her [Applause] [Applause] okay she's comfortable was that that I see no anyway this is Jasmine in the early hours of New Year's Day 2023 officer Paris observed a 2013 Chevrolet driving erratically on Route 47 southbound eventually the vehicle stopped near the intersection with West Elmer Road upon approaching the vehicle officer per has noticed that the occupant in the vehic vehicle was the same person who had been arrested for another DWI less than 2 weeks earlier on December 22nd 2022 now it was apparent that the unlicensed driver identified as yakan Lopez Lopez was going to be ringing in the new year with a new DWI me shut the car off for me vehicle did stop right up from I have it stop now one female shut the car off me everybody no we have htn available everybody start slowing down one shot you're good we me choke on me I need hdn yeah yep you guys can clear yep I just need one just one more just one more run it's fine let go in one of you guys you doing you're working on the 10 yeah Jaz me was recently arrested for 450 the other day why I'm driving down south on Deli she pulls out of Tequila's lot were you the one wearing the paj pants the other day speak Spanish on oh okay come swings a wide turn I start slowing my car down she's coming head at me I don't want to say a few inches maybe almost hit my car turn around and she pulls right over but she was driving on the opposite side of the road get over in the ready up can you stand straight up for me okay stand straight up some high high heel so I to she had him in the trunk you already work on something no I was uh I was Happ the with his 450 doing the rest stuff for him but I'm picking Up's doing okay Officer Lopez called for backup units to administer field sobriety tasks officer Rosa arrived shortly thereafter and started with the horizontal gaze nagus hgn test officer Lopez translated for officer Rosa since Lopez Lopez was not fluent in English the hgn test was followed by the walk and turn test involving Heel To Toe steps in both directions after starting the walk and turn test Lopez Lopez was unable to complete them satisfactorily first thing do check her eyes all right I'm going to lift my p face when I when I begin to Move It I want her to follow with her eyes and her eyes only understand anyway as why not this okay so she wears glasses or contact contacts no she can still do the test even if she don't have her glasses she's got to follow see okay before I start to test does you have any issues with see or no yeah [Music] okay she needs glasses to read and I explained to her that you don't need glasses for this test it's just moving of your eyes Okay okay so to put her feet together for I'm sorry she's not she's not walking for this yet okay [Applause] okay okay no no no no there's a straight path right over here okay that's a little bit safer I don't know okay ah so she had no issues with her legs right no okay all right first we do is walk your turn S you okay tell her I want her her uh to act like there's an imaginary straight line right here okay understand all right first thing we're going to do is put her in the starting position look at me okay try to put her left foot out [Applause] out I want her to put her right foot front of her left foot touching Heel To Toe it doesn't matter right that by side okay can she do the test are you willing to do the test or are you drunk okay I I see I [Applause] see right foot in front of left touching Heel To Toe right foot one yeah there we go okay all right all my side I'm going to explain the rest okay look at me I tell her to begin okay I want her to take nine steps on that imaginary line okay okay [Applause] for okay tell demonstrate when I say begin un until she gets to n she get to 9 I want to go count turn counterclockwise to your left to your left that okay n HS to [Applause] step she's like and if I can't do it I told her just do the best you can okay all right for this test we're just going to go through the points okay okay so it's going to be nine Heel To Toe steps I want her looking down at her feet counting out loud for okay she understands there no questions right all right she may get she's ready okay you drunk based on her erratic driving and her failure to adequately perform the field sobriety exercises Lopez Lopez was placed under arrest for driving Under the Influence she was subsequently brought to the station where she refused to take the breathalizer test we have one under [Applause] [Applause] 450 Lal came to jump from unther out getting [Music] further over there all
