on May 28th 2023 SLO to Robert Francis Ferguson with the Wildwood Crest Police Department observe the black 20201 Honda Civic failed to stop or yield at the intersection of lotus and New Jersey evue while going westbound he activated his emergency lights and closed the Gap with the vehicle before initiating a traffic stop on the 100 West block of Lotus Avenue as he was approaching the vehicle he observed cafin spray perfume on herself apparently in an attempt to mask the odor of alcohol did you have anything to drink tonight I did have a drink tonight yeah you did how many how many did you have like two two yeah I was going to go pick up my friend he left but yeah yeah um do you have your registration on you at all I do I think I have I think I have like the older one I was looking for for her documents and her hand movements seemed to be slow as she searched for them as SLA de Ferguson was speaking with her he detected the odor of alcohol Catherine admitted to consuming alcohol earlier that evening at kenan's as he returned to his patrol car to check her documents officer Tyler lavender arrived on scene to assist based on his suspicion of impairment SLO to Ferguson asked Catherine to exit the vehicle and performed field sobriety exercises I'm going to see how she is I'm going to ask to stand step out real quick she's all over the place I'm going to ask you to step out get it out of her now she sprayed like herself a lot she's admitting to drinking yes who are you I'm Sergeant sheets with West Police Department we're going to run you through a couple tests okay to make sure you're okay to drive okay all right come forward a little bit there's a big crack right there Sergeant Ryan sheets arrived on scene to administer the field sobriety exercises the first exercise was the horizontal gaze night stagnis hgn test during the hgn test Sergeant sheets observed the lack of smooth Pursuit distinct and sustained NI stagis at maximum deviation and the onset of Ni stagnis prior to 45° the second exercise was the walk- and turn test during the walk and turn test Catherine failed to touch Heel To Toe on each step and turned improperly the final exercise was the oneel leg stand test and Catherine failed to raise her foot in the proper fashion and raised her arms for balance all right first test I'm going to check your eyes all right I just need your feet together your arms relax down at your side okay can you see the tip of my pen yeah can you touch it for me touch the pen yep okay all right you can let go what I want you to do now is follow the tip the Influence her vehicle was impounded for a mandatory 12 hold on the law she was transported by Slo to Ferguson to the Wildwood Crest Police Department for further processing how much have you had to drink tonight like two to three drinks of margaritas and maybe one Shila how long ago maybe an hour ago okay can put can you put Trans on back please your fingers you failed my test okay you're the county at police HQ Catherine was read the standard statement for motor vehicle operators and agreed to submit breath samples for testing her Elco test results indicated a back of zero 0.14% which was almost double the legal limit of 0.08% after they were finished with processing her Catherine was eventually released to a sober adult after he signed the potential liability warrn inform form on her behalf she was issued the following summonses operating Under the Influence and failure to stop or yield my ending is 111 260 [Applause] right come on come this way legs first there you go watch your step see your head just stay right there close the door can come my way do you have anything in the poets or anything my cord records indicate that on August 1st 2023 Catherine was found guilty of operating Under the Influence as a result of being found guilty Catherine was required to spend 12 hours at an intoxicated driver Resource Center you use an ignition interlock device for 7 months and pay a total of $690 in fines the other citation was dismissed as part of a plea agreement come this way keep going straight keep going straight go this way going to make it right here make it
