around 12:27 a.m. on October 21st 2024 patrolman Dan folar Elli with the Princeton Police Department was on patrol on NASA Street near the intersection of University Place he observed a red 2010 Honda CRV following closely behind him and crossing the double yellow lines before eventually passing his vehicle he continued to follow the vehicle as the driver made a left turn onto Mercer Street he eventually initiated a traffic stop as the driver continued onto Mercer Road from Mercer Street and the driver continued to drive for approximately 12200 ft after he activated his emergency lights before pulling into a driveway on Mercer Street patrolman fol car Elli made contact with the driver of the Honda who was identified as 22-year-old litzy hello how are you good how are you good tman FY with the prin you have your Li registration Insurance on you yeah I do okay just you know I have a camera on it's recording I just have to tell everybody yeah that's fine do you live here uh yeah I live on okay so you don't live here then well I guess yeah I'm not here okay why why are we in this driveway in this driveway I just pulled in here okay yeah yeah okay there was a lot of room though before this you passed like a car after I put my lights on and everything okay that's why I asked if you lived here I didn't know if this was your house I didn't know why no not this house yeah so you don't live on not anymore all right uh where you coming from tonight so you're coming from your house okay and where are you heading to now um right now we going to head to okay where is she live um him that she was headed to see her ex-boyfriend she did admit to consuming alcohol earlier that evening before operating a motor vehicle based on his suspicion of impairment poman F Carelli asked her to to perform to simple exercises which would not require exiting the vehicle litu was asked to recite the alphabet from E to T and she did so satisfactorily she was then asked to count backwards from 75 to 49 but she did not do so perfectly okay take your best guess like drink wise or yeah like alcohol like two margarit two margaritas okay what time is that uh what so around maybe like 10: okay so a couple hours ago mhm yeah okay have you had anything to eat since then um no except for like rice and mo I don't know if you know what that is yeah sorry that's okay um all right so you had Margarita so I assume like tequila then okay where was that um at a party on I don't know the exact that I was on M River Road maybe okay River Road so some someone's house mhm okay yeah all right a salon what a salon oh a salon so what's in someone's house okay it was like a they just had like a party yeah it was a family party okay all right um do you know why I stopped you uh no sorry it's okay so a couple reasons um so you were I don't know if you realized but you were behind me on Nassau we were heading westbound okay and so I went to go into the left lane to turn left onto Mercer which is the road that we were just on okay and I couldn't even go in the left lane because you were already flying up into that left lane okay so at some point that means you went into the the other lane the eastbound Lane of Nassau I let you go through exactly yeah so you basically yeah and then even so leading up to that you were following me really really closely and then same thing with the car that was in front of you on Mercer do you remember doing that no okay so yeah you were you were tell getting them close really really close at certain points and then same thing with me on nasol before that so that was the reason for the stop okay okay um all right so based on everything I'm seeing right now I'm going to give you two uh verbal tests okay um I'm going to explain them to you do your best on them if you have questions feel free to ask me we're going to stay in the car for them all right um before we even do that though I'm going to just ask a few preliminary questions all right what's your highest level of Education highest level uh two years in college two years in college okay uh you're familiar with anyl alphabet yeah okay um um all right so for this first test like I said ask questions if you if you have any um for the first test I'm going to just have you recite the alphabet I want you to start at the letter e and end at the letter T and just say each letter consecutively without singing okay you understand those instructions okay so just like e f g h i j k l m o p q r s all right second test I'm going to have you count backwards I want you to start at the number 75 and end at the number 49 do you understand those instructions all right start whenever you're ready5 sorry that's right do you want me to count all the way to one though uh no do you remember what number I said you said just to count down from 15 uh no so I said 75 to 49 but that's okay though we'll we'll conclude that test um all right so how much have you had to drink for real Umar two all right two margaritas one shot was that tequila also so all tequila okay how many shots were in The margaritas actually I wouldn't know how many okay it's like premixed you didn't like drinking veros for yeah a shot 759 Mark the time testing one litzy was then asked to exit the vehicle and perform additional field sobriety exercises patrolman F car ell started with the horizontal gaze nagus hgn test the second exercise was the walk and turn test the third exercise was the oneel leg stand test she did not perform all field sobriety exercises in a satisf Factory Manor uh step out of the car for me we're going to do some more tests can you take my out uh yeah you can put them up on the dashboard just throw them up up on the yeah whatever that's okay all right walk over here for me watch your head over here all right just stand like right here take another few steps forward come like this way a little bit more please thank you perfect oh you're good right there all right um so we're going to do some more tests mhm um I'm going to explain all of them to you I'm going to demonstrate a few of them for you if you have any questions feel free to ask me okay there's no tricks there's no secrets just do your best and uh we'll go from there okay okay all right so for this first test I'm going to be checking your eyes okay it doesn't really have bearing on the test anyway it's just something that we asked in case you have them on it's just going to be something that's noted but so for this first test while I explain it to you and throughout the whole test I'm going to have you get in the ready position all right the ready position for this test is just going to be standing with your feet together your heels touching and your arms down your side it's going to look like this all right Perfect all right so just stay in that position for the entirety of this test you understand those instructions all right perfect all right so like I said for this one we're going to be checking your eyes M all right can you see can you see this tip of the pen here yeah mhm all right so for the duration of this test I want you to follow the tip of this pen with your eyes and your eyes only keep your head still for the entire time okay you understand those instructions all right you can see the tip of the pen correct mhm all right so just follow it with your eyes and your eyes only all right M follow the follow the pen you're not following it okay sorry yeah it's okay mhm all right I'm going to restart keep following it m keep your head still MH all right you're not following it you're not following it can you see it are you yeah I can see it that's the thing how come you're not following it with your eyes not sure but like I can see it with the corner not moving it far enough where you're not going to see it you just got to follow it mhm okay all right we're going to terminate that test um we're going to try the next ones all right so for this it's going to uh require just a little bit of balance and like some walking are you comfortable balancing in those shoes yeah okay before we okay so this first test is going to be the walk and turn test all right again I'm going to explain it to you I'm going to demonstrate it to you if you have questions feel free to ask me all right um while I explain this test to you I'm going to have you get in the ready position for this test okay the ready position for this test is just going to be standing with your right foot directly in front of your left with your right heel touching your left toe it's going to look something like this and your arms are going to be down to your side okay you can get in that position now yep just put your right your right heel on your left toe like right in front of nope no the other way uh yep that's good and then just stay in that position while I explain the test you understand those instructions all right so when I tell you to start the test you're going to take nine steps forward in a straight line connecting Heel To Toe with your arms down to your side looking down to your feet and Counting out loud it'll look something like this one two three I'm just doing three steps of the demonstration you're going to do nine all right on your ninth step you leave your lead foot down on the line and conduct a turn by taking a serious small steps it'll look something like this all right after you complete the turn you're going to take nine more steps in a straight line connecting heel the toe with your arms down to your side looking down at your feet and Counting out loud it'll look something like this one two 3 again I'm doing three for the demonstration you're going to do nine for the actual test um once you start the test don't stop until you complete the test you understand those instructions all right you can start whenever you're ready okay and I turn right uh-huh all right uh second test is going to be the one leg stand all right again I'm going to explain and demonstrate it for you all right so while I explain this test to you I'm going to have you get in the ready position again all right the ready position for this test is just going to be standing with your feet together your heels touching your arms down to your side it's going to look like this all right you understand those instructions all right good just stay like that uh while I explain the test okay you understand those instructions all right perfect uh so when I tell you to start the test you're going to raise whichever foot you feel more comfortable with about 6 in off the ground you're going to keep that foot parallel to the ground both of your legs straight your arms down to your side and you're going to look down to your toe and count out loud it's going to look something like this 1001 1,2,3,4,5 so on and so forth until I tell you to stop the test you understand those instructions okay so you just want me to put my foot up in the air for a couple seconds yep so you're uh you're going to raise whichever foot you feel more comfortable with about 6 in off the ground keep your foot parallel to the ground both of your legs straight your arms down to your side look down to your toe and count out loud it looks like this 1,1 1,2,3,4,5 keep going until I tell you to stop you understand those instructions all right you may begin keep going from where you left off 100 uh keep going from where you left off 23456789 based on her erratic driving the odor of alcohol her admission to consuming alcohol and her inability to satisfactorily complete the field sobriety exercises litzy was placed under arrest for driving Under the Influence after she was placed under arrest and placed in the patrol car her vehicle was impounded for a 12-hour hold according to John's law the trollman fa car Elli transported litzy to the Princeton Police Department for further processing while patrolman run remained uncen until the vehicle could be towed by Lakeside Towing all right you can stop stop all right turn around uh no just turn around for me on your back please all right you're being placed under rest for BWI okay uh yes I believe so all right let's walk over to my car MH all right you can just stand right there okay so I'm going to part of our policy is just searching you um do you have anything sharp on you or anything like that no okay and she agreed to submit breath samples her Alco test results indicated a back level of 0.39% which was nearly double the legal limit of 0.08% after they were finished processing litzy she was released to her ex-boyfriend pending her court appearance he signed the potential shery warning on litzy's behalf patroman F car Ellie issued lzy the following citations operating Under the Influence reckless driving following to closely failure to keep right and failure to update address 753 transport complete ending mileage 4421 14.2
