What if every American started standing for their rights against the intrusive actions of law enforcement? >> Officer, I do not consent of any searches of my person. I am not committing a crime at all. I am walking down the street. I'm not going to give you my name. I'm not committing a crime, sir. Do you have reasonable suspicion that I'm committing a crime right now? >> Hey, we're the cops. When we get a call, even if you aren't committing a crime, you have to provide your ID. >> You have to provide your name, okay? >> I'm not going to. >> Well, you have to. >> I'm not going to. >> In this video, a guy's walking to the store in the state of Pennsylvania to get potatoes. He's minding his own business. He's open carrying his firearm, and apparently, local people called the local police department, and the cops show up. When they do, they warn the guy not to touch his gun. This is where the action picks up. We're going to watch this together, and I'll make some comments along the way. The goal is to show people how to exercise their freedoms. Freedoms are like muscles. If you don't use them, if you don't flex them, you'll lose them. >> Absolutely not. My hand will not go near it. I just want to make sure everything's being recorded. I want to make sure this is all within the law. I have no problem with you guys checking. Again, trust me, I don't. I understand you're doing your job. It's just this is the fifth time. It's getting a little absurd, you know? It's almost harassment, guys. So, how you doing, officer? Can I have your name, sir? Please. Summers, Officer Summers. And your name, sir? Your name, sir? >> Officer Crab. >> Thank you. Thank you. I appreciate your officers' cooperation. Uh sir, officer, your depart- your department checked that, and then handed me my firearm back. Officer, there is no Cite me a law that says I have to do that. Cite me a law. That's not true, officer. Your department checked this weapon and told me it was not valid to me and gave it back to me. What does that tell you? Right. Right. That's ATF form. That's on them. I didn't fill out the ATF form. Officer, I do not consent of any searches of my person. I am not committing a crime at all. I am walking down the street. >> In other words, with these cops, your rights aren't important. Will you just let us violate your rights? Come on. What's the harm in that? I mean, you want us to be safe, don't you? >> I will not I'm not going to give you my name. I'm not committing a crime, sir. You have reasonable suspicion that I'm committing a crime right now? Well, you're in you're in public, so there's no presumption of privacy and you know that, so So, you're going to tell all these people to not listen? Are you going to tell everyone in the apartments to not listen? I should ask you guys that same thing. Again, this is the fifth time. Am I breaking a law? >> We don't know. Are you? >> No. >> Are you a felon? Are you convicted felon? >> Not at all. >> How do we know? >> How do we know that? >> I'm not I'm not a mind First time I ever met you, sir. >> I agree. >> First time. >> I agree, but what are you supposed to do when you see someone lawfully engaged in a lawful act? >> Make sure that you have a lawful allowed to carry that, number one, that you're not convicted felon. >> But that does not require a permit in the state of Pennsylvania, sir. That is not a reasonable >> Well, you are. If you're a convicted felon, you cannot have a weapon in PA. >> But that is not you What are you guys going to run a background check on me? I'm pretty sure that's dealt by by the Pennsylvania Instant Check System, sir. >> And for some reason, it never arises in a law enforcement officer's mind that it doesn't matter what the state laws are. It doesn't matter what the local laws are. It matters what the supreme law is. And the supreme law is still supposed to be the second amendment. You have the right to keep and bear arms, and that right shall not be infringed. It doesn't say dot dot dot unless you're a felon. If you are a former felon, if you did the crime and you did your time and now you're out, you still have a Second Amendment right to keep and bear arms, no matter what the judge says or the prosecutor says or the local or state police officers say. You have the right to keep and bear arms, and that right, even if you're a former felon, cuz you're not a you're not a felon anymore if you did your time. Or or else why did they release you? Did they release you to make sure that the public was further endangered? No, they released you because in their minds you were rehabilitated. So, all of your rights should then be restored. But again, that's not how cops think about this. They don't think, "Oh, wait a second, there's a Second Amendment barrier. I shall not infringe on this guy's right to keep and bear arms." >> I don't know that. How do we know that's in the system? Check that. Do you have any paperwork on the gun? >> I don't need any. It's not required by law. >> Do you have any paperwork? That sounds like uh 1940s Germany. Show me your papers. >> All right, listen. Let's Let's see your ID. >> Officer, I do not consent to any searches of my person or my property. >> that's what your name is. You have to, okay? It's not a choice, you have to. I'm asking you nicely, cuz as always, I just forgot your name. I know it's in our system. I've dealt with you before. But when the number of people call us that you're carrying a firearm, we have to check it out. >> It's not a choice, you have to show us your ID. You don't have an option. >> I agree. It needs to be investigated, and then you should be able to drive by me and see that I'm If I was running down the street with my shirt off with this in my hand bucking it off at people, I would completely say you have a valid point. How do I know? I can go to >> that you're the worst I've ever encountered before, right? Have you ever seen him on >> That does not matter, officer. >> Yes, we do. Your name is always >> Officer, I cannot do that. I do not consent to any searches of my person. I am not committing a crime. There is no reasonable articulable suspicion that there is a crime being committed. >> You have to provide your name. Okay? >> I'm not going to. >> For now, we're taking the gun. I want you to hit. We're taking control of the weapon until we figure out what's going on here. >> And that right there is very dangerous. How many times have we seen cops do this? Incompetent, inept cops taking a gun off of somebody's side and shooting them with it. >> Is it loaded? >> No, sir. There is a magazine in it, but there's no load in the chamber. >> All right. >> I do not Again, I do not consent to any searches of my person or my property. That includes serial number searches of my weapon. I don't want to give you guys a hard time. I really don't. >> why don't you just give your name? >> Because this is the fifth time I have been stopped for following the law. >> Listen to me. People see you walking down the street with a gun. >> I agree. >> They have no idea that I'm not just practicing. They don't know you. >> That does not constitute a reason to stop me. If I'm walking down the street wearing a Halloween mask that scares people, that is not a reason to stop me, officer. You know that. >> carrying a handgun >> in a legal, lawful manner in an open-carried holster. >> But you have >> That's threatening? >> In the land of the free, home of the brave with a constitutionally protected right to be able to keep and bear arms and warning the government, you shall not infringe. And here's the government attempting to infringe. >> You have to identify yourself. >> No, you don't. I don't need identification to walk down the street. Correct me if I'm wrong. Do I need identification? >> What about down the street, sir? >> I don't know you in the state of Pennsylvania. You can not carry a gun >> without if you have a conviction of a felony, right? >> Right, which is for the Pennsylvania instant check system to determine. >> of a felony if I never dealt with you before? >> That's not your position to do that. What do you stop Do you stop every single person you see to make sure they're not a felon? Do you stop every car that drives by to make sure they have a license? No, you do not. >> a If they have a firearm and somebody calls and says they're offended by a firearm >> Well, that's not It's not the law to to to deal with someone being offended. >> have it, then it's fine. >> Right. >> Is it the law to give me a hard time? >> This this makes no sense. If somebody calls us and tells us that they are offended that another American is exercising his constitutionally protected right, that gives the cops the open door to walk through and attempt to violate your rights instead of taking the time with the dispatcher or law enforcement to explain, "Wait a second. You got to understand, we have American freedoms and I will not trample those freedoms. I will not attempt to violate those freedoms and you don't lose your freedoms just because we got a call." >> It is the law that you should You guys should be offended. >> hard time? >> It's my right. I have the right to say these things and you know that. >> Well, you have the right to do anything you want. I have the right to protect myself. >> I agree. >> Is it your right to give me a hard time as the cops are giving him a hard time? >> You officers, you know, again, I understand you guys are doing your job. I get that. I get that. Trust me, I do. I don't want to give you guys a hard time. I don't. But this is the fifth, sixth time on this same block. >> Let me tell you what it's like to be better. >> I've been held at gunpoint by your guys's department twice for something that I can't conceal carry because our I heard what you said, officer. The only reason I don't conceal carry is because in this stupid state I got charged with a marijuana bowl when I was 18. That is a prohibiting offense for life. I am forced to open carry and I'm forced to deal with this BS every time. This is the sixth time I've been stopped. I've had firearms pulled on me for something that is completely lawful in our state. This is wrong, gentlemen. >> So, they made it illegal for this man to walk down the road with a weapon concealed. >> This is wrong. You should be following the Constitution. I get you have to do a job. I am There is no reasonable >> follow the Constitution. >> The president doesn't follow the Well, there you go. Yeah. Yeah. Isn't that sad? Turning into freaking Nazi Germany. You You gentlemen know about the National Defense Authorization Act, don't you? But yet I'm the crazy one for walking down the street with a gun? How many police cruisers are here? One, two. >> And that reference to the National Defense Authorization Act was the section in there that says you can go to jail without charge, without trial, without due process of law. The government can just disappear you. >> Three. >> Maybe four. >> Four. Four officers. This is at least the sixth time, seventh time I've been stopped. All I wanted to do was walk down and grab some potatoes. I've got food cooking at my house and I don't drive. And being that the shitty state that we live in, I'm forced to carry a firearm because as you guys know, your response time is what? Four, eight minutes? You guys are responders. You respond You guys respond to something that has already happened. You guys do not prevent crime, you respond to crime. That's That's That Thank you. Do you have a problem with civilians being armed, sir? Thank you. Good. Do you, sir? A complete waste of my time. And yours. This is a waste of tax dollars. This is a waste of four police cruisers for someone following the law. >> All right. We got all your stuff. Giving you your gun. We're holding the gun for your safety. >> You're holding my firearm. >> No, we're giving it back to you now. >> I would freaking hope so. >> Yeah, we're leaving. >> Thank you. Could you hand that to me locked open, please, sir? >> We were standing here. We're doing it for our safety, all right? But we're going to keep getting called. You know what I mean? >> That's what they keep telling me and you know, you should be telling the people on the phone, "Hey, what he's doing is not illegal." >> Well, we were wondering but we don't know that until we get >> That's not up for you guys to determine. You don't stop every car that drives by and ask them if they have a driver's license, do you? >> If I run your plate, it comes back suspended. >> If you run their plate? >> Well, that's what they say he's doing right now. >> I'll try. >> This is where the video ends. They give the man his gun back. They walk away and he walked away to go get his potatoes. We got a call that you were walking down the road exercising your unalienable rights should never Trump your unalienable rights. You don't have to give your name if you're not suspected of committing a crime. I personally think these cops know this. They just want to exercise their authority. They want to prove to the caller, "Hey, we did something." And they want to justify the intrusion on your life, and your liberty, and your pursuit of happiness.
