that you impaired driving again impaired driving again yep at 1:24 a.m. on July 15th 2023 officer Andrew perk with the belf Fontan Police Department responded to a report of a driver with a susp ended license who was driving he made contact with the suspect 26-year-old Jade irn in a parking lot near the intersection of in Detroit Street and W sanduski Avenue after he made contact with Jade officer perk noticed signs of impairment he also decided to search the vehicle and noticed that she was in possession of prohibited items based on his suspicion of impairment he offered Jade an opportunity to complete field sobriety exercise how how do you guys keep getting in PA of driving again I I don't know well we got a phone call I think you're lying I'm not I can pull up the call for service for you okay okay that's fine you can do I want you to because I I I didn't I I went to I went to my grandpa's okay okay where is that he lives down here I live down I was down at my grandpa's was I not he called me because he's hurt okay and he's a veteran and he only has one leg and he and he only has one leg okay how long have you been there uh my name's dad and i' I've been there probably I'm an hour boyfriend of her an hour an hour okay okay where were you where were you before that where were I before I wasn't there anywhere before that like before you went to your grandpa's where were you I didn't go anywhere before that she was here I was here you were here okay okay so you uh you haven't been driving around at all no okay so Jade you're aware that your license is suspended right yes okay so why you driving because my grandma needed he know it just a super emergency [Music] superer my mom we didn't have a license my mom a license he shouldn't my grandma can't drive but he's there's nobody here town that can help him but me okay so who is he staying with who is my grandpa staying with yeah he lives alone he I thought he had somebody living with him no he kicked him out a long long time ago okay yeah okay vagrant using them that he he the dude stole like over 400 something dollars from him okay so any idea why we would have somebody call and say that you been driving around after using drugs no no I have family that um I have family that um I used to have a drug problem and I go I go down to TCN and I and I I go through the um mat program okay and I take sub boxing MH and um that's the only thing I take okay and I'm legally allowed to take that okay um so that would be the only reason but um but I'm not impaired okay at all and that's literally the only reason why okay uh when's the last time you use this to boxing um I'm only allowed to have one a day so I take it in the morning okay is it the strip or the pill it's the pill the pill okay all right when was the last time your mom was in the car she had today she asked me to take my grandma to the store she asked you to take your grandma to the store do you have cigarettes in the car I don't no no so where did you get the cigarette that you were smoking when you were right there when I first pulled up in it was on the thing it was on the dash right there and I was just I was just throwing it down on the ground you don't know who those two guys are over there that vehicle I really don't I really don't Jade when's the last time you used any drugs or anything like that um let me see I was pregnant and I relapsed and I went and got help and um so I was on the boxer okay and then um she's saying that it that it wasn't she didn't know about it wasn't next that that it's not hers this or that they are hers though right but is she trying to make me take the blame for it right with you without her in possession of them like it's hard to say that but you know that but you know that you're they hurts yeah but is that going is that going to help anything not at all right it's not going to help anything if I say hey thr her cigarettes right nope not a single bed so what's the what's the what's the protocol for the charge that she'll receive and how she'll what'll happen tonight and what'll be done uh well unless her mom's willing to come out and say yep those are my drugs okay um I'm charging Jade with possession drugs and is that your mom there no grandma mom won't come out here and admit that the cigarettes were hers with the drugs in it they're her cigarettes she left them in my car what's the what's the charge on that it'll be possession of drugs uh what felony mror be felony be felony y and oh my god dude she left him in my car earlier when she when she was in don't about I really don't but you know but you know that there her sa Grandma I didn't even see them I I know they're HS I didn't even see them where they at they have them I they're in my car now what kind of cigarettes are what kind of what kind of hold on they're marbl okay I should put Mar in they're the black marbl no I don't smoke mom does I don't want to tell you so what can she get o right right where you were D I'm going to have you step up like by the by The Garden area there for me all right man the first field sobriety exercise involved the horizontal Gaye night stagis hgn test and officer perk observed the lack of smooth Pursuit distinct and sustained n stagis at maximum deviation and the onset of n stagis prior to 45° he did not observe any vertical gaze ni stagnis vgn afterwards he asked her to perform the walk and turn and one leg stand tests but she claimed that she wasn't able to complete it the second test that she agreed to complete was the modified Romberg balance test where she was asked to estimate the passage of 30 seconds Jade said done instead of stop after 27 seconds the third test was the recitation of the alphabet from sedu which she recited slowly in the correct sequence the final test involved counting backwards from 67 to 49 but she stopped at 50 before asking when she was supposed to stop all right take one step towards me that way you're not leaning on the car okay have you stand with your feet together hands out your sides okay maintain that position while I give you the rest instructions you understand okay okay did you give any recent head injuries yes okay when was that um I fell and had a concussion probably a couple months ago couple months ago okay did you go to the doctor for that or the emergency room um yeah you did okay what did they say um they they told me just um take it easy just U not do nothing heavy okay no hard work no heavy lifting stuff like that they give you timeline on that um no not really okay it wasn't a severe okay concussion okay do you have any issues with your neck back hips knees or ankles yes okay okay is that it everything I listed there no that's about it okay okay what you do is either you can either take your glasses off or you can raise them up whichever one you'd rather do okay I'd rather take them off cuz they're kind of broken okay well I can't kind of see you well that's all right I'll explain all that in just a second go and take them off for me okay okay all right take my glove off that's way that way it's easier for you to see it okay are you able to causes you not having good my my legs your legs yes okay okay so you're not able to walk well it's I have trouble walking especially because of um what I you do is I'm going to have you stand your feet together hands out your feet together then hands out your sides again okay uh what I'm going to have you do okay is I want you to think about how long 30 seconds is okay um what I'm going to do is I'm going to give you three commands I'm going to tell you to close your eyes tilt your head back so you're going to you're looking up at the sky and then begin when I say begin I want you to think of how long 30 seconds is okay okay all right once you feel that those 30 seconds has a laps so when you say begin when I say begin that's when you'll start thinking about how long those 30 seconds are okay once you feel that 30 seconds has has elapsed okay I want you to open your eyes look back down at me and say stop okay okay you understand those instructions okay you understand yes okay so I close my eyes yeah so so when I tell you to You'll close your eyes I'll say tilt your head back so you'll look up at the sky with your eyes closed and I'll say begin okay from the time I say begin okay that's when you'll start thinking about how long those 30 seconds are okay okay once you feel that those 30 seconds has elapsed from the time I say begin you open your eyes look down at me and say stop okay you understand yes okay so go and close your eyes tilt your head back and begin going to keep your head tilted back done okay how long do you think that was 30 30 seconds how did you get nagus okay it's an involuntary jerking of the eyes okay there's only a few things that can cause is that M all right the biggest one being central nervous system depressants okay uh such as like uh anxiety medications um you know like alcohol things like that okay yeah have you been drinking it all today no no okay no I'll do it Breer for you okay um do you take any any like anxiety medications or anything like that I have before when when did you take before um they gave them to me um when um when I when I go down to TCN okay so when is the last time you took your took the medication um they those me down there so my last um appointment was um I believe it was Monday Monday is there reason your speech is slow slurred kind of raspy no no okay do you want if I check something else with your eyes what do you want to check um if you would just take your glasses off for me yeah okay then I'll just have you just look right at my you see my microphone here yes I'll just have you look right at that okay okay is there any reason your your pupils are di or constricted constricted really small um no no okay you can put your glasses back on okay J do you have anything illegal on you no I don't no okay the reason I asked okay is because you are under arrest for possession of drugs okay and I'm going to be taking you out to the jail okay when you get there they're going to put you through a body scan okay okay I ask now because if you're found with something else on your person in the jail that's an additional fenal okay so do you have anything else on you right now that I need to know about no based on the witness report her indicators of impairment her inability to complete the field sub y tests and her being in possession of illegal items Jade was placed under arrest for operating a vehicle impaired over an transported to the Logan County jail for further processing at the jail officer perk read her BMV form to th to 155 Jade ultimately refused to provide a urine sample she was issued the following charges possession of controlled substance operating a vehicle impaired oie and driving under the suspension now's refusal go and turn around the TR find your back Pals together like you're praying Palms together like you're praying dere go and stay back for me boss okay just hang out one second want release your hands goe and release your hands release your
