belonged to her boyfriend but the name on the card did not match the police continued their investigation and discovered that the card belonged to someone named rosn Kimberly's answers to the police's questions were vague making it difficult for them to determine the truth from her statements yeah okay so what I'm going to do is I'm going to invite here your Miranda Rights at the end of understanding want to talk us okay so let me get through all of them and then we'll go from there okay so am I just am I being arrested you're being detained at this point okay so you AR free to leave right to talk to a lawyer no just a rece you have the right to talk to a lawyer and have him or her present with you while you are being questioned if you cannot afford to hire a lawyer one will be appointed to represent you you can decide at any time to exercise these rights and not answer any questions or statements do you understand each of these rights as I explained them to you yes having these rights in mind do you wish to talk to us now sure an officer explained Miranda rights to Kimberly and informed her that she was being detained on suspicion of identity theft Miranda writes right to remain silent you have the right to remain silent anything said can be used against you anything you say can and will be used against you in a court of law right to an attorney you have the right card um it's a has to be a debit card but it's only who who placed the order uh my boyfriend your boyfriend yeah and I was just coming to pick it up after donating okay so who's the the card that's on there it should be um one of ours should be yeah yourss it has to be with him has to be with him yeah so so so let me ask this where do you work at I work Atway which one one right here one right over yeah be be mine it should be yours you should have your name on it yeah I always faite this time you're being under arrest for identity theft the police continued questioning her about the card and she explained that she had only picked up food after ordering through an app at this point the police wanted to confirm whether the card had been used at the store the previous night but Kimberly was uncertain about it the police asked her to describe her own card ultimately the police decided to arrest her for identity theft identity theft and assumption deed an act itata 1998 according to itat identity theft is the use or attempted use of another person's personal information without permission for fraudulent purposes penalty identity theft offenders can face up to 15 years in prison fines and restitution to the victims aggravated identity theft supplemented by the identity theft penalty enhancement act 2004 this crime involved the unauthorized use of another person's identity in the commission of serious offenses such as financial fraud penalty an additional mandatory 2-year prison sentence for the underlying offenses before I uh patch down is there anything on you we'll get to all that don't worry okay um is there anything on you that I need to know about any Contraband what knives weapons oh no any narcotics drugs we should have on okay I just ask if you do have something on you up in you it'll it's an extra charge get to jail do you understand yeah the police asked Kimberly if she had any weapons or illegal substance on her to avoid additional charges when entering jail what do you need from your [Music] car jail okay you can do that when you get up to the jail is there like the only reason I'm saying that it's an internet phone I don't number and he now okay so how about this I can write the phone number down for you so when you get up to jail you'll have it you have your phone you can take all that with you yeah it's and they let you go through your phone to to get phone numbers to make phone [Music] calls so what meanwhile Kimberly requested to call her boyfriend and family to inform them of the situation the police agreed to record the phone number so she could call him upon arriving at the jail the police also explained that if she was honest everything could be resolved more easily finally Kimberly was taken to the pellis county jail for processing the woman was charged with fraudulent use of a credit card and unlawful use of personal identification she was transported to the penis County Jail on February 14th 2024 the charges against her were dropped and the case was closed by judge Susan St John what do you think about the police's decision in this case do you think their action is reasonable and effective enough as a deterrent content you not have a legitimate emergency and you have two standing in front of you let's go Z report you don't touch me I do not want you patting me down the incident occurred on May 26th 2023 when Key West Police received a call from a city employee reporting that Maya Goldsmith had become aggressive arguing and shouting when asked to leave the city restroom the police arrived on the scene and approached the one you got ID honest no you don't no where I'm at because I'm conducting an investigation when asked for ID by the police Goldsmith refused and questioned why she needed to provide identification it was only after the police explained that it was part of an investigation that she handed over her ID though with a challenging and uncooperative attitude what's your name I'm going to report you when I get done give you information that I um my name is we spell the first name please you need to see my ID you ask for my ID right yes I did that's fine talking to me all right ma'am you can lose the you can do what you got to do because I I've already submitted cooperating with the police offers many benefits firstly it helps reduce tension and ensures the safety of both parties cooperation makes the situation processing quicker and more efficient this can help mitigate legal consequences if there is a violation most importantly cooperating with the police is part of civic responsibility helping maintain order security and peace in the community you're not in control here ma'am yes I am so I'm going to tell you right now you can lower your voice I'm take you to jail for disordered conduct provide me a form of identification I don't want a man T me you need to that's not how this works man the police officer warned Goldsmith about disorderly conduct and mentioned that she would be arrested if she continued shouting the officer explained that they were investigating a suspicious incident reported by a city employee and under state law she was required to provide identification during a legitimate investigation Miss GOI what I said was if you continue to yell at me on cond that's what I said I don't need to see that I was standing right here what I said was if you continue to yell at me what I said was I've been recording the entire time what I told you was if you continue to yell at me and try to yell over me that's exactly what I said so I don't want to continue to come in contct I don't care okay I know you don't care I'm here investigating a suspicious incident that was reported by a a city employee and by state law you're required to identify yourself when I'm conducting a legal law the law on disorderly conducting Key West Florida is ulated under Florida statutes section 800 7.03 it includes any act that corrupts public morals outrages public decency affects the peace and quiet of others or engages in brawling or fighting disorderly conduct is classified as a second deegree misdemeanor with potential penalties including fines jail time or probation additionally if the disorderly conduct involves obstructing or disturbing the police the penalty can be more severe right now miss gold smith I'm not accusing you of anything I'm going to give you information to help you stay out of trouble in in the future okay so I'm going to inform you of some city ordinances such as in the city of Key West Key West defines camping a little bit differently than essentially if you have a barrier between yourself and the ground and your personal elements that is camping it does not matter if you're asleep or not if you're caught camping from this point forward you can and will be arrested the police explained the gold Smith that they were not accusing her of anything but wanted to provide information to help her avoid trouble in the future they also informed her about the prohibition on camping within the city of Key West if you walk around anywhere other than the theall street with open container alcohol however if you start acting like an ass on theall street is not a right and lastly after hours all the city parks all the city one of the city parks which you currently standing in Clos at 11:00 p.m. they do not reopen until 700 a.m. the officer contined to explain to goldsmith about the regulations regarding carrying open containers of alcoholic beverages in the city park and Beach closing hours these regulations are in place to ensure City security and require compliance when visiting another city and being informed by the police about local regulations listen and comply immediately the police may explain regulations such as prohibiting open containers of alcohol and park and Beach closing hours if needed ask for further explanation and inquire about any exceptions or special permits note the officer's name and badge number as well as the explained regulations these steps will help you comply with the rules and avoid legal trouble Miss gold smith I need a verbal you I have not yelled at you so don't ask questions this is how I you need to turn around and film the rules and regulations all the parts of City Beach it has all the city ordinances right that are relevant to you right there say what you need to say go ahead ma'am I'm being harassed and stopped by the Poli and I need help that's still disorderly conduct you're trying to involve someone who has nothing to do with this youing handcuffs for diso conduct if you keep trying to involve other people because I'm talking to someone else now the situation escalated when the police asked her to acknowledge the information and she refused to respond the officer continued to warn her but she seemed indifferent and called a friend to complain further escalating the situation as both sides stood firm Miss gold smith here's your identifications will be anotated well that's not very nice that's very rude actually gold smith man is my subject calling 911 okay well hang on cuz you're on the phone with our dispatch so we're just wanting to make sure you're okay what's the problem with us um the officer not wanting to exacerbate the situation returned her ID and let her go however she then called 911 compelling the officers to speak with her again come here miss Goldsmith I'm not going to chase you come here put your phone down put your bag down they're arresting me now put your phone down turn around face the wall you not have a legitimate emergency and you have two standing in front of you let's go so I can stop don't touch me I do not want you patting me down or anything I know how this works okay so if you touch me I'm going to I'm going the two officers decided to arrest Goldsmith for abusing the 911 service but during the arrest she resisted and continually yelled at the police in Florida resisting police officers can lead to the following charges resisting an officer without violence Florida statute section 84 4 3.02 outlines resisting police officers without violence as a first-degree misdemeanor punishable by up to one year in jail or a fine of up to $11,000 resisting an officer with violence Florida statute section 843.svg ree felony punishable by up to five years in prison or a fine of up to $5,000 if you touch me I swear to God I'm going to kick I'm going to fight if you touch me I'm going to fight Miss goldi not tou gold smith there is not miss gold smith stop pushing me Miss gold smith you need to stop I'm not doing anything you're going to jail stop stop you're going to jail in fact you are going to jail I've been in jail I know the procedures you got the right one so you need to call for another officer that is not how this work okay so I did so I'm not giving you permission to touch me that's not how this work but I'm not giving you permission to touch me gold smith you need to stop the situation quickly escalated as Goldsmith resisted arrest she demanded a female officer and refused the requests of the two present officers the police decided to handcuff her but she resisted aggressively St when being arrested by the police stay calm and follow their instructions do not resist or cause a disturbance as this will only worsen the situation and could lead to more severe charges respect and listen to the police's requests and provide basic personal information if asked you have the right to remain silent and request a lawyer it is essential to comply with the law and resolve issues through legal channels rather than through through violent or resistant actions gold smith stop screaming at me damn down and then I got it up cam with you dumy youy take me in [ __ ] I'm ready to let going to jail I know I'm ready I got somewh to L my now you dumb get in this instance despite the police advising her to calm down and avoid causing a public disturbance she continued to shout loudly use obscene language and accuse the officers during the arrest she also bit an officer when I came out of the bathroom there was two police officers waiting at me when I came out of the bathroom okay they asked me could they get my and um and they were going to tell me against the rules of regul the area I complied all of this is on camera is where I recorded all of this too um um Washington DC before I got the time he he did ask me for my identification so as I was walking away I called the police because I wanted to talk to the Sheriff's office because I wanted to talk to the sheriff 911 just for emergency I didn't know that that number to talk to to get the number for I'm not from to get the number to the sheriff so what was wrong with the police office because I felt like I was my my rights were violated correct in a conversation with a supervisor shortly after Goldsmith recounted the incident and said she called 9911 because she felt her rights were being violated her actions clearly constituted misuse of the 911 service the 911 number is intended for handling serious emergency involving safety health or life if you feel your rights are being violated and want to contact authorities seek other methods such as calling the non-emergency place number or seeking help from other public information Channel using 911 for non-emergencies Waste resources and delays responses to actual emergencies all I'm telling you is it's over and done with just go out in and if there's something that I need to do on my end based on what I see on I'll deal with it okay don't get yourself in any more trouble the officer promised to review the video and clarify the situation gold smith was then taken in a patrol car to jail to complete the necessary procedures Goldsmith was arrested on charges including two counts of assault on a law enforcement officer one count of resisting arrest and one count of abusing the 911 emergency number her actions exceeded reasonable boundaries for interacting with the police and violated legal regulation he was trying to see he has a Val he didn't that's why he tried to let me go you need to put his ass in jail he needs to get arrested in the car without complaining I'm saying if he doesn't I'mma make sure his ass is ining jail okay this serves as a clear lesson on the importance of complying with the law and using Emergency Services appropriately the advice for everyone is to always use Emergency Services reasonably and only in truly necessary situations if you encounter issues with the police remain calm follow their instructions and do not resist you have the right to remain silent and request a lawyer to protect your rights cooperating with law enforcement not only helps resolve issues quickly and efficiently but also ensures your safety and the safety of those around you thank you for watching the video I hope this case is has provided you with important legal lessons don't forget to like share and subscribe to the channel for more helpful videos see you in the next video I'm not going M and sit in the cell for hours on top of hours when I've been dropped from them just need your name and birthday how about that the police woke the woman and as a routine procedure asked her for personal information in this situation you have the right to ask the police why they are requesting your information and ID police usually need a valid reason to ask for these details and Georgia law does not require you to provide information unless you are driving or the police suspect you have committing a crime Additionally you have the right to refuse to answer questions and can remain silent until you have a lawyer what do yall want to do y'all just want her gone y'all want her CT or what what you want to do what's her for this of course mind taking her you sure yeah as long as you're good with it we'll do that okay I'm not trying to dump it out on you all right let's do it while trying to identify the woman the situation took a sudden turn when the officers discovered something shocking the woman later identified as Miss Jackson had an arrest warrant from fory County at this point they had to take her to jail an arrest warrant is a legal document issued by a court allowing law enforcement to arrest an individual or search property the purpose of a warrant is to Ure that the arrest or search is conducted lawfully and with a legal basis warrants are typically used when there is enough evidence to indicate that a person has committed a crime or when evidence related to a case needs to be gathered so you do have a warrant for his early conduct okay I know that it's just cond to an officer when he his chest and I know I have a warant but they let me go when I left tombs County after tombs County laid on me kept me for a week I I paid for the civil suit checks I should not be on probation here but you do you still do have that warrant that is active right now you want to transport me I'll take this [ __ ] yes ma'am that's what we're going to do we're going to take you we're going to go meet to jail and sit there and then I'll be the woman did not D having an arrest warrant for disorderly conduct but according to her she had paid the fine and should no longer be on probation according to section 161 139 disorderly conduct a person is considered to be engaging in disorderly conduct if they disturb obstruct or disrupt in a public place by making loud noises or causing annoyance to others acting or speaking in a threatening manner hours when I've been dropped from them charges you're going to have to speak with them they transported me here Magistrate Court said I could not come back like that okay I'm not going to argue with going to call I'm going to find out myself since you won't ask the woman began to show signs of resisting thece relas despite the officer's request to remain calm she continued to act out and became increasingly aggressive in Georgia the law regarding obstructing or hindering Law Enforcement Officers is outlined in Georgia code ss1 61024 according to this a person who knowingly and willfully obstructs or hinders any law enforcement officer in the lawful discharge of their official duties is guilty of of a misdemeanor penalties for a misdemeanor can include a fine of up to $11,000 impr prisonment for up to one year or both if a person knowingly and willfully resists obstructs or opposes any law enforcement officer by using or threatening to use violence they are guilty of a felony penalties for a felony can include imprisonment for 1 to 5 years okay so I'm a first responder I'm a five F I helped y last night for yall to go through it and [ __ ] with me all the time I to have no [Music] already on the ground get on the ground we're not asking I care could have got in we tried to do this put them in the front but you they're not going in the front you got to pull get my [Music] phone here the officers tried to deescalate the situation but the woman refused to listen repeatedly interrupting the officers realizing that persuasion was feudal the officers decided to handcuff her [Music] man I got this I got the left arm we're good got [Music] it I [Music] it became apparent that the woman was resisting forcefully making it difficult for the two officers to subdue her they had to call for additional support from other colleagues to control the situation resisting the police's dangerous and unnecessary when you resist your risk personal safety and legal repercussions police are trained to handle complex situations and may use Force to protect themselves and others instead of resisting you should follow their instructions and remain calm if you feel your rights are being violated you can file a complaint or seek legal assistance later cooperation and respect ensure everyone's [Music] safety you can put her in M like a transporter where's she at where at down here good job yeah she hit hit me she hit you yeah she hit me and you all right don't need to charge we did sweep her you good turn your camera on always yeah my keys in there on the the officer warned that a taser would be used if she did not comply like other states police in Georgia have the right to use tasers according to specific laws and regulations however this must follow certain conditions and procedures to ensure safety and legality according to Georgia Code SS 35826 police are only permitted to use taser completing training and certification prescribed by the Georgia police standards and training Council law enforcement agencies must establish written policies on the use and deployment of tasers before allowing their officers to use them in the case of Georgia V Copeland the Georgia Supreme Court determined that the use of tasers could be considered a form of force depending on the manner and circumstances of their use violating the regulations related to taser use can lead to disciplinary actions including revoking or suspending an officer's taser certification this ensures that taser use is conducted responsibly and safely standing here come on go the other side push her [Music] stand your big ass up [ __ ] take take down what should have S my best friend they should have sent me yeah I would have been in the car with [Music] your eventually after some time the police managed to subdue and restrain the woman she was charged with two count of obstruction two counts of simple battery on a law enforcement officer and one count of interference with government property this incident or scores the importance of complying with police orders resisting not only poses personal safety risk but also leads to severe legal consequences escalating from minor offenses to Serious crimes with heavy prison sentences when arrested staying calm and following police instructions is the right course of action if you feel your rights have been violated ated document everything and seek legal assistance afterward cooperation and respect for the police not only protect your safety but also ensure your rights during the legal process identity the officers tried to explain that they needed her personal information to ensure safety and that if she had no outstanding warrants they would let her go however the woman continued to resist and refus to cooperate the officer also warned her that she could be arrested for obstructing the police but this seemed to have no effect on her according to section 843.svg under the statute restraining her clearly she would not be released due to this behavior and would likely face additional charges including assaulting a police officer in Florida the crime of assaulting a police officer is defined under section 784.03 of the Florida Statutes this law imposes severe penalties for acts of assault battery or causing harm to public officials including police officers yes why are to cause a commotion crying and repeatedly insist insisting on her innocence she constantly struggled and resisted with such intensity that the officers had considerable difficulty getting her into the vehicle despite warnings and attempts to reason with her she continued to scream and obstruct the process of her transport the suspect was charged with trespassing assaulting an officer with violence and battery on an officer this woman is a prime example of overstepping boundaries and we should not follow our actions cooperating with law enforcement is crucial whether you believe you are multiple friends so that's yeah like his name or address or anything where he Liv number phone number it's just I find it odd that like I mean that's $30 that I sping and you just stole it out of my pocket like $30 a I have a my card so from a dispensary yeah absolutely and your license too I know have short hair but that's okay he didn't say he didn't he just said no I just said your license you thought was a sir no I said your license he said license to I heard sah but it's okay oh no he didn't say sir I can assure you I did not have to cover it up the woman explained that she had a legal medical card and used marijuana at night to help her sleep she also mentioned that the culprit could be a friend named Carlos whom she had only known for about a week she then proceeded to show her medical card to the police in Florida individuals can use marijuana for medical purposes as regulated by the for of medical marijuana gation initia amendment to users must have a medical card from a doctor for qualifying conditions like cancer or epilepsy additionally according to Florida statute section 381.986 Mar must be used in limited quantities and cannot be used in public places it's up class done of some sort you have any type of ID um I have my passport kind of works I'm sorry I just have never in my life had someone just literally I know he's ly because it's like I have OCD like everywhere exactly where I put it and okay so long long story short you had your friend Carlos here how how long roughly was you here well he got food he brought me some extra food very nice but then yeah but then like stole my whole entire where was where was your weat at um a jar like right by my socks was it like a bag a jar or I mean I have a little little grinder it was in the grinder like a yellow grinder or something yeah like a blue grinder blue one so all all the marijuana was in the grinder yeah it was already grinded up so like kind of Shish now yeah there's nothing in it okay so he took all the shake out of your grinder basic the woman was cooperative throughout the investigation answering all the police's questions and allowing them to search her room according to Carlos had visited her home brought some food and left afterward it was then that she discovered her marijuana was missing and called the police F I'm sorry about the mess I have all my stuff in hangers toiletries some extra clothes I'm moving in into an apartment probably like I say two days stops very nice yeah I'm excited but right now it's a little messy um I can give it to you and it's nowhere to be found like I've checked underneath the sheets I checked like underneath the toiletry items suitcase golf checked over here there's not there's not a lot over here yeah so do you have Carlos's last name I don't um just have his number yeah that's fine but he's he's like one of those people where like if I can explain this to you he's like very helpful to me but it's like when he doesn't get what he wants he's going to take cuz he I I think he likes me and I don't like him back fully but he took my weed and left and he's acting like he didn't take it and I mean for God's sake if the kid has a [ __ ] key to my apartment I'm a little scared yeah well obviously don't do that one of them was gone and I definitely think he might have took one and I'm a little bit scared again so I might have to go get new ones Goa it remains unclear whether Carlos truly exists but according to the woman he stole the marijuana after failing to achieve his personal goals however her disjointed story and obsession with the theft led the police to suspect she might be paranoid especially after they checked her records and found some concerning details not amazing that all right you had this is here's your medical marijuana card bed thank you and here's your I hope you understand all right I mean since we're standing in here just to make sure uh you have any weapons or anything on you oh God no just my golf bus okay here's your passport back [ __ ] ton of toiletries and some clothes I need to definitely get hang off I'm not going to search or anything well Lily you have a open warrant out of Palm Beach County after I just ran your name so you're being arrested right now okay an open warrant y failure for I think that's failure to appear failure to appear I was told about that and they rescheduled it all right well it's it's open right now so show up well it's right now you you I just confirmed it too and you have it's open right now well why was I told that I don't need to be there I clear that up later but right now you have open warant all right you got nothing on you right there anything you want to take you want to take your phone and your passport can I go to the bathroom real quick no can I ask just told you you have a warrant open out of West Palm Beach all right he just told you what it was for that's fine and we were going to help you out until we found out you yeah but the warrant I was told by my [ __ ] public defender that you want to take your phone and your passport with it's not going to change the warrant is still active Okay it turned out that the woman had an outstanding arrest warrant for failing to appear in court in Palm Beach County although she seemed surprised in explained that her public defender had informed her she didn't need to attend that hearing the police proceeded with their Duty police have the authority to arrest a person if they discover an act of warrant against them this Authority applies Nationwide under Federal and various state laws according to the Fourth Amendment if a valid warrant is issued by a judge or Court the police have the right to arrest the person named in the warrant in Florida under Florida Statutes chapter 9001 an officer can arrest a person with an outstanding warrant without needing a new warrant as long as the original warrant is still active not all right but why are you stopping because I'm trying to figure out something public do you want your phone and your passport or no yeah but we might be able toig you want that to go with you yeah all right so grab her passport can I ask you a quick question before door I have a public defender I've been working can I please continue you can keep talking while we walk though that's not fair he's giving you every OPP give me a second please yeah you are you need to stop I'm not relax you need to stop relax I am relaxing all right I just I just tried to give you your phone all right that's fine come on let's go he's giving you everything I'm trying to get some shoes I just asked you if you wanted shoes and you want to keep pushing against me now the door's locked P door locked not giv me enough patience I'm just a public defender and she said I didn't need to be at that like I told you confused it's my turn to talk okay okay I'm hearing like I told you we need to keep moving along along you can talk when we get to the jail you can call the public defender and if it's all cleared up then you'll be gone but right now we have an open warrant for you because we don't have anything to do with IES County but if it's told that it's open and we confirm it then we have to take it to jail if everything's clear and they made a mistake that's on them not on us okay so we have to go the police decided to arrest her according to the warrant and when she resisted and repeatedly questioned them the officers had to explain the situation she was also informed that she would be allowed to contact a lawyer and address the matter in jail I commend the officer for Patiently explaining everything and performing his duty responsibly can I ask why my public defender said I didn't need to be at I have no clue I'm not finished talking talking while we go the door lock we don't have now listen to me if you keep tensing up and you keep trying to stop then there could be additional charges why do we want to do additional charges there could be no cuz when I'm telling you to listen to me you're not she was taken to jail to resolve the warrant but the actual charges against her remain unclear whether caros truly stole her marijuana is also an open question if you have any additional information about this situation or Carlos please share it with us in the comments below this story highlights the importance of understanding and following the law knowing your legal rights and obligations helps avoid unnecessary trouble it also underscores the need for clarity emotional control and careful
