As a cop, I saw a lot of stupid behavior, man. But in today's episode, we'll see a simple traffic citation turn into something much worse. Step out of the vehicle. Are you going to step out? If No. Officer spotted this driver perform a rolling stop at a stop sign and resisting an officer. How you doing? You scared the heck out of me. I was going to I was expecting you to come over there. Hello, ma'am. Officer Roscoe PD 2K reason for your stop is you didn't stop at the stop sign and you went over the white line, okay? You got to stop behind the white line and make a complete stop, okay? You have your driver's license on you? I do. The I'm pretty sure I stopped at the stop sign. No, you went over it. Absolutely not. Okay, you have your insurance and registration for it? Yeah. I'm not going to I'm not going to argue with you, but I am a law-abiding citizen and this just really ticks me off. Okay. Okay. People who do everything right are the ones who get messed up. I I understand. Um so, you want to go to court or do you want to go to jail? >> Okay. Little upset. All right. All right, ma'am. So, here's your stuff, okay? It's going to be a citation, okay? Here's your stuff. All right. You can go ahead and sign here. By you signing it it's not an admission of guilt, okay? You're going to end up signing it to court, okay? The 15th of Okay, let's get this ticket signed. Let's see what happens. You came all the way across the white line, which is number one. >> What makes you right and me wrong if I say I stopped and you say I didn't? That's why Why why are you right and I'm So, that's why I'm I'm doing business with her, okay? She's the one that committed the violation. So, that's So, I understand. So, this is I don't have to talk to him, okay? So, this is why So, this is why I'm citing you into court so you can go ahead and fight it, okay? So, if you can sign up here on the side, by you signing it it's not an admission of guilt. It's a promise to appear, okay? I don't want to sign it. You don't want to sign it? I don't want to sign Are you sure? Uh yeah, for sure. Go ahead and step out. No, I'm not stepping Yes, you're going to jail. I'm not. Get out of the car. Let me Let me sign Get out of the car. No, it's too late now. You didn't want to sign it. OH, YOU ARE NOT taking me to jail. Tammy, just sign it. I said let me sign it. That's too late. Get out Step out of the car. Step out of the car. What in the world is wrong with you? What is wrong with you? I'm not resisting. Stop saying I'm resisting. You're going to be charged for resisting arrest if you don't get out. You say you don't want to sign it, step out of the vehicle. We're signing it. >> No. I will sign it. I asked you two times. >> Okay, you know what? You need to tell me You need to tell Yes, don't tell me Step out of the vehicle. You didn't need to You need to tell me if you don't sign it If you don't sign it, Step out of the vehicle. I'm not stepping out of the vehicle. I don't trust you. No. No. Either you're going to Okay. Well, we've seen that have a controversy, right? Because he did tell her twice to go ahead and sign the ticket, man. It's really not a big deal. You sign the ticket, and it is a promise to appear. It's not an admission of guilt. You're supposed to have this conversation in front of the judge. Hey judge, you know what? Uh I didn't roll that stop sign. And then the officer pleads his case. >> Step out, you're going to get charged for resisting another one, okay? Step out of the vehicle. I am not stepping out of the vehicle. Step out of the vehicle. I asked you twice if you're going to sign it. You said no. You're not putting your hands on me. Step out of the vehicle. >> You're not putting your hands on me. No, you're not touching me. Are you going TO STEP OUT? >> NO. >> going to STEP OUT? >> NO. ARE YOU SURE? HEY. Get out of the car. Step out of the vehicle. Stay in the vehicle, sir. Step out of the car. Step out. Step out of the vehicle. Let me tell you You're on camera and we're trying to give you multiple opportunities. I'm I'm Let me tell you something. >> of the vehicle. No, let me tell you something. You shouldn't have said >> Are you going to get out or not? You're going to Listen to >> Are you going to step out of the vehicle? >> I might, but you're going to listen to me first. >> step out. You're going to listen to me first. Step out of the vehicle. That's not how this goes. Step out of the vehicle. This is how it goes. This is my car. Step out of the vehicle. I am not stepping out of the vehicle and you're not putting your hands on me. >> of the vehicle. No, you're not putting your hands on me. >> Ma'am, I'm going to give you one last opportunity. Step out of the vehicle. Look. Step out of the vehicle. I'm going to ask you one more time before you get charged with resisting arrest. I am >> Step out of the vehicle. >> I am not resisting arrest. I told you I will sign that. You should have told me No, you I'm explaining it to you. You can't explain >> it to her and you're interrupting me. Step out of the vehicle. Are you going to step out? If No, you have to tell me that it's okay for me to sign this. I just I'm explaining to you the violation. I'm waiting for the other cop. >> Step out of the vehicle. If I want to talk to somebody else. Step out of the vehicle. I'm not going to. I don't Step out of the vehicle. YOU'RE NOT PUTTING HEY, STOP. HEY, HEY, BACK UP. HEY, ALL RIGHT, YOU CAN BACK UP. >> [screaming] >> GET HIM OUT OF THE VEHICLE. GET ALMOST 30 times he asked her to just step out of the vehicle. Look, in the academy they used to teach us uh this thing uh this acronym called ATD, ATD, or ATM. You ask, you tell, and you do. Or you ask, you tell, and you make. So, like in this example, ma'am, you need to step out of the vehicle. No, I'm not. Ma'am, I'm telling you to step out of the vehicle. No, I'm not. And then you know what? You make her or do it. That's pretty simple. Uh it's kind of like, you know what? You can't put the toothpaste back in the tube, right? You rang that bell, so now we have to effect an arrest. >> Hey, STAY IN THE CAR. STAY IN THE CAR. DO YOU SEE WHAT YOU'RE DOING? STAY IN THE CAR. HEY, CALL HIM. DETAIN HIM. He tried to punch me. You're on camera. Step in the front. I saw his fist come around trying to punch me, okay? He's going to join the party, too. He went like this. Everything's on camera. Hey, you're under arrest. You are under arrest. You are under arrest. You are under arrest. Put your hands behind your PUT YOUR HANDS BEHIND YOUR BACK. WHOA. CAN'T RESIST STOP RESISTING. Put your hands behind your back right now. Listen to me. Listen to me. You're going to put you on the ground. I can't You can't put my arm behind my back. I've got a really bad shoulder. Yes, sir. Yes, sir. This one I've had replaced and this one is really bad. You can't I can't go I can't go behind my And that's legitimate. You definitely want to be careful. You know, don't just grab that shoulder and put it behind his back. Relax. Uh there's a lot going on, sir. STOP RESISTING. I'M NOT RESISTING. WHY ARE you bleeding? Cuz you hurt me, dude, and I didn't even do anything. I told you multiple times to get in the vehicle. I didn't get out of the vehicle. I WAS SITTING >> WHY ARE YOU OUT HERE THEN? WHAT DO YOU MEAN? YOU WERE OUT HERE. You pulled me out of the chair. You pulled me Okay. I can't, dude. I can't. I've I've promised. I swear to you, I can't. I'm just trying to get along with you and I can't put my hands behind my back. >> You're not going to say I pulled you out of the DAMN CAR WHEN YOU GOT OUT YOURSELF. IT'S ON CAMERA. CAN I SEE the camera? Can I see it? You you You already forgot what you did? You got out of the vehicle and I told YOU MULTIPLE TIMES, GET BACK IN THE CAR. I didn't get out, though. You pulled me out. Okay. You're still tensing up. We're going to We can't put your hands BEHIND YOUR BACK IF YOU KEEP TENSING UP. Can I just explain something to you? Can I just ask you something? All right. Listen. Parker. Can you listen to me a minute? Hey, replace us. Huh? Replace us right here. He's bleeding a lot. Yeah, he's bleeding a lot. Place Mooder. Are we detaining him? Yeah. Yeah, he's detained. Yeah, let's get him some MT, man. Let's get him some medical treatment. Get the paramedics rolling. I don't know what's going on, sir. I just got here. I didn't see anything. They just attacked us. Who did? Oh. I've got a bad I've got really bad shoulders. >> [groaning] >> I don't know about attacking. Oh. Mhm. Okay, that's Yeah, you got double cuffed on it, okay? Okay. What say we can What do we have? Okay. He pulled me out of the car. I didn't get out. I opened the door Okay. and then he accused me of of of getting out and attacking him and I just didn't. Okay, take it easy. We're not talking about attacking here, but you know what? He does have a point because here's the deal. They tell him to stay in the vehicle. Stay in the vehicle. Stay in the vehicle. And all of a sudden they ask him to get out. Get out. Get out. So, there's like mixed messages. So, I suppose I can kind of understand where he's coming from, but let's take it easy on this attack word, you know? Words have meanings. Sit up. Don't talk to me like that. Take a seat. SIT DOWN. I'M NOT GOING TO BE PLAYING YOUR STUPID GAMES. You're going to jail. You're under arrest for assault. I'm taking you. Drop that hand up. Everything's on camera. Okay. You you reached your hand in my car. Did you reach your hand in my car? All right, well I'm just letting you know what you're under arrest for, okay? All right, sir. I'm going to You have the right to remain silent. Anything you say can and will be used against you in a court of law. You can decide anytime exercise these rights and not answer any questions or make any statements. Do you understand each of these rights I have explained to you? Yes, sir. Having these rights in mind, do you wish to talk to us now? Sir. Having these your in mind, do you wish to talk to us now? Talk to you? Yes. Sure. I I don't have anything to say. Uh-oh. Sure. They They were Okay, so maybe just might not You know what? Don't say much. You know, you got your Miranda rights advised you right there and then, which is a little bit unusual, right? But then again, we are talking about rolling a stop sign. That's an infraction, and we turned this into an arrestable offense, okay? So, keep that in mind. The way they practice is hey, let's give them the Miranda warnings right now and see if they want to talk. >> put him in the front? Okay, cuz you were combative with me just right now. I wasn't trying to be combative. You guys were grabbing my arms, and I I was I was tensed up and holding my arms in front of me because of my shoulders. Okay. That's fine. Go ahead and step out. Go go ahead and step out. We'll We'll put him in the front. Do you need help up? Okay, go ahead and step in. That better? Perfect. Okay, what you just saw right there is kind of modify the handcuffing of the uh suspect, right? You always do it from behind the back. Why? For several reasons. You definitely have a position of advantage, and you want to make it as uncomfortable as you can for the suspect, right? And plus, then you don't want to be able to slip the cuffs and put them in front because when you have your hands in the front, you know, you can do a lot of stuff. So, under circumstances like this, gentleman who's a little older, has a bad shoulder, you know what? You definitely want to modify and make it comfortable for them. Two, the fact that um they double cuff. That's another important procedure. Anytime that you have very, very close distance, and it's very uncomfortable, you can use two sets of cuffs to make it a little bit more easy for the suspect. And make sure you double click, right? Click click click. You don't want that to happen. She she you know, this and that so I got her identification card. I asked her before I walked back, I'm like, "You want to cuz I didn't You want to get cited to court? You want to pay the violation?" Okay, so this is the officer explaining to the uh sergeant what happened. >> Okay. So, I'm coming back. Uh I start presenting her with the citation, her ID, registration, and then I finally Um She starts being very argumentative. The husband starts being very argumentative. I talked to him, I'm like, "You know what? I'm not going to go and talk to you right now. I'm not doing business with you. I'm doing business with her. She's the one that committed the violation. She said, "Why can't I be in the car?" And then she said, "Why can't he be in the car?" So, after all that, um I told her, "Can you sign Can you sign here?" But you said you found a misdemeanor. She said, "I'm not signing anything." I'm like, "Ma'am, will you sign here but you said you found a misdemeanor. She said, "I'm not signing anything." She said, "Are you sure you're not signing?" I'm like, "No." I'm like, "Are you sure?" Nope. Okay. Get out of the vehicle. She didn't want to get out. She didn't want to get out. I'm like, "You want to get out?" She said, "No, I want to sign out." I'm like, "Nope, I'm not going to do that. I'm not going to be playing that game." You're going to get arrested first. Unless you sign here right now. Okay. Um so, as I'm calling for an extra back uh getting ready to reach in and get her out, she she fell and everything fell out. Um Calling shows up, and that's when I reach in, unlock her door, and as I'm going for her seatbelt, the husband goes like this, like wanting to punch me or to do like towards me. And that's when I grab her and I pull her back out, yank her out, and I Okay, good part on the officer explaining this to the sergeant. What I will add is this, when he was making the decision to get her out of the car, he was waiting for backup, which is very, very important. But also, just because I told you that acronym ATD, ask, tell, and do, which I was taught like 20 plus years ago, there's also this buzzword de-escalation. You always want to de-escalate the situation, and I'm here to tell you, when you tell someone over 30 times to get out of the car, that's definitely de-escalation. >> Henry, that's when I guess he starts getting confrontational with calling. Okay. So, I'm charging her for REO and a violation. Yeah. And then I'm charging him for assault on PO and resisting arrest. So, if you didn't want to pay the citation, that's fine. He didn't say that I pulled him out. Like, he he jumped out of the car. Okay. He was resisting the whole time. >> Okay. So, like I don't know what he has on his skin that it it like from us grabbing him Yeah. Open it up. Okay. Just roll her window down for me. Yes, ma'am. He's got a bad two bad shoulders. Okay. One of them he had a reverse shoulder replacement on. Uh-huh. If it pops out, we're in big trouble. Okay. So, I don't know if he should be handcuffed, number one. Well, he's going to jail, so he's so he's going to stay handcuffed, ma'am. As are you. Okay. What I'm the sergeant. What do you What do you want to What would you like to talk to me I'm Cathy's husband. Yeah, um sir. But yes, ma'am. >> son. Yes, ma'am. What What can What can I try to answer for you right now, okay? How did it happen? It's not that I that I didn't stop. I did stop. Okay. >> It might not have been long enough for him. I don't know. Okay. Okay. Okay. So, so yes, not on a traffic stop, when you're receiving a citation, you you have to sign it, okay? If not, it it becomes an arrestable offense at that point. But I don't know that. Okay, sure. But why so I think he did say that. Why not just sign the the tablet? >> Because I So, and that's that's your right that you don't believe that you stopped at this or that you made a complete stop? That's your right to contest that in court, 100% all day long. But you have to acknowledge the citation at the end of the day by signature. Okay. But he he asked you he asked you to to sign the tablet. Okay. Okay. How to you, how many times did he tell you to sign the tablet? I don't know. Okay. More than once? More than twice? >> Maybe twice. Okay. Okay. Fair enough. He did, but she The question is perhaps that if he would have told her, "You know what, ma'am? If you don't sign this, this is going to be an arrestable offense." Do you [snorts] really think that it would have turned out to be this way? I don't know. My thinking is, like she says, "I wasn't going to sign this ticket, period. Not at all." Fair enough. But I said, "Well, let me have it then." I said, "I'll sign it." I said, "I'm not going to be arrested." I said, "Seriously?" Yes, ma'am. And he said, "Yes." You know, I'm a trust guy. I said, "Oh my gosh." So, yes, ma'am, that's that's where we're at now, okay? So, what does that mean? So, you're you're going to go to jail tonight. You'll be booked into the Eddy County Detention Center, okay? >> to stay in jail? Yes, ma'am, you do. And that would be up So, New Mexico's no longer a no bond state. Um so, it'll be up to the warden >> Okay. or the judge if they if they can get to you and see you um to get you released over the weekend. >> If over the weekend? Yes, ma'am. Because it's Friday night, you will more than There There's a potential that you'll stay in through the weekend. This is the most ridiculous thing I have ever seen in my life. I I could agree. I could agree. Seriously, this Yes, ma'am. Yeah, so can I. I'm the kind of person who's always on the cops' side. Sure. Always always always because I hate what they've done. What they've done with how how people But But you know what? This kind of thing makes you start going, "Well, maybe people are treated wrongly, you know?" So So, you're in your position because the officer didn't ex- take the time to explain things instead of you just listening and signing the citation like every other person that gets pulled over? I did listen. But you But you disobeyed him. You disobeyed him. But that's not that's Good question, Sarge. That's your choice. You will be arrested. And then I said, "Okay." And I would have signed it. That simple. Sure. I don't know. Maybe. There you go, Sarge. Any questions or anything else for me? Yeah. One question I have is I need my purse. Hey, baby. Hi. Have you been texting me? No, but listen, something something terrible's happened. What? What? Well, it's okay. It's okay. I mean, we're we're fine, I think, but we we came down to the to the beach. We went to the garden when we came down to the beach to see how many people there were. Yeah. And I got pulled over cuz he said I didn't stop, which I did, but he said I didn't stop. Anyway, anyway, so he um told me that you know, I needed to sign this. I said, "I don't want to sign anything." And he said, "Then get out of the car." And I said I said, [screaming] "No, I'm not getting out of the car." Anyway, anyway, I'm sitting with him in handcuffs. Yeah. Right now? Yes, in the car. Well, why did you do that? Well, I I wasn't going to just sign something. You have to sign it. Just for receipt. It doesn't mean that you agreed. I didn't. And that's what I said. He could have said, "Ma'am, if you don't sign it, you're going to get arrested." And then I would have signed it. Right. Are you in handcuffs right now? Yes, so is Daddy. Oh my god. Yeah, and they MADE WHAT DID DADDY DO? UH WELL, he made The officer said he tried to punch him, which he didn't. He was just trying to protect me. But and they somebody made him bleed. I don't know how how how, but they made him bleed. And they've got him in handcuffs, so you know his shoulders. And he's bleeding? Anyway, anyway, uh the reason I'm calling is because I need you to come get my car. It's down here at the beach. And um How Why Why are you in with you guys? They're taking us in, and we're getting arrested. And And because it's a weekend, he said I probably will have to be here all weekend. Yeah, so tomorrow may be off. at our house. Yeah, I don't know. I Dude, I don't know. This is It's the most ridiculous thing I've ever heard in my life. Seriously. Mom, you cannot do Mom, you You're not get so defiant with cops. Honey, I wasn't defiant with him. I just said I didn't want to sign it. I SHOULD HAVE A RIGHT. I SHOULD HAVE a right to sign it or not. I And if I didn't have the right, he should have said, "Ma'am, Well, he should have said, "Ma'am, if you don't, you will get arrested." And I would have signed [laughter] it. It would have been that Yeah, he should have given you the Yeah, the opportunity. You know, sometimes as parents when we have kids, the roles are reversed and the daughter Hey Mom, you know what? You can't be so defiant, you know? So, it's almost as if she's trying to tell her mom, "If you just would have signed it." She did say it, right? It doesn't mean that you agree with it. Maybe you can figure it out in court. >> Get out of that. Oh my god. >> Yeah. Why would that happen? I don't know. I don't know what they did. >> holes. He had some He had some scabs on his arm that opened up. Well, cuz he was manhandled. Mom? Learn your lesson. Don't get defiant. You're in handcuffs. Honey, Right now. Don't be Don't >> You know what? >> Mom, be nice. Mom, I'm just telling you. I've This has happened to me before. When I got too big for my britches, they're going to win. Don't get too big for your britches. Be Be kind now. Now is the time to be kind. >> Who's the kindest person you know? I know, Mom, but I also know that you're getting super defiant about everything and this this is uh >> I'm getting old and I'm getting tired of people taking advantage. No one's taking advantage, Mom, but it's going to get taken care of. Don't worry. I know you're scared. I'm not scared. I'm mad. Do you have any questions or Uh well, I I just I don't understand what hap- what's happened. Okay. I really don't. I mean, he he pulls us over for a stop for not stopping at at at a stop sign. And she was just saying that I you know, she she was sure she stopped at it and she was just questioning him. Mhm. And he he just got I don't know if he's had a bad day or what, but he he was just very angry. He was very angry and he wasn't explaining himself to I I didn't she she I know I know she didn't understand Mhm. what he was saying. What What the deal What was going on? I mean, You got to understand, we've never been I will thoroughly talk to them about this. I'm 72 years old and she's 68 and we've never been in any trouble. >> Uh-huh. We're law-abiding. We stand by the police and You will have that opportunity to thoroughly explain all of this, okay, to a judge who's ultimately going to oversee all of this, okay? I I'm I'm listening to you and I'm going to allow you to continue talking, but I want you to know that you're you're going to have your opportunity to thoroughly explain all of this to to a judge who will who will oversee all of this, okay? You're saying that this is unfair that this has happened because you and your wife are law-abiding citizens, right? Yeah, and and we just I mean, it was just a stop sign. I I get it. I get it, but at what point At what point do citizens have to acknowledge that we have a job to do when people break the law. We have to enforce it, right? And it's Right. It's a constitutional >> Very well said as far to contest charges and violations Right. >> through courts, through the judicial system, right? So >> So, so when when do we as police officers allow law-abiding citizens who have never been in trouble, who who have a lot of respect for police to use that as an advantage over us to say, "We've never done anything wrong, so why are we Why are we getting in trouble now?" Well, mainly because I don't think we've done anything wrong right now. I just don't and I I'm being completely honest with you. If they instigated this. Okay. So They If I If If If [laughter] they would have been as nice as you Okay. >> else here, Mhm. it wouldn't have been a problem at all. I got you. It would not have been a problem at all. >> I get that. But she was just trying to talk to him because she didn't understand what her options were. Okay. So, her her admitting to me that she refused to sign the citation in itself becomes an arrestable offense for just a traffic violation. See, I I I I did not know that. Okay. So, if If you get pulled over for a traffic infraction, it's the officer's responsibility to prove reasonable suspicion or probable cause that a violation was take that occurred, okay? And then if the individual citizen disagrees with that, they have a right to contest that in court or agree and say, "Look, I did what I did." and pay the citation or whatever the case is. Can I Is there any way I could talk to my daughter? As long as we're quick cuz the sooner we get you to the jail, the sooner we can get you in and get you processed and stuff or and or get you to the hospital, okay? He just wants to talk to you real quick. Okay. Daughter shows up at scene. Are you okay? It must have been one of those camel straw that broke the camel's back type thing cuz I mean, they said it's possible that there might be a judge on Saturday. There won't be one tomorrow for sure, but it's possible on Saturday. So, I'll I'll call tonight. I'll call tomorrow and I'll figure out if possibly, hopefully we can push it through and if there is a judge Saturday, that's a possibility. So, hopefully Saturday and not having to wait till Monday. Okay, so here's what happened. The female suspect was charged with failure to stop at a stop sign and resisting an officer. She pleaded not guilty to both charges in court. However, both charges were later dismissed after the prosecutor failed to appear. The male suspect was charged with assault on an officer and resisting an officer as well. Those charges were also later dismissed after the prosecutor failed to appear in court.
