Hey man, is Alexandria here too? You guys having an argument? Yeah, that's I'm about to leave right now. Oh, you're about to take off. Do you mind if I just knock on the door real quick to talk to her? Um, so basically your neighbor called saying that there's a whole bunch of yelling and stuff. Do you mind just taking your hands out of your pocket? I I know it's a natural habit when we walked up. I understand you're getting ready to leave. Do you mind just let my partner hang out with you for just 1 second. Let me talk to her. What's it going? Everything's okay. Just loud and verbal. What's going on? Knocked everything down. Okay, so you guys were having an argument. About what? Just Just our normal argument. And then he got angry and started knocking things down and breaking things. Did he hit you at all? Anything ever get physical between the two of you? pushed me, but not hit me. And when you say pushed, was he like exiting or was he like physically Just like that. What was going on when he pushed you? He was just angry. I was just trying to talk to him to get him to leave my house. I don't want him to be here. Okay. Can you explain to me more about what happened during the push or where were you guys and what was going on? Okay. So, were you standing in between him and the doorway or was he standing on the back side? Okay. And he was coming out of my room getting stuff out of there. And I told him can you just leave and then he just pushed me back there. I'm not leaving. And that's when he pushed you back. Um, was it like a push with two hands, one hand? Just two. Okay. How long have you guys been together? Almost 3 years. And you guys both live here or do you live No, I live here. He doesn't live here. Okay. How long has he been staying here? He just came over yesterday. Just came over yesterday. Okay. Do you have any kids together or anything? No kids together? nothing together. But you guys have been dating for 3 years. Yeah. Do you understand that with domestic violence you know, somebody puts hands on somebody that's a domestic battery. Like he's not allowed to put his hands on you. You're not allowed to put his hand your hands on him. Do you understand that? Yeah, but he didn't just push me. I didn't fall down or anything. But I understand him just pushing you is still a battery. Somebody who's it's a whether it's a push, a punch, a slap. He's not supposed to be pushing around. Especially it would be one thing if you're like holding on to him to prevent him from leaving and he pushed to get himself to safety. That's one thing, but if he's just pushing you back against, you know, an area where he's not in any fear and not defending himself from anybody, that's still not okay. You understand that? Yeah. Okay. Um do you have your ID on you somewhere? So you guys were in this room back here? Yeah. All right, and you were standing in the room. No, I was just I was out here. And he was going back and forth grabbing things of his. Yeah. And then he turned towards you. Yeah, I just told him to leave and then he just pushed me. Pushed you back this way. Yeah. All right, you said you didn't hit anything, didn't injure yourself. He just pushed you out of the way. Yeah. Got you. Um if you could just hang out in here, I got to go talk to him about it and then we'll kind of go from there. Okay. Is it something where if this were to go to court, would you want to press charges or No. Okay. So understand that our hands are tied in domestic violence cases sometimes. You know, if it goes it goes any further than this and it goes to court and you want to drop charges, they'll allow you to drop charges, but it's something that we still have to enforce in lieu of the victim wanting to press charges regardless, okay? Yeah. Okay, and I'll explain that to him after we get through talking to him, okay? So, like I said when I walked up, my name's Officer Polsfut, okay? I'm with the Town of Sparks Police Department. We got called out here, obviously, for you guys having a disturbance. And I got to come out and talk to you, okay? With us having you here and talking to you and asking you questions about what's going on, I'm going to read you your rights before that. You're not under arrest. Yeah. I'm just needing to talk to you about the investigation, so I need to read you your rights beforehand, okay? Do you understand that? All right. I didn't know if my partner already asked you, I'm sure he did. Do you have any knives or anything on you, sharp? Nothing. Hanging, just a lighter and a cell phone in that pocket. Just a lighter. You're cool. You can put those right back in, man. I think that's fair. Yeah. I could kind of tell as you were standing there, I just wanted to double-check with you, okay? All right. So, I'm going to read these out to you, and then I just need a verbal yes or no for the answers, okay? You have the right to remain silent. Anything you say can will be used against you in a court of law. You have the right to talk to a lawyer and have him or her present with you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning if you wish. You can decide at any time to exercise these rights and not answer any questions or make any statements, okay? Do you understand each of those rights as I explained them to you? Having those rights in mind, do you wish to talk to me now? Yeah, I'll talk. Okay. So, what happened over in the room? I know she told me basically that you guys were having You guys were having a argument and um she didn't really want to tell me too much about it was. She said it was pretty normal. And what happened over in this back bedroom here in the hallway area? Yeah, well, uh something happened with our cousin, I guess. Some some dude came over, and uh we had a problem like this before, and I was just trying to figure out what it was. So She locked herself in the bathroom and I was banging on the door. And that was kind of all the noise and everything like that. That was it. I didn't hit her. I didn't You know what I'm saying? So I'll be up front with you and just ask you a question about it and your your answer is what I'll take down from your part. She's saying that when you were coming in and out of the bedroom grabbing some stuff to leave that she was yelling at you still and you guys were still going back and forth and at one point you had turned and pushed her to the side. Is that true? Yes, sir. Okay. All right. So I'm going to go ahead and place you under arrest, okay? And I'll explain everything that's going on, okay? I'm keeping her inside because she does not want you arrested so I don't want her to get re-aggravated and start freaking out again when she sees this, okay? Go ahead and put your hands behind you. I'm going to try to keep them as comfortable as possible but they're not too comfortable. So I got a little deal. So now I'm informing you that you're being placed under arrest, okay? And now I'm explaining to you why, okay? She does not want to press charges but in the state of Florida any type of unwanted touch regardless of whether it's a poke, spit, anything is considered battery. If you guys are domestically related, like you guys are, you guys have been in a relationship for a certain period of time, 3 years, at that point the state has a new has a rule that has come from safety to make the arrest and then when they contact her and they read my report and it says specifically she doesn't want to press any charges, there was no injuries, it was a very light push, they can choose to drop it. But for the for the for the yes, for the purpose of safety they I'm going to ask her if she wants to say anything before she goes but usually it's not best for you guys to talk to each other. Like I said, she verbalized it to me that she does not want to press any charges and that she's uninjured and that she was, you know, it was barely a light push at all. Like I didn't push her up against the wall. I just Absolutely and she made that same statement. Okay, she she doesn't seem like she's making up a story against you. She doesn't even want you being arrested. She wants you to be able to leave. Yeah. The state made a rule about domestic violence specifically because wasn't domestic. You You guys are related and you're in a relationship. Domestic just means it's a relationship. So if you're in a relationship with somebody longer than 6 months, you have a domestic relationship with them. That makes it a domestic battery. So it ties our hands as far as the arrest. Okay. After you get booked out, when they give you your your release, the state attorney contacts her whether or not she wants to press charges. She's already stated she does not full on body camera and statement. She tells them, "No, I'm not wanting to press charges. It was barely even a push." Can I at least call my mom or something? Um I'm going to get you into one of the cars first so that we're not standing out here in the rain and then we'll work on that portion. Is your phone your phone still in your pocket? Yeah. All right. I'm going to toss your lighters back in your car so that they don't get trashed. Well, you could just you could just throw it away. Do you mind just pulling your car up for me? I'll hang out here with him. Get this one ready. Again, man, it's one of these few situations where the state said it's the safest thing to do. Yeah. Um what we had too often was he said, she said situations and no evidence and no proof and we were like, "Okay, we can't make the arrest." Everyone all it was. It wasn't no you know what I'm saying? Absolutely. It was just a light little I absolutely understand, man. It's it happened so many times to where we would not make the arrest because it's, you know, it's a it's a domestic situation. We would not make the arrest as police officers. And then individuals would come back and then it would get violent and everyone was looking at the police officer or the police agency and saying, "Why weren't they doing more to prevent it?" And it was developed from there for everyone's safety to try to cool down immediately affecting arrest. That the state can drop the charges in court. Uh-huh. And goes nowhere on your permanent record or I mean it it shows as you were arrested for domestic battery, but it shows the case was dropped and completely dismissed, okay? Okay. He's going to walk you through this. shut up? Can you try to get her to I'll ask her and I'll if if so, I'll bring her out to the car, okay? He's still got the phone in his pocket. If you could just toss that in a bag for me. 585 on 10-15 one time. You can change this to a domestic. That's all. 1100. So, I understand that you don't want to press charges against him. I understand that it was a very light push and that it didn't cause any injury. But any 10-4 for the male. 10-4 male line. Um I understand that you didn't get injured or anything, but you have to understand in domestic violence um as far as cases of domestic violence it is on our behalf to try to identify whether or not any physical hap- any physical occurrence happened and if they do, the arrest is to be made, okay? Mhm. So, he's been placed under arrest for domestic battery, okay? Mhm. I I explained to him that you do not want to press charges at the time and that you were not injured and you're not making up any crazy story. His story of the what happened was exactly the same as your story, okay? So, he understands that but unfortunately with the way the statute goes for domestic violence for everyone's safety, the arrest has been made. Um when the state attorney office contacts you as far as the charges, that is your turn to explain to them what happened and explain whether or not you want to be a participant in this at all. And if they drop the charges based on the fact that you don't want to press them then the case gets no filed and you don't have to go to court for anything like that, okay? Moving forward, if you guys have any future issues or if you feel like it's going to be physical in the future, you know, separate yourself. If you feel like it's ever a danger, you have the process of an injunction. And that's again if you guys end up splitting and you don't want him to come back around anymore, you have an injunction process that can tell him not to come or by the house at all. Doesn't seem like he's that type of you know, physical person, but there's always those options, okay? Okay. I'm going to bring in a pamphlet for you that has some of those options as well as the case number with my name on it so that you'll have it here. Um, he was asking if you wanted to say goodbye to him. Usually we don't let them see each other after emotional situation like this cuz we don't want anything to happen. I'm going to leave that on you. If you would like to say goodbye to him, you can. before he's sitting in there for Um, I'm not 100% sure. It should be uh, relatively quick turnaround, especially if he doesn't have any extensive criminal history. He just has to see a judge that's going to tell him basically no contact order and that's going to be something you want to make sure he doesn't violate, okay? What's that? A no contact order is until the case is dropped, until you get word from the state attorney's office that this case has been dismissed or no filed. He's going to be told as he's leaving jail when he bonds out or gets released, they're going to tell him, "You're not allowed to go back to the house." This property here. You're not allowed to call her. You're not allowed to come and see her. You're You shouldn't be texting or calling him cuz that could get him in trouble. It's a no contact order until the state attorney says, "Okay, this case has been dropped." Okay. Cuz then the no contact order is dropped with it, okay? So, and that's to keep both of you guys safe until the case goes to court, okay? Okay. So, um, he As soon as they can get a judge to see him, that's what they'll tell him basically. They'll give him if he has a bond or if he doesn't have extensive he might not even have a bond and they'll tell him, "Hey, you're being released. This is your court date. These are your uh no contact orders. You can't You can't call her. You can't seek her out cuz we don't We also don't want victims being harassed by their their, you know, defendants trying to get them to drop the case or anything like that, okay? Um so if he reaches out to you, just tell him, "Hey, you're not supposed to." Or just hang up the phone. Don't answer. Wait till the court gives you the all clear to do what you want to do, okay? Mhm. Well, will it take long cuz it's a holiday weekend? I do not know how it's going to I don't work for that side of the system. Oh, okay. Um I don't I don't work at the jail side of it, so um I don't know exactly how that process is going to take him, okay? Mhm. So, um if you want to, you can just stay in here. If you wanted to say goodbye to him, that's completely on you. Again, we usually don't put two people back in the same room or next to each other after something like this cuz, you know, you you want to kind of stay separate, but I'll leave that on you because of the situation, okay? 20 5 So, if you wanted to stay in here, you can. It's completely up to you. Copy 20 5. He's over in this cruiser here. She just wanted to say goodbye to you. It's all right. I'll let her come over. Like I kind of explained to both of you, it's more of a state attorney thing than anybody's wishes here. Uh nothing was lied about or exaggerated, so I understand the situation, but you guys just in the future you guys got to if things are kind of getting a little loud or a little crazy, you got to seek that separation before before anything does happen, okay? Do you guys have anything to say to each other before you take off? All righty. Yep. Um I'll bring in that paperwork for you real quick. Just give me a second. Uh wait wait on that. I'll switch him to my car and then you can take off. Your keys, are they in your car or inside the house still? Are they on a lanyard or just a little thing? Okay, are you okay with me grabbing them and or do you want me to leave them in the car? Leave them in the car. Okay, mom's coming to get them. When I get you to my when he's going to move you over to a different place, when you get there, I'll fix the cuffs up a little bit. They're not the craziest comfortable things, but I can at least make them a little better, okay? And then when PTU the van gets here to pick you up, they'll put them in the front. We just can't do it because of our policy in the cars, okay? Um I'll let her know that mom's going to come and pick up the car so that there's no issue when she comes and gets it and if the keys are inside, I'll make sure they end up in the car. Okay?
