Bro, you were identified down to the mustache through a ski mask. >> I'm guilty. I'm as guilty as it gets. Just because you shot that person doesn't make you a bad person. Yes, it does. How does it make you a bad person? Cuz I shot him. >> Meet 17-year-old Gavin Smith, a teenager who has just realized that he is going to prison. And together with his partner in crime, Ashton, these two think they are gangsters. >> I mean, why why why choose this lifestyle? You guys aren't thug life, bro. But what detectives need right now are answers for one simple question. Why was 16-year-old Trenton Fort killed? And the only way to do that is to make these two teens turn on each other, which is going to be as easy as one, >> he doesn't care if you go to jail. I have dealt with Ash. I know he's a >> two. >> Right now, everybody's rolling on. >> Gavin pretty much told us everything. >> Three, >> Ashton's not going to come in here and drive a bus over you. He's going to be a steamroller. He's going to squash you like a pancake. >> So, what do you want to do? I'll tell you anything. Everything I >> February 24th, 2020, Nassau County Sheriff's Office in Florida raced to the local high school where they discovered 16-year-old Trenton Fort seated in the backseat of a car barely clinging to life. A talented football player with an infectious smile and a bright future. Trenton's friends and family were absolutely stunned that anyone would want to harm him. When police questioned the four friends who were in the car with him at the time of the shooting, they were able to put the pieces of the puzzle together. And sadly, each one only added to the nightmare picture in front of police and the public that this young man died for no reason at all. Trenton had been shot while the car was at a stop sign a few miles away in a residential neighborhood. After the shots were fired, his friends, fleeing in a panic, drove to the local high school where they called police. Sadly, Trenton passed away soon after being transported to the hospital. But police knew immediately who to speak to, 17-year-old Gavin Smith, who had fired the fatal shot. The following footage was kindly provided to us by the Nassau County Sheriff's Department. >> I'll see you over there. Not me. Hm. My knee. >> Your knee? >> Yeah. Come see. I'll get you uh sandwich. >> When detectives return to the room, they read Gavin his rights. And very quickly, Gavin slaps his rights aside to talk to them because in his mind, he did absolutely nothing wrong. guy was Snapchatting on the phone and offering you a ride. Yeah. >> Not right. And >> and then he said his >> Where were you trying to get right to my house? I was going there to pick up this sweatshirt. I was going pick up my sweatshirt. They had picked me up from school. I was like, "Are we going to Walmart?" I'm like, "No, you got to go to the house." So we went to the house. I grabbed this and another pair of another shirt to put in my bag. Put this in my bag cuz I was just trying to get my stuff and get from over there. My dad had talked to me and said, "I need to stop hanging out with them people cuz they're going to get in trouble and I'm not supposed to be around and stuff." And then he took a left, the stop sign. And when when he took a left, I seen like I'm not exactly sure how many people it was, but it was a bunch of kids walking down the street. It was like three big black kids, three or four big black kids and like two white and at least two white people. And then he kept going then turned around and then he came and then he stopped, unlocked the door and the big black kid came in, opened up the door and punched me in the face right here. >> Or can you lift your hair up so I can see if you have any marks or anything? >> My nose was bleeding earlier and there's like crusty blood in my nose. It was like right here. Okay. Yeah, right there. And then >> so so which guy opened the door? Do you remember? >> I I don't know his name. Okay. >> I've never seen him before, like ever, but apparently. >> Was he dark, light? >> He was He was dark. Um like not like super dark, but he was a little bit light, like kind of dark. And you remember what he was wearing or >> no [laughter] about how tall he was. >> He was pretty tall. Um, but he opened the door and as soon as he opened the door, he stuck me in the face. And when he stabbed me in the face, I went like that like there's like the center console and it was like right here like in his lap and I reached over and grabbed it and I took it and I just pointed at him and pulled the trigger and as soon as I pulled the trigger I dropped the gun and I was like, "Okay, okay, you got that. You got that. You got that." And I got up and I >> Now Gavin has said a lot in a short amount of time. a lot of BS that is because according to him the gun just happened to be there. He happened to get roped into the car because he wanted a ride and he didn't know the people that tried to rob them. In Gavin's version of events he's a poor innocent bystander when in reality he knew exactly what he was getting into. And it wasn't this Jacksonville Cowboys first rodeo. >> Cuz there's a bunch of people outside about try to jump me. So I ran and I grabbed that and I shot shot either at him or him or something. >> Well, so are you right or left-handed? >> I'm right-handed. >> So you grab it with your right hand? >> Yes, sir. >> And then you just Do you remember how you were aiming or did you >> I just I grabbed it and I went like that. I [clears throat] grabbed it and I had to just then point it out or anything. I just grabbed it like that and then toss it on the floor. Okay. Um, so and this this is nothing against you. I mean, obviously it's a a very heated situation. Sometimes we just make a mistake or whatever and forget details or whatnot. But after speaking with people, did you take the gun back and give it to what's his name? >> Ashm [clears throat] had guns um that he had like bought from people and stuff. That's another reason I didn't want to be over there because he had guns that he had bought before he had guns. Um that I honestly don't know cuz after that happened he had grabbed them and was like, "Oh, we got to get rid of the guns and he started putting them in bag and like ran off and I was still in the room talking to my dad on the phone." Hey. Um, when he So, this this is Okay, so we're Ashton is in the house, right? My dad told me like, "You need to stop hanging around him. He's going to get you in trouble. You're not supposed to be around him." And I sat down to talk to him. I was like, "All right, bro. Um, I'm going to stop hanging out with him. And but I had some of my stuff from there and I didn't want to straight up just ask me for anymore. >> You're trying to be a good friend and not hurt people's feelings, I guess. Is that right? >> I was going over there acting like I was just trying to chill out. I was really just trying to get the rest of my clothes, put them in my bag, and then go back home. >> Okay. That's the bag that you had with you. What What is that in there? There's a white hoodie. >> Yeah, there's a white a white hoodie. That's the one I was wearing at first. And [clears throat] this is the one I was picking up. And there's a black shirt, I think, in there. That like >> I'm pretty sure I put a black shirt in there, too. >> So, the white hoodie that's in the backpack is what you were actually wearing when all this happened. >> You were wearing that? >> Yes. >> Okay. So, the the your plan, I guess what I'm hearing, you tell me if I'm wrong. Okay. Your plan was to go over there and get your stuff and then get a ride back to your dad. Is that right? Did I get a ride? Yes, sir. Okay. And so while you're over there or sometime so that's about 3:30 they pick you up and um where's the bars come over this whole thing? gener. Um he said that he had some and he was like yeah bro you want to buy some of these like no and then [clears throat] um I guess like after was trying to sell them uh trying to sell his bars too because trying to make money or whatever and [clears throat] then that's another reason I didn't want to be they were all trying to like they were trying to sell weed and sell pills bills and stuff. >> I saw all this stuff, man. I saw all of it, >> you know, bro be a part, you know, not trying to get caught up for drug dealing. I'm on probation. >> What are you on probation for? >> I'm on resisting arrest. >> Okay. Well, you've been very cooperative tonight and we appreciate it. I promise you that. Um, it's just like, but we really want to get to the bottom of this. We not We want to know what happened 100%. you know, and I'm going to be straight up honest with you. I don't think you're giving us the whole scoop, man. And the reason why is because we're everybody's stories are kind of lining up on both sides except for yours, you know. Um, so what? You hang on to a gun, you take it back there, you know, Ashton grabs it from you, puts it with the rest of the guns he has. We have there's 25 people or 30 people out there with flashlights. They I don't know if you saw them. They brought out the lights. You know what I'm saying? >> We're bringing the daylight to the night, >> you know. We've got K9 scent, all of that. Um we're going to find it and we find it tonight. We'll find it when it turns light. But we're not leaving. There's something that Gavin hasn't quite realized about talking to the police. They can see your record. And as much as Gavin wants to paint Ashton as the mastermind selling drugs and getting into trouble, the reality is that Gavin was on probation at the time of this incident due to a long, long list of altercations and run-ins with the police. Starting with one at the tail end of 2019 when after getting caught with a gun in a car he was riding in, Gavin sprinted away from a cop and got in trouble for not only having a gun in his possession, but evading arrest. This is 2020. [ __ ] is magical in 2020. You know, I take a little swab from you. I send it to Cotas. When we find that bag, I swab that bag. I find the ski mask you were wearing. I find the >> I didn't have a ski. >> You did. And I also find the other thing. And unless you have a black shirt around your head, bro, you were identified down to the mustache through a ski mask. So, did Ashton say, "Give me the gun." Yeah. Ashton was like, "Bro, Ashton said, "Give me the gun." Cuz I still had it in my hand. I didn't drop him. I just didn't want to get Ashton in trouble, but Ashton said, "Give me the gun." >> I'm going to tell you what we're going to, Dude. This is about you and your life. >> All right. >> Cuz Ashton doesn't think he's going to come in here and he thinks it's going to be all hard. You guys aren't thug life, bro. >> I don't I don't want to do this [ __ ] >> I know you don't. So, we're here. This is your opportunity. get this out on the table because I guarantee you he Ashton's not going to come in here and drive a bus over you. There's going to be a steamroller and he's going to squat you like a pancake. You got the opportunity to be there first and tell us for real legit what happened. M. So tell me, we're back in the vehicle and I grabbed the gun, got you either shot or shot next to whatever. And [clears throat] then I went got out the other side and then >> draw me a picture, man. >> So you got passenger side of the vehicle? >> Yeah, I got the passenger side of the vehicle because there were still a kid standing. >> They're trying to rob you. What makes you think they're trying to rob you? Why do they think that you have money? They either think you have money or drugs. They don't think I have money or drugs. See these kids, they jumped Ashton when he first got out of jail at a park for no reason. >> Um, I don't mean to cut you off, okay? But Ashton told me that there's been this beef going on. >> Yeah. >> Okay. This goes way back. Is that what we're talking about? >> Yeah. They not I don't I don't even know these kids. I'm like even know you kids. Like why? What is What is your problem? Like I don't I have no clue what they want. And that's why I don't be walking around with count and stuff because if I do, I know one of them's going to see me and it's just going to start trouble. Just like today. They came up and it just started trouble. That could have been avoided. All these guys are like, "Well, we see Gav this beef or whatever that they've had for a long time. What what what's going on? How did it get started? Well, well, it all started because me and Austin were selling weed a long time ago when I first moved to Callahan and we had some money and we were walking down the side of the street and these people jumped out and tried to rob us. They didn't get anything. They I don't know what they want with me. And I ask them now all the time. I'm like, "Bro, I don't even know y'all. What do you want with me?" his actions got deep with them because he was talking [ __ ] about some kid's little brother or some [ __ ] and then um that's pretty much it. >> Now Gavin is surprisingly telling the truth about something here. Ashton was selling drugs and he did have beef with some of Trenton's friends, but not with Trenton. Trenton really was just in the wrong place at the wrong time with a friend that was trying to buy substances. And Gavin's forgetting something. The internet, specifically his own Instagram, was full of photos of him holding Xanax bars, clearly advertising them for sale. So, while he wants to blame it on Ashton, it wasn't a solo business endeavor. All right. So, you're sitting in the car and you pull that trigger. Did he just Was he standing face to face with you or like standing like you and me like this? >> He was face with me when I pulled it and then he said, "Ah shit." And then >> did you know where you shot him? >> No, I wasn't paying attention. I was as soon as I did that when I got up and ran out this side of the phone passenger side and started running and I was like, "No, bro. Go back to the house. Go back to the house." >> When did you give him the gun? >> Give Ash the gun. >> The gun. >> We went inside and then um Ashton was like when Ash was like, "Bro, what happened? What happened?" I was like, "Bro, I shot all of I saw one of them and then I was like here really and then asked was like dude give me that and he grabbed it and then put stuck it in the bag and then yeah like another silver one he stuck that in the bag. >> Okay. >> And then >> so he stuck the gun that you gave him and another silver colored gun >> in the bag. Is it a bag or a backpack? >> I don't really know. >> I was just standing there and black. Yeah. And um had you ever seen it before? The bag. >> The bag? No. >> It might have been one of the black bags. >> Room. >> It was like four backpacks that just sitting in the room. >> Okay. Ashton getting rid of the weapon is, of course, a crime, which explains why when police confront him with this information in his own interrogation, he starts to crumble, especially when they find the bag that he stashed the weapons in. >> There wasn't a situation where Gavin gave you the gun. >> Yes, sir. >> And you took a gun? >> Yes, sir. >> And put it in the backpack. >> No, sir. >> And ran out the back gate. They didn't come back with the backpack. >> No, sir. Tell me that didn't happen. >> That [snorts] what is that? M&P that 9 mm right there. You told me >> that's I don't think that's a real I don't that one right there. That's a CO2 pistol. It should be still out in the house. That's a CO2 pistol. That That is a thing a 380. And I think that's legal, too. Those two are legal. Those are his grandparents, actually. I think those are really that's a 22 that's a 380. Those are legal. That's a CO2 gun. I think that's a airsoft and I think that's a CO2 but I'm not 100% sure. >> That looks like a Taurus 40 to me. >> I think that looks more like a Taurus 40 caliber PT940 to me. What you guys doing, man? >> What do you mean? >> Well, I mean, why why why choose his lifestyle? >> Like, to be honest with you, sir, I'm not trying to make any trouble. That's why. >> So, why does lying have anything? uh we got the bag. It's right where she said it was >> next to the pink uh >> marked the pink. What is it? >> It's got the brass knuckles on them or what? >> Yeah, it's got the rice knuckles. It's got the um it's got the mask in it. Um it's got both guns or same guns that are showing the photo that these guys are posing with. Um so they're starting to work for for DNA right now. >> Is that what my text message was? >> Yeah. Trying to get my undivided attention right here. >> You got anything else? >> Uh, no. I think we're good. >> Okay. >> Look. More. That's crazy. Oh my god. That's why I don't understand why you're sitting here protecting people now. >> Hold on. >> Well, and see that's a noble purpose, right? >> But not the extent. I'm sorry. How long have you had that for? Um not that long. I just whenever I first met him, he just looked out for me and he was like my best friend. He just always looked out for me. We did everything together. I interrupted him. I was just curious about how long cuz both of them said that he hadn't been here long enough at all to be any real, you know, >> June of last year. >> Sorry. >> June of last year. It's not even a year. And in that time, he's gotten me in trouble in that program, but it's not looking out for you. Think we can get that real story? You think we can get that real story out? In Gavin's interrogation, he's not too thrilled to learn this news either. >> I got some good news and I got some bad news. Whichever way you want to look at it, we found the bag. We found another bag out of the woods. So, um, there's a process there. Um, anode detective anode is actually got to drive all the way over there, start documenting it and all that other stuff. But what are we going to find in that bag? >> Gun. >> Just one gun. >> No, two. Two. >> Yeah. >> What's caliber? >> Axe. And I don't know which one of them is, but axe had a freaking silver. He's telling me that at the point of time that he came back to the house and you tell me if I'm getting this wrong, you still had the gun. And Ashton took your gun or the gun that you had and had a silver gun that he had and he put it in the bag. And then there was some other stuff, too. >> Yeah. They had they had like a jar of weed and they do that in the bag, too. And then Well, You know those dab carts? They threw those in the bag, too. >> Oh, like the bank cartridges or whatever. >> Yeah, those things. They put all that in the bag and then I think they took like bullets and put them in the bag or something and then they all Ashton started running out the house and they were all running around. >> Police dig into Gavin demanding to know where he got the gun from. And though he has thrown Ashton under the bus a few times, he's actually been protecting him at the same time in a big way. Though with the clock ticking him closer and closer to time behind bars, that loyalty starts to fade. >> I don't played with before. Ashton, the silver one, I played with that before. Ashton was your whole one. L said he's gone. He's going to roll on you every chance he gets. So tell me the truth. Action let you hold one or what? What's up? Cuz you went down there with a gun. >> I have a gun. Tell me. >> There's no way. Four of the biggest black dudes you've ever seen in your life. You pass them in that vehicle. You turn around. Stop at the stop sign. and they start running up to the vehicle. One opens the door as you scoot it over from the center to the left side, get punched in the face, see a gun, pick it up, pull the trigger. >> Mhm. >> I mean, I seen John Wick 32, man. Come on now. I was sitting past in the face. I turned. The gun was right there. I grabbed that like that. Went like this and boom. Shot. Where was the gun? It wasn't up there on the seat, man. Just be straight with me, dude. I mean, it's okay. I'm trying. You're trying, but you think it's going to get you in more trouble if you had a gun on your person than if you found it. It doesn't matter. You know, you shot him. It's done. >> I am. And >> you told me why you shot him. You know, >> what you're not telling me is the truth where the men was when he come up because his DNA's DNA. >> Okay. >> One minute. It's next to his leg. Then you said he reached and got it from his waistband. >> We're audio video recording, man. That's the reason why we do it. That's the reason why neither one of us is making notes. >> Right here in the center console, laying on his leg right here in between his leg and center console. >> The second time you said it was in his waistband. >> Mhm. I didn't say that. >> You did? >> When? >> The second time you said it. The second time you explained to the medalist, you explained it. You saw it on his waistband and you pulled it from his waistband and you shot him. You pulled it from your waistband and shot. That's that's like your mind is trying to come up with a lie. You know, your conscious mind is trying to come up with a lie to tell me because you think it's going to make you feel better or make you look better. The only thing that's going to make you look better is logical explanation of the truth. You know, that's only thing that's going to make you look better, you know? And I'm not buying for a minute that you get punched in the face. See this gun? Like, oh [ __ ] gun. It doesn't work that way. How old are you? >> 17. >> 17. How many people would be shot? >> Zero. >> Zero. The first one. >> Yeah. >> You got four black guys coming up there after you. You look over there after you get punched in the face with a gun. I got to protect myself. It didn't happen that way, you know. didn't happen that way. So why are you trying to tell me it happened that way? >> I guess I'm going to go to jail either way. So I didn't say I'm going to jail. Do you have handcuffs on you? Have you had handcuffs on you since you walked this? >> No, probably will when I leave though. >> I'm not saying you will. I'm just saying I want the truth. >> I understand. I mean, are you feeling guilty? Is that what you're saying, man? >> I am guilty. I shot somebody. I'm guilty. I'm as guilty as it gets. Um, that's attempted murder. We're We're trying to figure out all the pieces. Okay. We're trying to figure out all the pieces. That's it. Just because you shot that person doesn't make you a bad person. >> Yes, it does. >> How does it make you a bad person? Cuz I shot him. >> Did you shoot him in the cold blood? >> No. >> That doesn't make you a bad person. But trying to lie and cover up and create and fabricate a story that makes you look like a guilty person. So just give me the truth. >> Every time you started out like partial, partial, partial, partial, you know, and I had to raise the little BS flag, you know, about the whole thing with Ashton. Then he wanted to protect Ashton, you know, by saying he threw the gun in the floorboard, you know. He didn't want me to know. >> Why? He doesn't care if he goes to jail. Wow. >> He's going to There's a reason why we're talking to you first, man. I've dealt with Ash. I know he's a [ __ ] stick. I haven't dealt with you. This is the first time I ever met you. [ __ ] well. I want you to do it. You can't. You're the only one that's saying you can't. >> Are you going to let me go? >> I want I want to know. I want to know the truth as far as where you got that gun when you went down there. >> I got it. No. >> Now, police have vital information to confront Ashton with. Not only did he supposedly dispose of the guns, but he provided them to Gavin to commit the crime. >> Um, what about the what do you know about the gun that was used? I don't know. Like I said, the only time I woke up was whenever the fight happened and then I tried to break him up. He ended up crying. I hit him and then I got scared cuz was calling the cops and grandma and then I ran. [snorts] me and my girlfriend they stayed at the house and that was um there's there's an incident or whatever. Do you do you know these people that came over there >> that came [clears throat] over to the that guy we got in the car with? >> Yeah. >> Um I'm pretty sure I know them. >> Okay. >> Pretty sure. And then um who who who do you think it is just from whoever you spoke with or whoever you whatever cuz I mean the only reason why I I say that I'm asking it that way is because I'm just I'm just reaching for some truth on your side. You know what I mean? >> I'm basically I'm not blowing smoke. And I'm just trying to test the waters and say, "Okay, is this kid going to really like follow through with what we agreed on at the beginning and say we're going to kind of, you know, yeah, they really do know what's going on, you know, test water." But I understand you're testing the water, too. You want to know how much I know, you know. Um, but that doesn't really help the situation as far as like your perceived notion or your perceived uh image of this incident that happened today. Um, so I got I do have quite a bit of information. Um, but I also have a lot of information about like a possible past history between these kids that came over there >> and picked up Gavin and you cuz the proof [snorts and clears throat] >> cuz he got from you gun. >> He definitely came back and gave you [clears throat] the gun. >> No, he didn't get the gun from me and he didn't give me the gun. You got the story wrong. I didn't give him the gun. I didn't have a gun. I had no weapon. >> Did you have your own gun? >> No, sir. I just got off on a firearm charge. Why would I have a gun? >> Why would uh because of protection? Because these guys have >> Yeah. >> Why would a guy Why would a guy that just shot another person say why? I mean, it's like, "Yeah, I did it." You know? >> I was like, "Well, where'd you get the gun?" >> From Ashley. >> No, I did not have no gun. He gave me a black M&P 9 mm small. >> And then what's so crazy is like, you know, you got to step up. You got to do this. He goes out there, he gets in the vehicle, he goes around the corner, comes back. Um, and then they go to get in the vehicle or whatever. That's when he had his little story. Um, anyways, after that happens, he runs down the down Max back towards the house or whatever >> and um, we got to get out of here. We got to get out of here. First of all, y'all are coming out of the house. >> Well, I was like a black ski mask or some [ __ ] >> Yeah, I was sitting on the couch whenever it happened. And [clears throat] um Zach, I just remember like I heard a bow and then Zach was running out the door and I jumped over the couch. I looked out the window I had seen by his ar [clears throat] running and he was like he was like um they stuck me up or something like that. And then >> you told me that outside. >> Yeah. He was like they stuck me up. They stuck me up. I was like damn bro what happened? What happened? He was like I grabbed a gun and shot him. And then he was like, Zack ran to the room and that's what they started arguing about was a ride. That's what happened. It was a ride that they were arguing about. And then I just started yelling, screaming. He's like, "They're fighting. They're fighting." So I bust his on top of his grandpa. I break it up and there you go. We're back to where we're at. But that's what happened. >> Okay. So >> I didn't give him a gun and I didn't have a gun after the fact. Well, so then by that account, >> Yes, sir. >> by that account, if I if I ask you for consent to do a DNA swap >> Mhm. >> and if I find this bag that you allegedly took out there to the uh wooded area. >> Mhm. >> It's not going to have the pistols in it, right? It's not going to have your DNA on it. >> Mhm. It's only going to have um whoever he snatched that pistol from his DNA on right >> and Gav. Yes, sir. >> Those are only two people's DNA is not going to be out there. >> Yes, sir. >> If I go out there and find that back. >> Yes, sir. >> Your DNA is not going to be out there. >> No, sir. >> Because you never carry a bag out there. I I carried Haley's bag out there. >> It was It was like a brown bag. And it was like this. And I carried it and we ran. That's what I had. So I didn't [clears throat] run all the way to the woods and come back. How? That's way too long. I was scared. I just hit a old man. I looked around for clothes and then I just grabbed H's bag, put some clothes in, and grabbed it and ran. That's right. But just in case there's not >> and you'll do consent. I have the above swap. [clears throat] >> Go ahead. >> And you're nothing. Okay. All right. Give me one second. >> You want some water or something? >> Uh, yes. DNA can be a bit confusing when you haven't even made it to your junior biology class. But Ashton does know enough to give a plausible reason why his fingerprints were on the bag. Unfortunately, Gavin has more information to give police regarding Ashton's involvement. Information that's going to be much harder to sidestep. >> So, you got that now from Ashton? >> Mhm. Are you doing that? Are you saying that just because you think it's going to appease me or is that the truth now? No, >> that's the truth. >> So, are we ready to start telling the truth? >> Yeah, that's pretty much the only other thing that wasn't the truth in the story is that I got to go. >> Why were they really over there? >> They were over there because Ashton wanted me to go out there and sell them freaking um like a gram of weed in his annex bar. And I was like, "Girl, I'm really not trying to do it." All right, fine. And then I was going to go do it and then have them take me home. And then [clears throat] I went to go do it, sell it to him. And then that's when they all came out and tried to jump me and rob me. And then I pulled out that little gunfight fine. Then I shot him and then ran back and gave to Ash. I was like I'm done with it and done with it. So Ashton sent you out there to do a drug deal pretty much. >> So this was this was all a drug deal going back. >> Mhm. [clears throat] And so I guess tell me the story from that point of view then from the from the drug deal. >> I guess I guess cuz the reason why I say is because we got the fabricated story the first time with um because he picked you up in the driveway, right? >> Mhm. >> Cuz we saw that on the Ring doorbell camera. >> Yeah. >> Picture you up in the driveway. You guys take a right out of there right back out. Go back up towards Deer Run. Then you drive back down Deer Run, right? What? Turn around after you saw those guys. Tell me like I was sitting there and then >> I don't want to put words in your mouth or anything. Won't you tell the truth? >> Yeah. I was sitting there and then this dude came in the back seat and the dude came up and opened up the door, hit me in the face. I was like, "Oh, and then the gun at like fell out of my pocket and it was on the seat and I just picked [clears throat] it up and shot him at him. I don't know if it hit him, but I saw I saw it and running down the road. I was like, "Just go back to the house. Just go back to the house." Both Ashton and Gavin were in on the drug deal together. When a fight ensued over the $300 worth of product they were selling, chaos erupted, which ended in Trenton, an innocent bystander, dead before he could even make it to the 11th grade. However, there is some justice in the fact that Gavin and Ashton are now facing their 11th hour. >> One or two questions. >> Good morning. All right. This [ __ ] ain't so cool no more, is it? We're in some serious [ __ ] Right now, everybody's rolling. Okay. Yeah. So, if there is anything you can think of to help yourself out right now, I don't know you from Jolo and you don't know me, but I'm telling you right now is the time to help yourself out. >> So, what do you want to know? I'll tell you anything. Everything. >> Tell me about the gun. Yeah. >> The gun that he had. Um, from what I know, um, he got it from somebody. Not sure how, but he got it. Maybe he stole it from somebody, something like that. >> Okay. Um, he said he told me. >> Yeah. We ain't running the game one yet, but it's for real. For real. Filled [ __ ] Uh um yeah, you're you're the [clears throat] last one that we we've talked to because uh everybody has done this right here. Pointed at me. Everybody said that. Everybody said I had a good idea. >> Everybody says that you were a major major player in this. I mean, from the beginning of orchestrating the drug deal to giving him the gun, >> everything. >> That's crazy. >> Oh, is it? It's all recorded. >> Yeah. Um, I can't believe that. Don't believe it. >> That's not what happened though. I can tell you how it went down. I'll tell you we had a plan or Gavin had which is one of the kids I jo and I didn't want to serve you drug test so he was going to sell Adam Xanax And um I was like, "All right, bro. I don't f that's all you." You know what I'm saying? I was like, "That's all your business." I even told him, I said, "We're [clears throat] good friends and Adam's got beef with me, so I don't think you should sell him." I never gave him. He's had that. He stole it. He's probably stealing it. That's what I heard. There's a rumor going around that he was stealing it. So, I didn't give him the gun and I didn't orchestrate the drug deal or whatever you said. I didn't start the drug deal. It was him that started it and there's probably text messages to prove it. Okay. Y'all already found my phone. >> No, we didn't. >> I didn't tell you how it was. >> Yeah. I'm 16. I just I can't believe everybody said that cuz that's not what happened. Why would everybody say that? That's not what happened. >> How do you think you found back, >> sir? How do you think you found? >> Someone probably told you. Who do you think? I'm not sure. trust. >> What was the plan? Did G know there was going to be some beef? I mean, I don't think he knew, but I had a feel. I told him, I said, "Bro, don't do it. It's going to be a sale. They're going to set you up. They're going to set you up." That's what I kept telling him. I said, "Bro," I said, "Don't [ __ ] do it. You were ask you're the bad guy." You know, everybody says says you're you're the bad guy. You're the last one we've talked to. >> Uh did Gavin make any comments about maybe any uh threats toward anybody that he was going to meet or anything like that? >> No. >> Did he say some [ __ ] was going to go down? >> No, he didn't say anything like that. All he said was um um he said [clears throat] if some [ __ ] does go down, I love you, bro. I love you, too. And he went out there and did it. And I just wonder why they rob me because I was trying to help them. You know what I'm saying? I knew I didn't do anything wrong. So I was like, "All right, well, I'm gonna diss you guns and I'm [clears throat] get out here and just >> What kind of phone is that?" >> It's iPhone. >> It was in, you know, years back. They found this one with Okay. Um, and what's the password? 0807 0807. These cops can destroy friendships better than the meanest high school girl out there. And it's made a big difference because not only has Ashton now caved and admitted the details of the drug deal, but he's admitted that he was ditching the guns. Though, police have one more question that can potentially earn him an even bigger charge. >> You sure he didn't have a gun, too? >> I don't know. >> What was he doing? >> My fault. I did everything. >> Can you get them in trouble? I got you in trouble. >> Yeah, I'm the only one in trouble. Why doesn't matter? >> You don't know that you're the only one in trouble? >> I'm the one that go to jail and get charged for it. >> Ask yourself the drug deal. You don't think he deserves something? Wow. Why didn't you get have to go to jail when I'm already gone? I did it. I saw sometimes more than one person can be in trouble for something, right? So I'm not going home trying to be stuck with you. >> Yeah. Wish you would have been start with me from the very beginning. >> I was. >> But yeah, he doesn't believe me. So I got to tell him what he wants to hear. >> Tell the truth. I I told you it's true. >> I'm going to go to jail for self-defense. >> Depends on whose opinion whether or not it's self-defense or not. >> Who was it? I'm pretty sure it was. >> This guy was unarmed. >> Unarmed. But >> he didn't have a weapon. >> I didn't know that. [groaning] And there were multiple of them. >> Did you see what we didn't see? >> Also, when it's self-defense, usually people stick around to tell the truth. Okay. >> I stick around to tell the truth. >> And you ran on. >> Yeah, cuz I was trying to get back to the house. I'm not going to stand there in the middle of the road. Listen. Listen, I'm not going to debate things with you because like I said, it's not my call. Okay? Not my call. That's Detective Murdoch's case, but I don't disagree with what he's saying. Okay? I really don't. This guy didn't have a weapon. So these guys are able to come up and try to jump me and hurt me and stuff. I don't know what their intent was. I didn't question any of them. Right. And the one that I would really like to talk to, I'm not able to cuz you know. Yeah. Shut up. I need the bathroom. >> Yeah, let me check them. Make sure what they're doing. Thank you. I'm not going to say that everybody was happy, but you know when they had to choose, you know, [clears throat] see where which way they chose. Well, again, I'm not trying to to make you feel bad about your friends. I don't want you to feel like the world's against you. I'm just saying it it's kind of the way things work in life, you know. Ultimately, for pulling the trigger and ending Trenton Fort's life, 18-year-old Gavin Smith was sentenced to 15 years in prison with 10 years probation. Trenton's family, who believed he should have received the maximum sentence of 30 years, were devastated by this ruling. Trenton left behind a mother, father, and two siblings who desperately miss him everyday. And for them, justice hasn't been served, especially when you look at Ashton's sentence. Ashton took a plea deal, earning just 1 year in prison and 5 years probation for a charge of accessory to a crime. Thank you for watching today's video.
