This woman threw an espresso cup, but Florida cops call it a deadly weapon. Hi, big guy. She did this. She us, bro. I'm going to become a felon. Cops respond to a report of a woman throwing a coffee cup at another car during a road rage incident. Hours later, when the officers track her down, she immediately denies throwing anything. Take a look. And there was a a moving construction. They were doing potholes. Mhm. So, as we approached them, I started to merge over. I was in the inside lane. and she saw me merging and tried to speed up to not let me in. So, I just kept coming over. So, she actually pulled up alongside of us on the shoulder and was giving us the business. And I'm like, "Yeah, whatever." So, then after the as soon as we got by the trucks, I went back into the inside lane, and she pulled up alongside of us, rolled her window down, and we thought, "All right, she's going to start yelling at us, whatever." So, I just said to my wife, "Just ignore her." And then the next thing we hear is bam. And so, she threw something at the car. Mhm. Yeah, it's not a big dang, but this is this is brand new. And this this is definitely new right here. Yeah. What kind of car did you say it was? It was a white Chevy Traverse. Okay. She's got a picture of the license plate. As soon as it happened, we we she sped away, but I spent we caught up with her. What did she look like? was she was a white female um seen glasses maybe ponytail blond blondish hair I thought it was more brown dark dirty didn't take dark brown maybe dark brown and we think she had a passenger but we didn't see them so it's up to you guys if you want to take her criminally I could try and find her and figure out who she is and try and file charges on them let's I say press it I'm going to press it you know what I'm going to press it too let's all press it for a couple of reasons reason. So, before I let you know, I'm a little biased because that SUV, I got the exact same one. It's got all the bells and whistles. It's the Ford Explorer ST model, twin turbo, and man, it's the cop me. I can't let it go, you know, for whatever reason. Now, let's get to the good stuff here. Chances are we're going to do a followup, which is great. Follow-up investigations on the misdemeanor not committed in your presence are good to go. With that being said, I think they call it criminal mischief is what they call it. destruction of property, maybe even felony vandalism. But Florida does have what they call a deadly missile statute, and we're going to find out what it is a little bit later on, but let's see what happens. 1401 to 1411. Uh, they want to press charges, but also the RORO of the other vehicle has an active 69 FYI. And the main the main thing is one finding her and two none of the business cameras go to the road and because like she was next to you guys it's going to be like right between Yeah. like blocking any cameras. Yeah. It's going to be unless she I can get her to admit it. It's going to be hard to prove and take her to court. 1412k. Well, we're getting ready to move. Sorry. Nope, you're fine. Oh, I'm officer with the KO Police Department. Hi. Do you guys have ID on you? Um, no. You don't? No. Okay. Sorry. What is your first name, ma'am? Uh, what's going on? Well, we have this vehicle. Okay. Uh, reported in a disturbance earlier where an item was thrown from this vehicle to another vehicle. Okay. Do you recall that incident? Um, No, we've been home. This is the first time leaving. What's that? This is our first time leaving today. Yeah, we just got food. Okay, awesome. Do you have ID with you? No, I don't. You don't? Okay, I have ask you to step out of the vehicle for me. Okay. What is your first name? Maggie. Maggie. Okay, Maggie. Face the vehicle for me. Do you have any weapons on you or anything like that? You don't? Okay. Go ahead and place your hands behind your back. You're just being detained for right now. Okay. Sir, do you have ID on you? I don't. My son actually lost my ID a while ago. Okay. What is your first name? What is the reason? One of my I haven't done anything though. Well, because this vehicle was involved in an disturbance earlier and I'm investigating. I don't know who was inside the vehicle. Call my parents right at home with my son all day. I'm going to ask you to stay off the phone for me cuz this isn't a current investigation. That's fine. My child in the car. Okay. All right. Go ahead and put the phone down for me. Call my parents. Put the phone down. Okay. It's my scene. I'm giving you a lawful order. Okay. 14. Okay. I just want to say what I did. I was been at home with my son. Okay. We'll figure that out in a second. Can you grab him? Can I step out for him? Yeah. He's going to step out for you, B. You got any weapons on you? No, I have no in my pocket. This is vape. Yeah. What's your name? Xander or Xavier? Yeah. Good. Can someone please call my mother and father-in-law so they can grab my son? He's in the back. Yeah. All right. Yeah, we'll do that. You got warrants? I got to take your hat off to you. All right. Thanks. You just double checking real quick. Yeah, no problem. No necklaces or anything like that. Really hope she doesn't get in trouble cuz that's not our car right now. Just got a new house and a dog and Oh, yeah. Well, she just has a couple warrants for um Yeah. Yeah. So, she might get a bond, so she might be able to get out right away, you know. So, I don't even think they have to transport her to I could be wrong. I don't think they they can transport her to collier. I think they could just if you could post a bond there. I think they can just let her out. All right. Do you know your parents phone number or her parents phone number off the top of your head? She'll be astounded to hear this [ __ ] Little. Is that the husband? Yeah, he has a warrant. Yeah, he has a warrant, too, right? There's a kid on the car. Yeah. Three-year-old. Uh, I'm going to grab the phone. We're going to call her parents. You say you don't have any ID on you? Um, no, sir. No. Nothing illegal in the car? No, sir. Okay. Go and take a seat for me. Okay. Spell your first name for me. M A G G I E. And where are you living at currently? Okay. What brings you into Cape Coral today? I'm door dashing. You're door dashing? Okay. Do your parents live here in the Cape? Um, no. We all live in Bonita. All right. So, I'm going to read you your rights. Am I being arrested? You're being detained right now regarding the investigation from earlier. All right. Okay. I also believe you to have a warrant. Okay. Okay. Are you aware of that? I am. Okay. Awesome. I think that's why you were acting all nervous and hesitant and trying to kind of be cooperative. I'm just trying to I mean, at least you didn't lie about your name. I know that much. Okay. Give me one second. Okay. Um are So, just be honest. Are you taking me to call here or I don't I don't know. If they confirm the warrant and they want you, okay, you will be arrested under that warrant. You'll be transferred to the county jail. Then they'll arrange for transport depending on where the warrant is out of. Is it out of Collier County? Yes, it is. Okay. What is it for? Um, assault. Assault. Okay. All right. Let's figure it out together. Okay. How old is your child? Cuz I don't want to leave the child alone in the car. He's three. I just want to call my parents to come down. I will allow you to do that. Give me one second to come. I will allow you to do that. Give me one second. Okay. So much. Hi big guy. My name is Officer Rodriguez. I work for the Kora Police Department. What is your name? Yeah. How old are you? I You're three years old. Oh, you're such a big boy, man. Yeah. What are you watching? Bluey, you stay in here. Okay. Grandma and Grandpa are going to come pick you up. Okay. 13. All right, I'll be right back. Okay. Okay. Thank you. Just heartbroken. How could you allow for your parents to be so irresponsible knowing that you have a three-year-old that you have to take care of, that you have to parent, you know, that you have to raise, uh, and you put yourself in circumstances that allow you not to parent your kid the right way. you know, just some uh you know, I had to put on my moral compass hat on and kind of let you know, you know, you let me know what you think. And it's just so sad. And such a good kid. Maggie, is this your phone? Yes. Mom right there. My mom. Yeah, they are coming from Bonita. Okay. So, all right. Well, I don't I'm not going to leave the kid alone. I can tell you that much. Your call has been forwarded to voicemail. Can you text her and say, "Call me ASAP. The cops are here." Hello. Um, so there was a I guess an incident. Um, my name's Officer Rodriguez with the Kore Police Department and I'm speaking to I'm Maggie's mom. Um, there was an incident involving uh the vehicle that's registered to your daughter uh in a disturbance where an item was thrown from that vehicle and then it was uh hit another vehicle. Um, so we've been looking for her vehicle and her cuz the description given by the people involved match the description of your daughter. Also, uh, I don't know if you're aware, but your daughter does have a warrant for her arrest that we're going to confirm here now and see if the jail wants her. Her boyfriend or husband, I'm not sure what the relationship is, but he also might have a warrant. So, can you come pick up your grandchild? Okay. Um, yes. If we could just have someone here and that way we don't have to turn them over to DCF. Yeah. Yeah, definitely. That I'm going to read you your rights regarding the issue earlier cuz I I believe you know what I'm talking about. Do you understand each of the rights I've explained to you with these rights in mind? You wish to speak to me? Okay. So, obviously I explained to you the initial reason for my contact with you and the vehicle. So, earlier my partner over here, Officer Bart, responded to a disturbance, what we call a rolling disturbance. That means it's usually involving a vehicle or some type of road rage incident. Um, the reporting party stated that this vehicle, which they photographed, and that's how we were able to find the tag for the vehicle and a white female driving the vehicle that matches your description, threw an item from that vehicle that struck the other vehicle. Is that true or false? Um, I didn't throw anything. You didn't throw this situation. No one threw anything. No one threw anything at all. throw anything outside of the So, there was a road rage incident, but there was no items thrown. No items thrown. Was there any threats made? Nothing. We didn't even roll down the window. Um, what had happened was we were turning on to going home. Mhm. Um, well, going trying to door dash on our way home and we were turning and there it was there was a sign. It said move over like to merge. They're like one of those big trucks with the orange arrows. And we're like, what is this truck doing? They're not like merging. And so all of a sudden, he starts turning on his signal and he literally turns and like starts running us off the road and I have my in the car and we ended up driving on the sidewalk. So I like get heated and I started following them and then they started following me. But we didn't throw anything at it. No items were thrown or anything like you didn't cause any uh criminal mischief to the other vehicle. You didn't hit it, strike it, went after it or anything like that. No, I don't know. I don't think they hit me. They about did. Okay. Yeah. Yeah. They didn't report that the vehicles collided or anything like that. It was very close though. They ran rammed us right off the All right. Perfect. I appreciate you uh giving me your part of the story. Okay. Just wait for uh me to let you know if they want you for this warrant or not. Fair enough. God, Maddie, I told you I didn't want to go out. I told her, bro, she did this. She us, bro. So, I'm going be honest. What led up to all this is uh I guess there was a road rage incident, but they're claiming there's some damage. All right. So, um I'm just going to read you this. All right. You have the right to remain silent. These rights of mind, do you wish to talk to me? Yeah. What What happened with the whole road rage thing earlier? So, we get over and we're in the right lane and that them they're in the left lane. They're trying to merge over and they're like they're like next to us like like how they these two cars are and she's trying to like creep up and they just keep creeping forward and it got to the point where they tried pushing us and we literally went off the road in the grass. dog. So, she got mad, drove up, and then got like up next to them, and then uh she went to throw in the little cup. And I I tried grabbing it from her and telling her to stop, and I knew this was going to happen. So, what kind of cup? Just a little like a little glass cup. After that, we What was it? A clear cup? Was it No, it was a white white cup. White cup. Yeah. Almost like an espresso cup. Like that kind of small. Yeah, just like that. All right. Um I know I didn't do anything with the cup. I don't want her to get in trouble. I'm not trying to throw her out in the bus, but man, I'm already going for a VIP. I'm I'm already screwed as is, man. Ratted out by your own husband. What if I You think if I play it like, "Hey, look." So, they sent me a video, they're recording it, I see a white cup and it just randomly throw out of the window through the like if I just bluff. What's going on? I have evidence that shows something was thrown out of the car. Okay. It seems to be something white. I didn't throw anything out of that car. I did not. I did not. I did not. I did not. I did not. Well, something came out of that car. How do you know that it was from me? All right. So, did Xavier throw something out? No. No. No one threw anything that came out of my car. Nothing. What if I told you exact He confirmed something came out of that car? I don't think he would say that because nothing did come out of that car. She She just won't admit that she threw the cuff. Let me Let me talk to her. Did you or did you not throw something out of the vehicle? So if it wasn't you, was it your husband? No. Nothing was thrown. No, sir. So these people are just alleging this damage to their vehicle out of nowhere. Previous damage. I don't know. I didn't throw anything at the vehicle. Okay. I gave them the finger. So I I just want to make this as clear as possible for you. So, what we're looking at right now is throwing a deadly missile from a moving vehicle. That in the state of Florida is a second degree felony. Okay. I am looking for your honesty in regards to this incident because obviously it's something very serious serious enough that the state declares it to be a second degree felony. So, I'm going to become a felon. Huh? You going to become a felon? What's that? I'm going to become a felon. An item was thrown by you from that vehicle today during the road rage incident. What was that item? Is there proof? What's that? Is there proof? Yes. What's the proof? Okay. Well, we can start off with the damage to the other vehicle. Okay. Okay. The victim proof that I did it. What's the proof? Mhm. That when these victims get here and identify you, that would be the proof. I can identify them. We were already in an altercation, but that doesn't mean that I threw something. Hold on. Hold the phone for a second because you actually have two witness statements. You got the husband and the wife from the other vehicle, right? The victim's vehicle, if you will. They also have a video, right? Cell phone video that depicts your car with your license plate. And your husband just got done throwing you under the bus and actually telling the truth. So essentially, you have three witness statements and one video. You got one cell phone video. It doesn't depict the actual movement and the actual crime committed, but it does give the circumstances that you were probably the one that actually did it. And all we're trying to do is just get a confession. Okay. I want a lawyer. Okay, perfect. Thank you. Yep. No problem. Hey, buddy. What you got there? Oh, you got the helmet from the firefighters. Yeah. I'm here, Dad. Okay. So, you can take him. Yes, sir. Okay. The vehicle is being towed, though. Can we Can we pick it up? No, not tonight. You can pick it up at the toyard. You can't just have somebody come pick it up. No, no, they it's part of a criminal investigation. Okay. Okay. Okay. So, I can take him. What about the keys to her house? Cuz we got allowed dogs and stuff like that. Yeah. Keys to you. Keys to the house. I appreciate it. Okay. Thank you, sir. Um, do you have any questions for me other than other than uh I uh No, not really. Okay. I guess uh pretty sad. Yeah. I mean, she knew she had a warrant. It wasn't like it was, you know, we don't we don't hear much other personal business. I got you. So, um it is this all could have been avoided if she just took care of it. It's it's all just just stuff that should have been taken care of. Yeah. 100%. Little things left alone can turn into bigger things. Hopefully, it's not too bad and we can we can deal with it. You behave good for grandpa. Okay. Oh, you will. You promise? All right. Can I get a fist bump? Fist bump. All right. Thanks, man. I want to talk about how if there's proof that I'm the one that threw something or if there was something that was thrown out of my vehicle where where the proof is at and that the mark wasn't already on their vehicle. Okay. So, right. You know what? I would have said, "Hey, Maggie, you know what? We're done talking. Uh you invoked your right to counsel. We're good to go. We have plenty of evidence uh to go ahead and move with the arrest and booking procedures. And you know what? You're more than welcome to retain a lawyer then when you uh go before the courts. My job is to establish probable cause. Right? So I have established that burden. Okay. Right. Based on the evidence that I have gathered throughout this investigation. I know that it was you. I know that it was you that threw the item. Right. And I even know what the item was. The only thing I want is to hear it out of you to allow you and give you the opportunity to be honest with yourself. We've already tied up enough of everybody's time. Yeah. No, I know. I get it. Okay. I apologize for that. No, you don't have to. I'm getting paid. I'm I'm out here getting paid. Fair enough. Right. I'm I'm out here to do a job and I'm doing my job. Embarrassed, my son. Like, I'm just Right. This This is This is what I'm trying to get to that it's time to be honest because you've been dodging this warrant for how long now? Almost a year. Yeah. Almost a year. You've been lying about where you've been physically living. I know that for sure. I know it's now Bonita Springs. You want me to give you the address? Yeah. Yeah. Is it Does that sound familiar? Like the keys you just gave to your dad where he's going to let out your dogs. You made a bad mistake today. We both know it. I would like to hear from you. I threw a cup. Was it like a coffee mug cup? Yeah, I know. [snorts] Well, I want to let you know that that coffee mug cup struck that person's vehicle and caused felony damage. Okay. I appreciate you coming up front and being honest with me. Like it's like when kids are on the side of the road and they throw rocks at cars. Same same law, right? Because if the window comes through and hit somebody and they crash and kill themselves, that's a pretty serious charge, right? That's what it is. It's called throwing deadly missiles. Okay, I'm going to have you step out for me real quick. Here's what you got. You got this Florida Deadly Missile Law statute 790.19. I know it sounds extreme, but check this out. The law is broader than it sounds. It is a secondderee felony. One, the maximum penalty you can get is 15 years and also a $10,000 fine. Now, here's the rule. Throw a hard object, you throw it on purpose, you throw it at an occupied car, that object could kill someone or cause serious bodily injury. FBI, that can be a deadly missile. Okay? Now, no one has to hit anybody. The car just has to have people in it. The accident is not the crime. The intent is actually the crime. Call that wantton and disregard. What that means is that if you knew a harm was likely to cause and you did it anyway, guess what? Florida finds that as the deadly missile lot. We're going to walk over here to the front of these headlights. Oh my god. I'm just going to go ahead and stand right here. We're going to face that sign right there. What are they doing? It's called a show up. What? Show up for the victims to identify the suspect. Oh yeah, but they ran us off the road with a toddler in the car. Huh. Funny. I should How do I press charges against them? For that for you can you said you can look up street cameras. You can see how he ran me off. So can you look into that? I can look into it. So what is your complaint? My complaint is that he ran me off the road and literally about killed us with my toddler in the car. Okay. So he committed a traffic infraction, right? Yeah. Okay. All right. At most I can give him a ticket for running me off the road and it's a traffic infraction. failure maintain a single lane. Yeah. Wow. Yeah. No crash was, you know, no vehicles didn't come into contact. Nobody crashed into anything. I'll give you an affidavit. Post Miranda admission. And I think they uh 100% ID, too. Uh so she post Miranda admitted to um throwing uh the item from the vehicle. That item being a coffee mug. But like I said, Officer Barto is the primary investigating officer in regards to the throwing deadly messos. I did advise him that you were foretelling and that you know you threw something out of the vehicle and that something was Yeah, I'll meet you. Coffee mug in in the sense of it. So, we do appreciate you being honest. Okay. It goes a long way with us. Oh, you you mean I see what you're saying. Yes. Sorry. It's been a long day. I believe you're sorry. I after talking to you for as long as I've been talking to you, I'm pretty sure this is not how you wanted your night to end. So, I believe that you're sorry. We just have to be make make better choices. We can't let our emotions dictate our actions cuz that's what leads us to these situations. If I let my interest thoughts win when I was driving, I'd be in your situation by far. Okay, this one right here. Let's watch it. Warmer this one. It's warmer. I just have Xavier was like, "Bro, it's too hot. You need to roll the window down." You still want the blanket? Yeah. Bae, I'm sorry. Can you see me? I love you. I'm sorry. I'm sorry. Will they give me my bond tonight? I'm not 100% sure, but I think they should. Okay. Cuz my dad said he's going to bail me out and not Xavier. [laughter] Well, you can't Xavier can't get bailed out. Yeah, that's Well, yeah. Yeah. So, that's that's the main problem there. I'm I'm so stupid. I and he told me not to throw it and I just I got so mad cuz he ran me like straight off the road and like I literally thought I was going to get into an accident with my kid and I was just so mad. Okay, I have kids too. I'd be especially if my kiddos are in the car. I would not be a happy camper. Fortunately, I got to leave the blanket out. They're not going to allow it in there. Well, I guess I consider this a mini mom vacation. Okay, final thoughts. Uh, first and foremost, big shout out to Cape Coral PD. Look, those officers, outstanding investigation. Not only did you have witness statements, conducted a follow-up, and you also did a field show up, which is spot on. Okay, up next, I'm looking at how a routine call can turn into a deadly standoff with officers coming under gunfire. Get inside the house. He hasn't since I shot last. But that's over on my second channel where I'll be covering some of the most critical incidents in policing history. Okay. So, Maggie was charged with the following: shooting or throwing a deadly missile and criminal mischief. Okay. She was ultimately sentenced to 36 months of probation. And as one of those conditions of her probation, she was ordered to have no contact with the victims and submit a DNA sample to the FDLE database. That's the Florida Department of Law Enforcement. She was also ordered to pay $1,831 in restitution, bringing the total to $2,496 after course cost and fees. Go ahead and click that like button and that notification bell.
