So, even if you were just shopping here and they had absolutely no indefinitely for the rest of your lives. I hear you. Let me explain this. So, a business Are you going to let me talk? A business has the right to trespass you no matter what, no matter if you've committed a crime or not, they can trespass you. Amy what? >> Am I being >> Yes, you are being detained, and you have to identify yourself before we conduct an investigation. You do not need a supervisor right now. Amy >> I would like a supervisor. You don't know what that man did to me. >> For what, exactly? What did he do? Explain to me. >> For us to get your side of the story, we need to conduct our investigation. >> Okay, well Okay, well, I have done nothing wrong. I'm on camera. You guys can see that for yourselves. >> And we will. You're not under arrest. You're being >> I know I'm not under arrest. I didn't do anything, and I know I want the supervisor, and I won't say nothing till my attorney gets here. >> My my supervisor is not how that works. >> Well, okay. Well, when my when my attorney and the supervisor gets here, and you guys look at those cameras and see what that man did to me. >> That is their right as a business. You can go to the one in Cypress, way up there, but you cannot come to this one. If you are seen on this property, I promise you they will prosecute you. You will go to jail, okay? It's not for the $3. >> Okay, so the problem is that you guys were with the person that did the crime, all right? So, just because you guys were with her, you guys are going to be trespassed. You guys understand that? There's another Walmart you can go to, all right? There's There's no need to make this any more complicated than what it needs to be, all right? >> All right. >> You guys are good to go. >> When my attorney and the supervisor gets here, and you guys look at those cameras and see what that man did to me. Yeah. >> Okay, and we still will review that. You need to stay right here. >> Um I'm just talking to my >> Okay, my friend. >> Stay over here. Sarah, come here. >> Did she take something? >> She, I think, stole $3. Yeah, so she They want to prosecute. You have to leave. You cannot go up there. >> Ms. Amy, you have to identify yourself cuz we're still conducting >> I want the supervisor here. >> Um you need to leave. You got to go. >> Wait, no. They let this man do this to me, and it's not fair, and I'm not going to put it I know my rights. I'm not I'm not being rude to you guys. >> Turn around. Put your hands behind your back. >> What? No. For what? >> Yeah, you got the right to turn around and put your hands behind your back, man. Yeah, I know my rights. I'm not going to say anything else until my attorney gets here. Well, okay. Tell him to meet you downtown. >> Stop. Don't resist. >> Sarah, come here. Get my stuff. Can I grab your phone so it doesn't get dropped? I'm trying to help you. Put your hands behind your back. You need to leave. If I tell you again, you're going to jail. >> She's still there? Hold on. She's still there? We might HAVE A TWO-FOR-ONE SPECIAL. SHE NOT LISTENING? >> LEAVE THE PROPERTY. >> You're resisting and I'm telling you >> How am I resisting? Sarah, get my stuff. I'm going to call you. I'll call you. Wait, can you give her my stuff, please? Sarah, come here. >> He had a knife and he's trying to signal five somewhere. >> My stuff. Okay, we're good. Yeah, we're good. You can get it. She'll give it to you. My stuff. Can you get my Can you give her my stuff, please? >> What do you want to give her? >> Everything. >> Not right now. >> No, there's She has There's I don't want my money stolen. >> Okay, your money's not going to be stolen, but we're not going to give someone your money. >> I want my family >> She got something in that bag. She got something in that bag and she trying to get her rid of it. >> I want my belongings. >> Okay, we'll go through. We'll figure it out. >> Wait, don't leave. >> We're recording. If you don't leave, you are going to jail. Get in your car and drive away. >> You're under arrest right now. >> For what? >> For stealing. >> I didn't steal anything. >> We're going to talk about it, okay? So, come with us. >> Okay, okay. When you see I don't steal it. >> And we're going to have to run an item number. >> Can you tell my family >> Have a seat at this time. >> What did you say I did wrong? Have a seat, ma'am. >> So, this is an intervention. So, now that stuff in your hand is scanned. >> That's not me. >> Be aware of it. She goes and bags >> Well, I told her to go just pay for it and that's it. >> me. >> That's not you right there with the black? >> Well, this is the second time. >> All right, ma'am. Just go ahead and leave her alone. >> She was showing me a couple of >> This is the second time. >> I scanned everything. >> so what I'm going to do, all right, I'm going to read you your rights. Okay? You have the right to remain silent. Do you understand each of these rights? >> Mhm. >> So, I'm going to explain something, okay? >> Did you see that one? >> Can I speak? >> Yes, ma'am. >> Okay. We are conducting an investigation for a shoplifter, okay? I have not watched video, I have not spoken to him, we have not gotten any information other than your assessment. Can I speak? >> Yeah, I'm sorry. >> Do not interrupt me again. >> I'm sorry. >> You are a suspect in a crime. Therefore, one, you are required to identify yourself. One, that's one. So, by not identifying yourself, that is resisting. Okay, you did not after being told multiple times. >> anything. You saw that >> You let her speak and then you can speak. >> I'm not going to play games with you. >> That's this guy. >> Officer Montas is the primary officer. He's going to conduct an investigation and until we figure out what's going on here, you're not coming out of handcuffs and I don't care you keep saying they're tight, I've already checked them, they're properly fitted. I'm telling you if you try to slip out of handcuffs, I'll I will charge you with attempted escape, okay? Okay, cool. So, let's let's stop the talking for a minute while we gather at all of our investigation and then we'll talk to you when we're ready to speak to you, okay? >> Show me from the beginning. >> She stands there, she doesn't scan the other item, puts it in there. There's items in her hand, goes ahead and puts everything that's in her hand in the shirt in the bag. That item's not scanned and she puts both in her bag. >> Okay. >> That's the second time. >> Okay. >> I stopped them and all I told her when I found out how much it was, all I said was just go pay for it. I gave them the option. I don't have to do that. >> You were in self >> I don't have to do that. >> Okay. >> And then she got aggressive. >> Oh, so >> By aggressive like what what you >> What she was doing is >> Oh my gosh. >> She said that I probably got my ass beat in high school and I was probably going to get my ass beat right now. >> she was at register over here. Her friend's at register over here. >> No, they were at the same >> They were together. Okay. So, she's scanning the items on her phone or with the scanner? >> She's scanning it on the the >> With the scanner. Okay. So, she's scanning items. She The one that we can confirm that she placed into the bag is the $3 perfume, the pink bottle, correct? Okay. The other items she was aware of not being scanned, but the one she physically placed in the bag was the pink one. >> Yeah, and then this is all the stuff that they gave up after, you know, I caught them under-ringing so this this $7 worth of stuff I think I said I was going to take back so at what point that she decided to grab cuz you can see her right here and say we don't want that anymore in her hands. >> Okay. So, at what point did they pass point of sale out of the door? >> I can even show you >> No, yeah, I'm not I am not talking to you. I genuinely am not and I'm sorry, but I've repeated myself and I can't do my job when you're talking in the middle of it. If you are innocent, I'd like to prove that. If you're not, then that's another case. No, I don't care who he is. I need you to stop talking for a minute. >> All of them passing all points of sale is when I contact with any of them and then once they all pass is when I make contact. >> audio on there so that you can hear >> We don't need to We we we see you passing all points of sale, so we're we're watching that right now. >> Okay. So, can you do me a favor? Can you You saw the part where she scanned? She has the blue bottle of spray and the pink one. She scans the blue one, takes the pink one, puts it in the bag. Okay. Who uh had it with them when they walked out, you know? >> Um the one in the dress. >> The dress lady? Okay. >> But she also attempted under-ringing, but since they're together, it's technically she should be in here, too, but I don't care about her. >> Okay. >> She's the one that started it. This this would have went >> Okay, so now we got the real reason why there's a difference between the two, okay? It she came fly out the mouth. The other one that everybody got caught. She held it down, the other two held it down. Whatever, you know. This one decided to get fly out the mouth and called him gay, said he a fruit cup and all of that and yeah, and so he got his feelings hurt. So, now he pressing the issue and it is what it is. But, you got to be a special kind of stupid to cause this amount of trouble for yourself over $3. A $3 item. $3. A $3 item. >> [screaming] >> DO YOU HEAR WHAT I'M SAYING? $3. $3. LIKE, THIS IS INSANE. This is insane. A $3 perfume thing. It's probably one of them little spray body spray joints, you know, those be the little cheapy joints. You know. $3, man. That's nuts. Come on, man. >> Smooth, right? If you you you would have only been trespassed from here, right? If you would have just complied, right? Now, you threaten him. So, everything everything changes. The whole dynamic changes. You see the whole how the whole dynamic changes when you're not when you're not being cooperative. That's why we're here right now. >> why? Because he started harassing about my face. Because my face he started >> So, she have a You have an ID in here? >> Um no. I have money, like >> All right. So, it's gone now. >> He came out and like straight up started Because I have a tattoo on my face, he started saying something mean. I said, "Why are you so angry?" They went to go pay him the money cuz we didn't even know that. And he's just so angry about me cuz I was like, "You want to talk about women's face?" >> All right. So, what's your first name? You definitely was seen on video stealing, also. So, you you were >> That was >> I need to get your first name. That would be good. Uh >> That wasn't me. >> to get your first name. Amy? >> No, that's >> Are you going to give me your first name or not? You're just going to be difficult. >> to be booked under John Doe. You're going to get an additional charge for resisting. You've already got two. >> But did you say I did anything? >> Please provide your identification to this officer. >> But you said I have a right to remain silent. >> Okay, cool. >> Okay. >> Right? So >> We'll take her under John Doe and then we'll just book her. >> Go ahead and get up. >> But I want to press charges on him. >> Okay. >> That's harassment. >> Hold on. Hold on. >> That's discrimination. >> Shh. >> Okay, doc. >> He wants to come at me because I had a tattoo on my face. And he was like, "Oh, nice ghetto tattoo." You You Talking about how ghetto I am. I'm not ghetto. So I should be treated like that? And when there clearly there was some other girl doing my lashes, but he went after me cuz I had a tattoo. >> I mean, stealing is pretty ghetto. I ain't you know, and then when we put a number on it, the amount that you you you you stealing over is $3. I mean, I would say that that is some ghetto activities. I mean, and they say, "Hey, don't judge a book by its cover." But I mean, >> [sighs] >> on my face? >> I just watched you >> take this. Did you say >> and not scan it and put it in the bag. >> Yes. >> So you shoplifted. >> Ah, see? I said it was like one of them little body sprays. I said that. >> No, I didn't. >> Okay. >> I scanned both of them. I don't know what that If you look, I put both of them over there. Like I I don't even care. That's not even my stuff. I don't wear that. I would not do that. I have four children. >> Okay. >> I have a very important job. Like this is This is him. He did that because he's talking about >> What important job you have having a tattoo on your face and neck? Don't judge a book by its cover. >> tattoos. I said you want to talk about women. I said, "Well, you must have your feet up a lot in high school." >> Do you guys think that I'm like really all wrong and that man's right? Like, do you think that? >> I take a phone number out of my my phone. >> You're asking for favors right now and you have been not cooperative this entire time. >> with you. Now, that man did me wrong. >> I apologize if that's the case, but >> I haven't done anything wrong with it. >> That's not our job. If someone is is unfortunately not the kindest to you, then that's a problem for you to call their corporate. But, as far as the one person somebody making you >> He But, he came at She came at me. >> He did not come at >> I'mma tell you something, right? For those of you guys that are not tatted up and stuff like that, like me, I have I have a whole bunch of tattoos, right? Um Uh well, not a bunch, but I have a uh a sleeve, right? The thing is is that back in the day, you know, a lot of important jobs or serious jobs did not allow tattoos, right? At all. And then, as time got along went along, um now that we're in more modern times and tattoos is more ups uh accepting and stuff like that, now it's pretty much you can have tattoos, but they would they can't go past the wrist. Past your wrist. That's what a lot of um nowadays, that's what a lot of uh you know, people go by. So, when you see cops and stuff like that back in the day, tattoos probably were not allowed and stuff like that, but now you see cops and everybody, you know, pretty much tatted up and stuff, but a lot of times you won't see them have tattoos on their hands, like down on their this area or fingers and stuff like that. You won't see it on the face, stuff like that. No, you know, if you can have it, you know, a lot of times it can't be below your wrist. And so, the fact that she does have a big a big tattoo on her on the side of her face and a big old I see the future throat tattoo, um I don't know what important job you have with that. It can't be nothing you know, it might be. I don't know, but yeah, it's just not giving that, you know. >> You we watched the footage. She did not advance on you as if to strike you. Do you have anything on you that will be introduced as contraband in the jail? Okay. Do you have a bra >> Yes. >> Okay. I'm going to sweep under your bra. Is there anything inside your bra? Money, lighters, >> I don't know. I don't know. >> Do you typically store items in your bra? >> Sometimes I have a lighter in there, but I don't know. >> Okay. Well, I'm shaking it out >> for that purpose so you don't accidentally light yourself on fire in my car. God forbid. >> So, I have to go to definitely go to jail even if the supervisor comes over and >> You're 100% you're 100% right. >> And what am I being charged with? Like I'm getting all these charges? Um can I have a phone number out of my phone to >> Not right now. You have not cooperated this entire time, so no. >> Can I put my hair up? >> No. >> You're asking for favors and you have not been cooperating with us, so we're not doing any favors for you. >> I didn't cooperate with you guys? >> No. You still haven't provided your name or date of birth. >> I told the guy my first name, my middle name, and my last name. >> What's your date of birth? Cuz that's not coming back. Exactly. >> I'll tell the supervisor. >> You'll tell the unit fingerprint scanner. >> She was 10-12 with I think her sister and her brother-in-law. They were scanning items. She took item and didn't scan it, put it in her sister's bag. They They walked out together. So, they didn't want to press charges on sister and brother-in-law because they were cooperative. She took a 10-8. >> Miss Amy? >> Yes. >> All right. What's going on? I'm the sergeant. >> Okay. I came over here with my uncle >> See, everybody tatted. You see that, right? >> [laughter] >> Everybody tatted, man. >> Let me ask you a question. Can I talk to you? >> Okay. Drugs.com field identifier. Damn it. Come on. Put that back in there. She's got a body like huge. She's like I think. >> I got what? >> So, you've already been provided your rights, correct? >> Okay. Which >> But you understood. We talked about inside, right? You understood them at the time. You've still been talking. So, >> Yeah. >> What's that bag of white powder before my officer gets exposed to fentanyl? >> What powder? I don't even know what you're talking about. >> Okay. There's a baggy >> I do. I There should be no baggy in my purse. The only thing that I ever do is smoke pot. There's nothing in my purse I can have >> There is a a large bag of a powdered substance inside of your purse. >> Can you show me? You can lift it. Just try like that. >> up the bag and show her. What is that? >> Can you come closer to me? Yeah. I don't know what That's not drugs. >> Do you have any infants? Do you have an infant? >> Um no. I don't >> Any baby that has formula or something like that? >> No. I don't That's not drugs. There's no way Yeah, it's I What is that? Go look at it. It's right on the table. >> I will Okay. Well, we'll do our own investigation. >> Yeah. What is that? Oh, no. That's my ashes. That's my baby That's my baby's ashes. That's Those are cremation ashes. Please don't mess that up. >> That's not ashes. >> Please don't mess that up. >> Miss Amy, why do you have Narcan? >> Narcan? >> Mhm. >> Okay. I always keep that on me. >> Why? >> Because I've had about like three friends die that are very close to me from high school. You don't know. I make sure I try to give that to everybody. >> I I see. >> Yeah. >> Okay. When I and Officer Montas made contact with you and he attempted to put you in handcuffs and you pulled away from him. Hold on, ma'am. When you pulled away from him, you tensed your arms and you made it difficult for him to secure you. That is resisting. >> You know what I was trying to get my sister my >> Two, when I asked your name when I asked for your name and you told I guess initially at CC's at CC's you told someone your name was Amy Foot. That's false identifying yourself. >> Amy Foot? >> That's what you told officers at CC's. >> I thought you said I didn't tell nobody my name. >> You said Amy Foot is what there is what Officer Outlaw said. Then when I asked you to provide your name date of birth to me three times and Officer Montas twice, you said no, I'm not I don't have to and you said I want to fight you. That's what you're being charged with. And depending on what that test was >> to but you guys saw what I was doing. I would never try to take from them. I was trying to get my family my purse that was in my hand. Sounds good. >> All right. Put your feet up. >> And that's what I told you guys. He wasn't going to prosecute but then he's like, yes, I'm going to prosecute when they went to go get her. And he's like, it's $3 but I want to press charges. >> So >> He said multiple times but I know they're not supposed to. >> I'll talk to them because under 25 we had agreed >> Right, which is why he let the other people go. >> Right. >> She took a 10-8 which is why he's like, no. She's leaving, she's uncooperative. >> Because she called him gay. That's uh come on. That was the main thing. All right. He said she called him gay. And yeah, she threatened him and stuff like that. Said he you know he he'll he'll get no girls or something like that, she said. That's the it hit him. It hit him, you know what I mean? And so, now he wants to go against their agreement. If they got an agreement with the law with the local law enforcement there, you know, hey, under 25 it's a waste of time. You know, what I mean? $3 and you're charging because she called you out your name, man. >> Just calling him like slurs. >> Yeah, I guess she said they were going back and forth. Yeah. Um taking it >> Hey, that is my baby. >> Sit down. That's my baby. >> Gently. >> Okay, we still got to test it. Don't mess it up. I didn't give it no fake name. >> Just so you know, you have three warrants. So far. So far. For this >> Warrants for what? >> For false IDing and failure to appear. >> Yeah, I'm here to appear for what? >> This is heroin and fentanyl. >> You're what? Is You're telling me I have heroin and fentanyl? You're going to tell me my baby's heroin and fentanyl? No, wait a minute. Are you guys saying that my baby's ashes have heroin and fentanyl? There's no way in hell. >> Ma'am, I hope for your sake that it's not. >> Go ahead and jot down whatever she says for the overdose. >> Are you guys trying to charge my baby's like my baby's ashes with heroin and fentanyl? >> Sign it. Switch with me. >> Somebody's trying to set me up. Like what is going on? >> Yes, ma'am. Go ahead. >> You guys think it's mixed? You guys said >> Could be, but the I don't feel confident with the fentanyl kit. >> Can you double check it? That is my baby. >> But that's [ __ ] I'd say that's cooking. >> There's no way there's I mean, you can try to charge my baby. >> I hope not. >> Can you test it? Test it? >> For cocaine. >> Cocaine? Is it my You're saying it's cocaine in my baby's ashes? Can you double check it because I don't >> I I don't have time to >> I don't have you to cocaine, yo. That's my baby. >> That's okay. It's going to go to FDLE for testing anyways. >> Are you guys setting me up? Is this like I didn't even do anything. You're charging me with 14 grams of cocaine as my daughter. What? >> Let's do it at the PD. Yeah. >> Thank you. >> You're going straight in the >> Yeah, like I said, it's confirmed. She's a special kind of stupid. I ain't going to lie. You You walking around hot and you're going to sit there and not just walk away or whatever, like pay the $3. You going to do crime and you walking around hot with stuff in your backpack. Mhm. >> Sell them. >> What? >> They're going right in here. There's a bathroom on that side of the wall. >> are you going to do with those ashes? Did he tell me? I wasn't I didn't >> Put your hands behind your back. You're not going to leave with those so just put your hands on the wall. >> What? >> Listen to what the sergeant has to say. >> I am, but I'm not what regardless. I know what I'm getting at. I'm just asking them what you're doing with them. >> Submitting them for evidence. >> Yeah. >> Going to forward to the Department of Law Enforcement at their headquarters to be processed. Go ahead and >> go ahead and >> Okay, and then do I get all of this back? >> I have no idea what happens from there. >> That's my baby. >> Had to be told of her actions at Walmart, the 41-year-old woman was given seven charges. Five probation violation charges plus petty theft and resisting an officer without violence. In court, she would ultimately be adjudicated guilty on resisting without violence and giving a false name to a law enforcement officer. Her petty theft charge didn't make it very far, likely due to, as you heard, the sergeant saying that they usually don't prosecute if the amount is under $25. There also weren't any details or charges related to the mysterious white powder she had, but after being adjudicated guilty on falsely identifying and resisting without violence, the 41-year-old woman was sentenced to 2 months and 1 day inside county jail. She also had to pay $604 in fees. We can clearly see the attempts to save $3 cost much more in her case. Let me know your >> crazy as the world goes by.
