So, there's no way that you can you can 100% look me in the eyes and say, "Yep, those are those guys that are sleeping somewhere over there." And let's be honest, Westgate is a really long way from 45th and Congress. They're not going to go burglarize something over here if they're homeless and then walk all the way from Westgate all the way over here. Cuz we're cuz we're talking Cherry and Military around there. So, now 45th Street and Congress. There's just no way. I I can go over there and see if they're if they're wearing the exact same outfit, but they're not. I can guarantee that cuz you've already been over there, correct? Okay. Were you across the street just doing a banking transaction and that's what you thought you saw? How did you know to come here? So, this was third-party information from one of your workers that thinks he saw the people that were in the store and then he communicated to you and then you came over here? Okay, that's not enough, sir. I'm sorry. Okay? Do you need anything else from us? Okay. All right. Okay, listen, okay? I've explained this to you numerous times, okay? Hold on. Cuz now you lied to me now two times, okay? while violence or nothing. Hey, listen. Is that Is that a That's a firearm, okay? So, here's my thing and I and I know what happened, okay? I I I know you. May I please talk to you? Cuz you you claiming you know me and I I don't know you at all. I never met you a day in my life. The name I told you, Washington, I know him, but I don't know you. Can you stop Right here. I'm You're staying over here. You're a little too close. Can you stop yanking me? Cuz shut up right now and listen to his line of questioning. You cannot provide me any kind of D license that means you're a security guard and that you can carry a firearm. If not, you're not allowed to wear a security security guard shirt while in possession of a firearm. Do you understand? Yes, sir. Why'd you stance? Like this? My stance is wide. Thank you. Hang on one second. [Applause] Yep. Huh? Yeah, what is it? What's that? Uh why are you brushing What? What did you say? This like what is the problem of like I work at a night club. I have not did anything wrong. The night club owner hired me. You're under arrest for right now. I I told him I don't have license. I told him that. He still wanted me to work because he said of my demeanor. And like I've been I've been doing great. I've been doing good. Whatever he's talking about, that is so long. I don't remember half of this half of the [ __ ] that I have done. All I know is I I've been working every since. I'm brother 10-47 5094. With nothing. I worked at numerous jobs and I have not Hello. Sir. Yes, what is it? What is it? Huh? What is it? What are you saying? You weren't even asking me a question. Yes, I'm trying You said you had a question and then you just made a big statement. Because I I was helping someone why did why did your partner started being rude and nasty to me? For what? I wasn't being rude or nothing. You know what I mean? Well, he's conducting an investigation. Huh? He's making sure you either are A who you are or B you are not who you think you may be. Like I have not I have not committed no crimes, no nothing. Can I ask you a question and make you hop? Huh? You hop? No. You hop? No. I'm not. Probably did. Because I I I went to the bank, right? Right over there. The try to uh deposit some money. But I don't have my real I didn't have my real photo card. So I was walking to the bus bench right there with my cup of coffee. A a store owner flag him and two other people were flagging me down. Okay. And I was helping him. And I I I saw I saw this officer right here with the hat. I seen him when he was about to turn into where our partner I flagged him down for for them to try to help the young man out. What is the problem that I'm in handcuffs? I'm just getting off work my me and my girlfriend been arguing fighting for 3 weeks. I'm I was getting all ready ready to get on the bus. You don't understand why you're in handcuffs? Like Blanco, can I answer your question like this? >> You just did and I gave you the answer. Do you have another question? Because if you're going to ask me again what I did wrong, then we're just going to keep going back and forth cuz you're not going to believe me when I tell you what you're actually doing wrong if you can't logically think and connect the dots like I said. >> the thing is that officer right there saying oh I I used to hang this and that. I never used to hang nowhere except downtown at the night clubs at night. >> Okay. Drink and I go home. Okay. And he's saying I used to hang out on Dixie and all that. No, I have not. The one standing 5 ft from me, okay? But at this time he is clearly conducting his investigation. He's not going to stop what he's doing to come answer your useless question. It's not useless. Yes, it is cuz I gave you the answer that you're looking for and apparently that's not enough. >> Yeah, but you don't have to be hostile. >> I'm not being hostile. I'm trying to close the door so we can so I can continue helping my partner out and I'm wasting time talking to you and that's incredibly frustrating. May I close the door now? [Applause] [Music] Mr. Patrick. All right. So, since you claimed several times that we didn't give you a chance to speak and tell your side of story, okay? I'm going to read you your rights before I talk to you. I want to make a phone call first. Okay. Uh That's fine. Let me read you your rights, okay? You have the right to remain silent and not answer any questions. Do you understand? Okay. You have the right to the presence of a lawyer of your choice before you make any statements and during any questioning. Do you understand? If you cannot afford a lawyer, you're entitled to the presence of a court-appointed lawyer before you make any statements and during any questioning. Do you understand? Any statement can and may be used against you in the court of law. Do you understand? Yeah. Any statement made must be freely and voluntarily given. Do you understand? Yeah. If at any time during the interview, you do not wish to answer any questions, you're privileged to remain silent. Do you understand? I can make no threats or promises to induce you to make a statement. This must be of your own free will. Do you understand? Okay. Do you know why you are under arrest today? Okay. You're being placed under arrest for several charges, okay? Some of them being uh impersonating a security officer, um felon in possession of a firearm. Uh What else do we got, Josh? What else What other charges do we got? Uh felon in possession, um stolen property, giving a false ID, and impersonating a security guard. Okay. And uh giving a false identification cuz you lied about your name. So, with that being said, do you want to tell me what's going on today? Let's start from the very beginning. You said you got off of work, right? Okay. Where do you work? I have two different jobs. I do I work at the Rabbits as a security and I work at a strip club as a security. Okay. So, and they the they Rabbits, they don't ask for a security license. The night club I work at, they don't ask for that either. Okay. Both separately said they don't ask for a license. They just want people good people to work there. I told them my background. I told them everything. They said that don't matter if you are a good person and you can come to work on time, I will let I will hire you. Okay. With that being said, do you understand that you cannot act as a security guard outside of your workplace? >> I was not. Okay. When you approached When you approached the first officer, you were stating that you needed some people trespassed from the property. All that I was only relaying what the what the Muslim guy was saying. That's fine, but that is enacting and acting as a security officer. Okay, that's fine. While wearing a security vest while wearing a bulletproof vest, a security a shirt that clearly says security with a badge embroidered on it and a full gun belt with at the time a concealed weapon in your pocket in in your pocket, right? Cuz you had the firearm in your pocket. So, do you see Do you see what I'm getting what I'm getting at, right? If you are allowed to work under a certain establishment as security and they don't ask for the proper credentials, that's one thing. But when you're out in public in full getup and people believe that you are a security officer, entirely different thing. Yeah, but I I simply told the the gentleman I am off. I just got off work. I'm just trying to trespass but I was at the bus stop with my cup of coffee and the young lady and young guy and the the gentleman pretty much kept waving their hands up at me. Okay. Saying come here, come here. And I >> Do you know why they were asking you to come come I was I was minding my own business. Is it fair to say that they were asking you to come over there because they saw you in full uniform and they thought you would be able to help them whether you were a security officer or a police officer? And I stated I stated that to them. Said this, I work at a strip club. If anything, you can call whatever you need to call but I I don't mind standing here and try to help you. So, moving on moving on from that. So then, we go out, we speak to you and I was just relaying what he said. Okay. Again, moving on from that. And upon the process of speaking to you, you were found to have a weapon in your pocket. Okay? Did you know that you were a convicted felon? So then, why did you originally lie about your name? I did I I go by my father's last name sometimes and I go by Your father's last name? I go by my father's last name a lot. Okay. Cuz I'm in the process of changing my name to my father's last name. I have my great So then, I have my great parents last name. So then, when the officer asked you for ID, why did you claim that you didn't have one? Because I didn't I didn't think that I did have my ID or my wallet with me. Okay. Do you see how >> I have two different wallets that I carry. Do you see how giving the wrong name to a police officer and then claiming you don't have ID when you are in fact in possession of an ID that actually has your government-issued name can make it seem kind of odd? Wouldn't you say any pertinent person would think, "Hey, this guy's lying about his name."? You'd agree, no? I I wasn't trying to do all that. I was just trying to help the guy outside there. But do you see how that that that makes it seem to us? I'm sorry. Okay. You don't have to apologize to me. I'm doing my job, man. It's not personal. You don't have to apologize to me but I'm just trying to make you see where we are coming from, where we see it. Yeah, but you wasn't there in the beginning. You You pretty You pretty much pulled that guy off. Right. You You don't even know what happened. Which is why I'm talking to you. Yeah, and then But I'm going off of what they're saying and I'm giving you a chance to dispel what they're saying and you're not. Yes, I am. You're telling I mean, you're going You're telling the truth. You're You're telling me what's going on. Yeah, and then So, once they once they once the guy that had the issue, you know, they explained it to him this and that. I was getting ready to go back to the bus stop. Listen, man. Nobody Nobody is disputing That officer just pretty much lied about oh, "Ain't you this? Ain't you that? What you doing?" And then like, I'm not doing anything wrong. Okay. If Nobody is disputing that disputing that somebody asked you for help. The Yeah, dude, I just told you everything you were charged with. Those are the crimes you have committed. So, I am explaining to you why you were charged with those things. I am not here to say that you're lying or that you're telling the truth. All I am here to to get is you have a a chance to speak your mind and and I'm giving you that opportunity. However, all right? The reason I'm I'm not disputing that you that somebody random person asked you for help to get somebody off the property, but it is clear and evident that the reason why they did so is because they thought you were security guard because you were in full uniform. >> somebody told them that I was not working. Okay. Um only I I just got my job. That's it. That was the original reason as to That was the original reason as to why you were stopped and then through throughout the investigation we found that you were in possession of a firearm and we also found that you were a 10-time convicted felon. So, it was 10, right, Josh? Uh 10 convictions? Uh yes, 10 convictions. Okay. You can't sit here and tell me that you had no idea you were I'm filling an auto auto to vote and I I have my voting rights. That means technically I'm I can't be a convicted felon. >> Oh, so so I'm lying to you about your your your 10-time convictions. I'm just lying to you for absolutely no reason. Apparently they let me vote. I Dude, I don't know if they let you vote or not. You could be lying to you, but what I am not lying to you about >> have my voting registrations and everything. I literally went to the school and re-enrolled and voted. Okay. That might be the case. I don't know, but what I am telling you what I know for sure is >> my mouth please? I'm talking to my girlfriend, please. No. I'm Right now we are in the middle of an interview, okay? So, what I do know is that you are a 10-time convicted felon that should not be in possession of a firearm, which you were. And what I don't believe you is that you can't possibly sit here and tell me that you didn't know you were a convicted felon when you were a 10-time convicted felon, man. Not once, not twice, which is already a stretch, 10 times. So, with that being said, I'm curious. Where did you get the firearm from? Cuz I know no no gun shop is going to is going to sell you one if they sell if they run a background check on you. So, where did you get the gun gun from? A friend of mine gave it to me. A friend of you just gave it to you? You didn't buy it from him? He just gave you a gun? 300. You bought it from him for 300. What's his name? It was a random guy that was selling guns and I just got it from him. He A random guy selling guns. How did you come in contact contact with him? I I was walking home from work cuz that's how I get I guess how I get home. I walk or catch the bus to work. And some some random dude said, "Hey, you want to buy a gun?" And I was literally on my street at my girl on my girlfriend's street and you know, this guy was like, "Yo, listen. I got four papers on it. It's clean, this and that. I I need to He randomly walked up to you and offered you a gun? Yeah. And I said, "Okay, well, let me see how it look." And he showed it You know, he had a little bag with him. A little man bag. You You do see how kind of unbelievable that sounds, right? Nobody's out here just randomly walking up to people saying, "Hey, do you want to buy a gun?" No, he lives in the neighborhood. How did you know How did he know that you needed a gun? He didn't. He asked do do I know anybody that wants to buy a gun and I said, "I'm looking to buy one, legit gun." And he said, "I have paperwork and everything." Okay. So, if he had paperwork for the gun, right, as a previous owner of the gun, right, you would have his name, right? It's It's on the piece of paper and then I have everything at my girlfriend's house. Okay. You were not at one point con- cerned about who you might be buying a gun from. If it might be stolen, if it was involved in a homicide, anything. Anything. You just said, "Yeah, I don't care who you are. I'm going to buy your gun." Did you ask for his name at least? He He had it He had everything on the on paper. He gave me the Yeah, the paper to it to the gun. He gave me the case, everything. The What The case of the gun, okay, but what paper? Cuz I've bought a gun before and I'm Other than receipts, >> Paper. I went I walked to his house. I And we we sat down. He gave me a bill of sale paperwork with the name. Okay. So, you walked to his house. Where does he live? Not far from where my girlfriend lives at. Okay. How many houses away? Like the next block over. The next block over? Where does your girlfriend live? Near here. What's the address? 15th Street. What's You turn front left and right? Straight ahead. Go straight ahead. Straight ahead? One block down? What's the house look like? A brown house. I'm sorry? Brownish. Like a brown house? Okay. And you have not seen him since. Uh no, because I'm always working. I'm I'm always going from one job to another. One job and then by the time I get home, it's it's broad daylight in the morning and I and I go to my girlfriend's house. I walk there. Okay. Cuz it's closer to both of my jobs. All right. Sometimes I go to my friend's house way down. Now, several times we asked you and several times you told us you don't have a security license, right? No. Are you aware that to work as a security officer that's legally armed, meaning that you carry a firearm, you have to have a special sort of security license, not just a regular Josh small security license. It is a special classification security license. You're aware of that? I No, I I'm sorry. Okay. All I know is at the three hours they I I even said, "Do you need a license to do security?" She said, "No, you do not." And they asked you to bring your firearm to work at the Rapids? >> I didn't I don't bring my I don't bring my firearm to the Rapids. I go strictly in uniform. Okay. And they asked you to bring your firearm to nightclub? Of course. They They said you, you know, if you got the gun, make sure you, you know, if stuff happens, you you allowed to, you know, protect yourself. Well, not if you're a convicted felon. I don't even I don't even use my gun. I I normally do it in in um a coworker's car and I just go, you know. I'm just trying to make a living, job. >> Okay. I haven't been to jail in a long time. Is there anything that we haven't spoken about that you would like to maybe add? That I'm not a bad person, man. No one's saying that you are. No one's saying that you are. I just can't remember back in the day of what I, you know, I I just I I try not to think about the the past. I can't I move forward. Okay, well, unfortunately, there are some things in the past that you have to think about like the fact that you you are a convicted felon. You can't just forget that and move on about your life acting as if you're not a convicted felon. There's certain things you can't do as a convicted felon and there's certain things that are going to land you in prison for being for a convicted felon while doing these things such as today. So, you I understand you're trying to move forward and and and and make a better life for yourself, but you also have to be cognizant of your status and what you do. Every job I have had numerous jobs since I've since I've been doing good. And I'm glad you do, man. But, >> I I just I do it over the phone. I'm trying to make a living. I'm not I'm not I'm not [Music] All right, man. I hear you, bro. All right, we're we're almost done here, okay? Just be patient. Well, we don't have any phones here. When you get to the county, we're not lying to you. When you get to the county, you'll be able to make a phone call. What's that? The officer said I can make one before I leave here. Well, then I'm Let me go talk to that officer, but he's busy typing that. So, let me see if he can make it. We'll see what he says, okay? Hey, look at that. You have a some money. Where did you get the Dominican money? Is your girlfriend Dominican? She won. Huh? She won. And I was going and I was I guess how I I was on on the I catch the bus before I go to my friend put it in there. Okay. So, it's going to go with you. Just so you know. You see, you have 1,000 pesos.
