period okay I have mental I have diagnosed anxiety mhm which explains my shaking I get you I understand that but I also don't think you're being very truthful with me about how much you've had to drink being very truthful okay around 1:30 a.m. on December 3rd 2023 officer Noah cam with the Athens Clark County Police observed a 2018 Ford Fiesta and another vehicle run through a stop sign in the vicinity of W Broad Street and old EPS Bridge Road the vehicle later ran a red light at another intersection as the driver continued to follow the other vehicle in front the officer initially thought it may be a road rage incident but he later learned that the driver was following the vehicle in front the driver later identified as 26-year-old Anna pulled into a parking lot and officer cavan made contact with her I'm going to be real with you real quick that was some of the shittiest driving I've seen in a while you ran that stop sign you failed to maintain your lane I don't know what you're doing with that car in front of you and then you blatantly go right through red light how how much how much you you had to drink tonight just be real with me how much two you had two three had three three what since 9 since 9:00 okay what' you drink at 9:00 traa I don't know I can't pronounce it troppa is it out or is it beer no SEL Seltzer okay no rum anything hard like that okay gotcha got your IDE all right um so now second though I thought you were about to get a road rage accident with them that's I'm sorry I was that's my roommate I was following him okay makes a little makes a little bit more sense that's to my roommate I was I was trying to follow him and I'm not trying to sound angry I'm not we've just been having a lot of issues between people like fighting and then getting in cars and then they drive crazy after each other um oh dear no I was just trying to make sure he was safe I'll get you get your ID real quick of course okay um yeah no that's my roomate I was just where I'm just trying to make sure he was safe I get you all right so um the see I I want to do is since you said that you've had some drinks I'd like to do some field sobriety test cuz after seeing your driving I want to make sure that you actually are safe to drive all right all right so if you could just step out for me 10 4 go Sone ready officer cam told Anna that he observed multiple traffic violations as he was speaking with her he detected the odor of alcohol Anna admitted to consuming three drinks earlier that evening based on his suspicion of impairment officer cam asked Anna to exit the vehicle and perform field sobriety exercises in the parking lot give me just one sec all we going to step over here it's a little bit more flatter ground clear log signal one checks okay um so so you had three selters around 9:00 one per hour one per hour um the drink water and you drink water okay I can take all that into consideration uh these tests I'm going to run you through you're okay doing them yes sir okay so they're scientifically proven to be pretty accurate um you can look up the actual statistics behind that it's not the say your ABC's backwards and none of that it's all done through the National Highway uh Traffic Safety standards oh not me this time so um all very accurate test um we're going to contuct four of them we're going to start the eyes and we'll do a walking turn and then one leg stand is that all going to be a fun with you okay um next question did you have anything to eat in between your drinks or while you're drinking okay what did you eat a burger a burger what time did you eat your burger at chicken burger around 99 okay I got you do you wear contacts glasses or anything I wear contacts contacts you have your contacts in okay they shouldn't affect the test but I'll take that into consideration at all you have any injuries head injuries lately any leg injuries back injuries anything that will uh keep you from performing these tests okay I got you so first I'm going to check your eyes um what I want you to do is we got a nice line right here um very flat ground would you agree officer cam started with the horizontal gaze ni stmas hgn test and he observed the lack of smooth Pursuit and distinct and sustained NI stmas at maximum deviation he also observed a lack of convergence the second exercise was the walk and turn test during the walk and turn test Anna did not touch Heel To Toe on each step and turned improperly the third exercise was the one leg stand test and Anna failed to raise her foot in the proper fashion while using her arms for balance officer cam repeated the hgn test once again before determining that she was not safe to drive okay so what I want you to do is treat together hands down your side all right so what I'm going to do is check your eyes what I want you to do is follow the tip of my pen right here with your eyes your eyes only without moving your head do you understand these instructions yes okay okay and during this you can relax you can blink your eyes I do have a stigmatism you get you do yes sir okay um if you don't mind me asking what what causes it genetics genetics okay this eye has a signal stigmatism okay so there's a bunch of different types of nagus um there's like 70 or 80 uh what we look for is a certain one horizontal and vertical nagus um those ones are what are to be proven to be what happens when you're under like depressant um and some other types of drugs and stuff so that shouldn't affect it but like I said I will take that into consider ation you say that to your left eye yes okay got you so once again um just step at tip of my pen with your eyes your eyes only without moving your head do you understand yes sir keep your head still [Music] [Music] okay so for this one I'm going just go down and then up once again with your eyes your eyes are only without moving your head just follow the tip of my pen do you understand yes sir okay feet together hands down by side feet together yep just like that once more okay so for this one I just stay just like that I'm going to make two circles once again follow the tip of my pen with your eyes only without moving your head I'm going to do two circles I'm going to come in towards the bridge of your nose I'm not going to touch your nose it's okay to cross your eyes just keep focusing on the tip of the fen you're fine okay [Music] okay um all right so we'll move on to the next one I like that one more that looks a little bit flatter than what we're on would you agree this is pretty flat but that's very flat yeah or is right here fine with you honestly that was looks more slow than this does does it to you okay that's fine so I want you to just come down to this end right here so for this exercise it's lucky that we do have these lines cuz they can represent an actual straight line for us us have someone imagine a straight line so this works very good for us once again you don't have any leg issues balance issues or anything of the sort yes sir okay so what I want you to do is place your left foot on that line taking your right foot place that heel tail in front of your left foot just like that I'm going move out so I can demonstrate for you all right put your hands down your side and stay in this position until I tell you to begin and do not start until I tell you to begin do you understand yes okay you're going to take nine heel or toe steps counting your steps out loud I'm going to demonstrate 1 2 3 on your ninth step keeping your lead foot planted you'll take a series of small steps around your lead foot they're going to look like this you're going to take nine heel the toe steps back counting them out loud 1 2 3 so on until 9 I did three for the demonstration you're going to do nine while doing this test you're going to keep your hands down at your side you're going to count your steps out loud you're going to be looking at your feet while you're doing this yes sir on your ninth step once again you're going to take series of small steps Take N heel tops back once you start the exercise do not stop until you complete it okay do you understand all these instructions I told you okay whenever you are ready you can go ahead and begin 1 2 3 4 4 5 6 7 8 9 1 2 3 1 2 3 4 5 6 7 8 9 okay do know the two you what the two steps yes okay all right so we're going to do one more exercise okay um this one you're going to choose whichever foot is best for you all right so what I want you to do keep your hands down your side feet together you're going to choose whichever foot you choose you're going to raise it approximately 6 in off the ground it's about the width of a dollar bill you're going to bring that foot up keep your toe pointed forward and you're going to stare at the tip of your toe count your steps wait for that car to pass so I can actually tell you the instructions all right once again you raise that foot approximately 6 in off the ground keeping your leg straight toe pointed forward you're going look the tip of your toe and you're going to count out 1,1 1,2 13 until I tell you to stop you understand these instructions yes sir okay give me just one [Music] second all right ready to begin sir all right you can begin when you're ready okay 2001 2002 up a little bit higher 20034 2005 2006 20078 2009 2010 2011 20124 13 2015 20167 go ahead stop and put the foot down okay I I want you to be real with me you had a little bit more than three right sorry you've had a little bit more than three drinks no sir you've not no okay so there be any reason I would have seen anything different during your test anxiety anxiety okay what are you anxious about I have diagnos okay I get you okay um I'mma be real with you for what I saw in your test I don't think you just had three I think you had a little bit more than that and if it was just three you've had it a lot more recent than what you're telling me no sir okay because I'm seeing clues that indicate that you've had a little bit more than what you're telling me do you have not yes okay so go tell me one more what you had the tree three Tropa I don't know the name of them it's Tropa it's trop I don't and I did this when I ordered them too I don't know the name of it's a Seltzer it's a hard Seltzer and I had great mhm do you had three of them yes okay and you had them at 9:00 all from 9: to 11: I was at the Georgia Theater from 9: to 9 to 11: I had three drinks I know one of the security guards there I had one drink per hour I drank water I'm very anxious I get you so from 11: to now what were you doing at the Georgia Theater okay what would you what time would you estimate it's at right now 12:45 1 okay um so if you left the theater at 11: and if say it's 2:00 now what were what were you doing for that 3 hours walking around downtown Athens walking around downtown Athens weren't drinking downtown Athens just walking around okay I get you I have that nacho stand there one of my friends got nachos okay I get you um okay so if you don't mind so I I'd like to check your eyes just one more time okay um and that can help me make my decision of where we go going opportunity to submit to a portable breath test but she refused officer cam asked her whether she had been arrested for DUI before and Anna admitted that she had previously gotten a DUI when she was 21 when when did you have a DUI when I was 21 okay I'm about to turn 25 21 I was going through a period okay I have mental I have diagnosed anxiety M which explains my shaking I get you I understand that but I also don't think you're being very truthful with me about how much you've had to drink I'm being very truthful okay I don't know how to say them it's too tropical that that's that's fine I I believe it's a Selzer and stuff um I have a portable breath test it's sometimes it's hit Miss for the works it's not something that's not admissable in court anyways it just confirms a suspicion or not mine for some reason sometimes just doesn't want to work at all so uh if you like I can try that um and I I'll make a decision going forward all right cuz I I do believe is that based is your decision no it has not my decision has nothing is based not off that especially with how wonky mine is um to be honest it it's not that it over reads or anything it just sometimes like it doesn't read at all officer what's your name officer quami nice to meet you too um so I mean I've already made a decision but I would like to give you a portable breath test or you want to do that is that your decision that you need that I would like to use it but it's has nothing to do with the decision going forward from here okay well I would like to decline respectfully okay that's fine based on her erratic driving the odor of alcohol her admission to consuming alcohol and her inability to adequately perform the field sobriety exercises Anna was placed under arrest for DUI that is completely fine uh right now I do need you to turn around for Trans behind your back all right you are being placed on arrest for DUI that good right there no sir may the right one be Loos a little bit or no it's chemical tests of your blood breath urine or other bodily substances for the purpose Pur of determining if you under the influence of alcohol or drugs if you refuse this testing your Georgia driver's license or privilege to drive on the highways of this state will be suspended for a minimum period of 1 year your refusal to submit to blood or urine testing may be offered into evidence against you at trial if you submit to testing and the result indicates an alcohol concentration of 8 G or more your Georgia driver's license or privilege to drive on the highways of this state may be suspended for a minimum period of 1 year after first to the requested state test you are entitled to additional chemical test of your blood breath urine or other bodily substances at your own expense and from you know I'm not going to ask you anything else pertaining to the case but I mean feel free to have conversation even though I mean I'm the one taking you to jail like I'm pretty chill I didn't lie like I'm telling you the truth I had those three tall I got you when am I able to call somebody uh when we get to the jail uh we can um you know you've been very respectful and very chill with me so I'll tell you what um is you get your a phone call to jail but I'll let you call someone before we leave that fine okay I got you do you have someone who can come pick up your car so it doesn't sit here till well I guess tomorrow's Sunday I don't know if this place will be open or not my car my car keys are in my pocket okay what is the remedy for that um do you have someone who can come pick it up right now not with a spare key I have the only key in my pocket right now to the car so if I let you out and you can leave it on the tire I don't want to I don't want to do that well if I let you out to call someone cuz we got to wait for that female anyways um call my roommate who I was following home do you think they'd be able to come back and get it I hope so okay we can do that ow dang to see if you're able to get a bond tonight um you said it was you were 21 your last Dy you're 27 now so that' be 6 years um if that like I said don't quote me I know but if that isn't the case then you might be able to get a bond I might be able to get a bond tonight no shot as out a personal recognizance if I have someone to come get me they're literally across the street what do you mean like could be charging with four different things all traffic things in Georgia are misdemeanor I could be charging running that stop sign failure to maintain Lane running that red light and a duy that's the reality of it I'm charging you with two things running a red light and duy so the here's the here's the thing my DUI cop it's one of the main things that I do duys kill people they kill innocent people you have a 25% chance of something good actually coming out di or driving drunk and that's just getting home 25% you're going to kill somebody 25% you're going to kill somebody else or yourself 25% you just get into a wck or a du so 25% is the only chance you have of something good coming from it it's not everybody else's fault that you chose to drink and get in a vehicle that can literally kill somebody and I know I've been to so many people getting hit by cars and stuff lately and losing their lives over stuff that is just just make better decisions I did it right I get you and that's that's the thing sometimes you know it's just taking a little bit extra time yeah but sometimes that doesn't always work you know it's what they teach you yeah but everybody is different it's not a set thing like if I have one drink isn't going to last this long not to mention you said that you drink tall boys that's like almost three drinks in one and if you had three of that those that's almost six drinks six to n drinks so your three drinks ended up being six to n drinks that is why you're in the position you're in now your own decision and it's it's just a selfish thing to do to put other innocent people at risk so no I cannot release you on on good conscious or what what whatever the term is it's just we're a little bit beyond that if it's just traffic citations on us telling the car okay we could but it's just in this situation that we can't right now she's going to search you um do you have any other questions I don't believe I do can I go ahead and take her car you're good to take your car have you had anything to drink no sir okay you can take the car you're going to go Clark County Jail yep Clark County Jail can I bail her out tonight is that going to be just something out of that I need to deal with that to do so I would give the jail a call uh before coming down or anything I'm going to get her uh there they're going to book her in after she's completely booked in they will tell her whether she has a bond or not um that is really up in the air because she's out a previous DUI so it's really just depends on what they say um but give them a call and through the woods yeah they they 100% work cuz they turned right U I was hoping to get both of them to be honest um but she flew up like it was a little bit more distinct how she went through that stop sign and then she was like in the road and then uh we got up to [Music] that light right there and Carl went through he pretty much went through on a red but it was clearly red for her and she just completely went through so I was like oh no we're we're doing this um SMS like alcohol said she had three drinks and uh didn't do two well on field so we're in the position you can smell alcohol couldn't you yeah I smell alol yeah so and then she spontaneously uttered that she had tall boys yeah three tall boys told you can't drink and dry she like okay yeah um and I just don't believe that she was down at downtown and didn't drink I saw four Clues it's that bad her six Clues it it was slight um it may or may not have been there so I'm going to put four that I saw for sure yeah um but her or walking turn three Clues uh lack of convergence man one eye just really yeah both times I did a double check so it it is what it is I appreciate you what's up nothing my mom's phone is dead I got you can I use my cell phone to call I can't let you do that back there who are you trying to call my mom so like she said you'll get a some phone calls at the jail especially if the jail says that you can bond out um you know they're going to try to get you bonded out it's it's a Saturday night after the game like they they don't want you sitting there any longer than you know you need to right yeah we're almost there not much farther I take it you've never been to this jail no sir so I'm ask a question it does not pertain anything to this case at all I want to make that established um CU I've read your rights and you said you do not want to agree to talk to anything about the case this is just curious cuz it it can help you know ter like you know if you get a pond were you jail U when you got your duy was it in Georgia or was it another state I'm I'm sorry when you got your first DUI was it in Georgia or was it in another state I did not get well I'm not saying you were convicted him I haven't seen him we haven't had much history with this guy I think the last name was a probation violation in like October I and there's a chance he probably could have sat here since October factor that's just generally how it is one more in now just remember Anna even when you think that you're okay to drive after drinking most probably about 100% of the people who are drunk and driving think they are okay to drive about 100% of them after Anna was placed under arrest officer cam read her the George implied consent notice but she refused to submit samples of her blood or breath after
