are you coming from where gwood Garwood you know you just fell asleep here on March 28th 2020 for around 5:03 p.m. officer Eric lofredo with the Westfield Police Department responded to the area of West South Avenue and West Broad Street on a report of a female slumped over the wheel of a silver sedan as he arrived on scene he observed that the driver later identified as Megan was sleeping inside a 2019 Nissan Sentra he knocked on the passenger side window and awakened the driver as he approached the driver's side Megan opened the door and told the officer that she was going to get her eyelashes done officer lofredo detected the odor of alcohol but Megan told the officer that she had not been drinking the light sorry I'm let me ask you a question have you been drinking any alcohol before you were driving today no sir cuz I'm kind of smelling it I promise you sir is the car in Drive no do you have your license on [Music] [Applause] you sorry [Music] for come right behind the vehicle with the camera on please it's Kathleen right where you coming from okay where were you headed to my you're where my eyelashes right you getting your eyelashes done yes did you get them done or were you on your way thereal got back the buiness I on the phone what's up she was sleep with the wheel do you know have you got whatever anything okay okay you got your mic running mic body cam oh yeah we get her outout to safety over here okay hi hi Miss hi hi what what's your name Megan Megan okay can you take the keys out of the car for me it's in park right all right can I have the keys on cuz it's a busy road let's step on the sidewalk okay are you feeling okay cuz we we got a call that you were you know pass I'm sorry you fell and when my partner pulled up you know you were passed out behind as he was speaking with her officer Anthony ponei arrived on scene to assist officer lofredo asked Megan for her license and officer pone asked her to exit the vehicle he escorted Megan to the sidewalk and she once again denied consuming alcohol officer lofredo asked her whether she had previously been arrested for DWI and she acknowledged her previous arrest from August 27th 2023 court records indicate she had also been arrested for another DWI on September 19 2018 the wheel um where you headed to over here to get my eyelashes done okay where where's this um right here somewhere okay where you coming from coming from Garwood M okay all right um what about the damage on your car is that new right there or what what's going on there um no nothing new it's it's old M that's been like that okay all right how come you passed out and we're asleep I didn't mean to be passed out I'm sorry all right talking to my boyfriend is okay do you want any medical attention or anything like that no sir no no okay how much have you had to drink you haven't had anything to drink okay cuz you're sleep behind the wheel I can smell it a little bit so I'm just asking how much youve had to old okay have you ever been arrested for DWI before in the past I'm assuming if you have an inter device okay all right my partner is going to continue with his questions I just want to make sure you're you seem a little off balance getting out of the car I know you just woke up but you're asleep behind the wheel the car was running right we took the keys out when we got there you know where I'm headed with this um like I said I could smell it immediately when I spoke to you you said you haven't been drinking like I said no medications no drugs or anything like that right no okay all you're willing to do some standard field sobriety test for me yes sir okay do you mind if I take um just a phone can we put it on uh on the car is that okay okay all right yep and just keep your hands out of your pockets while I speak with you that's all all right I'll put it right here it's dry look you mind just um moving the camera too all right so you came from Garwood and you came straight here where do you usually park when you go to the eyelash place right here where I mean on this right in this street yeah so that's what you were trying to do you were trying to park mhm okay all right let's go let's just take one step back right over here all right and then you can face me um do you have any um conditions with your eyes or anything like that no no do you wear contact or glasses no no okay all right so what I'm going to do is I'm going to ask you to stand with your feet together and hands down to your side all right try and stay in that position all right I'm going to just um do some tests on your eyes Okay okay so I'm going to hold the tip of my pen all right right in front like this okay I want you to follow it with your eyes and your eyes only don't move your head you understand based on his suspicion of impairment officer lofredo asked Megan to perform field sobriety exercises he started with a horizontal gaze ni stag Miss hgn test the second exercise was the walkand turn test during the walk and turn test Megan began the test before she was instructed to do so and did not touch heel tuto on each step the final exercise was the oneel leg stand test and Megan failed to raise her foot in the proper fashion while displaying the lack of balance you understand yes okay no worries [Applause] all right need a break good okay here [Music] right try to keep your head as straight as possible you're good all right we'll start again I we'll do one more I know it's a lot trying I know it's tough I'm trying to give you as best chance as possible just try and follow with your eyes only okay don't move your head so I can observe as best as possible okay all right I'll give you a few seconds to you know I know it's a straining on the eyes and everything all right [Applause] [Applause] this is the last one I'm just going to go vertical [Applause] okay one more time up okay all right that's it for the the eyes okay you have any um issues with your balance any injuries that I should know about that would your balance no okay so what I'm going to ask you to do is firste we going to be called the nin step walking turn okay I'm going to demonstrate it for you first and explain it all right so we'll go right here all right what what I'm going to ask you to do is imagine there's a straight line down on the ground in front of me okay or in front of you take your left foot place it directly on that imaginary line okay you can go ahead do that now take your left foot place it directly on that imaginary line take your right foot place it directly in front of your left just like that yep yep and touch them Heel To Toe okay no hold on I don't want you to start yet so we'll start over I'll give you again another chance so I just want you to imagine a straight line down on the ground in front of you take your left foot and place it on that straight line okay take your right foot place it directly in front of your left okay and hold this position touching them Heel To Toe hands down at your side all right hold that position as best you can okay and don't move until I tell you to do you understand all right so when I tell you to along that imaginary line okay you will take nine Heel To Toe steps okay you'll take nine down the line you'll turn around using a series of small steps which I'll demonstrate and you'll take nine Heel To Toe steps back along that line while doing so keep your hands down at your side okay and remain in that position as best you can remember the starting position all right so like I said keep your hands down at your side look down at your fat feet and keep count each step out loud I'll demonstrate it for you okay let me demonstrate it for you ready one two three again I did three you'll do nine heel the toe steps after your ninth step keep your lead foot planted on that imaginary line and you'll turn around using a series of small steps just like this okay you're going to take nine heel the toe steps back along that imaginary line again it's going to look like this one two three okay remember count each step out loud keep your hands down to your feet hands down at your side you have any questions don't stop the test till you've completed it all right so gilad get in that starting position first left foot on the line right foot in front Okay Hand okay one two three y just like I demonstrated yep sorry yep one 2 okay okay so the next test I'm going to ask you to do is going to be called the one leg stand okay so what I want you to do again I'm going to demonstrate it I want you to just put your feet together hands down at your side don't move from that position until I tell you to do so okay I'm going to demonstrate this test all right when I tell you to begin I want you to lift whichever leg you want left or right okay you'll lift it so that your foot is 6 in off the ground your foot should be parallel to the ground okay yep and you keep your hands down at your side keeping both legs straight look down at your toe okay and count each step or and count out loud in this manner 1,1 1,2 13 and continue to count in that manner so on and so forth until I tell you to stop all right I'll demonstrate it for you I got you just I'm going to I'm going to demonstrate it just so you know I want to give you the best chance possible for okay 1,1 1,2 10003 so on and so forth in that manner until I tell you to stop okay remember keep your both legs straight keep your hands down at your side all right and if you put your foot down pick it back up and continue the test as best as possible all right any questions no okay uh I'll let you know when to begin all right you're going to want to keep your hands down to your side though hold on hold on I'll tell you when to begin all right go ahead 20089 201 201 okay all right Miss um said 9 26 listen based off of the test and everything your sleep behind the wheel and everything like that you're telling me that you didn't have anything to drink based on her having fallen asleep in her car the odor of alcohol and her inability to adequately perform the field sobriety exercises Megan was placed under arrest for driving while intoxicated a search of her vehicle yielded open containers inside the vehicle her vehicle was impounded by C and anonin for a mandatory 12 hold under John's law but please off off the test all right I'm going to have to place you under arrest right need you to turn around and subscription of DUI okay we'll talk inside I understand you said you have anything to drink but right now I'm placing you under arrest okay all right one second make sure these don't get tighter on you that's one cold man you can get that jacket back on I know we're going this1 okay we're going to go right to this car here real quick do you have anything on you that I should know about I got I'm going to have to search you but I like I said I want it to be uh as least intrusive as possible before headquarters ending miles 58807 point2 officer lofredo transported Megan to the Westfield Police Department for further processing at the police station Megan was read the standard statement for motor vehicle operators and agreed to submit breath samples for testing her Elco test results indicated a back of 0 point to 5% which was more than triple the legal limit of 0.08% as she was being processed First Responders with the Westfield Rescue Squad arrived to evaluate her and it was determined that she would be transported to overlook Medical Center for further medical treatment [Applause] [Laughter] all right we're just going to wait for my partner one second okay [Music] [Music] you mind just grabbing her bag from the front seat I'll I'll I'll go with her and I have her property all police department and agreed to let the officers contact her mother so she could take responsibility for her around 12:46 a.m. Megan was released to her mother pending a court appearance after she signed the potential liability warn inform on Megan's behalf officer L fro issued her the following summonses operating Under the Influence reckless driving delaying traffic and open container of alcohol all right like I said you don't have anything on you any anything I'll just check with the back of my hand again very quickly just to make sure yep you can just put your hands on the wall for
