On June 5th, 2026, an officer on routine patrol observed a vehicle drifting while turning out of a McDonald's parking lot and initiated a traffic stop. The initial officer's body camera was not activated during this portion of the stop. During this time, the officer detected the odor of marijuana and asked the man to step out of the vehicle. A second officer then arrived on scene to conduct a DUI investigation. >> Sir, you came out from McDonald's, right? >> Yes, sir. >> Okay. And you saw where I was sitting, right? >> I didn't see you. >> Yeah, I know you didn't see me cuz you're sitting there burning out on your tires. So, I stopped you. Your car smells like weed. You tell me it's hemp, all right? I asked you about a marijuana card. You had You let it expire. You don't have one. >> I didn't let it expire just this week. >> It got suspended. Why did it get suspended? >> Because of um a stop like this. >> A stop like this, right. So, what I'm smelling in the car prior to me getting up here is you you were smoking weed in your car. At some point. All right. Do me a favor. Go with this sergeant over there and keep your hands out of your pockets. That's not your key yet. >> Did you give him your driver's ID already? >> Yeah. >> Keep your hands out of your pockets, like he said, okay? Thank you. All right. Stand by right here. Well, see you're coming from McDonald's. >> Yeah, if I can have you over here, another officer is going to speak with you over there for a minute, sir. >> Sir. >> Let me see your >> Yeah. >> Simple simple simple question. >> Simple direction. >> Directions I'm giving you, though. I mean over there on that sidewalk. >> All the way over on the sidewalk you want them? >> Yeah. >> Okay. Okay. >> Why do we have to do this every time, man? >> Well, because you're not supposed to be having weed in your car, first off, especially if you don't have a medical equipment card. >> 2018 hemp law, you're allowed to have CBD oil. >> Okay. So, it's hemp? >> Yeah, that's what I tried to tell him. >> Okay. >> Hey, man. All right. >> You seen y'all guys. >> Got you. Okay. What's going on tonight, man? >> I I scratched my tires and he smells weed. I told him it was hemp and so he I don't know what he wants to do. >> Okay. You have anything to drink tonight? >> No. >> Where are you Where are you coming from? >> I was coming from McDonald's. >> Okay. What about before that? >> I was downtown. >> Okay. So, you didn't drink anything downtown? >> No, I was with my buddies. >> Okay. All right. Would you mind submitting some exercises for me to dispel the belief that you're operating a motor vehicle while impaired? >> Sure. >> Cuz I can smell it. So. And he says you're driving careless, so. But yeah. So. >> That wasn't being careless. That's how I always drive. >> Okay. All right. So, what I need to do, we're going to go through the exercise, okay? So, go ahead and This is going to be your starting position, okay? So, you're going to stand in this position as I explain all the exercises, all right? So. Just like that, feet together, arms by your side, perfect. Uh the first thing I'm going to do is I'm going to check your eyes, all right? Obviously, you're wearing glasses. Um if you want to remove those to make it better for you, or if you just want to put it on your your shirt there or wherever you want to put them. You don't have any false eyes or anything like that? >> No. >> False eyes. Okay, that's good eyes. Yeah, are you diabetic at all? >> No, sir. >> What are we What are we doing with the phone? >> I just want to let my dad know what's going on. >> to let him know? You're You're going, man. We're not We're not doing all that. Okay. >> So, you're taking my phone down there? >> Yeah, just for now. >> Investigation, stay off the phone. We do a traffic stop, we don't want other people showing up. >> Why are we automatically doing all this, man? >> Okay, cuz we believe that you're you've been drinking, that's why. As soon as I came up here, I could smell it on you, okay? So, that's where we're at. Like I said, you've already not doing what I asked you to do, you're doing all this, okay? So, just stay in this position, all right? I'm going to check your eyes. >> my pockets, too? >> That's fine. You can have stuff in your pockets. >> Okay. >> That's fine. All right? So, here's what we're going to do. You're just going to listen, and then when I tell you to do something, you're just going to do it, okay? And that's how we're going to get through it, okay? >> Yes, sir. >> All right. So, just keep your feet together, arms by your side, get your hand out of your pocket, just like this, like I said. All right, first thing I'm going to do is I'm going to check your eyes, but before we do that, so you don't have any false eyes, you just didn't do what I just >> Sorry. Sorry. >> As I'm talking, you just stay in that position, all right? Are you diabetic? Do you take insulin? Do you have any prior recent head injuries or anything like that? >> No. >> TBI, nothing like that? Okay. Is there anything that may stop you from performing any of these exercises correctly? >> I've had like a bad ankle and then like >> Okay. >> Uh I like a problem with my eyes sometimes, that's about it. >> Okay. So, just keep your eyes like that, okay? All right, so what I'm going to do now, if I can get my pen to work, >> I guess he was uh squealing his tires when he came around the corner like off of coming from McDonald's onto US1. Squealing his tires and Matt was right there at the triangle and saw him do it, so. He made the initial stop. Turned into it turned into a DUI investigation. Matt run the dog on the car and it hit, so. But what do you know? >> It's going to be the stimulus right at the tip of this pen. Do you see the light? The red light? So, what you're going to do as I move this pen, you're going to stare at the tip of the pen and you're not going to move your head. You're just going to follow this tip of the pen with your eyes, okay? And your eyes on me. Do you understand? >> Yes. >> All right, just keep your arms by your side. Thank you. All right. Here you go. >> Yeah, the dog hit on the car, but it's he's hit on this car before. >> Yeah, he walked >> That we know he's done more than uh He's done more than we But, of course, he was messing with his phone, so he was probably calling his dad. >> Am I allowed to blink? >> You can blink. Just don't all right. You're trying to move your head now. Just don't move your head, okay? Do you have any um prior like leg injuries or anything like that? >> I I got I got injured like I had like >> You walk fine? >> Yeah, I had a ankle injury like a few years ago from a moped accident. >> I got yeah, I got my injuries, so. Um so, what I want you to do, I'm going to demonstrate it. Just uh get in your starting position, like I said. Okay? Just like that. So, you're going to have an imaginary line here. >> Sure. >> And you're going to put your left foot on the line. You're going to stay in that position. Like like that. And then you're going to put your right foot heel to toe in front of your left foot, okay? >> Get back in position for him. >> All right, you may begin. >> 1 2 3 4 5 6 7 8 9 1 2 3 4 5 6 7 8 9 Okay, I did that correctly. >> So, all right. The next one we're going to do the one leg stand, all right? And go ahead and get in the start position like I told you before. >> Not at this one, but here we go. >> No, I didn't tell you to start yet. I just So, start position is going to be this, okay? Just like this, remember? All right. >> 1 1,001 1,002 1,003 1,004 1,005 1,006 1,007 1,008 1,009 1,010 1,011 1,012 1,013 1,014 1,015 1,016 1,017 1,018 1,019 1,020 1,021 Can I try the other leg? >> Yeah. Whenever you're ready. Stay just like this. You're going to look at the tip of your foot there, and you're going to count 1,001 1,002 all the way to until I tell you to stop, okay? >> 1,001 1,002 1,003 1,004 1,005 1,006 1,007 1,008 1,009 2,016 2,017 2,018 2,019 3 3 1 2 3 4 5 6 7 8 9 40 41 42 43 44 45 46 47 I actually did better than I thought. I'm really usually better than that. >> Well, you didn't do too good, okay? So, you haven't drank anything tonight? >> No, I did a little bit, but I have a good tolerance, and I'm I promise you I'm not drunk. I went to McDonald's. I was coming right back. I actually forgot something. I had to go back there and come back. Like I swear to God I'm good. I have to go right back there. >> How How drinks you think you had? Like >> I had one at Rick's and one at Tacos n 'Ritas. >> Okay. >> And then way before that, I was at the beach when I was doing my food truck. >> Okay. All right. So, so what I just need you to do now, all right, man? Uh so, I'm going to place you under arrest for driving under the influence. >> What? >> Cuz we found it just found my belief that you're impaired, okay? So, just turn Go ahead and and give me your back. Okay. Can you just walk over here to my patrol car? >> Before uh cuz I need to finish with the uh inventory. I've not searched him yet. So, make sure you guys search him. >> Yeah. >> And I just got the keys, like I said, for the uh >> What did I do wrong on the test? >> It's not a test, it's an exercise. >> It's an exercise, man. And it's not pass or fail. For right now, I just have uh belief that you're impaired while operating the vehicle, okay? >> I mean, you know I've been drinking, but you don't know that I'm drunk. Why do y'all hate me so bad? >> No, I don't hate you, man. I ain't got no >> You're always You're always coming for me. >> Yeah, but I got to I got to do what I got to do. I got to do my job, right? If I believe that you're impaired, I got to >> You really don't think I can make it to one block down the road? >> So, here's what I need you to do, man. So, just go ahead and uh just lean forward a little bit and widen your stance. I'm just going to search you, okay? You don't have anything illegal on you, any weapons, contraband? >> No. >> Drugs? >> Nothing. >> Put your hands >> I have a hemp vape that I told you in the beginning. >> Okay. All right. So, before I uh search your my phone and stuff, we're going to go over it again, okay? So, I just got to warn you, if you do have anything you're hiding or you forgot, and I don't catch it here, if you introduce it to the jail, it is a felony, okay? That's why I always tell everyone always warn people, "Hey, if you got something I don't know about, you got to let me know." >> I just told you. >> Okay. I'm just making sure. Cuz I've had a a of people on the DUIs all the time, they forget or they don't you know >> Well, I'm not drunk, so >> Okay. And stand up. Go this way. Take a seat. >> I don't understand the light for you. >> Holy [ __ ] bro. All right. All right. I'll be right back with you, okay? >> Man, it's like this was planned. It was so quick. >> I'm getting off. I'm supposed to be getting off in like 30 minutes. >> And look, he's digging all the way through my car. There's nothing in there. No, he always does that. See, and that's my phone, too, isn't it? >> Yeah, it's your phone. >> Can you answer it, please? That's my dad, a lawyer, Ron Saunders. >> Okay, well, they're going to have a chance to talk to him like after we're done on this, okay? They're going to give you a call and everything. >> Yeah, they wait forever. I even went to my house, said I forgot my McDonald's order, went back to McDonald's, and this is what It's the middle of the night, so y'all automatically think people are drunk. >> No, actually I did it two other ones tonight, and I did I let them go. >> Really? >> They were driving, yeah. >> What the [ __ ] >> You're the only one that I thought was impaired tonight. >> Cuz they probably literally had zero drinks, but if you have one drink, of course you're going to smell like alcohol. And I think I did the test pretty well. >> Yeah, but for future though, like I wouldn't I wouldn't even chance drinking at all and driving, you know? Like you're just putting yourself in a bad situation. >> Well, cuz I passed a DUI test 3 months ago uh at Marriott Bayside, like half a mile from here. And the deputy told me KWP still thinks you're drunk, take a Uber home. So, it's like you y'all and the deputies can't be on the same page, it seems like. >> I don't really talk to them all. >> So, what's going to happen with my car? >> Uh well, I'll take your car. Uh you can pick it up from them once you once you get out. >> So, nothing was in there, right? >> Man, [clears throat] >> Did you find anything, sir? >> Huh? >> Did you find anything? >> Yes. >> What? >> Uh the weed I tested tested positive for weed. >> So, you're charging me with weed? >> No. And the second cocaine that was on your center console. >> What? >> Yes. >> You're charging me with coke? >> No. >> Thank you. >> Testable. It was testable. So, man, last time we had the same thing, we ran into it, and you know, it's testable, but it's not collectible, and that's what it was. So, you got to get off that stuff, all right, man? >> I have not been doing that. I promise. I swear to God. >> Hey, you keep it in your car, maybe? >> No. >> Friends? >> No. >> Okay. Just Could it be just leftovers from the time before? >> I still haven't cleaned [clears throat] it, yeah. >> Ah, okay. That's it. Just clean your car, Bubba. That's all. Clean your car. Drive sober, okay? All right. >> Like I kept my leg in there for 30 seconds. I walked a straight line. Like I don't know what Maybe it's the eye test. I don't know. I mean, obviously it was a setup thing. There was three or four cop cars within seconds. I'm going to blow. I already know the whole thing. And I honestly think I'm going to blow negative or whatever you call it. So, >> So, do you know the legal limit? It's 0.08, right? >> Yes, sir. >> So, you blew over. The first sample was uh 0.128, so 0.12, um and the second was 0.120. So you're over the limit. So You know. >> I turned it at .15 though, which I know is like a >> Right, right. So it's not like horrible still, but you're not good to drive, okay? >> I know the last one >> what I exactly what I thought when I was doing the the gate exercise. I'm like You're not the worst person, but like you're not I didn't think you were good to drive. And I was it looks like I was right, so. >> That's what I blew last my first DUI I was .121. So that's almost exactly >> Right, okay. >> The man was charged with DUI.
