This woman denied going to Walmart after police traced a parking lot crash to her SUV. >> Who's driving your car right now, officer? >> She was illegally driving? >> Who? >> Cops arrived after receiving reports of a hit-and-run at Walmart, only to trace the damaged car back to a couple who insist they were never there. Take a look. >> All right. Do you have a driver's license, your registration, your insurance? >> Yeah. >> May I may I get it from you? >> I'm not And I have a time frame and I had a witness just come up to me and tell me it was a black SUV. >> Okay. I'll have to go inside and get the video from the Walmart. >> Is this Geico? >> Yeah. >> Yeah, it should should show up. >> Um All right. Well, if you give me a few minutes, let me go see if they have video. >> Okay, thanks. >> All right. Um give me a few minutes. I'm going to go out there if you don't mind hanging tight here so I can get some photos afterwards and I'll bring you back your information, okay? I'm going to just go see if I can get some video first to see what's going on. Yeah, no problem. Yep, you're fine. You can just hang tight. >> Do I need to sign off? >> Okay. Is she home? >> Uh is your mom home? Well, you just I just dropped the grandkids off. >> Okay. Do you mind if we just go up now? >> Yeah. >> Okay. Hello. >> What's up? >> And is your wife home? >> Why? >> Okay, we need to speak with her about an incident that happened. Is the dog friendly? >> Okay, so before we get into the conversation with what I believe the husband and the wife who was driving the vehicle, allegedly, I got to tell you, man, state of Florida locked on to do follow-up investigations on hit-and-run misdemeanors that are not committed in your presence. I could tell you back in my days in patrol, we didn't do that stuff, man. We were chasing the radio, service call from service call to service call. So, the fact that they're actually going to conduct a full-blown investigation of this hit-and-run, you know what? You got to like it. Let's see what happens. >> Yeah. >> Okay. >> Don't shoot my dog. >> No. No, no, I'm just asking. I'm just asking. >> Akela, they want to talk to you. >> An incident? >> Yeah, we're we just need to talk to you about an incident that happened. >> You got a gun? >> Well, he's in training. >> He's in training. That's why there's an additional >> give a [ __ ] You all look the same. >> Okay, understood, sir. Well, we're we're just here to see what happened. That's all. >> Well, like I could give a [ __ ] who he is. You are three officers. For what? Like an incident that happened. You know what? >> We'll explain when she gets out here and we'll we'll tell you. It it's really we're just looking to get some answers, okay? That's all. Cuz Do you know where your wife was earlier today? Like approximately 2 hours ago, maybe? >> Absolutely. >> She was here? Okay. Okay. >> Absolutely. >> Tequila? >> Yes. >> Do you own this vehicle here? >> Yes. >> Were you at Walmart earlier today? >> No. >> You weren't? >> No. >> Okay, is there a reason why there's video of your vehicle at Walmart earlier today around 4:45-ish? >> No. >> What time is it right now? >> It is 6:30. >> I've been here the whole time. >> Is there somebody that would have been that would have taken your vehicle? >> Her vehicle's been here the whole time. >> Yeah. >> Okay, so there's no other reason why somebody would have your vehicle? >> No. >> And they'd be going to Walmart? >> No. >> Does anybody have access to your vehicle? Any extra keys? >> Real quick. >> Yep. >> I understand you got a lot of questions. What happened at Walmart? >> So, your vehicle is video recorded at Walmart hitting another vehicle and fleeing the scene. >> At Walmart today? >> today. So, all we're looking to know >> vehicle? >> This rear side. So, there's damage consistent as well here. Okay. We have photographs proving it. Like I said, there's video. So, this is consistent damage with exactly what happened. The all the red damage here, all the damage to the to the tail light is on the ground at Walmart. Okay? The video shows your vehicle backing out of a spot, >> Mhm. >> hitting another vehicle, and then leaving. And there's cameras everywhere that show your tag exactly on on that. So, that's why we're here today. >> At 4:45 >> At about 4:45. I'd have to pull the exact time, but that's what happened. So, is there anybody that that would have access to the vehicle? Cuz at this point, all I need to conduct is a traffic crash. That's why I'm here. >> Okay. So, I just want to say this. I know you're talking to her. >> Mhm. No, go ahead. >> She just told me you just started. Officer, I'm not going to disrespect you at all. But like, come on, man. >> Does that camera work? >> I don't know. >> You don't know? >> know. That's not our camera. >> Do you Are you the main driver of the vehicle? >> We're both the main. I mean, >> Who drives it more often? >> We're both 50/50 >> 50/50? Okay. So, nobody Nobody else would have had access to this vehicle whatsoever. >> I mean, I honestly I honestly don't know. I mean, there was several other people over here. >> Okay. >> There is a key we hang. >> Okay. >> Okay, I and I unders- I see by your okay that you're not trying to listen to what I got to say, but there I'mma say we're not trying to listen to you cuz you got to push that BS button. The officer has given you so much evidence. I mean, it can't get any more clearer with the fact that what? We seen this particular vehicle. You could have added that, you know what? This particular license plate. And we're about to find out cuz we actually have surveillance camera that's going to depict the driver because apparently the car drove close to the store near the actual camera. So, it is just a matter of maybe a couple of minutes or so where we're going to determine who actually driver was. >> We had a had several people here today. >> Okay. >> And >> Are you the sole registrant? So, this is you. >> I mean, obviously that confirms that. >> Okay. I'm just I'm just asking to confirm with you that there's nobody else that legally owns the vehicle, right? There's no other >> Not legally, no. >> But there's But there's no other >> like we said, there's been several people here today. We've been having a good time. >> Okay. >> Having a barbecue, having drinks. >> Okay. >> And >> Look, if if you don't know who took the vehicle, I'm just going to go about my day and complete my my my investigation, okay? >> going to be And what does that consist of for >> That's going to consist of trying to figure out who was driving the vehicle when this vehicle crashed into the other one. >> Okay. >> You got your phone on you? >> No, I don't. I legally don't have to. Here's your registration back. Um you can pull the record on my name for the rest of my investigation further, okay? Um like I said, this vehicle has been observed on video camera footage with the tag committing a crime, okay? >> So what, you'd be in contact if you >> I'll be in contact. Well, obviously your vehicle didn't damage Was this damage >> [ __ ] five cars deep with no [ __ ] proof like you just >> Two vehicles. There is proof. There's proof that your vehicle was in a crash, but not that you guys were in a crash. That's what we're here for. It's to find out who was driving. Your vehicle was in a crash. Right? Your vehicle was in a car That's what we're we're determining here. Cuz was this damage here yesterday? >> I've had damage on my vehicle for quite some time. Like I've had a [ __ ] car accident before. >> eight, nine people here >> Okay. >> right now. You know, we've been hanging out, we've been chilling cuz it's Memorial Day weekend. I'm a combat veteran myself. So, we've been [ __ ] partying. >> Of course. And um I'm sure that your your witnesses would be more than willing to vouch for you, correct? >> Witnesses? For y'all? >> No, your the people sitting here at your house, right? >> I Who Who >> They're just saying that you've been here, right? >> Who going to witness for y'all? >> I'm just asking. >> No, none of my people. >> Okay. >> My people not going to witness for y'all. >> I'm not asking them for anything. >> For the future, we not helping [ __ ] that's just trying to hurt us. >> Nobody's really >> they had nothing I If one of them did, you know what? You going to do your own investigation. >> Wait, I have to conduct my traffic investigation because this vehicle was involved in a car crash. Okay? Whether whether or not you guys know who was driving or not, the video shows that this tag and this vehicle were involved in a crash. Okay? That's why I'm here. >> I hear what you're saying. I mean, I I don't got no hater blockers like you do, but like we hear what you're saying. >> All right. Well, you guys have a better day. Like I said, I'm going to conduct our business. >> a great day till y'all pulled up. So, I ain't about a better day. Y'all have a better day. Y'all have a better day. >> Like I said, I'm just doing my job. >> that's showing out. What are we talking about? You know what I'm saying? That That y'all letting run [ __ ] >> You know what? Everybody always says something. You could be doing something better than to be here. Well, this is a crime. It's a misdemeanor crime. And here's the deal. That's all it is. It's probably a sight and release in the state of Florida. I don't know, but even a hit-and-run misdemeanor in the state of California, when you do that follow-up, you can actually just go through the booking procedures and sight and release and be gone about your day. But, the fact of the matter is that you kind of broke the law. And chances are you're going to end up at the Grey Bar Motel. >> Somebody could have grabbed it. >> Okay. >> And I could be completely wrong. >> Okay. >> But, I just have issues with people >> here accusing you guys of doing I just want to know who might have been driving the vehicle because the vehicle was clearly involved in a crash. >> Yeah. >> So, I'm not here accusing you guys of driving the vehicle. I have to ask and say, "Hey, were you driving the vehicle?" Right? Cuz that's the point of finding this out. >> Right. >> I don't I'm not accusing you. The point of reading your rights is so that you're aware of them because the the questions may or may not be incriminating. Obviously, you guys aren't under arrest. >> from not myself, but others. >> Of course. >> It's like when you read the rights, you know, you're kind of putting it out there like, "No matter what she says, you know, it could help her. It could hurt her and you have the opportunity to arrest her at any time." Or myself. Or myself. >> Right. It's It's indifferent. When I read your rights, it's not saying that you're going to jail. Contrary to most beliefs, it's not saying you're going to jail. It's simply saying, "Hey, I might be asking you questions that may or may not be incriminating to yourself." That is why we read the Miranda warning so that you are aware of what that is. >> Okay, so real quick question for history. >> If I get asked that by you right here. >> My You're You're asking about your Miranda rights. >> Let's say you read them to me and not her. >> Okay. >> When I get arrested, why do you read them again and and make me sign if this is legit? >> What do you mean? >> Let me help you out with that confusion so I can give you a little more clarity about Miranda warnings. Okay, look. The Fourth District Court of Appeals in the state of Florida in 2017, Davie State. Davie comes into the station on his own, okay? His infant son was hurt. Okay, he was injured. Before any questioning, the detective reads him his Miranda rights. Davie says he understands and he agrees to talk with no lawyer. Now, this interview lasts for hours. It starts friendly, then it turns very accusatory. Davie makes incriminating statements and he later moves to suppress those statements. This is his argument. The warnings came too early. He was not in custody when they were given. Once it becomes custodial, police had to read Miranda rights again. Now, here's what the Fourth District Court said, "No. Miranda is required only in custody. A person who is not in custody can still waive his rights. In fact, he's in a better position to do it, right? He has not been arrested, not been handcuffed, and not been booked whatsoever. The early waiver stays good even after the tone of the interview changes. Check this out. The police do not have to guess like this magical moment or the exact second that custody begins. Then stop and read the same rights all over again. The statement comes in and that conviction was affirmed. You got to give Miranda early in a voluntary interview, okay? Those are the lessons learned. The waiver can carry through once the interview turns custodial. And I was educated by that because back in my days, we didn't do that. The way we were taught is custody plus interrogation equals Miranda, all right? >> What do you mean? >> Okay, so let's when I connect the investigations? Let's say you guys arrest me, right? Or take me in for questioning. >> Okay. >> You read me my rights. You make me sign a piece of paper, correct? >> That is something that the jail would do. Personally, on the deputy level, on the investi- >> station. >> Uh no, we don't do that. We don't do that. We don't do that. We don't do that, sir. Then the investigators will do that. >> So you're saying that the jail has their own >> Jail has their own procedures and I our investigative division has their own That's why they might make you sign. It's because they did They weren't here at the time of Miranda being read when I was here. Does that make sense? So even though the camera shows that you've been read your rights, what they do is they do it a second time to verify that you are fully aware of what your rights are and then you sign a paper. Does that make sense? >> It makes a lot of sense. I like it. It's a good practice. Uh as a matter of fact, maybe here in the state of California, they should be practicing what they're doing out in Florida. >> All right, do you have any further questions? Okay. Well, you guys have a better day. Thank you. >> You guys have a >> I Why does that mean she had to be driving? She was not the only person in this house. She was not the only person in this house, officer. >> Answer the question. Who else was driving? >> Officer, there is other people in this >> I asked you a question. Answer. >> other people in this house right now. >> Answer. Who's in the house? >> You know, if you're Carolise right now, who's driving your car, officer? >> My car's right there. >> That's a [ __ ] job car. Who's driving your car right now, officer? >> I don't have a car. That's my >> You don't have a car? But you got to ring yourself up. >> to tell me that you, sir, are hiding something because you're being very evasive. >> something? >> Absolutely. >> Uh what am I hiding? >> All right, so here's what's going to happen. Charges are getting forwarded on you cuz you were driving, okay? I may not have proof of it from the cameras across the street, but you guys lied to us. You No, no, there is no backing out of this. All right? You told us this car did not leave. >> Officer. >> You told us this car did not leave. >> Officer. >> What? >> I said I do not remember this car leaving. Now, >> Okay. >> Who did on. Okay. We were cutting grass. We We were doing our job. I To be honest, I never seen it leave. I never seen it come. I never seen it go. I never seen anything. I was with my stepson. We were out here in the grass talking about the grass cutter. You know what? I'm not trying to put myself in it, but you know what? My 16-year-old uh uh stepdaughter who has a permit drives this car. I drive this car. She drives this car. I use both our vehicles for illegally driving? Who? You need an adult. No one got out of the passenger seat. I'm not saying she was driving right then, also. I'm just saying there's other people that drive this car. That's all I'm saying. I understand that. Look, this can be all squashed, okay? All we need is just a little bit quiet. Someone drove this car, and I know it wasn't you. It's a civil matter. It's an accident. It happens. Okay, so what are you trying to infer that you need? Like you were sitting there trying to pinpoint and say was involved in an accident. We have all of that. are you trying to infer right now after everything you sitting there or trying to say you that this car left Right now, what I'm inferring, someone is lying. They're pulling video right now to see who was inside the store. So, if if that video comes back to show you're in the store, would you have been in the store? Or obviously you were here cuz the camera pulled it that you were in front yard. So, No. would it show that you're in the store? No. Okay. Push that BS button cuz there's enough evidence to believe, right? A set of articulable facts. We got the video surveillance, you coming out of Walmart, lying about it, right? We have the damage, the tail light, it's splattered right next to the car that you hit, and we have a witness statement that describes the car. So, that is sufficient evidence to believe with these facts that you committed a crime, and that's your PC. So, you got you don't have any recollection of going to Walmart today? No, I did go to Walmart. >> But I'm explaining the process of a a crash report. Okay? Both drivers get each other's information >> so that insurances can collaborate on what's what's getting fixed. >> We've been down that road before. >> Right. So you've been there before. You understand that the insurances handle it civilly. Nothing is criminal at that point. >> we knew we did we >> You stick around, take care of it's some little bit of paperwork. >> before. >> It's a little bit of paperwork and you go about your days perfectly fine other than some obviously some damage on your vehicle which is unfortunate. But that's how it goes about. And then it's paperwork and gone and done with for the rest of the day, right? Until the insurances handle it civilly. >> Okay. So >> At this point this vehicle was visually witnessed on a video which pulls your tag, which shows your tag that this vehicle was at the location and did commit this crime. And given that it left, we need to find out who was driving because that is a crime. It's a misdemeanor infraction. >> If they knew that they hit the vehicle >> You it's >> If you don't know you hit a vehicle >> here's the red flag. It's like No, no, here's the red flag though, okay? Going across the street after talking to you guys, you said You're saying you believe it didn't leave that you could recall. Okay, I get that. But what I'm seeing across the street is you hanging out in the front yard and the it pulls into the driveway. And you're telling us you believe it didn't leave. >> I don't remember that. >> Am I allowed to I I got to Can I ask you something? Am I allowed to go talk to your stepson? >> We're not doing no minor talks >> Oh, okay. >> We're not I prefer not to. >> Got you. >> Like because you know what Like I said, like I said, we've had several offers to come, park around the corner, come here for a welfare check off off uh their their father saying um you know, since we got into it at Turn Bike Week he's been doing uh home checks on us. >> Right on. >> Everything's been good. You know what I'm saying? Everything's been straight. And kids come out, everything's good. You know, so I already had a problem with the way y'all operate because when they walked out last time, the officer said, "Hey, your dad loves you." I'm I'm dad around this [ __ ] okay? So, that's why I came with an attitude. And you know, if I disrespected anybody, you know, especially especially any one of y'all. >> Okay. >> Yeah. >> I'm going to apologize for myself and my family, like >> Well, cuz my mentality is if we swapped positions, let's say. Not you and I, but you and the other party involved. >> Yeah. >> You would be just as concerned, and you would want this. We're not here to embarrass your household or your property. We're here for a lawful reason. Your vehicle was involved in an accident. An accident. We call it an accident cuz it was unintentional. Okay? Because I asked >> saying in the >> I I asked if I Let me finish. Let me finish. I'm going to say it again. >> Sir, what is your name? >> Okay. That's fine. >> Sergeant Bis. >> We asked, "Did this car leave?" You said you don't believe so. You said no. Okay? And I went across the street. I may not see who's driving, but it pulled into the driveway >> Mhm. >> at 5:46. And you were in the front yard with your son, and you don't want me to talk to your son. >> neighbors in my house >> Why would we want you to talk to our minor son? >> I'm just saying I'm not forcing it. It's just suspicious. >> We had a >> How is that suspicious? Like, why are you going to sit there and try to question somebody? >> you my kids have been through enough with the police, okay? >> Maybe your son could help rule out that you didn't leave. >> How long ago How long ago did this uh damage supposedly happen? >> Supposedly it's supposedly happened, Sergeant. >> Yeah. >> It was at least 6 months ago. >> 6 months? >> It's been falling out and >> Sandalwood cuz >> initially it was just this. And over time it's >> Mhm. >> more kept falling out. Like this is [snorts] on its way >> Yeah, I mean that's already loose. >> Yeah. >> Which why would it be >> We've been holding stuff in. >> Well, you know, we do have a car wash membership and you know, it goes to the car wash quite frequently. >> Uh-huh. >> And we got definitely >> I mean there's tiny little pieces. If you're doing the car wash every day these tiny little pieces wouldn't be here. >> They've been falling out this for for the last >> more than just this. So and like this >> These are held in. >> wasn't in. Right. >> That was already >> I was just blowing on it and those flakes were just coming off, man. >> See all the little tiny things in there? >> I'm not saying >> I'm not making it up, you know? >> I know I know but you're saying you you know, you're putting certain words like when did this allegedly happen or when it when are you saying >> that's a fair statement. Cuz I don't know. >> For you it's a fair statement but it's not fair to us. [clears throat] >> Well, I'm asking you. It's a fair question. >> fair to us. >> Cuz I don't want to accuse you. I just want to you know Yeah. >> Right. Like you're trying to say like the whole vehicle >> You got vehicle the vehicle the front, the back, the side >> You're doing the most right now. Like you're just in there saying like certain things. >> Like any scratch on it is apparently from this accident. Come on. >> No, the only scratch from the accident is the corner of the panel. >> Yeah. >> Okay, but yet he was sitting there talking about certain things. Like how are you going to sit there and say that >> Allegedly like like the sergeant said, allegedly. Yeah, there's no doubt it was in a car crash and >> But how are you going to explain saying it was recently though? Like >> Because it still has debris. Nope, you don't need to be touching it, okay? >> But no. >> Or somebody already did touch it. I can see where somebody was wiping it off. >> The way you're saying like no, it's been >> See all the broken this is brand new pieces. >> quick real quick. >> See >> look how loose that is. >> We've been doing >> That doesn't matter, sir. >> See, this is wedged up here. That's a wedge. We specifically don't open the back so this thing don't Okay. >> bash on that. Like every time. So, we don't open this because it keeps messing this up. And the last thing we want to do is last thing I want to do is have a drink and swerve like this two times and I get stopped for a brake light or a tail light being white instead of red. I've been worried about this. She's been worried about it. I've been worried about her driving like this, too. >> Sir, are you are you trying to tell me this did this vehicle did not go to Walmart today? >> What I'm trying to tell you is that I did not see this vehicle leave. >> Okay. >> The other officer said, "I seen it pull in when I was with my stepson out here. We were working it cuz he cut the grass." >> Mhm. >> You ain't sweating. >> No, I'm getting them there. >> No, you're not. >> You're not sweaty enough, Mr. Vic. >> Oh, I sweat it. I believe it. >> But, you know, he's he's said it. He's seen me do it. But, we were doing the the grass thing like, you know, I'm making sure that he get paid for what he did or not paid for what he didn't do. And we was talking about that. I I never seen it pull in or pull out. >> Mhm. >> At that time, there was several other people in the house. There was >> Neighbors, friends >> yeah, I'm not pointing no no fingers, but there was several neighbors here that have had permission to move our vehicle to take our vehicle to maybe get more drinks or maybe get >> Sure, yeah. Whatever. Yeah. >> Hot dogs. >> Yeah, yeah, like, you know, like we just celebrating Memorial Day cuz this is Memorial It's not my holiday, but it's people who I lost when I was over there. This is This is our holiday. I celebrated it for them cuz they can't. >> Mhm. >> I'm sure you understand. >> Yes, you may. Yeah. Yeah. >> Sir, do you mind, sir? >> Sure. All right. >> The same thing. >> We'll finish this Well, yeah, we'll finish this in a >> Um today I went in today. >> Well, yesterday I went in the bank. >> I got prom. Okay. All right, sir, do you mind stepping back here with Mr. Preddy? David Preddy. I need you to come back here with me. >> The barbers. >> There's a couple over there. >> All right. >> All right, put your hands behind your back. >> You've been placed under arrest. >> You've been placed under arrest. >> Okay, I got to step over here. It's my [ __ ] house. Okay. You got her? [ __ ] out. >> [snorts] >> Can you give him my Can you give him my keys? Here. >> Your vehicle keys? Or your house keys? So, that's the vehicle keys you have? >> I Yes, I unlocked my vehicle to get that Here, Mr. >> this >> This >> is my car key. Give it to my husband. >> Is there anything that you want to come with you? >> I have nothing. >> Okay. Do you Do you have a bra on? >> No, ma'am. >> Well, now we Now we got paperwork to do. >> Public roadway. I don't have to leave. >> Okay, all right. Well, I'm on a public street, too. So, what? I'm I'm on a public street, too. So, what's up? >> You told us to leave. We're simply educating you as to the public >> So, you didn't leave. I didn't leave. So, what the [ __ ] we going to do? A standoff? >> Final thoughts. First and foremost, big shout out to Flagler County Sheriff's Office. You couldn't ask for better deputies to conduct a follow-up on a misdemeanor that wasn't committed in your presence. And the biggest lessons of them all is when you get involved in an accident at a parking lot, wherever that may be, you know what? Leave a note. Okay, take some responsibility and the cops would have never done a follow-up or showed up at your house, okay? Hope you learned something. Up next, I'm looking at how a routine call can turn into a deadly standoff with officers coming under gunfire. >> GET INSIDE THE HOUSE! >> BUT THAT'S OVER ON MY SECOND CHANNEL, where I'll be covering some of the most critical incidents in policing history. Okay, so Tequila Nelson was charged with offenses related to the traffic collision, along with alleged evidence tampering. The case was later handled through the courts and the investigation was closed. Okay, so let's go ahead and click that like button, that notification bell. Don't forget to subscribe.
