Um, so what can I do to rectify this with my insurance with you guys? >> Um, so you you got to just, you know, print out a new insurance card and you got to keep it in your car. >> Okay. >> All right. Um, you don't have a like a picture of it on your phone or anything like that? >> I do not. Around 9:31 p.m. on March 18, 2024, patrolman Christian Nelson with the Redbank Police Department observed the driver of a 2023 driving erratically in the vicinity of Globe Court and Mechanic Street. He initiated a traffic stop and made contact with the driver who was identified as Megan Stack. She told him that she was at 71 and that she was driving back home. Patrolman Nelson detected the odor of alcohol and observed multiple open containers inside the vehicle, but she denied consuming any alcohol earlier that evening. I >> I I'll see what I can do. But uh just give me one second. I'll be right back with you. All right. >> All right. Thank you. But uh >> Oh, good. >> I mean, I can I can have her step out. Um, >> I smell um >> I smell it really bad, but she's not really >> slinging or anything. And she said that she didn't have anything to drink. I see a little shooter popping out of her >> center console. >> So, here's what we're going to do. We're going to turn off your front lights. Just activate to the rear. And then what's your name? >> Uh, Megan. >> Megan. Okay. All right. >> Hey, Megan. >> Hi. >> Hi. It's Megan, right? Hi. So, listen. Uh, based on what this officer is telling me, um, he does smell the odor of an alcoholic beverage. Okay. I know you said you didn't have anything, but we want to make sure that you're going to be able to get from right here to wherever you're going. >> It's right down the street. >> Okay, that's fine. But, um, so I'd like for you to zip out. Um, you can leave your stuff in here. Is the car in park? >> Yes. >> Okay. Okay. Yeah. You So, you can Is that your phone wallet? You can leave that in here for now. >> Yep. >> All right. All right. Sweet yourself. Uh getting out. You're good. You're good. Is the door open? Yep. All right. Okay. All right. Um so we're going to walk to over here. I rather us be Oh, right there. curb sidewalk. Yep. I rather us be over here than on the road. Um and again, Megan, you had no alcohol or anything. >> I did earlier. >> You did earlier. Okay. Okay. What What would be earlier for you? Cuz it's around like 9:00 now, I think. Like 2 hours ago. >> Like 2 hours ago. Okay. Okay. What What did you have to drink alcohol- wise 2 hours ago? >> I have cranberry and absolute. >> Cranberry and absolute. Okay. And where did you have >> At home? >> At home. Okay. Okay. All right. Listen. Um I'd like to go through a series of field sobriety tests. Okay. Um again, we want to make sure that you're safe to drive. Um before I begin this test, do you have any recent head injuries, head trauma, anything I should know about? >> No. Nothing at all. Okay. Okay. No medical history I need to know about. >> Based on his suspicion of impairment, patrol woman Grace magi responded to the scene to administer field sobriety exercises. The first exercise was the horizontal gaze nestagmus a hgene and test. The second exercise was the walk and turn test. During the walk and turn test, Megan failed to touch heel to toe on each step and displayed a lack of balance. The final exercise was the one leg stand test and Megan failed to raise her foot in the proper fashion while counting incorrectly. >> No. Okay. All right. So, for this test, what I would like to do is have you take your glasses off. Do you think that you could do that for me? Would you? So, so what we're going to do for this test, you're just going to follow the tip of my pen with your eyes only for the duration of this test. Um, do you think that you would have trouble seeing this pen in front of you? >> No. >> No. Okay. So before we begin, I like you to stand with your feet together and your hands down at your sides. Just like that. Yep. Okay. What we're going to do with your Don't No, not the flashlight. I'm just using this to help me see. Yeah. No, you're all good. So, what I would like to do for this test is have you follow the tip of my pen that you can see in front of your face with your eyes only for the duration of this test. Do you understand my instructions? Okay. We're going to begin. Okay. Again, the tip of my pen. Ready? Don't wait. No, don't move your head. All right. Just your eyes. Just your eyes. Okay. So, hold on. You move your head like a little bit. I know there's like a tendency to want to do that, but just just with your eyes. Okay. Okay. Ready? We're going to begin. So, don't move it. Don't move your head. I know. I know there's a tendency to want to do that, but No, it's okay. It's okay. All right. Ready? We're going to keep going. 464. No. Okay, now move your eyes only. We're going to go up. Okay, just don't move your head. Eyes only. Ready? Okay. All right. So, I'd like to move on to the next couple tests. Okay. Um, the one test is called the You can put on your glasses for this, unless you feel like you don't want to wear them, but just for that test, I wanted you to take your glasses off. But, uh, do you want to put your glasses back on? >> Well, it depends on the test. >> It depends on the test. All right. So, this is going to be called a walk and turn. Okay. Um, as I'm explaining the instructions, what I would like for you to do is take the heel. So, stand right in front of me. No, you're good. You're good. You want to just uh shine your light on my shoes to make it easier. I mean, it's pretty well. No, no, look at me. Look at me. So, face me. So, I'm going to explain the test instructions to you. Okay. What I would like for you to do while I explain the rest of the instructions is stand with the heel of your right foot touching the toes of your left foot and your hands down at your sides. And you're going to maintain this heel to toe position. Uh before we begin, do you have any issues with your legs, feet or hips? Any injuries? Anything I need to know about? No. >> No. Okay. So again, the heel of your right foot touching the toes of your left foot and your hands down at your sides. And you're going to maintain this heel to toe position while I explain the test instructions. Okay. Um do you think you could do that? >> Yeah. Okay. All right. You So no. So face me. Yeah. No. No. It's okay. So face me. Can you Can you get in this position for me? The heel to toe. Do you think you can do that? Yep. Okay. So if you want to stand there, that's fine. Now, I'm going to stand over here cuz I need you to to watch what I'm doing. Okay. Mhm. >> Okay. So, when I tell you to begin, you're going to walk a heel to toe fashion with your arms down at your sides, nine paces forward. And you're going to count each pace out loud. So, it's going to look a little something like this. Ready? 1 2 3 4 until you get to nine. When you get to nine, you're going to take a series of small steps facing back in the other direction >> and repeat the same instructions. Do you understand what I just explained to you? >> I think so. Yeah. >> You think so? Okay. Okay. All right. So, if you're ready, you can begin whenever. >> All right. So, I'm doing 1 2 3 4 5 6 7 8 9. Correct. A series of small steps. Mhm. Uh and then doing the same thing. That's correct. Yep. So it's my right on my left. One 2 3 4 5 6 7 8 9. Okay. Good. Good. So So now we're going to move on to the uh third test which is called the one leg stand. Um, so what I would like for you to do, uh, before we begin is just stand with your feet together and your hands down at your sides. Okay? With the leg of your choosing, I'm going to raise my right. You can raise your left or your right, but for this demonstration, I'm going to raise my right. Okay? I want you to keep your hands down at your sides. And with the leg of your choosing, you're going to raise it approximately 6 in off the ground. While looking at that raised foot, I want you to count out loud in a 1,000 fashion until I tell you to stop. Are Are you with me so far? You understand what I'm telling you to do? Okay. Okay. So, it's going to look a little something like this. 1 1,00 2 100 3 100 4 100 5 100 6 100 until I tell you to stop. Do you do you understand the instructions? Okay. All right. So, you can begin whenever you're ready. >> So, I'm going to do I'm going to do my right foot. Okay. So, like I said, I raised my right foot for the demonstration. You could raise either. Uh, whichever you feel more comfortable doing. >> Okay. My right. >> Okay. All right. So, you can begin whenever you're ready, as long as you understand the instructions. >> Yeah. >> Okay. >> So, you're going to count? >> No, no, no, no. So, so, okay, I I'll say it one more time. So, um, with a leg of your choosing, you're going to raise it approximately 6 in off the ground. Okay. You're going to keep your hands down at your sides and while looking at your own raised foot, I want you to count out loud in a 1,000 fashion until I tell you to stop. >> Okay. >> All right. So, you understand you're you understand the instructions? >> Yeah. >> Okay. All right. So, you can begin whenever you're ready. >> All right. Uh I'm not good on my legs right now, but >> Okay. Why Why are you not good on your legs? >> Uh just cuz of working out and >> Okay. Okay. So, I'll do my right foot. >> Okay. Okay. Whichever you feel more comfortable doing. >> 1 2 100 3 100 4 100 5 100 6 100 7 100 8 100 9 100 8 100 I mean >> Okay. So, it's it's really when I tell you to stop. >> Oh, sorry. >> Yeah. Yeah. So, you want >> It's hurting my hips. It's hurting your hip. Why are you sore? Cuz it working out. Cuz working out. Okay. Okay. All right. You want to You want to try one more time? >> Sure. Okay. Uh 1,00 2 100 3 100 4 100 5 100 6 100 7 100 8 100 9 100 uh 10 100 Okay. Okay. Megan, listen. Listen. Put your hands on the wall. Okay. Okay. Do you have anything on you that you shouldn't have? >> Based on her erratic driving, the odor of alcohol, and her inability to adequately complete the field sobriety exercises, patrol woman magally placed Megan under arrest for driving under the influence. The vehicle that she had been driving was impounded for a mandatory 12hour hold under John's law. She was transported to the Red Bank Police Department for further processing. >> Okay, listen, Megan. You're being placed under arrest for driving while intoxicated. No, no, no, no, no. Don't, don't resist. Don't resist. Put your hands behind your back, Megan. All right. Keep your hands here. Okay. Okay. So, we go on the other side then, right? >> Yeah. >> All right. So, we'll get them. Hold on, Megan. Stop messing around. >> It's okay. No, it's okay.
