I need you to tell me from beginning to end what transpired cuz I need to figure out if there's a crime or not. She I I think this all stemmed from we're having our RV worked on cuz we're getting ready to go on vacation. So, we had to disconnect the power of hers. Is that where she resides? Yes. And I did give her 3 days warning that this morning she was like, "How much longer is it going to be?" And I said, "I don't know." And then it exploded from there. Um, and she's just this far from my face screaming. Uh, she hasn't touched me. She did shove me. I don't know that he wants to press charges, but just here's the deal. You I don't need your intent to prosecute. State of Florida takes those charges. I spent four years as a domestic violence detective before I came back to patrol nine months ago. If I, God forbid, leave here knowing that she already swung at you. Now, she just told me she shoved you and she, God forbid, and I know that this sounds crazy puts a knife in your back. The question is going to be asked of me. Why did I leave her here drunk? And I am not willing to sacrifice my career because she wants to be drunk. That's her problem. And please, I'm I'm not trying to be a jackass. Not at all. Very good explanation. And look, let me just add to that is, you know, when I keep mentioning misdemeanors not committed in your presence, uh there is certain exceptions and this is one of them where you have a domestic incident, right? The relationship and in the state of Florida, it's different than the state of California, but this is one of those exceptions when a misdemeanor has been committed not in the presence of a police officer. Guess what? You have arrest powers. In other words, it's arrestable offense. And like he said, I don't need your statements. I don't need much of your cooperation besides you got to tell me exactly what happened because I got to fact an arrest and that's just the way it goes. I just need you to understand when it comes to that kind of allegation and someone that's intoxicated. I leave and I'm driving down there, she turns around and punches you in the face and now you two are fighting her. Everyone's going to want to know why I did not take her to jail and I can't do that. But so far I can smell the alcohol. All she wants to do is argue with me. I'm getting nowhere. So, here's what I'm going to do. First, I'm going to call EMS and I'm going to have EMS come here to see if she is well within her normal faculties to care for herself. If EMS says she is, I'm most likely going to take her to jail with me. Have y'all seen her drink or you just smell it like I do? Okay. Does she live with anyone back in that RV besides yourself? There is a person visiting her yesterday. You want me to go get him? Sure. That'd be great. How are you? All right. So, you don't have to answer any question that I'm going to ask. I'm just asking so that I'm aware. So, her as in Ashley's behavior of being a little intoxicated right now, I guess a little upset, throwing the chair, doing whatever she's doing. Is this normal behavior for her? Normal? No, I wouldn't say normal. Okay. Um, something slightly upsets her, but it just builds up out of that. Make sense? Does alcohol kind of change the way that she reacts to situations? Uh, if it influence her to be more aggressive, then yes. Okay. Yeah. Which, by the way, uh, are you a happy drunk? You know, I know when I have my um my old fashions, you know, I get a little happy, but certainly I don't get belligerent and act aggressive, combative, and then pretty much impairs me to get aggressive. I don't know. Some people do. You tell me. Apparently Ashley does. Like, you know what? she takes it to a whole another level. So then again, in your opinion, would you say this is kind of not going to say necessarily normal, but something that you may or may not have witnessed a handful of times over the last few years? I'd say a handful of times, but nothing where you know, of course, we get nothing like that. Okay. Have you ever seen her be violent with anyone? Yourself included? Touchy. Yeah. Okay. So, I'm not telling you what to do. However, understand that literally this Mhm. that what I just did to you, that little nudge, right, constitutes battery in the state of Florida. Okay. So, if you're new to the channel, I talked about when you have a handcuffed suspect, you can still use force as long as that force is proportionate to the circumstances, right? Look, if you're handcuffed and you're pulling away, you're overcoming resistance, right? And I talked about the three main reasons why you use force: affect and arrest, prevented escape, and overcome resistance. And just because you're handcuffed doesn't necessarily mean that you cannot use force. Congratulations. You guys are doing a great job through your badge. And I usually Don't move. Is this a terrible that you guys have to deal with this? Final thoughts. First and foremost, big shout out to Lake County Sheriff's Office for conducting a professional no stone goes on turn investigation. And to top it all off, you had a deputy who has that domestic violence experience for being a detective and investigator. Okay. handled it with a lot of professionalism. Look, biggest lesson of them all is, uh, Ashley, I hope you get the necessary treatment and the help, rehab, whatever the case may be, so that you can have a better relationship with your parents. Because here's what's going to happen. They're going to call 911 again, and here we go all over again. So, there's got to be a better solution as to how we can all get healthier and better in situations like this, especially when it involves family disputes. Okay? Hope you learned something.
