I'm just past the mittnik school how are you license registration Insurance please I'm good right now around 11:30 to p.m. on August 9th 2023 Sergeant William Barkus with the lower Township Police Department observed the driver of a 2015 Jeep Renegade speeding excessively at 60 MPH and a 40 mph Zone on Town Bank Road the Jeep also struck the curb while being driven in an erratic manner Sergeant Barkus initiated a traffic stop in the vicinity of the seashore Road Bridge the driver was identified as 24-year-old Ava and Sergeant Barkus told her that she was driving like a lunatic I'm sorry I don't where are you coming from man I'm coming from North K May okay where at North Cape May um right you just swerved on camera you just swerved and you had to squeak your brakes because you almost went over the curb and you probably would have killed yourself cuz you're driving like an absolute lunatic right now I'm sorry have you been drinking tonight I was earlier yes okay I will not lie um I'm sorry here is my I'm sorry I have a lot of stuff my no problem okay registration and my license is in my phone thank you thank you how much have you had to drink tonight I had two drinks earlier fast that she loses it hits the curb and like then realizes and swerves back and like locks up the brakes and starts fing like fish tail and she was she was trying to gun I don't know I don't think she was trying to run from me I just think she's I mean she's moving huh in a hurry she's in a hurry you want to do me a favor B her out please because she's I I said where you comeing from I North K may I had two drinks at dinner but then I said where you haded Kate may I said we nowhere in particular go drive around Kate May at 60 MPH a lot of people out driving retardedly that's two I had almost 70 and a 40 to twice tonight she was 68 other one was 68 only I don't like with balance test is we're on the hill there I get it I mean we can that's new yeah he put that in after somebody's kid almost ran over his kids I really they think was like a cut through somebody's kid I mean we can transport her right back down here right right back you know right at the base of the down further if you want obviously we don't want to do it up here that's even steeper I only stopped her here it's not the ideal spot but I thought she was either taken off from me or she was going to wreck and go off the bridge Ava admitted to consuming alcohol before operating a motor vehicle Sergeant Barkus returned to his his patrol car to check her documents patrolman Louis bartleson arrived on scene around 11:36 p.m. to assist based on the officer's suspicion of impairment Ava was asked to exit the vehicle and perform field sobriety exercises hi ma'am I'm officer bson uh Sergeant Vargas who's my supervisor so um he asked me to uh ask you to come out and do some fields of ridy testing real quick okay you said you had a couple drinks tonight I did yeah okay I just want to make sure I have some drinks with um my mom we have one after dinner okay yeah I just want to make sure you're safe to drive all right so we're going to walk back to uh back behind the other police cars so we're not we're on like the hill of the bridge so for the purpose of balance testing I don't want to be on the steepest part of the the bridge where do you need me to go we're just going to walk back have heels on too so I don't walk well on Heels okay we uh if you want you have the option I'll let you take them off and you can do it Barefoot um it's just some balance testing and I'm going to do I'm going to uh just check your eyes for some ticks and stuff like that and I mean as long as you didn't have too many drinks we'll get you out of here okay okay um so we're just going to walk back to between this car and the next car and like I said everything's on camera just so you're aware so go ahead and just walk back that way toward between the cars okay pulling out okay all right so we'll stop in between these two cars right here ma'am ma'am we're going to stop between these two cars I know it's still a little bit of a hill um you do you want to take your uh well actually we're going to once horizontal gaze nagus hgn test the second exercise was the walk and turn test during the walk and turn test Ava failed to touch Heel To Toe on each step and turned improperly the final exercise was the one like stand test and Ava failed to raise her foot in the proper fashion and displayed a lack of balance so I'm going to use my smaller flashlight so I don't blind you like a just blinding myself all right do you have um can you remove your glasses yeah even if you have like significant Vision issues yeah I need to wear glasses to drive but the the glasses won't affect the test that I'm going to do so what I'm going to do is I'm going to hold my pen up and I'm going to hold I want you to follow the pen I'm going to try not to shine this directly in your eyes can you see the tip of my pen okay yes I'm going to can you is is your I know that one strain of ha it's just a bang okay so I'm going to move my pen from side to side okay when I move my pen from from side to side I want you to turn move your eyes and your eyes only don't turn your head keep your head straight pointed towards me okay mhm so just I'm going to move it from side to side I'm going to hold it Center I'm going to hold it out at one side just follow with your eyes and your eyes only understand that M [Music] okay okay got lack of smooth Pursuit just focus on the pen okay no resting the stagos I'm just making to do balance um so I going to do what I'm going to have you do is stand in the starting position you're going to put your arms down at your sides like they are and your heels together your feet together with your heels together at you can choose either foot that you wish you're going to raise that foot approximately 6 Ines off the ground okay you're going to keep your eye on the raised foot and you're going to count out loud 1,1 1,2 13 and so on until I tell you to stop okay again you can choose either foot I'm going to demonstrate so you see what the test is supposed to be okay so you're going to raise one foot 1001 10002 1003 1004 1005 and so on until I tell you to stop okay you understand the instructions yes sir okay you may begin whenever you're ready okay 1001 1002 13 I'm doing I'm going to demonstrate we're just going to imagine that there is a line here would you agree that this area is free of debris there's nothing you're going to trip on no sticks or stems or anything like that so you're going to put your left foot on the imaginary line and you're going to put your right foot in front of it touching Heel To Toe this is where the unevenness of the bridge is going to come into a factor so I'm you know I I'm going to put that I'm going to put that into Factor okay so you're going to keep your arms down to your side just like before and your feet will be like this you're going to take nine not 10 nine Heel To Toe steps okay okay when you reach the ninth step you're going to do you're going to turn around and walk nine steps back to your starting position okay I'm going to demonstrate I'm going to do three steps you're going to do nine okay so it's Heel To Toe one heel to toe two Heel To Toe three and then small steps and then Heel To Toe one heel to toe two Heel To Toe three do you understand those instructions yes sir all right you can begin yep all right the bridge makes it very difficult um put shoes back on yeah yeah you want to go balance test but the hdn the eyeball test you you know you're significantly impaired the the tracking of your eyes when I was again talking to my camera your eyes when you're not impaired your eyes mooved fluidly and smoothly and yours were ticking and that's an indication of impairment based on her erratic driving the odor of alcohol her admission to consuming alcohol before driving and her inab ility to adequately complete the field sobriety exercises patrolman barlon placed Ava under arrest for driving Under the Influence her vehicle was impounded for a mandatory 12-hour hold under John's law she was transported to the lower Township Police Department for further processing so at this time I have to place you under arrest okay for DUI all right so it's a policy that I handcuffed you behind your back um I'm going to take you to lower you're not going to jail or anything it's not the end of the world so I have to handcuff you behind your back and I'm going to place you in the rear of my vehicle and transport you okay okay all right so if you put your palms together like your palms facing together it's okay I I understand it's you know I'm going to put this below can you raise your hands away from your rearend I I just don't want to touch you like that I'm just trying to no like I'm going to here no no no you're it's okay I just don't want to mess up your watch and I'm not trying to you know you need out of your vehicle like a like a purse pocket book your cell phone my um because your car be told your car is going to be towed it has to be towed by law um my well we can walk you up there you can show us what we can grab it for you I just don't want to mess up your Camilla bracelet or whatever now I'm trying not to bite you if you turn your hands in like the standard statement from motor vehicle operators and agreed to submit breath samples for testing her Alco test results indicated a back of 0.19% which was more than double the legal limit of 0.08% after the officers were finished with their paperwork a eventually released to her feather after he signed the potential Sherl warning form on aa's behalf she was issued the following summonses operating Under the Influence reckless driving speed and failure to maintain Lane all right you can step out we're going to walk around the front of the car cuz we're kind of close to a barrier used to have go to that door follow right I'm going to go straight through all right I'm going to take those handcuffs off you and then you're going to have I'm going to have you have a seat on that blue bench okay yeah firm did I give you my ending stand by one I got to go back out my vehicle yeah you can have a seat on the on the blue b it is policy everything's on camera in here it is policy that uh you just lay your wrist in there but I would put it down here so it's in the small oh all right oh sure whatever is more comfortable for you the smaller part's usually more comfortable yeah I'm you're not going to jail it's not the end of the world this the penalty these for DUI have significantly reduced over the last several years but you know you just want to make sure you're safe and barcas um she was doing 68 on Town Bank Road he spun around by the time he stopped her she was already burning up the bridge he lit her up he hit the Curve she's a 1 n um so and she's been I got to tell you aside from the DUI she's been the most polite respectful responsible person that I've ever placed under arrest you know yes sir no sir like you did a good job you know raising a good girl at least that way um you know what I mean it's it's a learning experience it sucks um I will say I already called her um Murphy has significantly reduced the penalties for DUIs so since she has a job and everything they'll more than likely just give her an interlock I can't promise you anything but you know they'll be fines and whatever else but she probably will not lose her license because of the fact that she has a job and everything else so um I explained to your wife I don't know if she already so so this is um for a potential liability for John's law so she's not allowed to drive again until like 11:30 in the morning it's 12 hours from the time that she was arrested um her car was towed I got to find out where who towed it I I'll find out when I go back in get her um so you just I need you to sign just saying that you're not going to allow her to drive for a minimum of 12 hours that's all this is and uh if you want to read it you can I'll give you a copy if you want once you sign it and then uh I'll bring her out and just turn her over to your custody and um like I said she's been awesome you I I I feel terrible that we had to do this but you know she was going to hurt herself or someone else so that's why she's wound up here all right all right like I said long and a short of it this is all basically just um your I'm telling you not to let her drive because she's been charged with you know a DUI so um I just need you to sign there and date and time on that line please to it's the 10th now is it 10 10th now yep and it's 1:18 a.m. like I said I'll burn you a cor records indicate that on October 3rd 2023 AA was found guilty of operating under the influence as a result of being found guilty Ava's license was revoked for 4 months and she had to use an ignition in herlock device for 9 months spend 12 hours at an intoxicated driver resource center and pay a total of $690 in fines the other three citations were dismissed as part of a plea agreement
