Avenue he first made contact with the Uber driver whose car was allegedly struck by a 21-year-old woman driving a 2014 Subaru Legacy the Uber driver informed officer Santiago that the driver of the Subaru Legacy allegedly Gra Ed his door with a passenger side mirror and he observed damages to the other driver's mirror consistent with this description and I have a witness that she started to hit me for what reason well I was in my car like just getting in yeah and she grazed my door and I said what the hell you freaking doing what she Graz her door to her car yeah okay so then she came over all right and she started to uh swing at me okay and when she came over she did this to my uh with what like probably with her whatever sorry oh she did she do that on purpose well I told what the [ __ ] you doing all right and so she's in there right now do you have a description what she wearing uh Juan skinny what he also told officer Santiago that the other driver became physically aggressive towards him after the motor vehicle accident and that would later be confirmed by reviewing a cell phone video that was filmed by a witness the driver of the Subaru was identified as 21-year-old Alyssa and she also mentioned that she had a broken fingernail Alysa said that she was coming from exit 6 a bar in North Wildwood and she also admitted to being under the influence of alcohol the other officers continued to interview the Uber driver and officer Santiago began his DWI investigation based on his suspicion of impairment officer Santiago asked Alissa to perform field sobriety exercises hi hi officer Santiago I thought you know have a camera on this man all right what happened this man ripped my [ __ ] na my finger okay all right all right so what happened what happened dexterity test was not performed because of the apparent injury to her fingernail the third exercise was the horizontal gaze nystagmus hgn test during the hgn test officer Santiago observed the lack of smooth Pursuit distinct and sustained nice stagnis at maximum deviation and the onset of Ni stagnis prior to 45° he also observed vertical gaze nice stagis in both eyes the second exercise was the walk- and turn test during the walk and turn test Alyssa failed to touch Heel To Toe on each step and did not keep her arms at her sides the final exercise was the one leg stand test during the oneel leg stand test Alysa failed to raise her foot in the proper fashion and failed to count in the correct sequence all right all right are you are you diabetic or anything no I'm not diab I'm just like field sobriety exercises officer Santiago placed Alysa under arrest for driving Under the Influence a search of her vehicle revealed the presence of an open container her vehicle was impounded for a mandatory 12 hour hold under John's law she was transported by Officer San dieago to the North Wildwood police department for further processing all right so like I said we're we're going to investigate this assault we we have two officers that are investigating right now all right again I have no [ __ ] okay so I do I do have to place you under arrest for driving while intoxicated it's a motor vehicle operators and she agreed to submit breath samples for testing her Alco test results indicated a back of 0.19% which was more than double the legal limit of 0.08% drivers over 21 after they were finished with processing her she was released to a sober adult after she signed a potential liability warning form on Alyssa's behalf she was issued the following traffic tickets operating Under the Influence and careless driving you have the right to remain silent and anything you say can will be is against you in a court of law you have the right to talk to a lawyer and have one present while you're being questioned if you cannot afford to hire a lawyer one will be appointed to represent you before any question if you wish you can decide at any time to exercise these rights
