What's going on today? >> Uh, so my husband and I are in the process of getting a divorce. I'm still living here until I can find my own place. >> Okay. >> We got into an argument this evening because he wants me to start paying half the rent, but I was advised by my lawyer that I'm not responsible for it since I've not been responsible So we got into an argument over it and he started talking about how then the car is his car and I can't have it anymore and he said he wanted the keys. I started walking out so that way I could go ahead and head to the gym. I just told them I was just going out for the night. And as I was walking out the door, he grabbed me by my neck and shoved me out the door. I locked the door behind me. I walked back in and that's when I started to call 911. And my kids are both upset with me now for calling 911, but this is not the first time he has physically hit me, but this is me starting to file the reports and get everything done that I need to get done for my safety. >> Um, so did he just grab you by the neck? Did he try to choke you? >> grabbed me by the back of my neck and shoved me out the door. >> Okay. All right. Um, what's his name? >> Scott. >> And what's your name? >> Tabitha. >> Tabitha. Tabitha, do you have your ID on your person or is it inside? >> I do cuz I was going to the gym, so there you go. >> You just want to hang out over here by my car while I get this back for you? >> Thank you. >> Okay. So you were walking out the door, I assume this happened at like at the doorway? Just kind of walk me through it. >> Yeah, I was walking. I told him I was going to leave after he told me that I couldn't have the keys. >> Okay. >> And I started walking to the door. I opened up the door and that's when he grabbed me by the neck and just shoved me out, slammed the door behind me and then locked it. So I stood out here for about 10 seconds. I went back inside. I locked it. I said, "Why did you grab me by the back of my neck?" and he said, "I didn't do anything." which he always does every time he hits me is most men, you know, at least buy a woman flowers after he hits her, not him. He just says it was all my fault and I did it. Um and then after he said I didn't do anything, that's when I started to call 911 cuz I'm tired of it. >> All right. Well, so as soon as we get someone else here, I'm just going to have you hang outside with the other officer and I'm just going to try and have a conversation with him. Uh, did anyone else in the house see this and did they say anything? >> think my kids saw it because the stairs are in the doorway. >> Okay. And Scott, you said he's in the house. Oop. Good. Hello. She's sir. >> She's very friendly. >> Okay. Officer Garofalo, do you have a place to park? Can you step out here and talk to me real quick? >> Yes. Can I Can I put my shoes on? >> Yeah, go ahead. We'll just walk out here to the driveway. No worries. >> Just to the end of the driveway. Officer Garofalo. So, what's going on tonight? >> What? >> Why did we get a call? >> That's what everyone else is trying to figure out. >> Okay. >> Um Can I put my hands in my pockets? You can check them if you want. >> Just I know it's cold, but if you can, just keep them outside. >> Okay. Um can I hold them like this? >> Yeah. >> Sorry, I'm prior service, so like I know how you guys are. So Um we came home. She's making dinner. First off, backstory, I filed for divorce. >> Okay. >> So, there's been a lot of tension in the house. >> Okay. >> Um things like that. So me and my daughter were up in my room. She comes and knocks on the door. I say, "She Come in." She says, "Sure." I have to unlock the door cuz I had to put a deadbolt on that door. Um she comes in pretty aggressive and she's like, "Hey." She's like, "I'm not paying the rent. I'm not paying any bills." Phone bills and stuff. And I'm like, "Okay." I'm doing a a Chia Pet with my kid. So I'm like, "Okay." So I come downstairs a little bit later and I'm like, "Hey, Cindy, you know, if you're not going to pay rent, you're not going to like I need my car then. It's like, "Can't Can't use my car." Like, "If we're going to be doing this, it's like, you know, everything that's in my name is in my name." She's like, "Oh, I didn't say I'm not paying rent." I say, "You literally came up and told So, anyways, argument, right? So, argument back and forth. >> Mhm. >> Lots of threats back and forth. So, I'm like, "Okay, so then she goes to walk out." And my daughter's like, "Where are you going?" She's like, "I'm leaving." So, I'm with her cuz I'm going to go back upstairs. That's where my room is at. And then, you know, I'm going upstairs and then she comes back in. She's like, "Why did you do that?" Do what? And she's like, "Why did you put your hands on me?" Whoa, I did not put my hands on you. And my daughter's like, "He didn't do anything to you." And she's like, "Oh, yeah, he put his hand or he put his hands on me." So, I'm like, "Call police now." And everyone like both of my daughters like, "Call police for what? Like he didn't do anything." So, >> How old are your daughters? >> 12 and 13. >> 12 and 13. >> Yeah, so >> That's >> Yeah, absolutely. >> Okay. She's saying this happened at the bottom of the stairs. Would either of them have seen that or were they up in their room? >> They were both in the living room. Um, my daughter said that she was looking. >> Okay. >> But I don't know. >> Okay. >> So, I was still walking through the the hallway as she went outside. >> Okay. All right. >> I will say to you that this is not the first time that she's said things about like me hitting her. Um, I don't mean to sound like the typical divorced person, but it's like a lot I mean, she's like posting on Facebook to >> So, I'm not trying to meddle in your business, but I just want to let you know we don't care. Are you guys going to get a divorce is it because you're dating somebody else? Is there somebody else in the picture? >> We home problems. We've been having problems for years. No, no, nobody in No, no. I I think the only only reason why is because I was the one who filed. Yeah, maybe. I don't know. Um, unfortunately, it's going through one of those things right now where it's like I don't even recognize her anymore. Like I know it's really weird to say and like everyone's like, "Oh, yeah, that's normal during divorce." >> I mean, there's there's stages of >> Yeah. Mhm. Yeah. So, >> I'm not saying what she's saying isn't true. What >> No, I understand. Totally understand. Yeah. Um yeah, so we're just trying to keep the peace as much as possible. That's why I stay in my room. I put a I put a Deadpool on there because it's like I'll leave it at that. I'll put a Deadpool on there. Um but yeah, we can >> Yeah, your daughter that said she was looking You mind if you grab her? We can talk to her. >> Want her outside? Do you mind? >> Yeah, we'll talk to her inside. We'll talk to her inside. >> Um yeah, why don't you come in? >> And I'm I'm so sorry. What was your name again? >> Garofalo. >> Officer Garofalo. >> Garofalo. Garofalo. Garofalo. >> I just want to be clear. That's the correct pronunciation of Garofalo. >> Understood. >> Okay. You're good. Either way. >> It's your house. That is Give me a second. >> Make sure >> So, Sky is very, very calm. >> Are they biters? >> No. >> Oh, okay. >> Um the other one is put away. >> Can you remember that? >> What's up, papa? You smell my doggie? I know you smell my doggie. What's up? Come This is probably good once she says hi. >> Yeah, I don't care if she sniffs us. >> You can come out later. >> And we'll go into >> Yeah, we'll go into the living >> So, they just want to ask you a couple questions. Just be truthful, okay? >> Officer Garofalo. >> Yes. >> What was your name, sweetie? Just take a deep breath for me real quick, okay? So, I I there's a lot going on. Um a little stressful at the moment. Um Did you see anything that happened between Mom and Dad tonight? >> even hear anything. I was sitting right here. I didn't hear anything. >> Okay. Um do you know what happened? >> No. >> No? Okay. >> I was just right here. Heard the door violently shut. And then all of a sudden that's just >> Okay. No yelling, no screaming, nothing like that? >> No. It was like perfectly fine. >> Okay. All right. Well, I appreciate you talking to me. Like I said, I just wanted to ask you if you seen anything. We weren't sure. So, that's all I had to ask you, okay? All right. Thank you. Okay. >> Can you get the other one on the phone? >> You can ask her. They they were both out here, so. >> Okay. >> Would you like to? >> Yeah. >> If you don't mind. >> Yeah, sure. Um you want to go grab your sister and then you can you can come back down and you can sit with me if you want. >> One story short. They got into a verbal affair because she was saying she was the black sheep of the family. He was saying bad things about her and names. She's like, "Well, I didn't say that." And then the verbal abuse. And she's in bed. One thing and then he's just saying something after the divorce got filed recently. I don't know. >> Um so, like did you did you guys argue like down the stairs? Cuz she said she heard the door closing. Did she leave? Did you leave? >> She left. >> Okay. >> Uh we were actually here in the living room arguing. Uh she was outside smoking. She came back inside. And that's when you know, the that verbal part started. And you know, I told her like, "Hey, you know, if I like we're going to be petty and not pay bills, then we're not going to use the vehicles that I'm paying blamed right?" Um so, we were actually over here when that happened and then I'm in the kitchen. She said I or she was leaving and I asked her, "Where are you going?" She said, "I'm going to mom's." >> Please are just officers here to help. They just have a question for you. If you just answer honestly whatever questions they have. If you're comfortable, okay? You don't have to. There's nothing to be scared of. They're literally [clears throat] here to help. >> I get it. There's a lot There's a lot of us. It's not the easiest thing. >> Would you like for some of us to leave? You mean your sister to leave? You okay? >> Um So, do you mind if I just Did you hear your mom and dad arguing at all today? >> Yeah, it was just like a tiny little argument like that. >> They were arguing here in the here in the the kitchen slash living room? Okay. Um, what else did you see them argue? Did anything like like Tell me what happened. What did you see? >> just my dad and her talking to my mom and my dad. What was I don't know. My mom was mad and >> Uh-huh. >> and I don't know what she was talking about. I don't know what my mom was on. Oh, she was saying that she was having a pain in her back or something. And then she said that she was going to leave but he said that she couldn't leave with his car cuz it's in his name and it's not her name. And then I didn't really listen to what my dad was saying cuz they got in an argument and she left. >> Okay. Where did she leave out of? >> She just walked out the front. >> She just walked out the front door? Okay. Um >> Did she say anything before she left? >> I don't think so. >> No? Okay. Um When When she left the house, were any of you guys over there? Did any of you guys follow her or talk to her? Okay. Were you in here in the living room as well? >> I was in the living room. I was just there and then I left. >> Okay. Where were you at when she left? >> Uh, I was walking out with her. >> You were walking out with her? >> I was uh two steps behind. >> Okay. All right. Just give me 1 second, okay? >> Is daddy tweaking? Why is he so calm? >> I'm I'm going crazy. She is >> You guys want to go? >> Hello, ma'am. My name is Officer Rivera. I understand you need a written statement. >> I guess. >> Okay. >> me for a written statement. >> So, I'm going to give you this pen. Fill out the top, name, address, date of birth, all this. Don't worry about the case number, we'll take care of that. What I need is your printed name, your initials. Everything from beginning to end in as much detail as you can possibly remember as long as it's in order, semi, and the truth, we're happy. >> Okay. >> And then I'll need your signature at the bottom. >> Okay. >> And you still got Stahli coming. You probably can't. >> Stahli's coming, too? >> Yeah. >> Okay. >> Up to you. >> If he wants to come, let him come. >> Sure. 95 and more? >> I don't know yet. >> Okay. >> I got here and Quintero was talking with her and she just asked me to get a written statement, so I don't even know anything other than the dispatch notes. >> Did they already take a look? Do you have any injuries? >> Um she said I have marks on the back of my neck. >> Okay. Did anybody take pictures yet? >> No, not yet. >> If I can just take a look. Can I take a picture? >> Yes. >> Can you hold this for me? >> Yeah. >> Did you ever feel like the circulation or air- airway was cut off? Okay. >> I'm going to just make sure. >> How many officers does it take? >> So, it's kind of the funny thing about shift change is everybody shows up and then the day shift will go home. So, you have two day shifts here already. >> Yeah. >> Oh. >> Yeah. >> Three-day shift. >> Okay. And then if you could just put the date here, 20th. And then we can fill out the rest. >> Thank you. >> Hey, we're good. You can take it, honey. >> Do you want me to grab my phone out of my pocket? It keeps ringing. >> Not at all. Go right ahead. You said tonight, does this happen >> It's happened quite a few times over the years. That's one of the reasons why we're getting a divorce. >> Okay. >> I'm done with it. Um normally he doesn't I don't bruise easily, so he doesn't leave marks. And I've always been like, well, he's a combat vet, you know, he's PTSD, work through it. And I'm just done trying to work through it. >> Okay. Yeah, it's I mean, it's definitely about your safety more than anything else. >> I will say he does not touch the kids. It's just me. If he wants to pay for me to get a hotel room, I will gladly leave because this is going to be his house. I can't afford the rent. But if he doesn't, I can't afford to leave the apartment. >> Okay. Um I mean, I'll have to talk to them inside, but when there's a situation like this and you have marks and there's a clear primary aggressor, he's most likely going to be arrested. All right. >> Am I allowed to ask that he does not get arrested? I just want to file the report. >> In domestic situations, you cannot. Yeah. So, that'll be up to you once it goes further to the state attorney's office, um as the victim, if you want to cooperate with their investigation or not, that's going to be up to you. And like I said, I haven't even talked to them to figure out what they're going to do. I'm day shift, I'm going to be rolling off here, so that'll be up to the night shift, but most of the time we do not have a choice in the state of Florida. We have to make an arrest when there is a clear primary aggressor. So, you'll be here with the kids, hopefully, and if I had to guess, he's probably going to take the ride. >> Okay. >> And then after that, have you has this Have you ever called before for a situation like this? >> No, I haven't. >> Okay, so after that being a domestic situation, usually when he gets out, um he would see a judge in the morning when he gets out. There'd be a mandatory 24-hour no contact order. So, he would not be allowed to come around here for 24 hours is usually what the judge sets. Um it could be extended past that depending on the circumstances or it could just be set at the 24 hours. It kind of gives you time to do what you need to do if you wanted to try to get any paperwork in line or anything like that. Like it gives you time to do that. Um is usually what happens. It all depends on the circumstances. It can change, but that's probably how it would go. >> Okay. >> But, they'll give you uh Oh, yeah. Those booklets there. >> Yeah. Might as well get it out of the way. >> Yep. >> All right. I'm going to ask you we have three basic questions. I'll read them from the card, so just answer uh honestly. Has the perpetrator ever used a weapons against you? >> Given that you've answered yes to at least one of these three questions, would you like to speak to a domestic violence investigator or counselor? >> No, I'm fine. >> All right. Would you like the uh phone number or anything like that? >> I'll take that one. >> All right. So, I'm going to give you um two pamphlets. >> Do you have any idea what the next case number will be? Cuz I know I'm sure they haven't called one yet. >> I don't have them. One pops, too. I I did take pictures. It's on the left side of her neck. I'll submit them. >> Ma'am, can I have you print your right here and then sign it right there? I'm sorry. What this is is two books of your resources. There's my cell number in the resources that we can give you if there's anybody you want to call or anything. >> Thank you. >> So, got three of them. Did you say your husband served in the military? >> He did. >> branch? >> Army. >> What was his job? >> He was a communications, 25 uniform. >> Okay. I'm sure I don't have all the uh MOS's memorized. >> I was an 88 Mike. I can't remember his. >> Okay. I was a 91 Alpha Bravo back in the day. >> Is that infantry? >> Combat medic. >> Combat medic. >> I was going to be >> I was going to and then they decided cuz we were both in the same unit that his job was more important cuz there was only one of him and there was only one of me. And then I I found out 2 weeks later I was pregnant again, so I went to my commander and I told him he made a good choice. >> Okay. Yeah, I I spent 6 years out in the sandbox. >> Oh, really? >> Yeah. That was definitely an experience. >> Yes. I might have to go to court in the morning. >> In the morning? No. No, not by any means. Um he's being detained right now and like we were saying earlier, look more than likely that he was going to be arrested. So, what will happen is he will see a judge tomorrow and then go from there. More than likely he'll be issued a no contact order and until his trial date. I'm sorry you're having to go through this. >> I'm sorry my kids do. >> That too. >> The sad thing is that every time that happens and I file for a divorce, they blame me. And like I don't want you guys to grow up thinking that it's okay to be hit by a man, but I'm still the problem. >> Well, that wouldn't have been my first thought. Um Obviously, he's got some issues that he has to work through. Our initial dispatch note said you had some firearms in the house. >> Yes, we do. We have an AR-15 in the bedroom in his bedroom, a shotgun, and I think it's a 9 mm. >> Okay. So, three guns? >> Yes, they all have trigger locks on them. I don't know the codes to any of them, so don't ask. >> No, I'm I'm not I'm not asking you for the codes, but um but when he's um under uh a domestic violence arrest, he's he can't have any. >> Can I take them over to my parents' house? >> Yes, you may. So, that would be a smart thing. It's either that or you can turn it over to us for safekeeping and we'll we'll store it un- until said said time a judge says that he can have them. >> Okay. >> But yeah, if you're going to If you're going to take them to mom's house, that's perfectly acceptable. >> I can do that. >> Okay, so he's going to jail tonight for domestic battery. Okay. Um you'll have to meet with the state attorney after this. I'll give you my business card and the case number. They're going to contact you. Um you'll have to go sit down with them and kind of go Um here in a second, me and this other officer are going to run inside. You said he's on blood thinners. I'm just going to grab those for him so that they can go to the jail with them so the jail can see what kind of medication he's on. Um and then I'm also just going uh talk to your daughters real quick um and then we're going to get out of here and you can go back inside, okay? >> Can you please, when you're talking to them, can you please do me a favor? They blame me for divorcing him because I'm tired of being abused. Can you please tell them that it's not okay for a man to hit a woman? So that wouldn't have grown up thinking that that's normal. Cuz right now, I'm the one that's being blamed. >> Well, I'm I'm going to have a conversation with them. Wait, you can just stay out here. >> I'm good. >> My car's unlocked. Let me know if anything happens. >> Copy. >> What happens with the stuff on the top of the car? Does it go with you guys? >> It goes with him. Well, I guess it depends on what it is, too. >> It's his phone and his keys and his hat, it looks like. >> I would imagine he'd want his phone with him. >> He can have it in jail? >> No. It'll go with him. You can't You can't have anything. You can bring certain property. Unless he wants to leave that stuff here. >> He probably doesn't. He doesn't want me to see who he's talking to. >> I mean, it's a good idea for him to have the have the phone anyway, just so when whenever he is released, whenever he makes bond Um I mean, I'm sure he will. But he does have to see the judge. So. I would want I would want to be able to call somebody to say, "Hey, come pick me up." kind of thing. >> He doesn't have anybody. >> No family? >> No. All of our families are all his family is in Michigan. We just moved back down here in January. >> No friends? >> He has one friend over in Tarpon Springs, but I don't know if he'd call him. All of his combat friends are in Michigan, too. So. >> So, when you say he's struggling with PTSD, what does that look like for him? >> Anger issues. And he he says he's in therapy with the VA, but I never see him go or even talk to him on the phone. So, I don't know if he is anymore. He was for a long time. And he did start getting better. But it was like the happier unhappier he could see that I was getting the more aggressive he started getting, and it's like everything I do just instantly pisses him off. And he pushes me up against the wall and chokes me or he hits me or just whatever he feels like doing. And I'm just I just got done with it one day, and I'm just like, "I'm done with >> that's not okay. >> It's >> Have Have you called law enforcement before? >> One time back in Michigan, I think I did. I vaguely remember it. >> None here in Florida? >> No, none here in Florida. >> How long have you guys lived here? >> We lived here for 9 years from 2018. >> So since So it's been a minute. >> Well, we went back to Michigan for 3 years. So lived here for 9 years, went back to Michigan for 3 years, and came back here in July June in June. So but it's been over for a long time. We just didn't want to admit it. I don't know if you guys can put it in your report, but if he starts to look like he's having a heart attack and he's having a heart attack, please pay attention to that, please. >> Hey Scott. >> Yep. >> Can Can I just grab you back outside real quick? >> Yeah, sure. >> I got both the dogs pulled out. >> Yeah, you're good. Go ahead, boss. >> Albus? >> Yeah, yeah. >> This is just Albus? >> Yeah, yeah. >> This is just my supervisor. >> Okay. That's all right. >> We're right in the middle of switching day and night shifts. >> Oh, no worries. >> But yeah, we were in the hallway like she was already out. Well, I I wasn't even at the door yet. >> Okay. Um so she was out She was walking out the door, you were going ahead upstairs. Um she shuts the door, and then she just stays outside or does she come back in? >> She came back in like instantly. >> Okay. She comes back She comes out like and then turns around and comes back in. >> Yeah, comes back in and then that's when she's like, "Why'd you do that?" And I'm like, "Do what?" And that's when we got called. >> Yeah. Okay. All right, look, I'll be straight up with you. Um she's saying she's saying that you grabbed her by the back of her neck and pushed her out of the house, okay? Um she's got a little bit of redness on her neck. >> Okay. >> Um I'm not saying you're the one that's that caused it, but I'm saying she's saying you're the one that's that caused it, okay? >> Understood. >> Um because of that, I got to take you to jail for domestic battery, okay? I don't have a choice in this matter, okay? >> It's a domestic with injuries. >> I have a question for you. >> Go ahead. >> So >> I got to take you to jail for domestic battery, okay? I don't have a choice in this matter, okay? >> It's a domestic with injuries. >> I have a question for you. >> Go ahead. >> So, I know that Florida is a two-person state >> As far as what? >> As far as recordings. >> Mhm. >> Mhm. >> Things like that. I also had to barricade myself in my room, change [snorts] the coms on my locks, stuff to my guns, stuff like that because I'm the one who's fearful. >> Mhm. >> And I know you guys don't know all of that, right? And I know everything's hearsay. >> Mhm. >> So, because I'm the one who's fearful. >> Mhm. >> And I know you guys don't know all of that, right? And I know everything's hearsay. >> Mhm. >> So I mean, does that take into account for anything? >> So, it it will when you talk to the state attorney. It Jerkel. >> I mean, I already told him I said I don't know what's going on tonight. I said I don't know. But I can't even say goodnight to you. Because I understand. I understand. Well, I I'm going to respect you guys, okay? Because I understand. I understand. Well, I I'm going to respect you guys, okay? >> So And if if you really want to talk to them, I can let you talk to them in my car, but I just don't see the >> But again, I will respect you guys in whatever decision you guys This is your guys' profession, so >> We We will We'll talk cuz we don't want you >> That's what I'm asking. But again, I will respect you guys and whatever decision you guys This is your guys' profession, so >> We We will We'll talk cuz we don't want you going back in the house or something happening. You know what But unfortunately, she has an injury. She's saying it came from the incident tonight. Or did you just get angry? Like what's going on? >> No. I swear I did not touch her. This is unfortunately what I've been dealing with and what I've been trying to keep the peace with. I don't want to leave my kids. Um I'm at a loss. I don't know what to do because she's known that this divorce was coming for a long time. And it's like a switch just flipped as soon as it became real. And every day, it's like she's picking the fights. And it's Every day, I just got to go to my room. Lock with the I'm literally, not figuratively, lock myself in there just to keep the peace, you know. Because I'm tired of my kids seeing the fighting, you know. So, I'm doing everything I can. And now this just escalated. You know, so it's like I've been trying to play extremely fair. You know, if you look at our actual divorce that's been filed, everything is very, very fair. Like it's I'm not fighting >> her for anything. I'm not asking her for anything. If anything, I'm offering her stuff, right? Now it's like, okay, well, you're going to try to pull this stuff for for what? Like We've been married for 14 years, and I've given you everything you asked for. And this is how we're going to end it? You know, like getting the police called on me, you know, that This is not even the first time she's So, you know, like we had a an episode Michigan where I just finished surgery. I'm all bundled up. I was in the army. I'm all bundled up and she's attacking me. But anyways, so Anyways, I respect you guys. I understand you guys have to do what you have to do and you're going off of the best information you guys have so I'm not going to fight you on anything so >> All right, well >> Anyways, I respect you guys. I understand you guys have to do what you have to do and you're going off of the best information you guys have so I'm not going to fight you on anything so >> All right, well Be careful.
