Do you have a medical marijuana card? >> No. >> Is there any marijuana, hemp, low concentration THC, anything that would cause the odor to be emitting from your vehicle? Like you said, you said it it would no it normally smells like that. Is that what you're saying? >> say car. Yeah, it's really not. >> I smell it in this car. How old are you? >> I'm 19. >> You're 19? >> My twin sister 19, too. >> Okay. >> And then my cousin. >> How old are you? >> 14. >> Okay. You know, you guys have been cheating on me. >> Yeah, you can search too. I'm all good. You're good. You're good. Be careful there. >> Yep. Sorry, I got you. >> Uh I need your what's your phone? >> Uh my phone >> It's on the floor. Right behind you. >> I don't know where I'm going or if I'm going to jail. I don't know if >> You're going to go to jail. >> You're going to jail. >> And you guys are making us go to jail. >> It's okay. [laughter] No worries. It's fine. But I do want to know something. What's going to happen, sir? Can you Can you tell me Why am I going to jail for? Okay. Thank you very much. Bye. I mean, how you feeling? >> I feel like I got so much >> The afternoon of March 17th, 2025, as part of a publicized spring break crackdown, a Volusia County deputy pulls over a silver Toyota SUV in New Smyrna Beach. The legal reason is simple and specific. The front windshield is tinted far below Florida's AS1 line, the mark that sets how low tint can legally go on a windshield. On paper, this is a routine equipment violation. But watch the deputy's posture change as he reaches the window. According to his account on the footage, he immediately notices a strong odor of both burnt and unburnt cannabis coming from inside the cabin. >> You don't need to dig in there just yet. >> Hey, just one second, man. 9 WCPD central drug task force. >> [screaming] >> 9WCC2. >> Quad 1 in North Atlantic. What is that? Romeo Romeo India Sierra 18 beyond silver Toyota. >> We'll let you know. >> I copy. >> Hey, I'm Lieutenant McDowell with the New Smyrna Beach Police Department, okay? Uh one of the reasons I'm stopping you is cuz your windshield is tinted, okay? Two, when you passed by me, the odor of marijuana just hit me in the face, okay? Is there any weed or anything like that in the car? >> I got my little cousins in here, so there's really nothing in the car, but my car smells like that, >> Yeah, it smells like weed, man. So, okay. Do you have a license, registration, insurance for me? Do you have Does anybody else in here have uh IDs on them? >> Uh that's kids. You know, they're >> How old are you? Do you have an ID, though? Yeah, yeah. Can I get it? >> I got everything in the car. I'll start with my my child's >> Do you have a medical marijuana card? >> No. >> Is there any marijuana, hemp, low concentration THC, anything that would cause the odor to be emitting from your vehicle? Like you said, you said it it would no it normally smells like that, is that what you're saying? >> said car, yeah. It's really not weed. >> Okay. You say Do you just smoke a lot or do you have a you commonly have weed? >> I don't smoke a lot, but when I smoke, I try to do it in my car. >> Okay. >> That's why. >> Okay. >> I know it's here. This is the registration. I have the insurance on paper, but I if if we renew, I can show paper, so I'm going to go look it up in my phone. >> You're going to what? You're going to look on your phone? All right, so you put that stuff away for me. And then you can get out. >> And in Florida, at least as the law was [music] applied here, that reported smell is the hinge the entire stop turns on because it's what an officer can use to justify what comes next. Citing that odor as probable cause, the deputy asks all four occupants to step out so the vehicle can be searched. And here's who was in the SUV. >> All right. All right, both of you guys are Everybody get out and just sit. Get in the front of the car. >> In the front, 19-year-old twin sisters. In the back, a young adult male passenger and the sisters' 14-year-old cousin, a minor. For that reason, we've blurred the youngest passenger throughout and we won't be discussing them further. That's not up for debate. It's a child. >> Put your arms up against the front of the car. >> I got two kids, but >> Arms up against the car. How old are you? >> I'm 19. >> You're 19. >> My twin sister 19, too. >> Okay. >> And then my cousin. >> How old are you? >> 14. >> Okay. >> I got her name. >> Will you run them for me? I'm going to go ahead and search the car real quick. It smells like weed, so >> With everyone detained roadside, [music] deputies search the interior. On the footage, they report finding a partially smoked cannabis cigarette sitting right in the driver's side door pocket along with loose cannabis and paraphernalia in the center console. In other words, not hidden in a trunk or a bag, but within immediate reach of the two people sitting up front. Remember that detail because in a possession case, location is everything. >> 407 1147 >> Because the items were found within immediate reach and control of the front cabin, both 19-year-old sisters are placed in handcuffs and arrested. They're each charged with misdemeanor possession of cannabis under 20 g and possession of drug paraphernalia. I want to be precise. These are misdemeanor charges and being charged is not the same as being convicted. >> Who was in the passenger seat? Were you? Can you stand up for me? Do you have any more on you? Any anything else? >> I have something right here. I think it's in my pocket. >> In your pocket? >> I don't know. I put it in my pocket this week. >> Here. Where at? I was like, I feel it. >> It's on you. It's in here. >> Oh, okay. >> I got a hole in the pocket of >> Turn around for me. All right, you face that way in a second. You know what? You just have a baby sister on you. >> Yeah, you can check, too. I'm all good. You're good. You're good. >> Yep. Sorry I got you hurt. All right. You can sit back down. Do you have anything on you? You have >> I don't have anything on me. >> Okay. You stand up for me. I still got to check you. >> Check her before she go. >> Cuz there was a joint in your door, too. >> Oh, that's Trust me. Trust me. >> Is this your friend? I'm going to keep spinning. Yeah. Yeah, that's unfortunate you're all girls, so >> Yeah. It's so fun now so I have to search everybody. I got to search Nope, I don't search you. I search females. >> Oh, you got to >> Yep. You have anything in your pocket? >> Yeah. >> Lift it up for me. Just shake it. >> What's that? I'm going to take it out. >> Okay. >> We don't have a court outcome, so we're not going to pretend we do. As for everyone else in the car, the adult male passenger is questioned and released without charges. And the 14-year-old is released from the scene into the custody of an adult family member. That's the whole disposition, two arrests, two releases from a single window tint stop. >> The only thing I shouldn't have in my pocket which is a pen, so you can take that one away. >> Man, I stopped you and then you tell me there's nothing in the car because you got your cousins in it stuff like that. That's not the case, man. >> Listen, I didn't >> All right, turn around. Let's have a backup at the front of the car. Where Who had the scissors? >> It was in her pants. >> Oh, hers? Okay. Yeah. She was She had a bunch of pre-rolled ones, so >> Oh, mine. They weren't mine. >> And then they dropped So, hey. There's a joint in that back door, okay? Where your 14-year-old cousin was, okay? >> I didn't know that, honestly. >> Like that >> I understand. I'm not >> That's the kind of business lady is probably in. >> No, I'm not going to lie, I'm not taking any drugs but I do. >> Okay. >> She is not smoking drugs or anything. >> That's our 14 year old girl she's in the army. They're good, trust me. >> She's 14 and who's in the army? >> She's in the 14 and she's going to be in the army. She's in like her fourth year in high school. >> That That you guys can go ahead that's our little cousin. We No, if you fight for anything because that's our stuff. >> Yeah, I'm not looking to jam you guys. I'm not looking to jam you guys in okay? Yeah. >> Then I have my purse and >> we're going to talk to you guys not them right now, okay? >> Okay, good. >> So I just want to make her make a quick phone call. Um so you just hang out with her for a second? >> Yeah. >> Turn around for everybody are we both going to keep going? >> What? What? >> Take my car. >> Turn around for everybody back. >> She too? >> Yep. We have a zero tolerance policy. >> So what happened with the minor? >> Uh we're going to make a school call. So and we're going to So the 16 year old has a has a license, okay? >> Okay, can she take my car? >> I'm going to ask you do you want me to allow her to take your car? >> for sure. >> Okay. Do you want her to take your jewelry? Uh he talked to you. Do you want her to take your jewelry? >> My jewelry like this? >> Yeah. >> And your bracelet and stuff. Yeah, I'll take all that stuff, yeah. >> Okay. >> I got all the golden stuff. Do you want to take my car? >> We put that in your We put that in your truck? Oh, that's good. Yeah. Here, I'll take it off. >> The money you put in your purse. >> You have to do your tolerance test. >> Do you want your phone with you? >> Yeah, yeah. >> Okay. >> I'll I'll put it on my wrist and stuff. We get your bracelet and stuff off, girl. Do you want your phone to go with you? >> Uh I think it was your phone. >> Uh my phone >> It's on the floor right behind you. >> So can can we leave my phone in the car too? >> Yep, that's fine. Do you want to take it with you? It's up to you if you want to take it with you. >> Am I going to be able to I don't know where I'm going or if I'm going to jail or anything like that for a couple days. >> You're going to jail. >> Okay, fair. >> So, do you want You can have this and then give me numbers out of it when you go. You want that? >> I know mommy number. We know all the mommy numbers. My grandpa, I know them. >> Leave my phone, right? I don't want to lose that or anything. >> Yeah, but so one thing, can we make a can we make a call to her mom and so that way she knows what's going on or her dad? >> Either one. >> We just we need to we need to talk to them. Okay, do you have We got service? >> Yes, I do, man. >> Okay, what's your phone number or the thing? >> Um 23. >> What is it? >> 676 >> 676 You have anything on you, man, that's any like rings or anything like that? >> Uh no. No? >> Actually, I have my >> So, you don't have a a watch or anything on you? Can I give her the $2? >> Uh no, no, that's not that's a sign. You can give her my phone. >> Oh, did you give her the whole phone? >> She needs to put her aunt's number in there. >> Oh, you have to put the aunt's number in? So, can you call her? >> Okay, you know it's not worth anything like trying to talk to you guys. Unfortunately, man, hey I'm being honest with you. People have been going to jail for less than a week than this. So, I get it. >> Yeah, it's zero tolerance this whole week. >> It's just so many criminals and you guys are making us go to jail. >> It's okay, [laughter] no worries. It's fine. But I do want to know something. What's going to happen, sir? Can you can you tell me? >> We're going to stay there. >> I don't know where am I going to jail for? >> You're going to jail for possession of marijuana under 20 grams, possession of paraphernalia, and then you'll end up probably getting out in a >> Uh so, the rolling papers or like the um >> Like the stuff that is used to roll like joints, okay. >> So, he he probably has rolling papers. I don't know if I don't know if you have rolling papers, so. >> Everything in that car is mine. >> Okay. >> Everything in that car is mine, please. >> It's It's unfortunately literally in her purse. And that's her name and stuff like that in it, so that's the reason why she's going is cuz you can't take the >> you going to do? >> The The The weed that's in the Hey. >> But if you see us being like this is because we're twins, right? >> cool. I don't mind talking to you guys, but the weed that's in the center console, this is your car, so you're responsible for the weed that's in the car. >> So if So the car Her purse is in my car as well. >> Yes, but it's clearly hers because it has all her identification. >> Well, the weed doesn't have a name. The weed doesn't have an identification. I'm the owner of the car. I'm telling you that that weed right there is mine. And the purse that's in my car. >> I'll I'll I can add a note to the report that you're claiming all of it. However, then that way maybe in the court system she's just going to go She's going to go >> It's okay. We're good. We're good. Yeah, that's all We're going to go. >> All right. You guys are there, and then I'm going to have you guys just slide over, okay? >> All right, guys, keep walking. You can't block the sidewalk. >> All right, we're going to walk. >> They're not recording, right? >> Yeah, I guess they are. Yeah, you guys are. >> They're not recording. No, not yet. People are. >> They're gone. They're gone. >> Okay. >> Let me see that way. >> They can leave now after we leave, right? >> Yeah. Yeah, I'll get them out of here in just a second. >> Yep. >> Can you slide the cheap >> Should I go in? Are you good? >> Yeah, my car is cleaned out. >> Yeah, I'm waiting for you. >> Sophia. >> Okay, help me with this, please. You have to go like quick. I got you. >> The footage was captured on an Axon body 4 camera and became part of the county's very public messaging around its spring break enforcement, which is really the point of the whole thing. A stop that began over tint became a searchable case the moment an odor was reported >> [music] >> and that is exactly how these zero tolerance details are designed to work. So, here's the question for the comments. A window tint stop, [music] a reported smell, and two 19-year-olds arrested for a misdemeanor during a spring break crackdown. Is that good proactive policing or is it a small thing turned into a big one? There's no wrong answer, but keep it respectful. These are real young people and the case may not [music] even be finished. >> Okay, then can I say hi? I mean, how are you filming? >> I feel like there was so many criminals and we are back here. But right now this street is really like maybe seven criminals, seven real criminals, more than seven. Somebody having a seizure. I'm hearing it. But we're technically not going to be in jail, right? >> No, we're going to go to jail. >> Oh, jail jail? Oh my goodness. >> Yeah, you're going to go to jail. >> So, I'm going to be in a room with >> a bunch of strangers. >> A couple of them or a bunch? >> A bunch. >> If you want the clean, no-nonsense version of body cam cases, just the facts and the procedure, subscribe and hit the bell. There are two more stops on screen right now. I'll see you in the next one.
