Okay, how old is your son right now? >> 15 years old. >> He's the one that took the life of someone. As of right now, your son is going to be charged with three counts of murder. >> This mother is in the middle of realizing that her own son is a deranged murderer. >> It's 4K, dog. It's clear as day. The best thing for you is to tell the truth. >> Because this is her son, 15-year-old Josiah Ontiveros, a teenager responsible for turning a 200-person car meet >> [music] >> into a deadly casualty event. >> We have at least 10 victims. We're doing good. >> I'm just I'm just >> Just multiple gunshots let off. Everyone starts running. >> [crying] >> Leading police to multiple arrests in one of New Mexico's largest manhunts to solve this tragedy. >> Once the gunfire stopped, I'm looking around and I see the people on the ground. >> People died yesterday over some [ __ ] There's no denial, nothing you can say that will change that fact. >> On March 21st, 2025, at around 10:00 p.m., there were several parents in Las Cruces, New Mexico, who couldn't answer the classic question, "Do you know where your children are?" Because if they did know, they probably wouldn't be too pleased with them. That night, an unauthorized car meet was taking place at Young Park. There, 200 people gathered to show off their cars and do stunts in front of a screaming, vlogging crowd of teens and young adults. The events were known to get rowdy quickly, but no one could have expected just how chaotic this one would be. At first, everything seemed to be going well. People were having a good time, laughing, doing donuts, burning rubber, and probably burning a little something else, too, if you catch my drift. >> THAT'S RIGHT, BABY. >> [screaming] >> UNFORTUNATELY, THE FUN DID NOT LAST. Just after 10:00 p.m., in between the sounds of tires squealing and engines revving, attendees could make out another sound, gunshots. >> OH, HELL NO. >> [clears throat] >> What happened, fool? >> One side of the glass >> The [ __ ] out here, dog. Hey, homie's here. >> News spread quickly about the shooting, and police raced through the stream of fleeing civilians to find and help those who were too injured to move. Unfortunately, they found more than they bargained for. 17 people were caught in the crossfire of what appeared to be a fight between two rival groups, and sadly, three [music] teens were already dead. 19-year-old Dominic Estrada, 17-year-old Jason Gomez, and 16-year-old Andrew A.J. Madrid. All over Las Cruces, there were parents about to learn horrific news. Their sons were dead. But soon, police learned that there were other parents who were about to learn a different kind of terrible news, that their sons were the killer. As police spoke with witnesses on the scene, trying to piece together who fired the fatal shots, they're led to a realization. This was some teen-on-teen crime. >> What were they driving, man? >> I don't know. It was like five of them. >> Okay, were they on foot or were they driving in a car? How can we find them? >> They were in a Colorado wearing a hoodie and a khaki jacket. >> Do you know what they Do you know what they were wearing? >> One was wearing a red hat with black. I don't know. There was five guys, FIVE LITTLE BOYS. >> Take a deep breath. I need you to describe them to me, okay? >> [laughter] >> You want to go? >> Colorado guy with the 1080. >> With that, police have their first lead, and it's a distressing one. The witnesses saw five little boys, teenagers, wielding the guns that killed three people and injured nearly two dozen more. But despite their young ages, the teens the witnesses saw caused unforgettable destruction, and police witnessed it firsthand at the hospital, where families of those who hadn't survived the shooting struggled with the reality of what their future looked like without their loved ones in it. And if you enjoy killers like this realize they're not winning an Oscar, subscribe, [music] and check out our Spotify, where we upload podcasts every week. These are mothers, sisters, friends, fathers, all sitting in a chapel at the hospital trying to come to terms with what's become of their loved ones. Sitting in that room are mothers who have lost their children to gun violence and are desperate for answers. And sadly, they aren't the only mothers about to face the worst night of their lives. Because when police meet with other survivors in the hospital, they're led to their perpetrators, all of whom are under 20, and whose parents are about to find out that their children aren't just dumb teens, they're cold-blooded killers. >> They go by the Remeta boys? >> Remeta boys? >> Yeah. There was three of them. Two like Mexican young kids. >> [snorts] >> And then a tall white complected with curly hair, and they had hoodies on. >> [snorts] >> And my nephews and my nephews and my brother >> I'm sorry. I'm sorry to stop you. What color were the What color were the hoodies? >> Uh one was black and it had red, and then another one was red all red. >> And who had those up? >> Uh the Rivota boys. >> Okay. >> [snorts] >> My boyfriend had said it was my boyfriend and my two nephews and me and my family were on our side by side and my boyfriend said that there was about to be a shootout because they were talking [ __ ] to my nephews. The Rivota boys were talking [laughter] [ __ ] to my nephews. >> Okay. >> And they busted out their guns and cocked them back. My nephews did the same thing. And my [snorts] boyfriend just said to get the kids out of there. So, when I took off by the time I got out of the youngster, the bullets were just flying everywhere. >> [snorts] >> Okay. So, your your your boyfriend is saying, "Hey, this is going to go down." And then you see the Rivota boys pull their guns, rack them. What what does the taller white kid do? >> Well, they all did the same thing. >> All three of them? >> They just pulled them back. One put it up here in his jacket and held it there. The other two had them in their pocket. The two Rivota boys had them in their pocket. The taller white guy had it up here in his jacket. >> I I know one of them for sure for sure is Nathan Rivas and that's the little brother. >> Okay. >> Nathan Rivas, do you know how old he is? >> No, I don't. He's the littlest brother, I think. >> He's the youngest? >> He's like no idea how old. >> I don't >> Maybe under the age 17 if if 17. >> I got it. >> With that, people already have the name of two of their alleged perpetrators, the so-called Rivota boys, 17-year-old Nathan Rivas and 20-year-old Thomas. Using surveillance footage, footage posted on social media and witness testimony, police are able to identify two of the other culprits, 17-year-old Gustavo Dominguez Puga and his cousin, 15-year-old Josiah Ontiveros. Quickly they launch into action to take all four culprits into custody for questioning. While Thomas and Nathan go down without much issue, Gustavo doesn't go down as easily and his age starts to show fast. At the same time, he's about to learn a big life lesson. If you can't run with the big dogs, you got to stay on the porch. >> You want to take this one to the back of the car, bro? >> The girl with the no kids? >> No, I'll just wait on you. >> She's up here right there sleeping. Just stay there. Just keep eyes on her. We're bringing out one more people here. >> I got you. >> Y'all already doing so much for our house, bro. >> Bro. >> Brother. >> Chill. >> Lilly pulled out the flashlight, bro. >> 50. >> Come on. 5-year-old kids, bro. If y'all wanted me to come out, y'all started with that. Y'all could have knocked. Y'all could have started with hey. Come out with all of you, you know? >> Spend, bro. >> So it is, bro. >> [snorts] >> Laughing at it. >> Bro, chill. Chill. Chill. Hey. Hey, what up? Let's show them that. >> Stop. Stop. Stop, guys. Stop, please. I got you. I got you. Chill. >> [snorts] >> Ma'am. Get inside. Get them inside. >> Okay, can you see the recording, right? And if something happen to my mom's house, you are guys are responsible. >> Yeah. Yes, ma'am. We are. >> Okay. >> All right? >> Yes, we're responsible for this whole scene and every situation. >> All right? >> Keep out. >> Ma'am, please stop. >> IS THERE A PROBLEM? PUT YOUR HANDS UP. >> NO, we're good. >> Y'all want to take this to the car? >> Bro, that's why I had over taking the Ma'am. >> I got you. >> That's that's what she was doing in there. >> Come on, Gus. Can we get him in the car? >> Yeah, I got you. Come over here, Gus. Come on. I'm going to watch you one more time, okay? Anything else I need to worry about, bro? >> No. >> No, all right, good. Just have a seat. I'm going to put this here, okay? >> Yeah. And what about my family, like >> We're going to We're going to find out and take care of it, okay? They're going to be good. Just hang tight, bro. >> Every perpetrator in this case acts like a child, yet their violent actions were anything but childish. However, police are reminded of just how young they are when shortly after 15-year-old Josiah is taken into custody. They visit his mother to see if he's left any evidence behind. And there, they see a brand new perspective on the devastation Josiah's actions have left behind. Because not only did he betray the victims and their loved ones in the worst way possible, he's betrayed his own mother. >> It's even worse cuz it's right here. >> Okay. >> But when he's here, he keeps it on the top. >> Okay. >> Yeah, that's the >> Yeah, this is >> Yeah, the drawer on the right might get a little stuck, but it'll open. >> Nobody else is here, sir. >> No. >> No. >> No. >> Okay, all right. >> He hasn't brought anything else, has he? That you >> He hasn't been here. >> He hasn't been. >> No. >> He hasn't been here. You got to apply If you go look at their room >> Yeah. >> No, he was just asking if he came. >> As a quick bite. Pretty much if HE'S BEEN HERE. >> YES. AND DID HE DID HE BRING ANYTHING with him? Yeah. And he's only 40? >> Yeah, he's fine. So, his time is to come keep me company. >> Okay. >> I'm always by myself, and he doesn't like that. >> Okay. >> So, he decided to come keep me company, and we just started talking. He was borrowing my lighter. He was like, "Mom, I'll just stay the night with you." >> Yeah. [snorts] >> And then he woke up >> So, when he was talking to you >> It was that day. It was just Saturday. >> Just the Saturday? >> Yeah, I haven't Today is the only time I picked him up with what I told you earlier. That's not I haven't talked to him before this in a past. Like we I you can look through my phone like we >> Yeah. Um do you have a number [laughter] for him, a phone number? >> Um his >> Does he have Instagram? >> I don't have him on any social media like he doesn't like me cuz he doesn't want to so I don't have I don't have him on any media. So I used to but he erased me like once he became a teenager. >> Yeah. >> But now yeah. Um like as bad as it sounds like I don't talk to him on a daily basis which I maybe I should have. >> Yeah. >> But >> Yeah, maybe you could start again. >> Yeah, I mean I'm going to have to but like I I feel like a lot of it should have If I would have just kept him home if I would have brought him home >> Yeah. >> a long time ago he would I want to honestly almost say since September of last year. >> Was it? >> He has not like stayed with me constantly before because what happened once he had gotten suspended from school for fighting and he was under Since then we've never He's never came >> I'm going to ask you there's a >> [snorts] >> This what I want you to [laughter] see, okay? Um Okay, this is why we're letting you know that we do we have our facts, okay? We don't just assume. Okay, if you see I I I I know it's a bad picture it's from a video, okay? Your son is right there, okay? Your son is right there. And that's the other individual that we arrested. >> Mhm. >> He's right here, one of the Revas brothers, okay? >> Okay. >> The mom has two options here to shut down and fight the cops to protect her son or to help the cops in order to give the people her son has hurt answers. For any mother it's the ultimate test. Does she love her son more than she respects the victim's right to justice? Here it's a little bit more clear. But that's him and that's the other guy since you guys were all together, okay? But that's your son right there. Can you [snorts] see him? >> I can see. Have you seen that sweatshirt? >> No. As a matter of fact, well, I have a sweatshirt he's wearing but um >> You have the sweatshirt? >> That he's wearing today, like when I picked him up. >> It was it this one? >> No, it's a it's a gray and white one. >> It's a gray It's not that one, black with like a V? >> No, I can >> I'll take Yeah, yeah, well, I'll take a look at it right now. You can look at it. Okay, so that was in You don't know where that is? >> I don't know if >> Did you buy that for him? >> No. >> I mean, it's a black >> It's black with gray. >> I honestly haven't bought him clothes. I give him I give him money and he just buys his own He hasn't been with me. Like even with school, whenever it first started, that's when he was living with me in August of last year is when he was here. But then not even a month that he got into that whole thing at school and since that day that he got into that week, he has not stayed here. >> Yep. And this is the sweatshirt that was recovered. So, the one that the other guy was wearing, okay? >> That who the other kid? >> Yeah, the kid. >> Mhm. The kid's the same one. >> Josiah's mom ultimately supplied police with his sweatshirt and later provided invaluable insight about her son. For Josiah, it likely felt like a betrayal, but she showed immense strength doing what she's already done and that's before she finds out what her son is truly facing because she isn't the only one willing to talk about her son's actions. Remember the Ravana boys, two brothers who were immediately named as the shooters by witnesses? When it's their turn to talk, they don't just talk, they squeal. And when Josiah's mom finds this out, her reaction is even worse than her son's. First, Nathan, the oldest of the two, sits down for an interrogation and initially, he claims that at the time of the shooting, he was actually [music] 45 miles away at a party in El Paso, a drive that would take close to an hour. Unfortunately for him, detectives know the truth. [music] >> What were you doing last night? >> I was in El Paso. >> You were in El Paso? >> Yes. I was with my friends at a party. >> Okay. What time did you go to El Paso? >> Like by the time they had already sent just like at 9:40-ish around there. I just we just checked the time and everything and then after that that's when we had left left right after I had contacted about that address and that address and then I went to meet up with my brother and then that's when we got to the wedding like >> Okay, so what time did you leave Cruces do you think to go like right when you got that message? >> So like at 10:00 exactly like at 10:00 9:50 10:00-ish. >> 9:50 10:00 you left. Okay. Um so 21:50 slash 22:00 you left to go to El Paso. Okay. And what car were you driving? >> My red car. >> Your red Mercedes. Okay. Do you know your tag on that? >> I don't. [clears throat] >> Is it um New Mexico tags or Texas? >> No, I I just got the car. >> Mhm. >> So it's Texas. >> Texas tags you said it's a silver like that. Okay, is it registered to you? >> No, it's not registered. >> Who's it registered to? >> Um to the guy I bought it off Facebook. >> You bought it off Facebook? >> Yeah. >> Okay. How long have you had it? >> Probably like 3 days or 4 5 days. >> Okay, nice. Okay, do you have like is it on your Facebook that you like bought it off of? >> Um it's on my brother's Facebook cuz he was messaging cuz my marketplace got updated and you have to be 18. >> Oh, okay. >> Yeah, so cuz I >> And how old are you? >> I'm 17. >> Okay, I don't care about that. >> [laughter] >> Um okay, so you um bought the car 3 days ago >> Like 3 or 4 days >> 3 or 4 days ago. Okay, so what day It's Saturday right now. So what day do you think that was? >> I probably bought it no yeah so then no I bought it on like Sunday or Monday I can't >> So almost a week. >> Sunday or Monday, yeah. >> Okay, Sunday or Monday you bought it. Okay. Does anybody else drive it? >> No. >> You're the only person that drives it since you bought it. >> Well, yesterday I had also went to El Paso earlier in the morning to go get my window fixed. So yeah. >> Okay. Um what's your brother's name that you bought it off his marketplace? >> Um Thomas. >> Thomas. Okay. Um Okay. Um your phone here Um we can't let you go if I know where you were going through earlier but we like can I look through this to see some of the stuff that you were showing them? >> Look at the what? >> Like the pictures, the the videos and stuff that you were showing that you were in El Paso. >> Oh, yeah, you you you're fine. >> Okay, we have pictures of your car in Las Cruces. >> Yeah. >> Not in El Paso. >> At what time? >> Um about 9:20, even earlier than that. >> Yeah, but I got there at 12:00. >> Well, even even later than that. Even later than that. Your car is not And we also have cameras that that capture tags going into El Paso and your car isn't hitting on those until after the the shooting. Okay? So, that's kind of an issue. >> I don't know around what time means. I'm just you know, like I'm estimating cuz I'm Well, how like, you know, you guys are asking the time I can't say a specific time. I'm just >> I get that, but what just what you're telling us right now, what the story you're giving us isn't is not adding up to the evidence that we have showing you that you were in town at the time of the shooting. People are saying you're there at the time of the shooting. We're going to go into your phone. We're going to get exact locations of where you were. We're going to find out if you were at the park or not. Yeah. So, just right now is your chance to tell us if you were there and tell us what really happened, to tell us your side of the story because right now there's three people dead. There's probably a fourth person that's going to die. And there's 14 other people, 13 other people shot. It's a big deal. >> Yeah. >> Right? It's This isn't just a little jail time where you're going to go to Doña Ana for a couple days and get out. >> Yeah. >> This is federal time where you're going to go to jail until you're 80 years old. Yeah. So, right now is your time to tell us what happened and what the truth is. Otherwise, you know, it's I didn't do anything. It wasn't me. I was in El Paso. And then you just look like this person who's lied to the feds. And that's it. You know what I'm saying? >> Yeah. >> Okay, so did you go to that party? >> Yes. >> Okay. >> And then when the cops that got there the cops that got there when we got there as well. So then we just went to transfer. >> So like you didn't even go to anyone's house for the party cuz the cops were already >> Well, we were there we were walking in but then that's when the cops showed up and all they know Paso I don't they don't just like stop the parties they get there with guns and make everyone leave. >> Okay. So you saw the Paso PD was there >> Yeah, we we saw the lights and everything and that's when we were like well let's just go. >> So you didn't even walk into the party. >> No. >> And if I can interject one other piece of evidence which is going to be seized is unfortunately your car. It's full of bullet holes. >> Oh, that was from a long time ago already. >> I mean you think you would have mentioned that to me when you were talking about where you >> I I I had you know how I mentioned about fixing my window earlier that day? >> Yeah. >> That's what it was for. >> The holes in the window or the car? >> In the car and in the window. >> All right. Well, come in your your car was seen at the scene of a shooting where people were firing randomly and and it's got bullet holes. You got to see how that makes it evidence, you know what I mean? >> Well, not that already had happened a long time ago. >> Right, but >> How what did it What was it? When did [laughter] that happen? >> That happened yesterday. [clears throat] >> Like when I had got the car I had went to a bonfire and someone had gotten shoot out and my car had got hit. >> When was that? >> Uh last weekend already. It would be like right after I had got the car so like on a Sunday. You know how everyone was on spring break? >> Mhm. >> Everyone was out and everything and that's when they were like well I was like well why you guys need a bonfire on a Sunday and they were like well it's spring break we should just all go. So that I have the receipt in my car too. You guys could look for it I mean he said you guys are going to get it for evidence. I mean if you guys look for the for the receipts and then where I had already went to go fix my window earlier that day. >> Mhm. >> Cuz I it'll go by now. And and it'll go by now. >> Like you said you're not dumb and I don't think you're dumb. And honestly you're doing very well holding. Okay. I applaud you. Some people crack me but the stuff that you're saying bro is exactly what I would say if I was in your situation. Like the pictures. Bro, the when you showed me those pictures of El Paso and the way you're describing it like with your picture my friend took a shitty picture. You know what that speaks You know what that speaks to me? That's me thinking, "Oh, that was me and people were texting me saying Oh no, I got to get something to prove it. >> Well, no, no, I I didn't get texts I didn't get texts till way after that already. >> You said that picture was at 11:45? >> Yeah, I didn't get no texts till way after that. I can show you guys. >> Okay. I'm just saying You know what I mean? You know what I mean? Like and you're doing good. I'll give you that, okay? Even with federal agents here and you are facing [ __ ] because you know, if you tell a lie, like to me, you can lie to me all you want, right? It doesn't mean [ __ ] If you lie to a federal agent and they prove it's a lie, even if you're not guilty on everything else, that's a year in federal prison just for telling a lie. >> For the first time in his life, it seems Nathan has realized that he might not be as smart as he thinks he is. So, finally, he tells at least part of the truth and by doing that, he throws Gustavo and Josiah under [music] the bus. >> You were there at the party? >> Me and my brother, yeah. >> Gustavo? >> Yeah, my friend Gustavo. >> You You went with or >> I went for Gustavo. >> Okay. And he was there? >> And he was there when we were all there. We pulled up to the party. >> Okay. >> A car. I don't know I was wearing all black with the ski mask with the guy right there. I had my nephew. Yeah, you were with my nephew and my sister. >> Okay. >> After that, anything to I hope I mean, but he lied to you to be under arrest. He had nothing to do with saying he was at his girlfriend's apartment. So, I had called him that's why I called my brother to the last I said, "Come on, guys, like we're not getting involved in anything." So, after that, we go meet the mans we see in the blue blue car doing donuts. And I was like, "Damn, I'm going to record this cuz it's Marcos and this is Marcos." There was a white a white Scat Pack and I was in the recording cuz it was like nice and it was going to play. And [clears throat] after that, well, Gustavo and then my brother still getting into it and then the guy with the black things that the guy was with the media. >> [clears throat] >> Yeah. >> And then the guy with the 29 black was behind him and pulls out the gun and aims it. And then after that a big guy goes behind goes walks behind he goes get something from his car. He goes get Gustavo. He puts him in a choke. >> Mhm. >> And he carries him. His cousin Josiah was like let go of him. And then the other guy the 29 black with his ski mask and everything pulls out the gun he starts shooting. Gustavo's cousin pulls out the gun and starts shooting at him. >> Josiah? >> Josiah. >> Josiah. >> Was he the one that shoots the guy in the head that had Gustavo in the headlock? >> No, he didn't shoot him. Gustavo the cousin the the guy that was wearing all black I don't know if you guys remember who was wearing all black right? With the ski mask and everything. >> Mhm. >> Just like that Josiah has been named as not just a shooter but the only shooter. Armed with this information and the knowledge that both his mom and his friend turned on him police head in to interrogate him. >> One of the main things we're trying to do is to make sure we have the correct information from everyone because as you can imagine there's a whole lot of rumors flying around. And like an example is I don't know if you saw on social media there was a guy standing there with like a rifle. >> Right. >> And everyone >> He became Cruz's most wanted and people were like literally like rounding up to go kill him and he actually wasn't involved. >> Yeah. >> Right? So we're trying to make sure that we're protecting people's families by getting legitimate stuff out. Well and get cuz here's the deal like people did stuff that's [laughter] not necessarily the right thing to do but we just want to make sure the information is accurate. Okay? Um I mean you guys you know mom had less know one of the victims lives across the street from you. Juan's beats. Okay. So we want to make sure we have all the correct information so that way >> Yeah. >> people know what's up. So we've already done a ton. As you can imagine, this is a big case. >> Yeah. >> Uh and >> Hit the whole world with the >> The whole world is national. So, we we've been working like 3 days straight. We've done a ton. We've gotten a bunch of videos. Everyone was taking videos. And some of them are real good quality. And we can actually [snorts] like see people and make them out. We've also gotten information from people who know people who were there. And yesterday we scooped up uh the Rios brothers. >> Okay. >> And well, you know, they did not keep to the the street code and they were quite open. So, we got all the information. And we got they let us in their phones and we saw all the messages that they've been sending before, during, after, the pictures. So, we got all that. And they dumped some of the guns and we went recovered those. >> Okay. >> So, we got that. Gustavo's here. He's also arrested as well. >> Okay. >> Gustavo. So, the last person in that crew we want to talk to is you. Obviously, this was multiple people, multiple groups. And if I'm going to be honest with you, this started with something that shouldn't have escalated to what it did. However, it did. And so, we're here and we're dealing with it. So, when we talk to you, just know that we already know a lot of stuff. >> Okay. >> The best thing for you is to tell the truth. You know, and the video when you know, when that that red car is spinning >> Yeah. >> in the circle, you know, I can see you. I can see uh uh Tomas. And ironically, let me show you this. So, I can see Tomas and then uh I don't know why Tomas didn't think we'd uh see this, but we went to the place where he dumped all his stuff. And he dumped that. And you can see that like clear as day, that sweater that Tomas is wearing cuz it's like sticking out. You can see it. And, unfortunately for you, you're hanging out with a bunch of short dudes. A bunch of short kings and you're the tall guy, so you're pretty easy to pick out, too. So, it's my understanding when all this [ __ ] went down that there what maybe started your involvement in it is there's a moment when a big guy picks up Gustavo from behind. Or grabs him by the neck from behind and picks him up and then he also has a gun. >> Yeah. >> The guy The big guy who picks up Gustavo. >> Yeah. >> Todd So, he picks him up. He He He came from the side by side. He's like a big guy. He had like a beard. I don't I would doubt you even know who he was, but he gets involved with Dom and he picks up Gustavo. And it's my understanding from talking to Nathan and everyone else and all the eyewitnesses that that's potentially where you get involved, at least initially maybe trying to help Gustavo out. >> Wait, [snorts] so is there like a video my face and I put that >> Oh, yeah. Yeah, no, no, no. I mean, like I said, the people were taking videos during the car show, like the whole time. And so, even before the [ __ ] happens, you can see you guys just watching. Like, we can see you watching when that red car is spinning around. And and I mean, it's like it's 4K, Doug. It's clear as day. So, what Well, like I said, the the fact that you were there, you know, the [snorts] fact that shooting happened and that you were involved in the shooting, all that's not really what we're interested in cuz that's already a done deal. Like, that's why you're getting Right, you know. That's why we're not talking to you at your house cuz that's already a done deal. And like I have got all the social media stuff back it up. I got the statements from Nathan, which kind of sucks cuz you're the youngest one there. And the older ones are kind of trying to put more of it on you, making you sound a lot worse. They're even saying like when you're leaving Gustavo, you know, was bragging about smoking people in the car. Like, they're making you guys sound a lot worse." >> Me >> You and Gustavo. They're making They're making They're making Nathan and Tomas were basically making it sound like Nathan said this repeatedly, "I knew I shouldn't have gone with with with Dabo and Jojo." Like, they knew they were going to doing this [ __ ] and I'm trying to be good, which I think is [ __ ] because I got his social media phone guns. I've dealt with him before. >> I'm not I'm not trying to be like against like, "Can I see a picture of Nathan?" So, I mean, got heat since >> Uh >> There is there is a document >> I don't have a signed document. You see You see these cameras? His His statement's recorded. Here's a picture from Nathan's phone. He was selling the guns to that guy. He had met him at Scorpion Park, so he gave me consent and he gave me the password to his phone. I can tell you the his phone password if that makes you feel better. So, that's how we found him. >> So, these are some of the guns that >> I just want to I just want to see the picture of me being in this. Yeah, yeah. No, no, I got you. Um so, like I said, we We We are What we operate on a standard to charge someone with a crime, we already have met for you, okay? What we're trying to do is keep your family safe, okay? Cuz literally, victim's family who are out for blood literally live across the street from your mom, and you're not going to be there to protect her, okay? She's going to be there alone. So, what we're trying to get is for you to see the seriousness of the situation and to make a clear statement because I don't think it's fair that the Rivas brothers are putting this [ __ ] on you. I don't think that's right, but that's the narrative we have, and that's what's going to go into all the police reports. That's what these guys, when they get the police reports, are going to see, okay, it this mass shooting, the biggest one we've ever had in Las Cruces, is because of Jojo and Gustavo. That's currently what the information that we have. >> But can I see the picture? You saying I was different cuz you said you had a picture. >> But here's the thing you like We we're going to We can we can do that we can do that if you want. But if if you're if if the idea in your head right now is that we don't have enough to charge you with it, you know we served an arrest warrant on you, right? You are currently under arrest and charged with this crime right now. A judge has already signed it and said that there's probable cause to arrest you. That's already done. You're already under arrest for this. So we don't we've already proven to the satisfaction of a judge that you were there and you were involved. So I mean again, we can go around and round and do all this. The thing is >> No, okay. I'm down to say whatever. >> Yeah, I need a lawyer. >> With Josiah refusing to budge, even with the whole world and endless proof against him, police speak with the one person they think might be able to get him to talk. And unfortunately, she's just moments away from a total breakdown as she comes to realize something that hasn't clicked for her son yet. He's going to spend the rest of his life in jail. >> Just to let you know your son is already done the game. He requested a lawyer and we stopped all all communication, okay? That just means you know what? You know, we're giving him his constitutional rights. He's not cooperating, okay? Remember I told you from the get-go? >> Mhm. >> The Rivas brothers okay, they threw him under the bus, okay? They said that that was that he was there, he was the one involved in the shooting, okay? I mean, that all of them were involved, okay? But that he's the one that took the life was one of them that took the life of of some of the people, okay? So you when you talk to your son, ask him did the detective tell you that the Rivas brothers said blood is thicker? Okay? Okay? And that it's thick and that family is pretty thick, all right? So they they're they're saying that Josiah, okay, was the one responsible as well, okay? That he was you know, responsible in this shooting. He took the life of these individuals, okay? So, your son right now, we can't hear his side of the story because now he said, "I want a lawyer." Great, you know, that's your constitutional [clears throat] right, you know? So, now you all are going to have to take care of of an attorney, pay for an attorney, okay? Because we just stopped talking. We can't help him anymore, okay? We cannot say that he cooperated in this investigation because he didn't. All right? So, as of right now, he's going to be charged with three counts of murder, okay? And that's just There's other charges pending because there's 17 [clears throat] others that were shot, okay? So, right now we're just charging him with these charges. So, what we're trying to get to you, Matt, is that maybe you can talk to your son. He's We can't talk to him no more, okay? You can tell him You know what's up. You still have a chance. You have to talk You have to tell him you know, what's going on, okay? Let whether the [laughter] police, the district attorney's office know, you got to speak you tell the truth, okay? Because you know, he thinks that by not talking that nothing's going to happen to him, okay? And he thinks that the brothers are not saying anything. They're all sticking to the story and [snorts] guess what? They're not. Your son is going down on this you know, the the Rivas brothers want your son to go down on this, all right? [clears throat] And so, what we do is we obtain statements. I showed you the pictures, okay? Your son is there, people have identified him of being a shooter in this case. So, now he could have talked to us and said, "You know what? Whatever it was self-defense, whatever it was." He didn't, >> [snorts] >> okay? So, now as a mom, you might want to take this opportunity to talk to your son and tell him, "What are you doing?" Okay? What [snorts] you doing? First of all, I can't hire you, you know, a top dollar attorney. I can't. So, you're going to get a a defense attorney that's one that's given to you. You know, are they good? Yeah, I'm not going to say they're not, but you as a family want the best, I'm sure, you know? And it's tough. These defense attorneys cost a lot of money. So, for you, you might want to talk to your son and say, "You know what? You're young, you can still change your your your your life." And that's usually what I tell people. I say, "You know what? We've all been in trouble. We've all gotten ourselves into some kind of a mess. It's not how we get into the mess, >> [snorts] >> it's how we get out of it, okay?" >> I think he's just scared. >> He's scared, I'm sure he is. But you as a mom, maybe you can talk to him and tell him, "Hey, you know what? What happened? Tell me the truth. Tell me be honest with me." "How can I help you as a mom? I love you, you're my son. Yeah, we might not get along 100%, but how do I help you if you don't open up to me and tell me the truth, okay? You don't have to tell us the truth, but tell your talk to you. That way you can help him. Okay? And um that's my advice to you is to talk to him. Okay? So, we good? >> Yeah. >> Yeah, it's all set, man. Okay. >> Okay. >> Okay. >> No, we were just talking about it. He doesn't think he's going to stay here. >> Yeah. >> Yeah. >> No, no, no. >> No, thank you so much, but and I you know, >> You need to be careful. >> I wish you all, you know, luck moving forward. Okay, this is not We don't wish this on anybody, but we have a job to do, you know? And we got to do it where it's fair. But we also want Josiah to have a fair shake in this. And if the [clears throat] others are throwing him under the bus, you think Josiah's going to have a fair chance? >> So, what is his charges? >> Murder. Three counts of open counts of murder. And I guess it's they're still we haven't done the charges on the people that got shot. Okay, we're just going to go murder charges. Yeah, okay. Yeah, so he's looking at for another maybe 17 counts. And if anybody else passes away that are in critical condition right now, those are additional charges that he gets. So, that's why it's very important you talk to your son, okay? All right. All right, good luck to you all. >> In uncharacteristic fashion for New Mexico, all of the teens involved in this case, Gustavo, Nathan, and Josiah, were all charged as adults for three counts of first-degree murder. And in August of 2026, three of the defendants got a look at what exactly that charge can result in. Thomas, who was the first to go on trial due to his age, was sentenced to three consecutive life sentences. He must serve 90 years before becoming eligible for parole. So, unless he's looking to break a world record, he will be spending the rest of his life behind bars. The District Attorney's Office is seeking 90-year sentences for the remaining three defendants, whose sentencing hearing should take place before the end of 2026.
