I promise. >> So, will you do Phil soiety? >> Yes, if I don't have to do this, please. >> Okay. A3 central. Can I get her up? No, we can see. Get your hands out of your pocket. >> I got you. It's true. >> As long as like the batteries die. Whatever. >> Well, if we turn it off, then the battery is going to die, right? >> We're just waiting for my partner to get here. Okay. >> Yeah. No worries. I guess what's your 20? Stay right there. See if there's a sidewalk there anymore. Here, let's step over here to the sidewalk. How about that? As she was speaking with Lindsay, Officer Barnard detected an odor of alcohol and observed other indicators of impairment. Lindsay admitted to consuming two drinks earlier that evening. Since Officer Barnard suspected that Lindsay was impaired, she was asked to perform field sobriety exercises. However, Lindsay initially refused to perform any field sobriety exercises. However, she eventually did agree to perform the field sobriety exercises. Following the field sobriety exercises, Officer Barnard determined that Lindsay was impaired. >> All right. So, you said that you're good with doing Phil to make sure that you're okay to continue to drive, correct? >> Yes, ma'am. >> Okay. How old are you? >> I was 21. >> You're 21? >> Mhm. Yeah, I'm clear. Do you understand? >> Mhm. >> Okay. >> See it? >> Mhm. >> Okay. >> Hey, Joe, can you get them to cut their lights off, please? Oops. Sorry. >> There you go. Oh, right here. That's just my backup. You got to focus on her. >> Are you good? Right here. >> Yeah, you're good. All right. Do the same thing up and down. Okay. I'm sorry. I'm so nervous. >> There you go. All right. Do you have any like disability that's going to not allow you take nine hill toeups for nine hill toeups back? >> No, ma'am. >> No. Okay. Let's start back here. So, I'll give you some space. All right. Let's go all the way to the >> No, no, no. You're good. Just get in front of it >> and then turn around. Turn around. >> All right. >> There you go. >> All right. So, what I want you to do, I want you to imagine a line coming out your left foot. I want you to place your left foot on that line. Left foot. >> There you go. Then I want you to put your right foot in front of your left foot. Make sure your right heel touches your left toes. >> Right foot touches my left toes. >> Yep. Right heel. >> Make sure touching your left toes. All right, >> you got it. >> Yep. How many paces? >> Shoot. Give me a second. I'm going to demonstrate it. Okay. All right. So, you're going to take nine hill toe steps forward. So, I got you set up just like this. Okay. >> One. >> Hold on. >> You're going to go one, two, all the way to your ninth step. Once you get to your nightst, you're going to leave your lead foot planted. Then, you're going to take a series of small steps to turn around. So, just just like this. Hold on. You're getting ahead of yourself. So, just like that. See how my foot didn't touch the uh come off the ground? Okay. Then you're going to do nine hill toe steps back. >> So, one, two, all the way to your next step. >> Nine. >> Yep. Hold on. I got some things that you need to remember. Okay. I want you to look down at your feet. Count your steps out loud. Make sure your hands are by your side. >> And once you begin the examination, don't stop till you finish. Okay. I demonstrated it and instructed it to you and you stated that you understood it. So, are you finished with the exam? >> Yes. >> Okay. All right. We're going to move on to the next one which is called the one leg stand. All right. >> All right. >> So, I want you to put your feet together, hands by your side, just like this. I don't want you to move from that position till until I tell you otherwise. Do you understand? >> Yes, ma'am. >> Okay. I don't care which foot. You're going to lift it up approximately 6 in off the ground parallel to the ground. So, watch my foot. It's going to look just like this. Begin to count. 1,00 1,002 1,003 until I tell you to stop. Okay. >> Things I want you to remember. Uh, look down at your elevated foot. Make sure your hands are by your side. No bending your legs. So, no nothing like this, anything. Both legs have to be straight. Okay. Do you understand? >> Yes, sir. >> All right. You may begin. Sorry. All right, you're good. All right. So, what the last thing I want you to do was you go like this. >> Based on her traffic infractions, the odor of alcohol, her indicators of impairment, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily perform the field sobriety exercises, Lindsay was placed under arrest for DUI. After placing her under arrest, officer Barnard read her the Georgia implied consent notice at the scene and she agreed to submit to a breath test. >> And then I want you to like an airplane turn around for me. >> All right, >> turn around. >> Okay, >> cool. May I ask why I'm being detained? >> Uh, you're being arrested. Um, so the examinations that I just did and everything leads me to believe that you were under the influence and behind a wheel in operating a vehicle. Okay. All right. So, >> small pause here.
