Let me see your hands. >> How far is over there? >> Cool, don't do that, all right? >> I'm cool. >> I'm telling you step over there. I mean step over there so I'm got you guys separated, okay? Just five more steps. >> All right, mister. >> Since you want everything to be exact. All right, what's going on? >> I was in the road here driving down here and I have no idea but this guy turned his car and you can see exactly where he parked. >> So, where were you coming from? >> He was coming from We were both at a stop sign. >> So, you guys were both stopped here? >> We were both stopped here. I was coming this way. You can see exactly where he pulled his car to cut me off and he made me run into him. >> Okay. >> He pulled his car into a fashion that like I couldn't stop and I ran into him and he got out of his car and he started yelling at me. >> Okay. >> And I said, "I did not do anything. You pulled your car." Look at how he pulled his car. >> I see. >> I said, "You pulled your car in front of me. What are you doing?" And he got out of his car and tried to attack me. >> How? >> He came up and put his hands on >> Okay. On your shoulders? Or where? >> No, he pushed me like this. >> I punched him back cuz I was scared for my life. >> Okay. >> Uh I have no idea what the why the [ __ ] he would pull his car in to make me run into him and I punched him and I backed away and he came at me again. So, I punched him again. >> Okay. >> And I backed away and he came at me again. >> Okay. >> And so, I punched him again for a third time. >> Okay. >> And he fell down on the the pavement. >> Fell down right there? Do you have your ID on you? >> Uh it'll be video. >> You got video? Video? Can I see it? >> I asked him twice. When he came at me the first time, I punched him. >> Okay, can I see your hands? >> And he was >> Just your hands. Can you put them flat out? Okay. And what's going on with this mirror? >> Uh when you cut me off, I pushed his mirror in. >> Okay. All right, just hang on 1 second, all right? >> He crashed into his car. I just want to make that >> Okay. >> Translation is for a 22 physical, maybe a signal four. Not 100% sure what's going on. >> How come you just pull up like >> Okay, yeah. Could you move your car? Did you run him yet? >> Uh not yet. >> Do you need me to? I'm on two. >> I just want to make it clear that he aggressed me. >> Okay. All right, so just so I got it right, okay? You guys were both stopped at the red light. Stopped at the red light, you're probably on the on the side of him, and then >> Yeah, and I have no idea what I did to piss him off, but uh I was pedaling this way, and he swung his van in his his uh his vehicle in front of me so that I had like I couldn't even break in time to crash into his vehicle. >> Okay. >> So I crashed into his vehicle, and out of anger, I punched his mirror, not in a way that broke the mirror, but in a way that like pushed it in. >> Okay. >> And uh and he got out of his car, and he came at me, and I said, "I'm not trying to fight. You crashed into me." And uh and he came at me with his fists up, and I I did punch him in the face. >> Okay, what's your phone number? Oh, no. Just hang out with him for a second so I can go over there. >> And I stopped after I punched him. I said, "Are we done? Are we done?" And he came at me again. So I punched him again. He was at me with fists up. >> Okay. All right, this guy got a little bit of a persona. Uh he said basically that uh the both of them were stopped at the light. The the light turned green, they were coming and then this guy swerved in front of him, I guess. >> From where? >> From like right here. >> So, they were both going straight? >> Yeah, they're both going straight and he says that he swerved in front of him causing him to crash into crash into him. So, when he crashed into him, um he hit the mirror. And then he got out and this guy came out all aggressive um trying to trying to fight in aggressive manner, so he was scared and then um he said the guy like pushed him and then he punched him. And then he backed off and then the guy came at him again, so he punched him again, backed off and then he punched him again and fell down. >> All right, there's a witness, I guess, Berlin told me who said that she watched or they watched everything happen and that there was a crash, this guy got out, he was all apologetic, not aggressive, and that guy attacked him. >> Okay. This What does he have on the video? I don't know if he's going to show you the phone. Yeah. Okay. Miss Danielle, can you go see if they saw what happened? Thank you. J-Dub is about to get his ass whooped. >> Is he going? >> Who? >> J-Dub. >> Are they going? Cuz he's going to fight. But we took him down earlier, he probably fought. >> Yeah, J-Dub and K-Hill and Anzalone are going. >> Cuz I just don't know what that's going to show. >> All right. >> I don't know what kind of angle he has. >> Let's see what this guy has to say about it first. >> coming? >> Yeah, Sharp's on his way. >> Okay. And what what part of your bike uh hit the vehicle? >> My whole entire side. He [ __ ] He pulled right in front of me. He swerved his He swerved his vehicle in front of me so that I couldn't like like so fast that I couldn't stop and I side swiped his whole his whole vehicle and and fell off my bike. >> Would your head hit his window? >> What's that? >> Did your head hit his window? >> My whole body hit his window. >> Okay, I'm just Yeah, cuz there's a smear on his window. I'm trying to see see if if your body or anything hit the window. All right, we're just waiting for a translator to come over and then um we'll move on to whatever needs to be done, all right? >> It's only two. I think he has a 10-50. >> Yeah, is Sheriff with him? >> I don't know. Sheriff said he's coming. That's why I called. >> I told him to call the police before he came at me. >> Okay, that's fine. >> I said call the police. >> Yeah, we'll do what needs to be done and then um like I said, waiting for the translator to come so we can get better information. >> I don't even know what I did. I don't even know what I did from the time I pulled up next to him and the light turned green. I had a little bit of momentum and I was trying to uh make this bike lane. I have no idea. I have no idea. I don't know >> Honestly, I don't know how I got knocked off earlier on the seawall. >> I don't know what, but he just like as soon as I was about ready to pull >> We're waiting on the corner for the translator. >> And you got that right? Like you saw you saw the you saw the angle of his >> Yeah, that's what we're trying to That's what he's looking He has dash cam so we're trying to see what angle he has. >> I also want you to know I could have rode off, but I told him to call the police. >> All right, I'm going to read you something really quick. >> Oh [ __ ] I don't got my [ __ ] on. >> Well, I'm going to read you something and then that's going to determine um you know, how this goes, okay? Um so you have the right to remain silent and anything you say can and will be used against you in a court of law. Having these rights in mind, are you willing to answer my questions? >> Yes. >> Okay. And have you asked either me or him for um a lawyer or someone to represent you? >> I have not yet. >> Okay. Where were you placed before the whole disturbance took place? Where were you at? >> I was at this intersection. >> Okay. Were you Were you at that light facing going towards the bridge or were you here? >> I was at that light facing this way. >> On this side of the street. So, you were here and then what? >> Um I the light turned green. >> And what was the truck facing? >> He was facing this way as well. >> So, you guys were both facing the same direction. >> this way. >> Okay. >> Um I don't remember if I was at a complete stop or if I had some momentum when the light turned green. >> Okay. >> I don't remember that. Um but the light turned green and I started pedaling this way to get onto this bike path. >> Okay. >> This is a path I take often. Um and as I was coming this way he pulled his van or his SUV in a way that made me sideswipe his van or his SUV. Out of anger, I did punch his window. >> The window or the side mirror? >> I punched the side mirror. I think I punched his window as well. >> Okay. Okay. >> After that he got out and he confronted me. >> Do you do you remember what he was saying? >> I don't recall what he was saying. >> Okay. >> Um but he had his fists up. He was coming out to confront me. He confronted me two times. >> Okay. >> And uh this did all happen very fast. I apologize if this isn't perhaps accurate, but I think it is pretty pretty accurate. Uh if he came out the second time tried to confront me with his fists. I think he pushed me before I punched him. >> Okay. >> When I punched him, he fell down and he got back up and came at me again. And I said, "Are we done? Are we done?" But he came at me again. I did punch him again. >> You I I hear you keep saying that he came at you in an aggressive manner with his hands up. Was it in a fighting stance or in a like, "Hey, what's up? What are you doing? Or like how was his demeanor? >> He walked all the way around he got out of his passenger seat and walked all the way around with his hands up in an aggressive manner. >> Like like a hey, what like what's wrong? Why would you do that? Or like a hey, I'm going to kick your ass kind of. >> Like it the way I interpreted it, I would not I would not my lay my hands on somebody that wasn't threatening me. >> Okay. >> If he if he got out and said, "Hey, why'd you do that?" I would have been like, "You cut me off. I don't understand why you did that." I would have had a conversation >> Okay. >> and been on my way. But no, he came all the way around. >> Okay. All right. So, I'm just going to we take both sides of every story, your side, um his side, and we got a witness. Your story does not add up to what he's saying and what the witness is saying, okay? Obviously, nothing what you're saying is not adding up, so I know. I I don't I mean, I wasn't here, so I wasn't involved in it, so I'm not the one to say this happened or this did not happen, okay? So, just right now I need you to turn around and put your hands behind your back. >> Can I >> Yeah, we'll lock it up for you. >> This is crazy. Did he have his uh his dash cam footage? I would have been willing to walk away from this, but when we when I get that dash dash cam footage We had one witness. >> Yes, one witness. And then so we got your story, his story, and the witness's story. Currently, we're going to go to the front. >> Okay. Do I get to press charges against this guy? >> For what? >> For attacking me, for coming at me aggressively. >> Like officer, I was wearing stripes. >> We take every the totality of the circumstances when we we investigate. Like you said, we weren't there, so we have to go on what he said, what you said, and what the witness says. >> From all we've gathered >> So, where did the witness come into play? >> With giving his statement about what he saw. >> but did they see him cut me off and force me into his vehicle? >> He forced you into his vehicle? He You saw? >> Mhm. >> So, you guys have body cam footage of the position his vehicle was in? >> It was parked on the that right side where it is. No, it was not. >> It was not parked >> Right. So, I don't have that I don't my body cam wasn't on where you guys were at. >> guy you have your body cam, right? >> I do. >> And you can see where that vehicle was positioned? >> It was turned 45° into this sidewalk. >> The bike lane. >> Into the bike lane. >> Was your bicycle in the bike lane or the sidewalk? >> My bike was when I was riding it. >> Yeah. >> I was riding aiming towards the bike lane. And he pulled his vehicle and you can see this on his body cam. >> Can I adjust my pants real quick? They're falling off. >> You can now. No, we we already have I spoke to you we we spoke to all the witnesses. Anything after you're going to say is just going to be used against you in court. If you want to keep speaking, you can. But, like I said, I already Mirandized you anything you say >> But, you guys saw like when you arrived, you saw the position his vehicle was in. >> No, but that doesn't matter. That the the position of his vehicle doesn't matter of what actions you made. Do you understand that? I get we're going about his vehicle, but again, your actions doesn't justify the reason why his vehicle was parked like that, okay? You still attacked him. >> Where is my No, no, he attacked me. He came at me. >> Okay. >> Bro, turn some AC on in here. This is crazy. That's where you you can hear him hitting it. It's hot. >> Bro, I need some AC, man. This is crazy. He left me in here, dude. Dude, this is crazy. Did you get his dash cam footage? >> I can't hear you cuz I'm going to turn the AC off. >> There's no AC. You already told me that, but did you get his dash cam footage? You got it? >> Yeah, you crashed into him way before the incident. >> Well, I want to press charges against him. Look at that. Look at that. Look at that. That's not somebody who's trying to drive straight. He swerved into my lane. He swerved into my lane. How is that not obvious? Did you not see the footage? Are you guys aware >> to watch the footage. What don't you understand? >> arrested me based on that footage. He pulled in front of me. You can see it clearly. >> He crashed into me. You can see clearly how he pulled in front of me. >> into you, >> You can see clearly how he pulled in front of me. Why would I crash into a car? Why [laughter] would I crash Why would I crash into a car, sir? >> The man was charged with battery and criminal mischief over $200.
