he's a he's throwing up on Saturday August 20th 2022 officer Katherine fielman with the Athens Clark County Police Department observed a 2021 Toyota raford Drive eastbound through a red light at the intersection of Atlanta Highway and Huntington Road she initiated a traffic stop and the driver pulled over on Atlanta Highway near Jennings Mill Road she made contact with the woman who was driving the vehicle who was identified as 22-year-old Carolyn as she was speaking with Carolyn officer fman detected the odor of alcohol and noticed that her passenger appeared highly intoxicated here go ahead and un loock this back door okay it's cool it's unlocked hey [Music] man all right you need to stand up you're going to choke on your own vomit [Music] hey he he yeah you can step [Music] out hey how are you good how are you good well you ran right through that red light I'm sorry I kind of took it as like AED so I'm sorry I'm trying to get my friend does he need EMS no no no no no he's consuming to shots at Academia brewing and Company where she had worked as a bartender as she was asking her whether she had any open containers her passenger vomited inside the vehicle based on her and then everybody two from downtown back to our workplace and then I agreed to take Kim home because I was the most sober out of everybody and I agreed to take Kim home to make sure he got to a safe place because I live like I have three cats so like I'm my my main priority is getting home to them so like I agreed to take him home to make sure he was safe and okay cuz we all knew he was a little [ __ ] up like we didn't expect him to get this drunk but like worked all day and like he worked a double in the kitchen today and I don't know if he work in a service industry but like I bartended all day today so like me taking care of him is not like a step out of the way to what two shots did you drink uh two lemon drops okay like did you take those shots like it I took one maybe at like 9:20 and I probably took one later after 10 p.m. maybe like 10:30 it even later than that okay but like I went downtown with everybody and I made sure everybody was okay and like we had a designated driver the entire night and like I didn't drink any much past them but like I mean I've been working since like 10:00 today so like I just made sure he was okay and like I was just trying to give him a ride home and I understand that I didn't I I I I literally am new to living here I'm from so like I'm not from here so like this whole like red light situation has kind of gotten me a little messed up so like the whole like double light situation like it's very new to me so like I apologize like I don't really understand like the traffic laws here and it's been a little hard for me to like test during the hgn test officer Cal observed 66 syndicators of impairment the second exercise was the walk- and turn test during the walk- and turn test she did not touch heel tuto on each step and walked backwards as she returned to the starting position the final exercise was the one leg stand test and she did not raise her foot in the proper fashion and put her foot down in the middle of the test before attempting to restart okay when's the last time you took uh this morning at like 10:30 10:30 in the morning yes sir do you have a prescription for it okay all right um I take it like daily mandatory like by my therapist do you wear contacts yes sir do you have those in right now yes sir okay all right do you have any physical impairments that hry you from walking a straight line she was able to call someone else to come and get her passenger because he was unable to drive when officer fielman read the implied consent statement to her she agreed to provide blood samples like I said I'm just trying to get my I'm trying to be the good friend out of the group one I'm justy to [Music] get put your hands together like that that way it's more comfortable okay put your hands like you're [Music] praying what chest did I feel and so it's not a pass or fail test like to know legitimately have not so it's a performance base right so standfield sobriety has Clues okay so we see clues in the eyes that's what it's called horizontal gaze and stagis it's the first thing we did we had six Clues which indicates that you're above the level of legal limit okay all right then you had seven at least have to review the footage and see she had at least seven on the Walking turn which includes missing Hill to toe by more than half an inch which I saw from over here you stopped while walking it was an incorrect walk you even walk backwards all right I didn't walk backwards when I just showed you a second ago did I so this this test is just a way to not account for the people that just work like 10 plus hours it doesn't matter if you walk backwards or you miss it doesn't I I'm just saying I'm just doing a good thing and I'm going to call my dad an attorney that's great I've I I transported her to Pete M Area Regional Medical Center Park to obtain blood samples for testing she was then booked into the Clark County jail and issued the following summonses DOI alcohol less safe for 063 91 A1 reckless driving for 06390 and obedience to Traffic Control devices required for 06 to good go ahead I do [Music] make sure you clear be Carolyn was eventually released pending her initial court appearance on September 12th 2022 an arraignment hearing was scheduled on December 6 2022 her attorney filed for a waiver of formal arraignment and entered a not- guilty plea on December 5th 2020 a hearing was scheduled before judge eelyn Simpson on February 7th 2023 a hearing scheduling a p trial motion from March 15th 2023 was scheduled on February 27th 2023 on March 27th 2023 a calendar call and jury trial was scheduled for June 5th 2023 we're at pedmont why cuz you can send it to giv blood so we're doing blood not this I'm let you know you you well appreciate the warning I me I I'm cry like on May 16th 2023 Carolyn entered the guilty plea to count one in regards to being in physical control of the vehicle a dismissal was filed for counts to N3 DUI and reckless driving respectively while a plea of Nolo cont tender was entered for count for red light violation the memorandum of plea agreement indicates that on May 16th 2023 counts to and3 DUI and reckless driving respectively were dismissed in regards to count one physical control Carolyn was given a sentence that included 12 months of supervised probation 40 hours of community service completion of a DUI risk Reduction Program a Victim Impact Panel within 60 days proof of evaluation and treatment for substance abuse within 30 days and a $1,000 fine she was also fined to $100 for count for this was followed by a notice of revocation suspension that was issued on May 16th 2023 including ining other sear charges the total fines amounted to $2,396 okay it's going to have oh goodness you're good I'm not going to like brast or I'm just it'll be okay [Music] all right let's go I'm so scared just going unfortunately we got to go in do you have any come on like a tissue or anything not on me come on girl
