This school principal gets pulled over for drunk driving. What her friend does next makes everything worse. Take a look. >> Please >> You're under arrest. >> No, why? >> You were given an opportunity to go home. >> Can you slowly without her? I'm not It's not about >> Uh after after you answer my questions. >> You guys going to like arrest both of us? >> Yeah. >> Cops stop a woman after watching her swerve across the road. Then they realize she's been drinking and it escalates fast. >> Lady, good evening. >> Hi. >> Hey, do you happen to have your driver's license and registration on you? >> I have a copy of it. >> Don't have your license, but you have a copy? >> Yeah, I have it. >> Okay. >> I'm Jennifer. >> Good evening, Anthony. >> Hi. >> Ladies having a good fourth or I guess it's the fifth now. >> I can get it. My license is in my car. This is my car. >> Your car? >> Yes, this is my >> Okay. Okay. Well, she's driving so we got to have her license. >> I got I know. Where's your >> You still looking for it? What's your first name? >> Jennifer. >> Jennifer? >> We're both principals. >> Oh, you have a picture of it. Okay. >> Yeah. >> All right. All right. Okay. All right, then. And you said it's your car, correct? >> It's her car. >> Okay, that's fine. No problem. And where are you ladies coming from tonight? >> We're going We're going We're like two seconds away from the house. >> Yeah, but I said where I asked where you were coming from. Okay, that's fine. Just curious. All right. Miss Jennifer, you consumed any alcohol today? Cuz I can smell it, which Okay. Would you mind sitting back here so I can talk to you? Are you related to her or anything? >> I'm her best friend. That's why >> Why Right over here. Be careful. Why Why is she speaking for you? Whoop. Let's Let's not talk. Here, let's go right where the light is. Yep, just right there. Okay, say that again. >> She's worried about me. >> Okay, why is she worried about you? You're >> Cuz we are both high up high in total pole of, you know, education and >> Okay. >> our workforce, so it's it's it's hard and we're both uh married to police officers. >> Okay, allow me to interject at this point to say that if your best friend is so worried about you, perhaps she would have told you, "You know what? You drank too much. Let's get an Uber or Lyft. We can't be driving." Considering that you're high up in education, right? You're both principals and you're married to cops. And and I don't know what kind of decision-making, perhaps when you're drunk, right? When you had one too many, you can't really make some reasonable, good decisions, so therefore you might end up with a SFST, right? The field sobriety test and chances are you're going to end up at the Grey Bar Motel. >> Okay, well, my wife's married to a police officer, too. And I'm >> got home and I >> Is she currently married to one or is she have an ex? >> Um both of us are We just recently divorced. >> So, not currently married to a police officer. >> and >> Okay. >> I thought she was going to be the DD, but it didn't happen and so I'm just trying to get a quarter of the way home. I just moved. We just got divorced and I just moved. >> Sorry to hear that. >> Uh I don't know. You should be thankful for me. >> Well, >> I don't >> I don't know about the personal stuff, but just just to be clear, the reason why we're here is because you were get you guys were over by Minnehaha. >> Yeah. >> Okay, so you're over by Minnehaha. >> Mhm. >> Um and what [snorts] would that be? East Avenue? >> Yeah. >> You know where that is? >> Yes. >> Okay, you guys were at the light. When you're coming down Minnehaha, you're all over the road. >> Okay. >> And so the point even when you come around this corner, you're in that travel lane. >> Okay. So then I'm not sure about it. Okay. I trust you have leave you. I do I I don't know I'm going to leave you. >> Do you remember hitting the curb over there by like Morning Drive? >> No, I do not. >> Okay. So that's why I'm here. And then I go up, I talk to you. I notice you have like very slow delay reactions. I can smell the alcohol. Um you even have like slow blink, you know, your orbital sway like I say when you see >> I know it all. I've been there 20 years with my husband. >> Okay. So I'm just I'm just explaining to you why I got you out of the car. It's not every day that I usually have a passenger do more talking than the driver does. So >> Let's just worry about me. >> I'm worried I'm worried too. That's why I'm here. >> Because I'm a good person and I just don't want me to be >> So Jennifer, I never said you're a bad person. >> No, no, no. I wasn't talking about that. It's just >> All right. >> It's all about my future. >> Okay. Well, since we're in this position with you, you know, having operating control of the motor vehicle >> Yes. >> What I'm going to ask of you is if you would like to perform field sobriety exercises to dispel my concern >> I can't do that. >> Can't do it? >> Remember my ex was >> Your ex is irrelevant. He's He's not in the car with you. >> I No, I get that, but you know >> So I'm asking you cuz you're you're an adult. >> No, I can't. >> So do you want me to repeat it or do you understand what I said? >> I'm sorry. Repeat it if you want. >> Okay. So what I'm asking or requesting of you is that you perform field sobriety exercises to dispel my concern that you're able to safely operate Okay. So you don't want me to explain it? >> No. >> Okay. You sure you don't want me to explain? >> I mean you can you're explaining if you want to, sure. >> Well, I keep trying, you keep interrupting. So I don't want you to be confused. If you If you understand, you understand. I don't have to go. I'm just trying to >> You know what? I'mma going to BS on that. I want to say that she understands, but then again, she's impaired, right? So, maybe she doesn't understand. The fact of the matter is that if you refuse a standard field sobriety test, that's an automatic trip to the Greybar Motel without you having, you know, the three basic tests, right? And And by the way, if you new to the channel, we've had some really good full-body discussions about the field sobriety tests. Uh some of you think that uh it's designed for you to fail, right? Or for you not to pass. I think I said something like, "Well, it's a test, right? You're either going to pass it or fail it. Or we're going to determine whether or not you are too impaired to operate a motor vehicle." There probably isn't that many drunk driving suspects that have passed the field sobriety test. We haven't seen a video. But for the most part, you're going to get all those objective symptoms, and that's what it comes down to, right? The slurred speech, uh the odor of alcohol. By the way, I did my research. Uh ethanol has vapor. You can't smell it, right? And it reeks like alcohol. Anyways, just let me know what you think. >> The reason I'm asking that is because I would like you to perform field sobriety exercises to dispel my concern that you are able to safely operate that vehicle. >> I should. >> So, I know you've given me an answer, but with me saying that, do you not want to perform field sobriety exercises or do you? Okay, and you understand the recourse from that. What what takes place with it? >> I I I I think so. You can expand on that if you >> I I will. So, what that means is that I'm going to take the information gathered from your driving pattern and and the roadside that I made with you, roadside contact, and make a determination on what I'm going to do next. So, when I ask, that's you know, and you say you don't want to dispel my concerns, that's okay, that's your right. But then I'm telling you I have to take, based off what I have, and make a determination. Does that make sense? >> Yes, I do. >> Okay. >> Can I speak to you solely without another party or not? >> Well, I was just It was you and me here before she got here. >> Yeah, exactly. That's what I'm asking. >> So, do you want to perform the field sobriety exercises? >> Can I speak to you solely without her? I'm not It's not about >> Uh after the after you answer my questions. >> Okay. >> So, do you want to perform the exercise? Okay. And you do understand the adverse consequences. Okay. All right. So, go ahead and put Jane's mind back. Yeah, yeah. And on a side note, uh some of you have mentioned, I've been thinking about this too, is maybe we should kind of get away from the SFST. You tell me what you think because I was reading the comments and someone did make a point like, "Well, look, if I'm 60, 70 years old, 75, 80, and I don't really have a good balance, and I haven't had no drinks whatsoever, am I able to pass the I suppose the walk-and-turn, heel-to-toe, or the uh the one-leg stand? Maybe the horizontal gaze nystagmus one able to tell you the shaking of the pupils if they're large, if they're tracking, etc., etc." But, you bring up a good point, and I don't know, but we've been doing SFST since like the 1970s when we standardized the test for all officers, all deputies, all law enforcement agents across the nations to do that standard three tests, right? >> Hey, stay in the car. >> I know. We're good, I mean. >> Okay, stay in the car. >> We're like 2 seconds from home. >> Okay, cool. >> We're both school principals. We're like, come on. Don't do this to us. >> Do what? I do I'm standing here. >> I know. We're like >> Okay, I I I didn't I didn't say y'all did anything wrong. I'm just standing. >> I'm going to push the BS button right here. You know why? Because you did a lot wrong. You decided to get drunk and then go on a ride, right? Operate a motor vehicle to go home. That's beyond wrong. >> All right, so she is going to be arrested. >> No, she's not. >> That's >> Why? >> That's what that officer came to conclusion. >> Why? >> He came to that conclusion she was driving intoxicated. >> No, why? >> Okay. >> Come on. >> So >> Like we're two principals of two charter schools. Please don't do this to our careers. >> Okay, so that's not that's >> Okay. >> Please don't. >> It's not up to me. What's what's already done is done. Okay, it's done. It's done. So, can you call someone to give you a ride? >> I will, but please don't do that to me. >> Okay, call someone to give you a ride. >> But, come on. Please don't. >> someone to come pick you up. >> Call someone to come pick you up cuz obviously you're not in a good state to drive. >> I understand. I like >> And it'll be a danger to yourself and other people out on the road. >> I I understand, but I I don't want that to happen to her. >> Okay, so it's it's already done. It's already done. >> Why? >> She's already >> Why? >> She's already placed under arrest. She's already >> No. Please don't. Please don't. Please don't. >> It's it's done. It's done. >> Why? >> It's done. There is no There's no negotiating. >> Like we work for a really >> Okay, that's cool. Okay, but no no no no. You got to listen to me. All right? No no no no. >> You're listening to me. >> Get Get a [ __ ] ride here right now. We're done. >> I will. >> We're done. >> I will. >> It's already said and done. Get a ride. >> I will. >> Get a ride. >> We We legit. Like we We literally live to serve the community. >> That's that's cool. >> We're not [ __ ] trying to be nothing. We're trying to make our community safe. Please, you don't know my friend. She's a super good person. >> Okay, so it's already done. >> No. >> It's already done. The officer already made that arrest. >> No. >> It's already done. We're >> Please. >> Saying please gets you nowhere. It It's done. >> So, what do I do to help her? >> There's nothing you can do right now. >> Why? >> She's already under arrest in the back of a cop car. It's It's over. >> Please. >> The right thing to do The right thing The right thing to do would have been to get a ride home instead of having her drive. >> I will. I would have done that. >> Okay. >> I would have done that if you would just take care of me, please. >> Nope. >> Are you going to hold her down, can you hold her down, please? >> Uh no. >> I beg you, take me instead. >> Why you There's no There's no reason to take you. >> instead. Yes, please. Can you please take me instead? >> Hey, I'm just going to turn this off right now. >> No. Can you please please? We are two school principals. >> This This is her phone. She wants her phone. >> I know. Listen to me, please. >> Okay, I'm listening. >> Listen to me. We are two school principals. We need to [ __ ] live our lives for other people. >> Okay. >> Please. >> Well, cops live their lives for other people, too. But again, I I don't get this part. You know, please like 50 I think I counted like maybe 48 times. But that's besides the point. The sense of I suppose some kind of entitlement, childish, uh she looks impaired and probably is talking with slurred speech a little bit. I kind of caught that a little bit. But this is not going to get you no work. Your best bet is, again, get a ride and just leave the scene and let the officers continue their DUI investigation. >> Don't do this. Please take me instead. >> Hey, Christina, right? Christina, hey. >> Listen to me. >> I want you to I want you to listen to me real quick. >> We work for our school. >> mentioned that. I'm going to tell you something. >> Come on. >> Jennifer already made a decision. She wants her phone. I'm going to take it with her. You can call Listen, you can call for Uber or a ride. >> I will. >> Okay, go ahead and work on that. Does your Uber say it's here? What do you want us to do with your vehicle? >> So, where are you going to make her >> So >> You can leave her in Colonial. >> Do you want us to put it over there? >> I can put it over there. You can put it over there, whatever you want. >> No, we can't have you drive over there. That's the thing. So, you want us to go move this in that parking lot right there? Is that Are you good with that? Like 100% Are you I'm sure that cuz this is your vehicle. I'm not going to do what you want. >> I'm 100% sure you can put it over there. >> Okay. Can you stay out of the road? Here, the Uber's over here if you want to go sit down. I'll bring you your tea, okay? How's that, buddy? >> She's a school principal, bro. She's a principal of Harris. She's a good person. She's just trying to get me home safely. I understand. >> I hear you, buddy. I understand that you're upset about this. We we have a job to do, okay? >> I understand. >> It is what it is for now. Like, this this conversation isn't good for you. If you wanted to talk about this with somebody like when you're a little more sober, like sure, but this isn't a this isn't a good time for you, either, okay? >> Okay. >> But we helped you out. We didn't tow the car. Helped you get to the Uber. He's right here. He's uh waiting on you. You got your key back, right? >> Okay. So, how do I get my friend back? >> So, she she has to go through our process. >> Uh uh phone? Did she have anything? >> Yeah, she you'll have access to her phone. She can get phone numbers out of it. She'll be able to call you or whoever she needs to, okay? She has a process. It's not crazy like she's not going to not have a phone, but you just got to be patient and wait, okay? It's going to be a little bit. But I think he's uh waiting on you, okay? >> Thank you. >> Uh-huh. What's up, bro? Looks like Christine's going to drive. Hey, turn off the car. Why are you driving? >> I'm worried. >> Worried? >> It was something to care. Transfer to Lake to Harris. So, I'm just going to go and wait. >> Okay, well, we're in a different area now because you're driving and you shouldn't be driving. >> I understand that. Uh she lives right there. I was at her house and then I called and they told me that she was right there at the South Lake place, the South Lake whatever. They told me I needed $2,000 to bond her out. So, I went to the ATM, but my ATM card doesn't work. So, then, now I'm like stuck. So, I don't know what to do cuz she can't get out till 10:30. So, then I'm going to go back to her house right now. That's what I was doing. Like I'm not meaning to do anything wrong. I'm >> Well, well, I just talked to You were really drunk when I talked to you. It was a couple of >> I understand. I'm really not. I promise you I'm not. I'm just really worried >> Okay. Well, look, I can still smell it. So, are you able to do field sobriety exercises for me? >> I'm fine. Leave her alone. I don't want to go to jail, either. >> I don't want to go to jail. >> Well, well, chances are you're going to end up at the Great Bar Motel cuz, look, you decided to double down, which comes to a surprise. I want to say, in my years of patrol in LAPD, no, I did a straight DUI, but not two, right? I mean, come on. You got to make better decisions. I understand you're very worried about your friend, and that is that's a good thing to have friends like that, right? You have to make better decisions, okay? >> Talk about it with me, okay? We're just going to come to the sidewalk. All right, this way. All right, got a couple of questions before we get started, okay? All right, are you sick or injured? >> No. >> Are you diabetic? Do you take insulin? Are you under the care of a doctor? Do you have seizures? >> No. >> I'm going to go on this side cuz of the flashlights. >> And if I may interject again just for a little bit, she thinks that she can pass the standard field sobriety test. I don't know, let's see. >> All right, what's your question? >> What would you do if you were in prison? >> Not drive. What what what was your question about your options? >> I don't want to I want to be able to wake up in the morning and go get and be okay. I'll be okay. I'll be okay. What are the most important people in my people? >> Okay. >> The freaking cop was with this. I don't know what she said. I don't know what she did. She had a freaking abusive husband that was a cop. So, she has PTSD. >> okay? >> I understand. She probably gave him attitude. I'm not going to say she didn't, but >> Not relevant, okay? So, what we have now, >> right? >> I know. >> Do you understand where we're at? You said you're willing to do field sobriety exercises. You still willing to do that? >> I I I feel way better than it was before when you sent me home. I understand that. And I did go home. I was there for like 2 hours and then I called and they told me she was at Southgate. So, like they told me she was right there. So, I tried to pay it $2,000. They don't take it right now. So, I just want to pay it. I don't want to go to jail. >> What are my options? >> So, your options are you can do field sobriety exercises and if you say you're better, that gives you the opportunity to dispel my concerns that you're not operating a vehicle while you're intoxicated, okay? If you don't want to do those, that can be used against you in court, your refusal to participate, and I have to make a determination based on what I have so far, which I just talked to you. >> I know. >> You were really drunk and you were already driving again. Do you understand? >> That was a long time ago. I get it. I know. >> Yeah. So, you want to do field sobriety exercises? >> I'm I don't I'm I'm not sure what's like what's better for me and I I don't know. >> Your choice. I >> I just want to I would trade for her and it's like so it's fair. >> I got you. I gave you your options. You can do them or not. Up to you. >> Okay. >> So, what I'm going to have you do, put your feet together. Put your hands down by your sides and stay like this. This is I'm going to check your eyes. So, follow my finger with your eyes and your eyes only, okay? Um don't move your head and stay in that position while I do the exercise. Do you understand so far? >> Yeah. >> Okay. Do you wear contacts? >> No. >> Keep your head still, okay? Um so, the next thing I'm going to have you do is I'm going to have you come over to this line. It's not the most flat here, but is this flat enough? Do you feel okay to walk? All right. So, what I'm going to have you do, put your left foot Are you comfortable in those shoes? Do you have other shoes in the car or would you rather be barefoot? It's whatever you're more comfortable with. All right. So, put your left foot on that line. Put your right heel touching your left toe on that line. Put your arms down by your sides. Don't start yet. Put your arms down by your sides like this. >> I'm sorry about balancing like on a day, so it's this. >> Okay. But, so with in that position, can you remain like that while I explain the rest of the instructions? Do you understand so far? All right. So, what I have you do is from that position, you're going to take nine heel-to-toe steps on this line in front of you, okay? Um it's a continuous exercise. Don't stop once you start. Count your steps out loud. When you get to the end, you're going to take a series of small steps turn around, which I'm going to demonstrate. And then you're going to take nine heel-to-toe steps back. Feet together. Or like right there. Sorry, not like right up on me. So, right there. Stand like there, feet together while I explain the rest of the instructions. Do you understand so far? Put your feet together. Okay. Um so, what you're going to do is you're going to pick whichever foot you want, um and you're going to lift it about 6 in off the ground. Keep your foot parallel to the ground about the height of a Coke can. With your arms by your sides, looking down at your toe, you're going to count out loud like this. Don't start yet. 1,001, 1,002, 1,003, 1,004, 1,005. >> 1,001, 1,002, 1,003, 1,004, 1,005. >> All right, you can stop. >> [snorts] >> All right, go ahead and put your hands behind your back, okay? Put your hands behind your back. Put on your wrist. >> Well, because you you were given an opportunity to go home. You got it right. And then you made the choice to then go get the car that you were told to leave in the parking lot and drink impaired or driving. >> Please, please, please. We don't have anybody else. They close it like >> Well, she was going to be in there for 8 hours. There was no point. >> that, but please. Please. Do you think someone can get her at 10:30? Please. Thank you. Please. >> It's not 10:30. >> Please. She was going to get out at 10:30. Please. Come on. Go ahead and I'm not like a parent. I just passed a whole test. >> It's not a test, it's exercises. There's no pass or fail. >> but I just >> facing the car? >> Come on, please. >> And move your feet apart. >> Please. >> Do you mind moving your feet apart? I don't want to have to do it for you. Thank you. >> two kids. Please, I'm not doing anything. >> Is there somebody at home with their kid with your kids? >> Yes, their dad. >> Okay. As long as there's an adult there. >> So, how do we get out? >> You have You're going to have to wait 8 hours. You have to sober up. You can bond out in 8 hours. >> am. >> No. >> Okay. >> You can bond out in 8 hours. Do you have anything in your bra? >> No, I have nothing. >> Okay. >> Are you guys going to like arrest both of us? >> Yeah. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining the alcohol content. Will you take the test? >> No. Will you take the test? >> If you refuse to take the test as requested of you, your privilege your driving privilege, excuse me, will be suspended for a period of 1 year for your first refusal. Additionally, if you refuse to take the test as requested of you, you will be committing a misdemeanor in the second degree. If this is your first refusal in addition to any other penalties which can be imposed by law, if you refuse to take the test as requested of you, and if your driving privilege has previously been suspended, or if you have been previously fined under section 327.35215 for a refusal to submit to a lawful test of your breath, urine, or blood, your driving privilege will be suspended for a period of 18 months. Additionally, you'll be committing a misdemeanor in the first degree. In addition any other penalties which can be imposed by law, refusal to submit to the test as requested of you is admissible as evidence in any criminal proceeding. Do you still refuse to submit? Do you still refuse to submit? I need a I I need to know. Yes, you refuse to submit? Okay. Do you still refuse to submit to the test? >> My husband is a police officer. He's waiting a little bit. >> I thought it was your ex-boyfriend. >> Uh, no, ex-husband. >> Sorry, just got divorced. >> Okay, so ex-husband. >> ago. A few months ago. >> Okay, so >> I need you to understand that I'm a I'm a human being. So >> Okay, I hear you. >> It's cool. I know you're reading a paper, but like >> Do you want me to explain what the paper says? >> It's It's really hard for me to understand what you're reading when you're just spitting it out to me. >> So, what part of that didn't you understand? Do you want me to like give you an explanation of it? Or would you like me to read it? >> So >> So >> In my for me, it's like a primary lawyer. If I have to. >> Okay, so this doesn't This doesn't require This doesn't require a lawyer. >> It does. >> This doesn't. >> It kind of does. >> Can I Can I Can I talk? >> Absolutely. >> Thank you so much. I'm going to talk without interruption, right? Okay. So, this doesn't require a lawyer. This part doesn't require a lawyer cuz it's not any questioning. That's when you have a right to a lawyer. It's when there's questioning. This doesn't have questioning. When there's questioning. >> Right. >> Okay. This isn't questioning. This So, when you sign your driver's license, you are agreeing to submit to a test of your breath, urine, or blood if requested by law enforcement during a custodial arrest. Okay? >> Yes. >> That's what that's saying when you sign your driver's license. To drive in the state of Florida is a privilege. >> Yes. >> Not a right. >> Not a right. >> When you When you take that privilege, when you sign your driver's license, you are saying that when law enforcement officer requests it, you'll provide it. >> Right. >> You choosing not to, if you choose to say no, that means your driver's license is going to be suspended for a year. Which means you're not allowed to drive. >> Great explanation on her part. That's pretty much standard across the nation. It really is, even here in the state of California. If you refuse to submit to a blood, urine sample, it's an automatic suspension for 1 year. Then you're going to have to go to the DMV hearing, the Department of Motor Vehicles is what we call it out here, and you're going to have to plead your case to that I believe it's an arbitrator, a DMV hearing officer to let them know, "Hey, I need my driver's license. Again, I need to drive and here are the reasons why." Now, her friend has got it even worse because she decided to double down. So, I don't know if we were going to go to that hearing, I would imagine the hearing officer from DMV is going to be like, "No, you really made some very, very uh poor decisions." >> You're going to get charged with a second-degree misdemeanor for refusing to submit to a test because it's required. You submit to the test. You provide me breath samples. That's the alternative. You only have two options. You either provide me breath samples, I can't physically force you, but if you choose not to, I just charge you additionally. So, the DUI >> who would help me. >> I'm not possible. This does not require you or it's not any questioning. So, >> It sounds like I guess I can't. >> So, you if you refuse, just understand >> I refuse cuz I I have no one else other than you to help me. >> Okay, that's you're a grown adult, you're a grown woman. No, I don't understand cuz you're a grown woman. So, >> You should understand cuz I'm grown and it's me against you and I I don't know you. >> I don't know you. >> So, it's like I don't trust you, you don't trust me either. >> It's It's not about trusting. This is I'm having you breathe into something. It's recording on body camera. It's recording on body camera. And this is body camera, is trust me. Oh, okay. This is >> I've married 20-something years, so I trust me, I know body camera. >> Cool, great, me too. So, so just understand we are charging you additionally with a second-degree misdemeanor for for refusing to provide cuz that's the law. When you refuse to submit, the law is we charge you.
