Around 1:20 a.m. on December 20th, 2024, patrolman Christopher Fuentes with the Red Bank Police Department, a 2025 Volvo that was improperly parked in the parking lot in front of Volcave. He activated his emergency lights to initiate a traffic stop and made contact with the driver who was identified as Dana. How you doing? Good. How are you? Officer Fuentes Bank Police. Do you have your license, registration, insurance? Yes. Not here. Sorry. Where is it? What? Dana told patrolman Fuentes that she had been at Gabriella's Italian steakhouse in Red Bank and that she had been in a fight with her boyfriend earlier that evening. As he was speaking with Dana, he detected the odor of alcohol and observed other indicators of impairment. Dana was unable to locate all her documents and she admitted to consuming alcohol earlier that evening. Just your uh license, registration, insurance. No, it's a brand new car. What was that? So, you said three glasses of wine. Based on his suspicion of impairment, Dana was asked to perform field sobriety exercises. The first exercise was the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Dana failed to touch heel to toe on each step, counted incorrectly, and turned improperly. The final exercise was the one leg stand test, and Dana failed to raise her foot in the proper fashion while putting her foot down before the test was complete. Maybe more. Patrolman Fuentes placed Dana under arrest for driving under the influence. The vehicle that she had been driving was impounded for a mandatory 12-hour hold under J's law. Operating under the influence, open container, failure to give proper signal, failure to possess driver license, failure to possess driver registration, and failure to possess driver insurance card.
