here in October okay around 3:51 a.m. on May 18th 2024 officer Samantha Pickering with the Verona Police Department observed a black 2019 Honda CRV traveling west at approximately 40 mph and a 25 mph Zone on East Verona Avenue in the vicinity of Lincoln Street she made a u-turn and activated her emergency lights to initiate a traffic stop and the driver pulled over on East Verona Avenue near Gilman Street she made contact with the driver who was identified as Bethany and asked her where she was coming from and where she was headed Bethany told officer Pickering that she had gone out in Madison earlier that evening and that she was headed home have you ever gone downtown and gone home from there before not often though okay do you know what city you're in currently yes I mean this is when she was asked where she was Bethany told the officer that she was in Madison even though she happened to be in Verona as she was speaking with Bethany officer Pickering detected the odor of alcohol and observed other indicators of impairment she asked Bethany how much she had to drink and Bethany admitted to drinking a white claw earlier that evening she returned to her patrol car to run her information through the system and based on her suspicion of impairment she asked Bethany to perform field sobriety exercises B can you step by a car for me please yes you can close your door let's come back here so we're out of traffic are you aware your registration is also expired um oh it was not yeah some people just don't have the current sticker but yeah yours expired in October of nagus hgn test during the hgn test officer Pickering observed the lack of smooth Pursuit distinct and sustained NI stagnis at maximum deviation and the onset of nagus prior to 45° she did not observe vertical nagus in either eye the second exercise was the walk and turn test and Bethany failed to touch heel Tut toe on each step failed to turn as instructed and walked backwards as she attempted to return to the starting position the final field sobriety exercise was the one leg stand test during the oneel leg stand test Bethany failed to raise her foot in the proper fashion while displaying a lack of balance do you have somewhere you can put your glasses I just don't want them to tuck in your pocket just so you don't have to hold them that's fine or even if you tuck them in your pants need you to to do is pretend there's an imaginary straight line that goes from you to the front of my car okay take your left foot oh here we'll go back just so you're at the center just to give yourself space take your left foot put it on that line take your right foot put it in front of your left foot with your heel touching your toe put your arms flat against your sides stay in that position until instructed otherwise do you understand when instructed to do so you're going to take nine Heel To Toe steps down that line on the ninth step you're going to keep your lead foot on the ground take a series of small steps to turn and take nine Heel To Toe steps back down that line it's going to look like this okay one are you watching me yeah I'll demonstrate it okay okay just straight down the line right you can use this line yes so it's going to look like this one two three keep your lead foot on the ground take a series of small steps to turn one 2 3 I took three steps raised you're going to count in this fashion 1,1 1,002 13 so on and so forth until I tell you to stop it's going to look like this 1,1 1,2 13 so on and so forth my foot's approximately 6 in off the ground and parallel to the ground while you're completing this look at your raised foot keep your arms flat against your sides and keep both legs straight okay do you have any questions no do you preliminary breath test BBT and the results indicated a back of 0.1 for 6% Bas on her erratic driving her indicators of impairment her admission to consuming alcohol her inability to perform the field sobriety tests adequately and the results of the PBT indicating that she was over the legal limit Bethany was placed under arrest for operating while intoxicated OE I mean I don't know the legal limit I just had a w CL earlier that's all I did okay you're at a point4 146 so you're under arrest for operating while Under the Influence 6741 1095 earlier I don't I don't understand do you have anything on you can I search you you can yes okay I'm going to go this way we'll stop right here for a minute I'm just going to put on some gloves nothing that's going to poke me or anything no I see doesn't look like you have anything I just always ask anything in your car no can we search your car so it looks like this would be a first offense for you yes so with that being said as long as you have somebody that is 18 completely sober drugs and alcohol they can come pick you up tonight and you can go home do you think you have somebody yes okay yeah I can yeah what do you need from your car I question okay under Wisconsin's implied consent law I'm required to read this notice to you you've either been arrested for an offense that involves driving or operating a motor vehicle while under the influence of alcohol or drugs or both or you're the operator of a vehicle that was involved in an accident that caused the death of great bodily harm to or substantial bodily harm to a person or you're suspected of driving or being on duty time with respect to a commercial motor vehicle after after consuming and intoxicating beverage this law enforcement agency now wants to test one or more samples of your breath blood or urine to determine the concentration of alcohol or drugs in your system if any Test shows more alcohol in your system than the law permits while driving your operating privilege will be suspended if you refuse to take any test that this agency requests your operating privilege will be revoked and you'll be subject to other penalties the test results are the fact that you refuse testing can be used against you in court if you take all the requested tests you may choose to take further test you may take the alternative test at this law enforcement agency provides free of charge you also may have a test conducted by a qualified person of your choice at your expense you however will have to make your own arrangements for that test if you have a commercial driver's license or operating a commercial motor vehicle other consequences may result from positive test results or from refusing testing such as being placed out of service or disqualified in addition your operating privileges will also be suspended if a detectable amount of a restricted controlled substance is in your blood will you submit to an evidentiary chemical test of your breath I mean I'll I'll cooperate with you guys I just I don't I'm just tired I just want to go home I was broken up with I'm just sad I I know you're having a rough night but it's a I just foran she agreed to submit breath samples for test ing Bethany was subsequently transported to the Verona Police Department for further processing her intoximeter results indicated ABAC of .15 G to one o of breath after they finished processing her she was released to a friend pending a court appearance in the Verona Municipal Court on July 17th 2020 for after they took responsibility for her she was issued the following citations operating while intoxicated first operating with prohibited alcohol concentration greater than 0.15 exceeding speed zones Etc 1115 mph and non-registration of
