomplice to criminal activity just for filming it. And who's going to cite you, fine you, and take you to jail if you don't cooperate? Why, our always heroic and patriotic protectors and servants, of course. Here's the story. This guy shows up at a legitimate Florida car show, only to be stopped by police who claim it's illegal to watch. Well, what happens when a peaceful permitted Cars and Coffee event becomes open season for spectator citations? Joseph attended a Cars and Coffee in Palm Beach, Florida. It's a daytime automotive meetup at a commercial plaza simply to take photos and enjoy the scene. As attendees started packing up and leaving, the Palm Beach County Sheriff's Office launched a targeted sweep. Not a sweep of suspected criminals, but a sweep of innocent bystanders like Joseph. Deputy Calmes, ID number 20186, detained Joseph as he walked back to his parked car insisting undercover officers had filmed him spectating illegal street racing or takeover activity. Deputy Calmes claimed that undercover video showed Joseph watching an illegal burnout or a street takeover. But FOIA and public records requests produced zero footage of any drag racing whatsoever. There was no street takeover even tied to the event. When asked on camera why people standing on public sidewalks near a legal meet-up were being targeted, Detective Kelsey Schultz, ID number 30545, who appeared to oversee parts of the operation, refused to explain. Under Florida Statute 316.191, proving someone is an illegal spectator requires evidence that their presence resulted from an affirmative choice to attend or participate in an actual street takeover or drag race. Merely showing up at a public daytime car show does not automatically turn law-abiding enthusiasts into co-conspirators in illegal street racing. Florida's anti-takeover statute has already faced legal challenges including State of Florida versus Wells. And they face challenges for vagueness and arbitrary enforcement. Go figure. This statute fails to give ordinary people clear notice of where the legal line is drawn. All right, let's take a look at this and we'll make some comments along the way. >> What kind of show is this? You're being stopped for spectating a racing event. I need your driver's ID, please. >> I'm I'm being what? >> You're being detained. I need your driver's license, please, for citing for spectating a racing event. >> Who says I was spectating? >> We have you on video, sir. I need your license, please. >> illegal to watch? >> Yes, sir. It's a moving violation. >> That's a moving violation? >> Yes, sir. I need your license, sir. >> Okay, and So, you're telling me it's >> I'm not going to ask you again, sir. I understand you can record. I'm recording as well. I need your license, please, and then we can discuss further. >> Okay, so you're telling me that if I do not give you my license, you're >> You'll be subject to arrest, yes, sir. >> Okay. >> Yeah, you've got three on the other side walking. >> Imagine being such a scumbag that you're willing to economically terrorize somebody who's recording cars leaving a legitimate car show. >> Westbound on line. >> What statute is that? >> I'll look up the exact statute. >> Or even recording street racing, period. You talk about a complete violation of the First Amendment. >> Found the third of arrest. >> I will provide my information. >> Thank you. >> What's your name and badge number? >> Deputy Calvin, side unit 20186. >> And miss >> What's your current address? >> Yep. >> What is it? >> That's it. >> What is the address? >> You have the ID right there. >> I'm just trying to confirm the address. >> It's whatever's there. >> Perfect. >> Calvin, you had these people filmed. >> Yeah. >> That's why I didn't know if he was making you delete your [ __ ] or what he was doing. >> He can't make me delete it. >> That's how I was going to get your number. You mind if I get your number? >> Sure. >> Cuz I can send you some videos as well. >> Oh, yeah. We have a car show, but it's illegal to to spectate somehow. >> No, how is it illegal to spectate? What the [ __ ] >> Excuse me. Can I ask you something? >> I'll take something. >> Sure. >> What's going on? >> That was >> Can I help you with anything? >> No, I'm just a >> That was Schultz. That was Deputy Schultz. >> They would have cited you for this. >> the last one over here? >> I believe so. Yeah, you had three that were moving uh three three white males that were moving uh Westbound on Lime. I don't know. One of them had a like a a green shirt. I don't know if they're still going to be over there or not. >> I can y'all take a walk. >> All right. Thank you, ma'am. >> So, you're stopping other people for the same thing? >> I'm standing right here talking to >> What's your name and badge number? >> I'm Schultz, 30545. >> 30545. >> They're burning out out of there, and then we'll do the spect- spectators identification as well as if they're still there. >> That's fine. >> Look at this guy backing up in a turning lane. That's not dangerous. >> And have one of the units that are going to be uh using the spectator identification coming through the plaza. Cuz if you come in on say 101, they're just going to run back to their cars. They're not going to be able to drive. So, just coming through the plaza, and as they run to their cars, you just grab them there. >> So, not only are they giving spectator citations and economically terrorizing people who are literally doing nothing wrong, but he's putting people on the road way at risk. >> We have undercover in this parking lot, and you identified as one of the people that were spectating. That's that's where this is. We didn't just We didn't just decide to stop random people here. >> I understand that. I was standing >> You totally decided to stop random people. >> He did, >> [clears throat] >> and he said, "This is for watching the car doing burnouts." >> When I just got there, all the good cars left. >> They had already left. >> If you have video surveillance, video they show you that North Lauderdale is No not there. No, I said I come from North Lauderdale. He's going to say, "I asked you a million times. North is what?" Obviously, I got an accent. It's not going to sound like North. I'm from Jamaica, North Lauderdale. He's making fun of me saying North Lauderdale. >> Well, why are you doing that? That's not But don't start jumping to the racist >> So, why is he making fun of my accent? >> I mean, he probably tried to make light of the situation. I wasn't even there, bro. I was Yeah, make light of the situation while you're issuing $400 tickets. >> I didn't even stand in the sun. >> I didn't even do anything. >> So, So, there's cars in the background that are driving. So, how would that be illegal if if I'm recording this cop and there's a car in the background? Is that also illegal? Like, what would the difference be? All right, here he comes. He's probably going to write me a ticket. >> License. It's going to be a citation as well as a traffic citation guide. It explains to you how to take care of the citation, sir. Okay? You have any questions for me, sir? >> Yeah, I do. I have plenty of questions, but first and foremost, so like how I'm recording you right now in a public space, which is a my rights to do so according to the Constitution. My question >> I didn't cite the Constitution. I told you it's okay for you to record. >> Let me Let me ask the question. So, if there's a car behind me, like that Camaro that is behind me right now, you're telling me I can be cited for recording that? >> When there's an organized event like that, yes. >> What do you mean there's Well, the whole point of the event was for people to record. So, I was in there recording. So, is that against the law? >> No, not until they're actually on here street racing or whatnot that you're actively participating, so. >> So, you can be a legal and sanctioned event like Cars and Coffee. And if somebody who owns a Lamborghini leaves that event, and you happen to be standing on the street with a camera, and he does a burnout in the middle of the street, and you record that, you can be cited and given a ticket for $400 for this spectator rule, this Florida statute. It's criminal. This is criminal. >> Um Hold on. Let's see. You asked for the statute. The statute's on the citation, so >> Okay, so you said when they were street racing >> sir. >> No, no, no. I'm just making sure. You said when they were street >> And that's what I believe, right? I've already answered your question, sir. >> street racing The guy who got the $400 ticket deserves to ask questions, and it's this cop's duty to at least answer the questions. >> There was, sir. Several cars were pulled over down the street. They also burned out in front of you that I'm sure you have on your >> I don't have any of that on camera. >> Okay, that's fine. >> And if you had that on your recording, then you're lying. >> Okay, listen. Again, on the citation, you have three options to take care of the ticket. Pay the fine, that's go to traffic court, or let's go to traffic school. >> All right. >> Have a good day. >> As he gets into his vehicle with the heavy tint, but would also pull you over for illegal tint. Joseph filed an official internal affairs complaint over the detention and lack of evidence. Deputy Schultz and Deputy Calmus's Sergeant Safford, as we've all come to expect, cleared his officers of any wrongdoing. Spectator citations carry roughly a $400 fine, and many innocent attendees simply pay the fine rather than fight it in court or fund a constitutional challenge. Costs that quickly dwarf the ticket itself. So, is writing spectator tickets at permitted car shows about safety or just revenue generation through arbitrary enforcement?
