Just take me to jail. Goddamn it. You got me, right? >> Can you stop, please? >> Deputies stopped a driver for an illegal U-turn, but after he admitted drinking, refused sobriety tests, argued through every instruction, then suddenly tried walking away during the investigation. The traffic stop exploded into a violent fight that left a deputy slashed, and the suspect facing multiple felony charges. >> Hi, Richard. I'm Deputy Blake, the Clara County Sheriff's Office. Would you mind just keeping your hands on the meal, please? Thank you very much. People are crazy nowadays. You never know how, you know, people feel. Do you have a copy of your insurance by chance? >> Pretty sure I gave it to them. >> No, you gave them the registration. The insurance is a different document. >> Probably would have to look for it pretty hard. >> Do you think maybe you can try? I mean, neither of us are really big ticket riders, but just so you're aware of not having a copy of the insurance is $116 fine. So, do you want to try to look for it? Do you know who your insurance provider is? >> State Farm. >> State Farm. Okay. If you can find a copy, that'd be great. Do you want to give it a shot? >> Can I move my hand from here? >> You're good. I just I saw your other hand tucked. I was just making sure you were, you know, didn't have nothing tucked over there. You don't have any guns, nothing in the car. Okay. Yeah, you're good. >> There you go. See, that wasn't too hard, was it? You got a bunch of them here. So, I believe that one's expired. We'll start with that one. >> Going to be expired. I think >> they all probably right now. >> Do you think there is going to be a current one in there? >> They're all current. Well, the card Yeah, the card itself would be expired just because you know you >> Well, you need to look it up with me. >> Okay. I mean, I'm just trying to help you out and tell you that you got to have a current copy, you know? I mean, we're not going to write you a ticket. >> Why you yelling at me? I'm staying right here. >> I'm not. >> You're getting you're getting a little rage, man. >> Okay. >> Okay. Here, you can take this one back cuz this one isn't. We'll start there. Okay. And you take the ones that aren't. Like I said, I mean, neither of us are really going to write you a ticket for that, but it's just making you aware that you got to have a copy of it, okay? So, when you do get home, just make sure you have a copy of it. You headed home. Okay. I mean, it's Tuesday night. There's not a whole lot going on. You leaving work or any Oh, okay. You retired? >> Still trying to work? It's It's tough out there, man. Well, I'll see how Officer Cory's doing on your paperwork and whatnot. Okay. What started as a routine traffic stop soon became a DUI investigation after deputies say the driver admitted drinking and refused to cooperate. >> Sword speech, blood, glossy eyes. Uh I don't want to say argue monitor like not very happy with my presence whatsoever, >> right? >> Um I mean it's kind of entirely up to you if you want to run him through or whatever. I mean >> you're the DUI one. I mean if you want to run them through I mean it's all yours. >> What driving patterns you have? Just the illegal U-turn. >> I Yeah, it was literally just illegal U-turn. That was my That was my traffic stop. >> And he didn't tell me where he was getting from. >> Yeah, he he told me the bar, so I was like 1405. Yeah, I didn't see him pulling out of I get a slight order. >> Um >> I mean I can I can ask him out and see if he'd be willing, but I mean without >> doing fields, I would recommend him getting a ride. And he seems slightly argumentative like he may not. Um, >> so I mean we can try, but he I mean if he was more forthcoming with you about the bar and everything, maybe it'd be better if you asked him cuz he was not very happy with my presence at all. >> Okay. >> So, and then I can run him through the rest. But that's that's up to you. >> I mean, if you want to ask him out because like I said, he doesn't seem very happy with me. >> Okay. >> Um, and he keeps like, you know, facing away and not really speaking very loudly at all. Mhm. >> So, but what I what I can hear is is definitely slur. >> Yeah. I just I I just can't tell if it's because of a possible impairment or if that's just him. >> Yeah. >> That's the thing with, you know, >> and I and I was mistaken that that Jeep did look familiar. Um but it wasn't I don't believe it was the same guy. >> That's him. >> No. So, >> well, do you want do you want to start by asking him if he's willing to do anything? >> He seemed more forthcoming with you. Do you want to ask him and I'll do the rest? >> No, he doesn't. He doesn't want to get out of the car. Um, >> he does have what looks like a holster. Um, I could only see the bottom half of it. It did look like a holster on his right hand side. His arm was by his right hand side when I walked up to the car initially. >> Okay. >> Um, but passenger side now I can I can see what it looks like a holster. >> Okay. Did you see a firearm? >> I did not. His jacket was covering it, but it looked like the bottom half of the holster, just so you're aware. >> What he said to me was uh I asked him, I said, "Are um I know you came out of the 1405." I said, "How much is the four beers?" I said, "Are you willing to perform any field sobriety?" He said, "No, I refused." I said, "Okay." Is there a particular reason for that? He said, "No, you got me. I was drinking." >> Well, here's the thing. That alone, I mean, he has an admission of drinking. I observe his slurred speech, uh, bloodshot, glossy eyes, and a slight odor of alcohol >> and refusal to fit submit to the field soiety exercises. Not a crime, but I have to make him aware. >> The roadside investigation was nearly over. What happened next is what transformed the stop into a felony arrest. >> So, I mean, I'm sure Officer Cory explained a little bit. Maybe he might be a little concerned with, you know, the the U-turn with your bloodshot, glossy eyes. Your eyes are a little watery. You did say you had a few beers at the at the bar. He said you had four four beers. Okay. I mean, now it's just a matter of making sure you're willing. You're safe to drive. And if you are willing to do the exercises, again, those parts are optional. However, I just want to make you aware we'd have to go based on what we see if you were not to perform the exercises. So that again is a decision you can make, but I'm just telling you what we see and what determination we we would have to make in that situation. You know what I mean? Again, it's optional. You know, I mean, you I'm not forcing you to do them, but I'm just explaining it to you and being forthcoming. I'm a very blunt person. I'll be honest with you. >> Unfortunately, that's not true, sir. Um, I do smell the odor of an alcoholic beverage coming from the vehicle at this point. Like I said, if you don't want to perform the exercises, again, they're optional. That's entirely up to you. However, I'm not comfortable in this point just letting you drive off. >> Did you want to perform though again? It's entirely option. Where you going? >> Out of the side of the road over here to where it's safe. Okay. >> I'm getting you out of the road. You out of the road. I'm trying to be safe to everybody here. >> Calm down. >> Well, tell me that first before you walk off. That's all I'm saying. I I don't know if you're walking off to leave. You know what I mean? That's all. We can go to the sidewalk. It's safer for everybody that way. There's no road. Look right here. >> Where's the safe? >> Did you say you want to do them? >> Yeah. No choice. Do I? >> I said you did, but I was just explaining the options. If that weren't what you were willing to do, that's all. >> What was my options if I wasn't willing to do? >> Well, like I said, we'd have to go based off of what we already have, which again, like I said, the order of an alcoholic beverage, the admission to drinking prior to getting in the vehicle, your bloodshot, glossy eyes, and your speech. Again, you have the option, but I'm just explaining to you >> what are we doing here? >> You're willing to do them? >> What do we do? >> I can explain it to you. So, what I would do >> is I would check your eyes. You'd walk down a line and stand on one leg. It's all there is to it. Stand on one leg is going to be hard because I got bad knees, but but >> okay. We can modify them, too. >> Right. >> Okay. I'm going to turn off the flashing lights so you don't have things flashing in your eyes. Okay. I'm going to explain everything to you and I'm going to demonstrate everything. Okay. Any questions so far? >> Fantastic. What I'm just going to have you do is stand with your toes touching, heels touching, hands down by your side, and you're just going to stay like that until I tell you to do something else. Okay. Any questions so far? >> No. >> Fantastic. Do you wear glasses or contacts? >> No. >> Do you mind if I take your hat off? I can just sit it right over here just so I can see your eyes a little bit better. Would you mind? You can flip it backwards. >> I don't I'll flip it backwards. >> Yeah, that's fine. You can flip it backwards. >> My hat. >> That's okay. You're not going to lose your hat. I wouldn't steal your hat. I'm Listen, cowboy hats are nothing for me. I can't do that kind of hat. >> All right. Do you have any I know you said your knees you struggle with your knees a bit. Do you have any other physical ailments that would stop you from walking down a line or standing straight up? Anything like that? >> Okay. >> All right. Remember, hands down by your side, just the way I explained it. Okay? You see how my hands are flat and flush with my sides? >> Is that Am I good where I'm at now? >> You see how my hands are touching my sides? >> Touching. All right. >> Yes, sir. Flat with your sides. Okay. >> Any questions so far? >> No. >> Do you see the tip of my pen? >> No. >> The red tip of my pen? >> I do. Now, >> you see the color of it? >> Red. Yeah. >> Okay. What I want you to do is I just want you to follow this with your eyes and your eyes only. And I don't want you to move your head. Okay. I want you to try to keep your eyes as open as you can. Any questions so far? Right. >> Just follow this with your eyes and your eyes only. You still follow it. You're looking at me. >> I can see it. It's right there between you and I. It's going out a little. >> Mhm. >> I still see it. >> Okay. >> When I was a football player, they worked on a peripheral vision. I could see that thing clearly. So, this is more just focusing with the front of your eyes. So, if you're just looking at it and following it, >> I never not could see it. >> Okay. But what I'm saying is following it with your eyes completely, not just peripherals. Okay. What I want you to do is just follow it with your eyes. Can we do that? >> Sounds like you're trying to trap me on that. >> I'm not. I'm just asking you to follow it with your eyes instead of >> I never once took it off my eyes. >> I'm standing right here. I can hear you just fine. >> All right. >> There you go. Now you're doing it. You're doing great. Just the way you're doing now. >> Well, you're blinding me with thising light right here. I have the most of the light towards your chest so I can >> No, it's right square in my damn eyes. >> All I want you to do is open your eyes and follow it. Can you see the red light? >> I can see the red light and I'm being blinded by your flashlight right in front of us at the same time. >> There we go. >> And now I'm being blinded even more. It's right down by your chest. >> Well, I have to see as well. I'm not I'm trying not to get the direct light in your eyes. Okay. It's just a flood light. >> Okay. >> What are you talking about? I I see it the whole time. I've never not seen it. >> Okay. Do you understand the instructions? >> The other in the fact you blinded me with your flashlight. Yes. >> Okay. I have barely any of the flashlight on your face. I'm trying my best, but I also >> Trust me on this. It's a piece of crap method you're going with. You're Yeah, you're blinding me with your lies, with your flashlight. And >> I only have the flood light around you. That's all I have. Okay. Remember, with your toes touching, heels touching the same way I showed you. Okay. the whole time. You see the way I'm standing with my toes touching, heels touching, and my arms. >> Yours weren't, but go ahead. I will do that. >> Well, mine weren't, but I would like you to stand that way until I tell you to do something else the same way I explained earlier. Okay. >> All right. >> We can just do the next one. Okay. We'll do the walk and turn. Like I said, I'm going to explain everything to you and then I'm just going to demonstrate it. Okay. Any questions so far? What I can do is get you a line of duct tape so that way you have a reference. Okay. I'm just going to put some duct tape. You got it, Cory? That way it's more of a fair shot. No, you don't got to start yet. We're not starting anything. Where you going? Where you going? >> Practicing. >> You're practicing? >> Yeah. >> Okay. I mean, as long as you ain't running off, I mean, you want to practice, you can practice. But I didn't tell you to start anything. >> For several minutes, deputies attempted to complete the DUI investigation while repeatedly explaining each instruction. But before the testing could be finished, the encounter suddenly changed. >> What the are you alling around for? Just take me to jail. Godamn it. You got me, right? >> Well, there's a reason. Where you going? Where you going? To jail. >> Come on. Where you going? What are you What are you doing? What are you doing? What are you in >> jail? You finished though? >> If you refuse to do any further further testing, you're under arrest. >> Let's go. Hey, stop. Stop. Stop. Stop. Stop. Stop. Stop. Stop. What are you doing? >> Why are you testing? >> No, I'm just telling you to stop. Stop. Stop. What's the matter with you? >> Stop. You're a little Can you stop, please? Stop. Stop. What is the matter with you? >> You alling got me. >> Good. Now you're getting charge of battery on an LEO as well. >> Get on your stomach. >> That's right. >> Get on your stomach. Get on your stomach. >> The other side. >> Stop. >> Put your hands behind your back. >> Get that one. >> I always wanted to be tased. >> You're about to get chased. Stop. Put your hands behind your back. >> Stop. >> Grab the arm. >> Get us another unit. >> That's in full for no reason. >> Knock my damn cowboy hat off. >> You got both locked. >> All that for no damn reason. No damn reason. >> What followed was a violent struggle during the arrest that authorities say left one deputy and one assisting officer with injuries caused by broken glass, resulting in additional felony charges. >> All right. He's going in my car. >> Uh, >> he's going to he's not going to cooperate at all when we try to get in the car. >> All right. Well, we'll get him in there. >> Got it unlocked. >> Get it unlocked. >> Do that. I got him. >> I take my key. >> Just get it unlocked. >> Yes. Roll up. >> Thank you. >> Yep. >> Two seconds ago is you got me. You got me. Just take me to jail. Then you started to fight. Why? >> Who wants to go in handcuffs? You ever been handcuffed? >> Well, you got to know one way or another you're going to go in handcuffs. Better go the easier way. Put your knees up so you can stand up. Okay. >> Inward. >> Bring Bring this one up. >> Bring it up >> towards me. There you go. >> Bring that knee in. >> Do this. Bring it in. >> Stop. >> You kick me one more time, you're going to get more charges and your day is going to be even worse. You hear me? I'm trying to be nice. I'm trying to help you up. Let's be Let's be cordial >> and let's stand up. Okay. I'm not going to charge you with that. You do it again, you're going to get charged. >> You're fine. You call me whatever you want, sir. I've heard where >> Damn it. I don't need nobody talk getting up. >> You do bitches. >> 11. >> You got anything on you? It's going to poke me stick me hurt me. >> No. >> All right. >> Problem one. Yes. >> The other problems. That's definitely >> your feet. >> We don't either, man. >> I got a phone. >> Battery. >> Battery. >> You want to be hitting people and kicking people?
