involving a Nissan minivan on W California Avenue in Beach Park Illinois he arrived on scene and made contact with a 26-year-old female who was identified as Taylor he also made contact with a male who claimed to be Taylor's boyfriend tlor admitted to being the driver of the vehicle that had struck a tree before sustaining severe frontend damages along with a bag deployment okay I just don't want to like go to jail okay do you think you're okay to be driving a car right now no but I can go okay well I don't want to go to jail what did you hit that tree wh which one that one this one here I don't know either do you have your driver's license on you I do but I don't have my I'm not going to lie I have my insurance that just paid this Lo okay am I going to go to jail for that I need your indicators of impairment when he asked her if she had consumed alcohol Taylor admitted to consuming vodka before operating a motor vehicle based on his suspicion of impairment the deputy offered Taylor an opportunity to participate in field sobriety exercises two like an hour ago like within the hour two and a half yeah about what kind of drinks was it vodka vodka okay I just don't want to you have any physical disabilities that would stop you from doing some simple balance tests me uh I smoke weed well besides that a lot of people smoke weed uh you have like any knee injuries from Sports or gymnastics or anything I can't it's not straight I have glasses head injury or me yeah okay what what happened uh but I have a lot of trauma in my head okay physical trauma or mental trauma mental okay my head like doing a sobriety test that's are you able to walk in a straight line normally like if you were walking if I have I have my son yeah but like I can't walk in the straight line probably no okay I don't want to go to jail for it but like no I'm going to be honest like yeah my eyesight you want to give it a you want to give it a try we'll run you through some sprouty test am I going to go to jail well I don't know it'll determine on how well you do on all these tests and what what kind of answers you have to the questions that I ask you I can't walk your straight L okay well why can smell the odor of an alcoholic beverage coming from your breath you admitted that you were drinking some vup prior to dry driving you in physical control of the car am I going to jail can incorrect number of steps the final exercise was the one leg stand test during the one leg stand test Taylor failed to raise her foot in the proper fashion and displayed a lack of balance just come walk forward over the FI walk forward a few steps walk forward a few steps all right right there now stand with your feet together like that hands at your side okay I'm just going to check your eyes in the car are you willing to submit to a portable breath test to see where you're at I believe you're under the influence of alcohol drink yes I have no problem saying that I have had alcohol in my you're at that's all I don't want to go to deal following the field sobriety exercises Deputy Somerville offered Taylor an opportunity to take a preliminary breath test PBT but she refused based on the motor vehicle accident the order of alcohol her admission to consuming alcohol and her inability to adequately perform the field sobriety exercises Deputy Somerville placed Taylor under arrest for driving Under the Influence after she was handcuffed Taylor was placed in Deputy nakanishi's patrol car okay why do I have to go to jail okay here's what's going to happen you go ahead and turn around a ticket place your hands behind your back you are under arrest for DUI okay so go ahead and do that this is not a joke where my K I would hope you would know where your kid is where my dad is this a you are Taylor sat inside the vehicle for a while as the deputies completed some paperwork after the warning to motorist form was read to her Taylor refused to submit breath samples for testing instead of transporting her to the station for processing they decided to release Taylor to her father pending a future court appearance after he arrived on scene what's the point take my ticket I won't drive you guys can impound my car what like what did I do am I going to get like out of these cars like I'm CED for no reason I'm sorry I won't drive my car ever take get [Music] impounded like to the Illinois vehicle code or a driver's license suspension or revocation for violating section 11- 5011 of the Illinois vehicle code except in cases where you submitted to a chemical test dis closing an alcohol concentration of 08 or more or any amount of drug substance or intoxicating compound resulting from the unlawful use or consumption of cannabis is listed in the Cannabis Control Act do I comply yes a controlled substance is listed in the only Controlled Substances Act an intoxicating compound is listed in use of intoxicating compounds act or amphetamine is listed in the methamphetamine control and Community protection act and were subsequently found not guilty of the associated DUI charge considering the above you are warned if you refuse or fail to complete all chemical tests requested and you're a first offender your driving privileges would be suspended for a minimum of 12 months so I me can I pee if you were not hold on if you are not a first offender
