again yes the reason I'm stopping you you took the stop sign on forth incra you know stop around the 31 a.m. on November 15 2024 officer Matthew banano with the Hoboken Police Department observed the driver of white Honda failed to stop at a stop sign on Sinatra drive he followed the vehicle as the driver headed Northbound and he initiated a traffic stop on Sinatra Drive in the vicinity of 6th Street officer banano made contact with the driver who was identified as Daniela are you stepping out of the vehicle ma'am yeah she will from just give me one moment I'm going to go on the other side okay okay yeah do your just your ID not that I don't know why you're giving me that you dropped okay whatever you need can you send me uh somebody that's certified [Music] man relax stay in your car insurance officer banano recognized the driver as someone who had been transported to Hoboken University Medical Center hum earlier that evening due to her state of intoxication he asked Daniela for her documents but she was initially unable to locate all of the necessary documentation he was aware that she had consumed alcohol earlier that evening so he called for another officer who was certified and field sobriety exercises to come on scene Lieutenant Edward celik arrived on scene to assist and officer Dominic aliga came to administer the field sobriety exercises um I have uh I was purposely coming back cuz I knew she was getting released so I wanted to make sure the car was still there as I'm there the car is driving away who's this who this is the girl from earlier that was drunk that we brought to the hospital okay that's why I asked for SFS okay uh so I shut the car off you have her shut the car off uh so I didn't observe her get in the car and then I was on the phone with uh Sergeant Straton as I was on a phone she took the stop sign right on Sinatra and that that's what uh caused me to stop her and here we are I'm just waiting uh who did you you hear who they sent this one was I'm sorry who was this this is the one that I called out uh her friend yeah yeah yeah yeah she's looking for her insurance card I is anybody else in the car uh her friend no no it aliga LED Daniela to a parking lot nearby and he started with the horizontal gaze nice stus hgn test the second exercise was the walk and turn test during the walk and turn test Daniela failed to touch Heel To Toe on each step while taking an incorrect number of steps the final exercise was the one leg stand test and Daniela failed to raise her foot in the proper fashion and put her foot down before the test was complete all right so I'm just going to perform a uh standard field sobriety testing on you okay um do you have any medical conditions that would prohibit you from performing the test um don't okay um if you can just take your hands out of your pockets and just place them at your sides for me okay do you wear contacts glasses no no okay do you have any problems with your knees legs back no no no no no okay all right so if you can what you're going to do is you see the tip of the pen here going to shine this above your head so all I need you to do is follow the tip of the your left foot can you can you look towards me you're going to take your left foot and you're going to place it on this yellow line right here you see where it goes here this way no look at me Miss so place your left yep like that okay so you're going to follow this line okay so you're going to take your left foot and you're going to place that on the line so if you can do that for me now hold on hold on no no I didn't tell you to begin anything yet so I'm going to demonstrate the test for you you're going to begin when I tell you to begin okay so take your left foot you're going to place it on this line here do that for me now all right you're going to take your right foot and you're going to place it in front of your left foot touching Heel To Toe just like this okay and you're going to remain in that position until I tell you to begin now I'm going to demonstrate it okay okay so now what you're going to do is you're going to take nine Heel To Toe steps and you're going to count each step out loud okay so it's going to look something like this one 2 3 but you're going to do nine okay when you get to your ninth step you're going to keep your lead foot on the ground you're going to take a series of small steps to turn around and you're going to take an additional nine Heel To Toe steps back okay do you understand okay you can begin the test count your steps all loud 6 7 8 9 1 2 3 4 5 6 sorry 7 8 9 10 okay okay all right now there's one more test okay so just face me keep your arms at your sides again now what you're going to do is you can pick whichever leg of you're the Influence after she was placed under arrest her vehicle was impounded for a 12 hour hold according to John's law okay all right Miss if you can you just turn around going to be placed under arrest
