Margaret, we're not going to play this game. Okay. >> Thank you. >> Okay, let's go. Okay. >> On October 10th, 20124, officers were dispatched after witnesses reported a vehicle veering off the road and into a front yard. Margaret, >> what? >> So, I'm going to have you blow into this machine right here. Okay. >> You're an idiot. >> I'm going to have you blow into this machine. It's like blowing up a balloon. Okay. >> You blowing up balloons in your life, right? So, just you're going to take a deep breath in. You're going to go and then you're going to blow out. Okay? And you're going to blow in this machine for me. Okay? This is going to check your blood alcohol content. Okay? Are you fine doing that for me? >> Whatever. >> Okay? So, if you can look this way, just take a steady deep breath in and then blowing this. Oh, nope. You got to put your lips right around the stroll. Okay, you're going to have to do it one more time for me. Okay. >> No. >> Try it one more time cuz it did not get a reading. Okay, >> good. You're an idiot. >> All right. So, this this came back as a 143. Okay. And that was only for a brief second that you blew in this machine. Typically, I want you to blow in it for a couple of seconds. Okay. So, this was just kind of a small little reading. And it does show that you have alcohol >> in your system. Okay. >> Yep. >> So, that's what we're dealing with right now. Okay. So, what I'm going to ask for you to do, if you're willing to, is come out of your vehicle and take some more tests for me. Okay. No, whatever. Whatever. >> Are you going to be willing to do some more field sobriety test for me or you want to or do you or do you want to refuse all tests? >> Do you want you want to refuse all tests? >> No. >> Okay. Well, right now, okay, based off the call, okay, and you're driving, you being parked out here, okay, that I have enough probable calls right now to arrest you for suspicion of OVI, >> right? >> Okay. Do you understand where we're at right now? >> Yep. >> Okay. So, if you want to refuse all tests, then I'm going to go ahead and take you into custody right now and I'm going to walk you back to my car. Okay, >> you got it. >> All right. So, go ahead and remove your seat belt for me. Okay. >> Yep. >> Can you remove your seat belt or am I going to have to remove your seat belt for you? >> Yep. >> You want me to remove your seat belt or can you do it yourself? >> Kiss my ass. >> Okay. >> You're an idiot. >> Okay. I'm going to have you come on out of the vehicle. Okay. >> You're an idiot. >> I'm going to help you out of the vehicle. Okay. >> Nope. Well, you're going to you're going to come on out. Okay. >> No. >> You. >> Okay. I need you to come out of the vehicle. Okay. >> No. >> Are you able to walk? Do you have any bad legs? Is there anything wrong with your legs? >> You. >> Is there anything wrong with your legs? >> No. >> Okay. Are you going to willingly come out with me or do I need another officer out here? >> No. You need another officer. >> Okay. I'm going to ask you politely. Okay. Because if you don't come out, >> you >> Hey, look at me. Look at me. Okay. I'm being very nice to you. Q. >> If we're going to keep on playing this game, you're going to get a resisting arrest charge. Okay. Yep. That's an add. >> That's an additional charge. Okay. So, I'm going to have you get out of the vehicle. Okay. >> You >> Margaret, we're not going to play this game. Okay. >> Thank you. >> Okay. Let's go. Okay. You going to get out of the vehicle or we going to have to remove you from the vehicle? Margaret, >> you coming on out or I'm gonna have to get you out. You're coming out of the vehicle. >> You stop that, you [ __ ] >> Okay. >> Oh, you're an idiot. >> Let's just walk back to my vehicle. Okay, just stop right here. No. >> I'll patch you down and make sure you got nothing on you that's going to harm me. Okay. >> You're an [ __ ] >> Okay. Now, let's go walk back to my vehicle. Okay. >> An idiot. You're an idiot. >> Okay. Go and have a seat back in the back of my cruiser right now. Okay. >> An idiot. Oh, you're an idiot. Ow. >> You're an idiot. >> Okay. >> 436. >> No. You're an idiot. You're an idiot. You're an idiot. >> Go to hell. >> Okay. Since you now are in custody, okay, that you're under arrest, okay, for for sus for for suspicion of OBI, I'm going to read you your Miranda rights, okay? You have the right to remain silent. Anything that you say can and will be used against you in court. You have the right to consult with an attorney, have an attorney present during questioning. If you cannot afford an attorney, one will be provided before question at no cost. If with these rights in mind, do you want to talk to me or do you want to remain? >> Yeah, you got it. >> Okay. What else do you want to tell me? >> You okay? Okay. Gotcha. So, our next step is that I'm going to take you out to our sheriff's office and I'm going to offer you our test out there, okay? So, right now, you have to stay in my vehicle, okay? Cuz you're not going anywhere. You're in custody right now, okay? Again, you're placed under arrest for suspicion of OVI, okay? So, I'm going to take you out to the sheriff's office and I'm going to allow you to take a test out there, okay? >> You're an idiot. >> Okay? So, just go ahead and stick your feet back in here and [laughter] I'm going to I'm going to roll my window down. Okay. >> Whatever. >> I'm going to have you put your feet back in here. Okay. >> Yep. There you go. Okay. >> Okay. Whatever. >> I'm going to see if I can't get a form. I'm actually working the road. Usually I'm back in the detector side of things. So, I got someone else's car to see if uh you would you guys be willing to write out a statement by chance. Something quick just kind of what [clears throat] you seen her driving wise. >> You can write or talk or whatever you want. >> Okay. They prefer in writing, but if not, um let me see if I can find your form. If not, we'll just kind of talk real quick. >> I was going to say if we can go quick, it'd be nice just to just tell you what the heck happened. That's fine, too. >> Get to shelling corn. Nope. I I get it. >> Really move my fly. >> I get it. Gotcha. Gotcha. So, what did you observe then again? >> So, I came down the road. I was going to turn on town supply. This this white car was coming from the east. I was like, I thought she was confused where she was trying to turn. She wasn't turning up to intersect it. Going real slow. I'm like, "Okay, what's going on?" She goes by me and all once I see her and her head kind of rolls back. >> I assume heart attack stroke something. Okay. So I got on 911 and then I came turned around tried to get traffic stopped because she was in the middle of the road at that time. >> Stopped in the railroad slowly going >> slowly going like okay something's going on. So >> I was on 911 got the traffic stopped these guys came out they luckily cuz at that point they started to come in the yard and they got her stopped and hollered at her. She jumped up, shut it off and I guess that's the extent of it >> cuz you guys all live out here. Is that correct? >> I'm across the road. >> But this is your residence? >> Yes. >> Okay. Out here. Okay. Gotcha. So, other than that, um, I mean, if you guys got stuff going on today, I mean, you're more than welcome to to go back to the house. Like I said, I'm going to grab some pictures. I don't see any physical property damage. >> Um, so no, nothing hit as far as no mailbox cuz everything else on the other side of the street. >> So, nobody sees >> Yeah, I know. Yeah. She could have went head on with somebody. >> Hi there. >> Okay. Is this your vehicle then? >> Yes. >> Okay. Um, does she ever drink alcohol? Well, she's a recovered alcoholic, but uh I'm not saying she I haven't I have cuz I monitor >> Okay. >> my alcohol bottles. I've got them all more so to make sure that she's not drinking, but I know she's on some different medication that they just started on her own not too long ago. She wears patch. >> Okay. And that's what I wanted to make sure it wasn't something medical and I could smell alcohol in her breath, but I wanted to make sure it wasn't a mix of, you know, something else going on with her. Okay. Um, so like I said, I did get a very short um, PBT breath on her and they did test a 0.143, I believe, somewhere right around there. And that was for, like I said, just a quick breath. Usually, we want a 3 to 4 second breath in there. Um, so to get a reading like that, she she's definitely highly intoxicated. She is somewhat combative as well. Um, she's not answering any sort of questions. Um, kind of talking out of her of her head. She has no idea where she's at. You >> want me to talk to her? >> I don't. Yep. Hey, Margaret. >> He scared the [ __ ] out of me. >> Okay. Fred's here. Fred's going to take the vehicle back. Okay. Since that's his vehicle. Okay. So, he's going to take the vehicle. Okay. >> I have no concept. >> Have you been drinking today? >> No. >> I have no concept. >> They uh did a breathalyzer under your 1.4. >> I have no concept. No concept. >> Nope. >> Do you do you know where you're at by chance yet? Do you have any idea where you're at? >> I'm somewhere in Ohio. >> Okay. Um did you just have your nails done this morning? >> Yeah. >> Yeah. >> Okay. And what did you do after you had your nails done? >> Nothing. >> Did you stop somewhere and drink? >> Nope. Nothing. >> No. They're in there. They want to do some extra testing. You tell them yes. Okay. >> Okay. I want to know if you've been drinking or if it's something to do with your medication, you can take her. >> Yeah. Okay. >> So, we'll get her ran out to the jail. We'll take care of her and um I got your phone number. We'll stay in touch. >> Fair enough. >> All right. Cuz I can't come into the jail in there probably. >> You can't go back with us. Um I mean, you can wait out there. Um but I it's probably going to take a good 40 minutes or so until we'll be all said and done once we get out there. >> Yeah. I mean, I would prefer some blood tests to rule out cuz I know she's been working with different medications trying to get medications regulated. >> Yes. I don't know if it's really truly a medication thing as as more of a um an alcohol thing. So, the only test I'm probably going to offer her is uh the the breathalyzer if she wants to do some sort of additional testing um whether you know urine and or blood. Um that's something we could talk about as well. But um we'll get her out there, read her forms, and we'll go from there. Sound fair enough? >> Yeah. All righty. >> Keep me in touch. >> All right, sounds good. >> The woman was transported to the station for further testing where she remained fully cooperative and consented to a breath sample registering a 0.21. She was subsequently charged with OVY.
