During my years with the LAPD, I dealt with my fair share of crazy people. But calling your mother, who is a judge, mid arrest, that's one thing I've never experienced. Take a look. So, what happened? So, and you are being recorded. Okay. Um, she rear ended me and I got out of the car, asked for uh insurance info. She can't find it. I I hate to say it, but I feel like she might be under the influence. She's got a little kid in the car. I got a little kid in the car. I'm nine months pregnant. Okay. Talk to my partner real quick. I'll talk with How's it going? I know. I don't want to get arrested. You're not going to get arrested, dude. I don't want You're not going to get arrested. Can I see your license registration proof of insurance? Just so you know, you're being audio and video recorded. Okay. So, what happened? I don't You don't know what happened? I mean, she said I rearended her, but I don't see like any damage. Well, you still may have bumped her. Do you see anything? I don't. I honestly don't. I don't know. How much have you had to drink today? Not any Not a lot. How much is not a lot? You can. How much is not a lot? my daddy. All right, honey. I know. Let's here. Let's go over to this. No, no, do not start this car. Okay, I won't. Let's not go that that way. Okay. You are not free to leave. You are not free to start this car. That's fine. In fact, why don't you go ahead and pull the keys out and hand it to me. What are you going to be? You're free. Let me Let me see your Let me see your keys real quick. It's a uh It's a remote start. So, I will not start. I will hang on to that. Okay. Yeah. Are you keeping that? Nope. How much have you had to drink today? Not a lot. How much is not a lot? I could not. How much is not a lot? I had like two Bloody Marys. Okay. So, have you noticed that when we do these DUI breakdowns, they always say two shots, like two shots of vodka, two shots of tequila, and two Bloody Marys. It's always two. But that's never really the case because as you can see, she seems as though she's very very slow in talking. Kind of like a slur speech. I know the officer hasn't said anything about, you know, I smell alcohol emitting from your breath or even the car. Uh, you know what? We got to be really empathetic about this whole situation because you do have a kid in the car. So, I don't know, man. Let's see what happens. before I ever came to pick him up. Okay. So, please like What time was that? What time was that? At like 10:00. 10. I work from home. Yeah. So, okay. 10. Well, you willing to do some voluntary field sobriety tests to make sure you're okay to drive. Uh, I don't know. I feel like I should call an attorney only because my mom is a retired judge and I I don't love police officers or trust. Later on in the process is when you'll get the chance to talk to an attorney. So, it's either it's a yes or a no whether you want to do voluntary field sobriety test. But like there is no damage to our car. What is your name? There's no damage to our car. What's your uh what's your husband's name? What's a good phone number for him? He's never going to let me see him again. He really said Yeah. Yeah. Okay. [ __ ] So, that phone number is Honestly, he probably will get taken away from me. Like, am I going to get taken away from you? Not by me. Don't be Don't be telling if if you keep if you keep talking to him like that, I'm going to take you out of the car and I'm going to put him with a female officer that we have here. Divorce. Like, it's like But can I get a good phone number for him? Don't be don't be scaring your son. Anyone tell me I'm trying to scare my son? Like I love him more than anything. So the fact that you are dreaming something other than that is I just you will say is you know what if you love your son so much you shouldn't be driving when you had a lot to drink ma'am. You know you got to make better decisions. But again I'm not here to be the moral police or anything of that sort. Uh, but what I will say is, and I haven't said it in the past in other videos, is that body warn video is a really good thing as you can see because it depicts kind of like the whole story and more than anything what cops have to deal with in terms of empathy, in terms of deescalation, and obviously maintaining your professionalism and being respectful. But you could imagine before they had body warn video, and again, I get it. She says that she doesn't like cops. I don't trust cops. And yes, there's a lot of gaps that we have to bridge with the community, but this is a form and a way of doing so. So, I just kind of want to let you know that what you're saying is supered up. So, say whatever you want to say, but the fact that you wrote something down, you wrote it down exactly what I said. So the exact and then you're telling me Yeah. And the fact that you're telling me that I'm up because and you when it's the exact number I gave you. Yeah. And then tell me I want to do something bad for my son. You Well, I heard what you told him. What? What did I tell him? I told him Don't be scaring him when you were giving him the right Okay. You don't scare him either. I'm not going to. Hey. Um, so your wife has been involved in a collision. Everybody's okay. Um, she's not in any condition to be driving and so I am looking for someone to come pick up your son. Yeah. And I don't want to do anything until you come pick up your son cuz he's already, you know, crying saying that he doesn't want to, you know, go to jail. Um. All right. Um, one question. What um I mean it sounds silly to ask, but just for documentation purposes, um what is it that led you to believe that she might be um under the influence of something? Well, I mean, she's not like the most prepared. Okay. And like I saw her like coming out of the parking lot and she just kind of like she wasn't she was not paying attention. There was like a huge gap between my car and your car. And then like the other car like backed up and then finally she pulled forward and we were at another stop and that's when she slammed into me. Okay. I got out of the car and asked for insurance and she just kind of went all over the place. Yeah, I got you. Okay. Yeah. Well, um, now that we're at this point in the conversation, um, I actually was when you your collision occurred, I was parked down the street attempting to contact her about [screaming] a 5 minutes prior hit and run that occurred for these same circumstances. So, anyway, so this was already a um, developing thing. Um, I'm just bummed that it is what it is and that she actually was able to make it to the school prior to us catching her. Okay. So, not only do you have this ongoing DUI investigation, but you also have a hit-and-run misdemeanor that just occurred. So, now she's responsible for these two separate crimes. And uh it's just not looking good whatsoever. All right, you're good to go. Thank you very much. All right, Mom. I am so I am so like I didn't Mom, I can't talk anymore. The officer is right here. Do you want to talk to him for me or do you want me to answer his questions? Yeah, you can talk to him cuz I don't I don't need to talk to her. Yeah, you I'm not going to talk to her. She'll answer your questions. I'm not going to talk to her. Well, she's a judge, so she'll understand why I'm not talking to her. Here, I'll put you on speaker and you can ask him whatever you would like to. I don't know. I have no idea what's going to happen. Put me on speaker then. Put me on speaker. You're already on speaker. Can the officer hear me now? Yeah. Is it likely Oh my god. I can't believe you. Oh my god. What's that? Sound. Is it likely that she will be arrested? I'm not saying anything in front of a child. I will be. I absolutely will be because I am intoxicated and rearranged in other people and I'll probably get fired from my job tomorrow. Yeah. I'm Yeah. I would just recommend as your mother that you stop talking. Yeah. Well, I'm okay. I'm take [clears throat] Yeah. here for the rest of my life. Just blowing up the rest of my life. Blowing up. Yeah. Well, daddy's I know. I see daddy's truck. There's his dad's truck is right there. Right there. Okay. Okay. So, a couple of things here. Dad arrived at scene. It's going to help out with this whole situation. Now, as far as the mom, whether she's an active or retired judge, look, don't put your mom in that predicament. I mean, imagine if the officer does talk uh to this retired judge. What's going to happen? Besides the fact that she's going to end up being a witness to this DUI arrest, it's just not a good recipe. Uh it's not a very ethical thing to do from both the officer's uh lens and definitely from the uh the mother. out. You can pull over right in front real quick if you want. You want to You want to get out and go see your dad? Well, come on, buddy. There he is. Coming out this way. There's your dad right there. Right there. I'm going to talk. Okay. So, he doesn't want to do anything. Oh, there it is. Yeah. So, what I'm going to have you do like for sure or just have you stand in front of your car? do this. Wait, hold on. No. Come on. No, I'm good. I'm not wearing slippers. It's for your You You can take them off. Yeah. Come on. Come on. Okay. Wait. Hold on. Yeah. I need you to step out of the car. What do I do? So, they're asking you can take the field test. It's time to get out of the car. Yeah. Okay. Well, you just make your decision whether you want to take the field soiety test or not. You I don't have to. Right. Do you want to take? I don't have to. Do you want to take the voluntary field soiety test or not? If I take it voluntarily, they're going to what? Ask me to walk a straight line. We're done. No, we're not done. You're under arrest for do you? Go ahead and step out of the car. Okay. So, interesting enough that the mom is saying, "Look, Amber, take the FST. You got to do it, right?" And she's sitting there saying, "Well, maybe I should or not." Look, can we all agree that if she does the horizontal gaze n stagments, peoples are going to be flying everywhere, right? Uh the one leg stand and the walk and turn, nine steps toe to toe and turn around and walk in addition to other test. I mean, you tell me what do you think. Okay. Thank you. And just to let you know, you are under arrest for DUI and you are being audio media recorded. Do you understand that? Okay. Ask him about the car. Oh, okay. Car. Come on over here. My car. He has no right to his car. Well, we got to figure out if we're going to tow it or what we're going to do with it. Do you want it towed? Tow it tow my car. Or would you rather have him do something with it? No. Can you tow it to my house? No, we don't tow it to your house. It's not how this works. It would go to the toward. We don't want to. I don't want to, but there's no parking on this road. What do you do? What's the cheapest? I'm [snorts] not I'm not here to give you advice. Okay. You like, can you not just be a I'm not being a Okay. And to remind you, you are being audio and video recorded. Okay. Okay. Let's say I'm your daughter. What would you tell her to do with your car right now? What would you tell her? I wouldn't be here. You Yeah, you would. You would. Cuz your daughter can make bad decisions. Yeah. you. That's why I'm saying you cuz you think I'm a bad person, but I'm not. If it was my daughter, I would If it was my daughter, they would be dealing with it, not me. I wouldn't even be standing here right now. His daughter's car. What would you advise her to do? Not drink with uh her child in the car. Yeah. No [ __ ] But now that we're in this situation, what would you advise? Do you have somebody that can come pick up the car like Pronto? Yeah. Anyone? My mom. Where does she live? My husband that you just called. We just asked you. You didn't want to do anything with the car. So, that was I did not want He's okay moving it. If you're okay with that? Yeah. If not, we'll tell you. He won't move it. Is there anything else you need out of the car? My purse and my phone. Is it okay if I grab those two things? Please, too. So, it sounds like to prevent hau, she says that you can move the vehicle. Are you okay with that? Would you like me to stay with Is he going to give only a resident for overnight? Oh, it'll be very quick. Don't you worry. It'll be quick. Um, sometimes sometimes adults do naughty things too, right? It's almost like uh Have you ever been in a timeout before? It's kind of like an adult timeout. And timeouts don't last forever, right? They're usually pretty quick. Yeah. So, it'll all be okay. Were you just at school right here? How was your day? Good. It was good. So, was there an actual accident involved? Um, this was the second accident that she was reported to be involved in. I was within 10 minutes. Really? She reportedly had rear rented another vehicle at another location and then took off. Oh my god. Took off apparently to the school here. Blahol. Are we talking, you know? Say it again. I'm sorry. Blood alcohol level. Uh, if in my 10 years of experience, she's going to be pretty heavy. Yeah. Yeah, she's going to be pretty heavy. Um, I mean, I I didn't even stand within 8 ft of her. The car has the odor of it. Yeah. Um, totally. So, thank you guys. Appreciate it. Absolutely. Back to you, buddy. I'm going to let you and your dad get out of here. Okay. And I hope you have a great rest of the day. All right. If you need anything, you know where to find us. You know what I will say is that it doesn't get any better than what the officer just did for that child. Uh, the fact that he said it's adult timeout and kind of explain, you know, sometimes when you do these DUI investigations or like I said about traffic stops, you know, they're the unknown, right? you don't know what you're walking into. Uh it's those moments where cops give, in this case the child some sense of calmness, you know, cuz there's a lot of chaos in his life and it just sucks. It completely completely is just a horrible situation for all parents and the child and even the cops, you know, they have to endure, you know, it's a little bit of trauma. You know, imagine responding to DUI after DUI after DUI. So, okay, I'm going to go ahead and read some stuff, too. So, I need you to Pay attention. Yes, he is. I want an attorney. Okay. Do you But answer my question. You knew that. You knew that, too. I know. Answer my question. Do you understand your rights? You do that. Yeah. Do you understand your rights? Yes or no? My rights of having an attorney. Yeah. Talking to Absolutely. I understand that. Yes. And I asked you for one 2 hours ago and here I am still listening. Look, do you have an attorney you want to talk to or do you I totally have to talk to I will I have to look it up. My cell phone then I would look for an attorney and look my fingers work. So yes. Yes. Sit down. Okay. But camera look could you see that I would like an attorney and I would like to use my fingers to find one on my phone. Hi. Ask for an attorney, Amber. Yeah, I asked for an attorney cuz they they did let me call, which is who I work for, you know? I was just thinking right about now, let's just leave the mom alone. Like, why call her back? Or maybe you should tell her, look, don't call your mom. Don't get your mom involved with this whatsoever. I just don't get that part. I understand she's a judge and she's asking for advice, but let's get the judge out of this. But he hasn't responded. Is there anyone else besides you obviously, but mom, this is like really, you know, just let her know, hey, you're going to get your mom in trouble. Like, doesn't look good if you keep calling your mom and she's a judge. You know, don't use her influence to see what's going to happen here. The bottom line is you're being arrested for DUI and you got to do this uh breath test. That's what we got to do. Where's the officer saying? I don't know. Hi. Hi. So, she's already given opportunity to do the BAC, but we're trying to get her hold of her attorney first. He's actually calling back right now, so I'll let her talk. You're here. So as my attorney should I say you told me to will you submit to a breath test? Yeah sure. So there's a bunch of questions here. You want to answer these questions? I don't think I can with my hands behind my back. No, I'm going to I'm going to read them to you. Do you have any physical impairments? Yeah, my hands are behind my back and I can't do anything. I don't know what you You don't have to answer these questions. No, I'm just curious. Like right now, the way you're acting, I'm not going to take your handcuffs off. I told you you're not nice. You haven't been nice this entire time. So, you don't have to take my handcuffs off. Put me in jail cuz you're mad at me. And that'll all be on record on the video right there cuz you can't handle it cuz you're mad at me for not answering your little questions. No, I don't care if you ask these questions. That's great. Doesn't hurt me. No. Well, whatever this video has seen. I need to get my VA. Yeah. Take a deep breath in. Just slow breath in. Yeah. Just don't blow into the machine, though. Okay. No, that's not a good sound. You want to hear that high? There you go. Keep it just like that. As long as you can. Keep it going. Keep [singing] it going. You're almost there. Keep it going. You got it. Don't stop. You're good. Good. Good job. There you go. Well, I hope you and your wife never get divorced and that if you do, neither of you never go down a self attractive path. And if you do, maybe you'll end up here. And then maybe you'll have a little more empathy because you're kind of an [ __ ] You want to know your result? No. No. What is it? Good. You do? You do? Yeah. 268 277 251 261. Way above. Yeah. Okay. Ready? For what? Go. Okay. Oh, [ __ ] You want me Would you like me to open up the window for you? I don't care. I'm gonna look out like I'm gonna probably look outside and not talk to you. So totally that's totally fine. That's totally up to you. Whatever you want to do. You're welcome to open it. Just being like wait I've been drinking all day. So question for you. Yes, ma'am. So I'm just curious if I need an attorney again because um I have to work tomorrow, right? So I need to understand of like am I getting out? Am I getting arrested? If I go to jail, I need someone to come to the jail, bail me out, like all of that stuff. So as of right now, you are going to be booked into Spokane County Jail. Okay. Okay. Then you'll have to see a judge in the morning tomorrow. Yes, ma'am. And then the judge is going to decide if you're staying longer or they going to release. So I absolutely there's no possible way I could go on my work trip tomorrow, right? Like I need to I'm going to sleep in jail tonight. Yes, ma'am. Why would they make me spend the night in jail because you're under arrest right now for DUI? And I'm probably going to get fired from my job cuz I won't make the flight and I won't make the work trip. And that's what I need to just like start preparing for is like the aftermath of the reality of what I did, but then also the reality of like my schedule this week and what I can't do. Hi. Oh no, you're being recorded again. I am citing you for DUI. You're going to have to be in court tomorrow at 3:00. I'm also uh charging you with reckless endangerment for your child being in the car. Okay, same thing. Here's the citation for that. Okay, so some final thoughts. First and foremost, big shout out to uh those officers or deputies from uh Spokane County in the state of Washington. You guys did an outstanding job, maintain your professionalism throughout this whole incident, got the father to arrive at scene to help out and assist, and you were very, very empathetic uh with the child. Okay. Now, Amber did mention something about being on this self-destructive path. You know what, Amber? If that's the case, you have to bake better decisions. So many consequences can cause so much damage when you decide to get behind the wheel and start driving away being drunk and because you drank all day, especially when you have your child in the car. Okay, hope you learned something. Okay, so Amber was charged with the following: driving under the influence and reckless endangerment. She later provided breast samples and the reading of the blood alcohol content known as the BAC was 0.25 and 0.27. That is over three times over the legal limit.
