Driving this SUV is 66-year-old Marshella Chidster. This afternoon, Marshella has been drinking wine glass after wine glass. Right now, she is drunk, accelerating to 44 mph on a crash course 25 ft into this boat house filled with families inside. [music] [screaming] >> We have several war here. We need this has to be. >> With two people dead [music] and multiple others fighting for their lives, emergency personnel have a disaster on their hands. And behind it [music] all is one sick grandma. >> You drove your car into a birthday party and killed two. >> You did this. You see that there? You did that. >> It was actually a pretty good one. It was like a sparkling. >> It was a day of innocent celebration. April 20th, 2024, a three-year-old's birthday party was being thrown at this boat club in Michigan where his mother worked. All the locals and their kids were invited for a fun, relaxing day by the water. But in an instant, that day was thrown into chaos. Just as happy families were gathering to cut the cake, a car barreled in through the building, crashing into a wall and trapping innocent victims underneath. Before police arrived on the scene, frantic partygoers worked together to lift up the vehicle. They knew that someone was injured underneath, but they had no idea that the victims were two young ones. Their mother watched in horror as the car was lifted, revealing Zayn and Alana Phillips, injured underneath. Everyone worked together to get them out as police raced to the scene to help. All the while, as a mother was enduring her worst nightmare, the person behind it sat casually nearby, not offering to help, not reacting at all, just sitting and watching as a community tried desperately to save two of their own. And sadly, those two weren't the only ones injured. [music] After several minutes, police finally arrived in the rural area. under the car. >> Okay, >> you may need oxygen. >> The firefighters are coming right over here. >> They're on their way. Take care of the baby first. >> Yeah. >> Take care of the baby first. [laughter] >> Which one? >> Can you come with me just for a second? >> Are you driving? >> What? >> Can you come with me just for a second? You okay? >> Are you okay? >> I think so. >> Okay. >> I think so. >> Okay. >> This one here. I got you. I got >> Where you going with her? Over towards my car. Okay. >> Everyone at the scene gave up the driver, 66-year-old Marcella Chidster, as quickly as possible as she stumbled out with a police officer leading her to a quiet area for questioning. Those at the scene were forced to deal with the consequences of her heinous actions. And if you want to see more real raw footage, be sure to like and subscribe. It's literally all we do here. >> Is anybody in there? >> Here. >> I don't know. >> Is anybody in here? >> I don't think that. >> Okay. >> I don't think it penetrated all in there. >> Several victims were trapped in the bathroom and storage area behind the crashed car, which was inaccessible with the car in place. Officers worked to move the car to gain access to the additional victims. Sadly, both of the victims who had been trapped beneath the vehicle, Zayn and Alana, did not make it out alive. The victims had their whole lives ahead of them, celebrating a friend's birthday on a warm spring afternoon, and one woman's selfish actions took everything from them. Outside, she doesn't quite seem to comprehend what she's done. >> What happened? >> I just I passed out. >> Okay. Have you been feeling ill or anything like that? >> Yes. >> Were you here for the party? >> No. What were you What were you out here at the bowl club for? Are you remember? >> Yeah, I was just coming down here. >> Okay. >> Oh my gosh, this is terrible. >> Have you been drinking at all today? >> A little bit. Yes. >> Okay. When's the last time you had something to drink? >> Probably half hour ago. >> Half an hour ago. What do you drink? >> Wine. >> Wine. What's What's your name, hun? >> Marshalla. >> Marshall. What? Chennison. >> Chennison. Okay. You don't have any weapons on you, do you? >> No. >> All right. I'm just going to leave you back here just for a little bit. Okay. >> Okay. >> All right. >> Do you need to see any medical attention right now? >> I don't think so. >> Okay. I'm going to roll down this window over here. Just get you some air. Okay. >> Marshella didn't have just one drink, which is pretty obvious to officers at the scene who can smell the alcohol on her breath and on her person, which only makes what they have to do next more heartbreaking. Because as Marcella casually talks about her day and dismisses her drunkenness, the father of the children who have died arrives on the scene and the police have to tell him what's happened. >> You don't know nothing. >> Come up here. >> This is good right here. >> This is good right here, sir. I just want you. He's right here with me. Okay. >> Don't do this to me. Please. Please. >> I'm begging you. I'm begging you. Don't Don't tell me. Don't tell me, >> Brian. Okay, listen to me. Okay. All right. We're here to support you, okay? So, Mariah is your is your wife, right? >> She's my baby's mother. >> Okay. NO. NO. NO. NO. I'M BEGGING YOU. Begging you. >> Come on. Come on. Come on. Come on, bro. Come on, bro. Come on, bro. >> Come on, bro. I didn't do nothing. >> I haven't done nothing. I haven't done nothing, bro. No. >> No. >> No. >> In 2022, 229 innocent children were the victims of drunk driving accidents in the US alone. Every day, it's estimated that approximately 32 people are killed by drunk drivers. 32 innocent lives taken for no reason. This footage is hard to watch and it's a bit more serious than our usuals, but that makes it even more important because it shows that drinking and driving isn't just a silly story to tell your friends or a war story to laugh about. It can do this to people. For the Phillips family, life was never the same. But inside the car, the person who caused them that pain is completely oblivious. Even as officers read her, her Miranda writes, >> "Do you understand what I've just read to you?" >> Yes. >> Okay. Do you wish to speak to me? >> Pardon? >> Do you wish to speak to me? Like, do you want to have a >> No, I'm I'm good. >> Like, do you want to talk or No. >> Oh, I'm I'm just hoping no one was hurt. >> Oh, sure. Um I just So, can I talk to you? >> Yes. >> Okay, perfect. Okay. So, what happened today? Where where were we at today? >> I went to lunch with some friends. >> Okay. But what time was that? >> Um noonish. >> Okay. So, around noon, you went to lunch. Do you remember what you ate? >> Um yep. I had some chili and a um a fish sandwich. >> A fish sandwich. Okay. Where was that at? >> At Verest. >> At Verest. Uh what' you drink there? You drink water pop? Anything? >> I had a glass of wine. >> Just one glass of wine. >> Yep. >> Okay. Okay. So, you have one glass of wine at Verna's. Um after that, what happens? You leave at noon. Where do you go? >> Came home. >> Um what do you do when you get home? Um, I just came home and just kind of chilled out and was waiting for my husband to get up. He was taking a nap. >> Okay. >> Um, did you drink anything else there? >> No, I didn't even I didn't even get a drink down there because I never made it this far. >> Okay. >> Do you remember what happened when you were going around here? >> No, not really. I pulled into the parking lot and I was I thought I was driving up to the bowl club and evidently I was driving right into the pavilion. >> So this a breath test. Um I just want to see where you're at with your alcohol level. If you have one glass of wine it's going to be really low. Okay. So uh just go ahead and uh blow like you're blowing a balloon. Okay. >> Keep going. Keep going. Keep going. Keep going. Thank you. [laughter] I just want to make sure everything is okay. >> Oh, absolutely. >> Oh my gosh, that was so scary. >> On a scale of zero to 10, zero being like you're stone cold, sober, you can drive perfectly. Uh 10 being you're passed out drunk. Uh where do you think you're at right now? >> Uh seven. >> A seven. Okay. Do you think you're okay to drive? >> I wouldn't want to drive. >> You wouldn't let you drive? No. >> Okay. >> Okay. Just give me one second. Okay. Sorry, my phone's ringing. I think it's going to be my boss. I apologize. >> Marcella gave herself a seven. And yet, as you'll see, she routinely claims that she only had a single drink. One glass of wine. All the while, a few feet away, a father is forced to reconcile with what she's done. >> He's lying, bro. I'm telling No. Stop. He's lying. I'm telling you to lying, bro. He's lying. No. No. He's lying. LISTEN. LISTEN. >> STOP. HE'S LYING. HE'S LYING, BRO. >> NO. It was just It was at a birthday. >> Marella is placed in cuffs and taken to the hospital for a blood alcohol test where she begins her campaign as a victim. >> Take my boot off, please. >> Your boot. >> You're going to have to put it back on soon. Just take it off. >> At the hospital, Marcela's blood alcohol level was revealed to be8, which is twice the legal limit, and obviously points to her having had more than just one glass of wine, in spite of what she tells officers when they bring her in for questioning the following day once she's sobered up. At this point, she's completely unaware that she's killed two people. Okay. So, uh again I want to talk to you about uh what transpired yesterday and what you can recall and possibly give us shed some light on what happened. Okay. >> And I find it's easier with people that you know what you when we recall events we start we said well I got up I had um I had a bowl of cereal. I watched the morning news. And then it just goes on until we're here right now. >> Okay. And so, do you think you can do that? >> Mhm. >> Okay. All right. You can tell us how your day begins. >> Um, how did my day begin? Um, I met some friends for lunch. >> Okay. >> Um, and then, um, I didn't finish eating my lunch because I got like a canker sore on the inside of my mouth. So, it's pretty sore. Um, and then, um, I went to the bow club. Parts of the footage provided by the police department are redacted because Marella discusses a medical condition she has at length. She claims that this condition caused her to pass out at the wheel the day before. And while she does have records of her having the condition she claims, that doesn't exactly account for the BAC or her behavior before and after the crash. >> So you you said you met some people for lunch. >> Mhm. >> Okay. Where was that at? >> At Vern. >> Okay. So anyway, like and don't mind me writing stuff down because I I just have to sometimes and if I repeat things, don't take it offend, you know, offense to it. >> Sometimes I have to create a picture in my head. Okay. >> Okay. Um, so do you know about what time at Vern? >> Um, I think we met at 11:30. >> 11:30 >> a.m. >> Mhm. >> lunch with friends. And when you're at Vern, you said you had lunch. Um, do you recall what you had? >> I was going to have um a cup of chili, but like I said, I had a canker sore, so I couldn't finish it. >> Okay. Okay. >> I still actually have it. >> Um, any water, pop, beer, wine? >> Um, had a water and a glass of wine. >> What type of wine? Uh, Chardonnay. >> Chardonnay. Okay. Is that your normal Mhm. >> Chardonnay? The fruity nutty. [laughter] >> I'm not a wine. I I'm not Hawaiian snob either. I I've read it on the bottle though before. >> Sure. >> All right. So, uh, that takes us up to about 1210. >> Yep. >> Okay. Do you, uh, how did you get to Verus? I drove. >> Okay. Was anybody with you? >> No. >> Okay. >> I met them there. >> Okay. Got it. >> All right. When you're done at Verest, where did you go to? >> Um, went to the boat club. >> Straight to the boat club. >> Mhm. >> What's the next thing you remember? >> Um, waking up in the patrol car. >> So, you woke up in the police car. >> Yeah. >> Okay. And then basically we know the events after that. >> No, I don't I don't recall anything prior to that at all. >> Okay. >> Marshella's condition, which has never been publicly disclosed, is proven to result in seizures and neuropathy or numbness and tingling of the extremities. A year prior, Marshella had suffered from a seizure and was told that she wouldn't be able to operate a motor vehicle until she had been seizureree for 4 months. She had also been warned repeatedly not to drink alcohol with her condition. Something that according to friends and everyone who knew Marcella, she didn't take too seriously. >> Okay, so uh what we do as investigators is we put together a puzzle. >> Okay, each different, you know, situation is a puzzle. And so I look for puzzle pieces. That's my job. I'm a fact impartial factf finder. Okay. >> And so that's why I talk to everybody and I also gather evidence. We gather evidence. Okay. And part of that evidence is say like surveillance footage and this that and the other. And so what we do then is we create a timeline. And that's what I'm trying to do here with you. >> Okay. >> Okay. >> So we know you're at Vern at 1210 and then you say you go to the boat club. Right. To the boat club. >> Mhm. So, that's not exactly accurate because I have surveillance footage of you at the boat club at 3:00. >> Okay, that could be >> Okay. So, that's that's why I'm I'm trying to get a a full account of the time. So, so from 12:10, we didn't go directly to the boat club. We went home. Did we go to the store? Did we go to a friend's house? Um, what did we do during that time? >> I I don't know. I don't know. I know that um the party started at 3:00, the birthday party. So, I was there a little bit before that. [cough] [clears throat] >> Bless you. >> Thank you. I'm going to step out real quick. >> Okay. >> Okay. So, you're saying you believe the party started at 3:00? Well, the party actually started at 1:00. >> Oh, okay. >> Um and so 3 um again between that 1210 and 3. Um now part of the job you know with collecting you know v video surveillance and putting pieces together is we talk to people >> okay just like how I'm talking with you you know I take people's statements and those are puzzle pieces now however a lot of times people's uh statements aren't always 100% truthful and accurate but however there is accuracy there to where it it makes sense and so with this puzzle or like a picture I'm trying to paint a big picture or put together this big puzzle. >> Okay, >> so um now getting back to our timeline here, Marcela. >> Um >> hi. >> I I really need you to think long and hard about where you're at between noon and 3. We need to fill in that time gap. And it's very important that you think as hard as you can because it's very important. >> I may have stopped home um just to check on my husband to see what he was up to. So I could have >> Okay. >> I could have stopped at home. I wouldn't be there for very long. How's your guys' relationship? Again, I have to ask these tough questions. >> Hey, we made it 30 years. >> Yeah. I mean, [clears throat] you guys are still good. >> We're good. >> Okay. >> And if you stopped home, would it be common that you had another glass of wine? >> I don't believe so. No. >> No. Okay, >> we know exactly where Marcela was between noon and 3 when the crash occurred at home drinking. Inside her house, investigators discovered these bottles and surveillance footage showing her stumbling to the kitchen to put down one of the empty bottles of wine. >> Now, again, these hard questions, Marshall, how often do you drink? Um, I was drinking quite a bit there, but I've kind of switched over and I'm doing a free now, more so because of the um >> What's a free? >> It's uh alcohol free. Alcohol free Cabernet. >> Alcohol-free Cabernet. Mhm. >> Okay. Is it like a I guess it was like a Ojles like a oles of wine. >> Yeah. Okay. Okay. >> I still have an occasional regular, but I've been trying to stay away from regular because of this. >> Is that what you had at Verna's or was it regular? >> I had a regular. >> Okay. >> And it was just one glass. >> Yes. >> So, it's really important and I wouldn't be doing my job if I didn't do this. Sure. >> Okay. We know that you weren't drinking alcohol-free wine. >> That's correct. >> Okay. You had a little much. Would you agree? >> Again, I don't remember. >> Okay. So, um we know that you had a little much. >> Okay. Okay. And you know you crashed into the building, right? >> I know. >> Do you know what happened? >> I do not know. I just everything just went blank. That's what happens when I hear >> flash of white light and then >> this alcohol. >> Stay away from it as much as I can. Yeah. >> Okay. But yesterday you partaked in non-alcohol or the regular alcohol wine. Okay. Um you've been trying to stay away from the but yesterday you slept. >> Yep. >> And you had the real stuff. >> Yep, I did. >> Okay. How much did you have? >> Um again I just had one glass at um Vera. Um >> do you do you drink hard liquor? >> No. Vodka? >> No. >> Beer? >> No. >> Okay. >> So, one glass at Vernus? >> Yes. And I might have had a glass at the boat club. >> When at the boat club? >> When I went there after Verest. >> So, >> so you went there after Veras? >> Yes. >> And then you went home? >> No, I went stuck at home first. and then went to the boat club, had a glass of wine. >> Yes. >> And then blacked out in the back of the car. >> Yes. >> Well, that's not accurate. >> Okay. >> Okay. Because your car is going 50 m an hour into the driveway and drives into the building. >> So, you didn't go to the boat club before the crash. Okay. And we know the crash is at 3. >> Okay. >> And we know that Vera is at 12:10. >> Okay. And so, >> and it might have been 12:30, I >> Okay, that's fine. So, from 12:30 to 3, would you have been at home drinking regular wine? >> No. >> No. >> No. >> Okay. Because the alcohol level you were at at 4:00, it's not practical. It's not feasible that you had one glass of wine. It is not. >> And I I >> I've I've been doing this for 23 years. >> And I may had um glass of wine at Burners, but then I had a glass of wine at the boat club, too. Or two glasses of wine. >> Oh, wow. Well, we know when you were at the boat club. >> Okay. >> Okay. And so, did you go into the did you do you recall going into the party at all? Being at the party at all? >> No. >> Being in the bar at all? >> I was in the bar >> while the party was going on? >> Yes. Well, I thought the party didn't start till 3:00. >> Okay. So, yeah. So, so you go from Vera's home to boat club, back home, and then back to boat club. >> No. No, that's not >> No, I stopped at home first. >> Okay. Before I went to the boat. >> Okay. So then then it's not possible that you drank at the boat club because your car drives into the building and everybody stops drinking. Nobody's drinking >> and you didn't go over to the bar and get a drink after you drove into the drove. No. >> And I don't remember any of that. There's a reason that Marcela's chain of events makes frankly no sense. Because she hadn't had her first drink at the restaurant with her friends around noon. She had it soon after she got up in the morning. As revealed by surveillance footage inside her home at 10:45 a.m. prior to going out with friends for her single glass of wine, Marella was caught at home drinking on surveillance and stumbling as she did. As she left the house, she was seen supporting herself on the railing to get to her car, where she then backed into a neighbor's vehicle before taking off. Crashing into the car is obviously bad enough, but the fact that she had to do a whole horseshoe maneuver to do so really speaks to her level of intoxication prior to driving off. >> So, your doctor um didn't tell you not to drive after that last one at the boat club. Did he tell you not to drive? >> Yes, >> he did. >> Yes. And I didn't. >> That's what I >> But you did yesterday. >> Yes, I did yesterday. They said takes about four months or so before you know you can drive again. >> Okay. But that's a month. >> Yeah. The end of January. >> Yeah. Um >> so this is April. So >> Michelle, getting back to that honest assessment of how much you drank. >> Are we going to be honest? >> Yes. >> Because your level, you were a 21. >> Oh, that sounds like a lot. >> Yeah. So 08's the legal level. >> Okay. >> Okay. So, one glass of wine or one beer or one 1 oz shot of liquor is 02. >> Okay. And you eliminate one of those an hour. >> Okay. >> Okay. So, you can see where I'm doing my math. I don't know. Are you good at math? >> Yes. >> Okay. So, that would equal about 10 drinks within an hour. >> Oh, wow. That's a lot. I I don't I mean I don't know. Everybody Everybody's drinking is different. Okay. Some people drink out of a pitcher. I've seen it. I've talked to people drink out of pictures. >> Mhm. >> Um everybody's thing is different. So I'm trying to get that accurate picture from you. >> Okay. >> Did you know anybody at that party? >> Yes. >> Who'd you know? Um, we call her Tweety. She's a barmaid there. And then, uh, Dan Deavar, he is the, uh, rear commodor. >> Okay. Anybody else? >> Um, there was probably some other people there that belongs to the boat club. >> Okay. Were you upset with anybody there? >> No. >> No. Would you intentionally drive your car into the boat club? >> No. >> No. >> I wouldn't be doing my job if I >> No. So, you didn't know anybody there at the party? >> Um, >> other than Tweety and Dan and >> just boat club people? >> Yes, boat club people. >> Okay. Do you know what type of party it was? >> A birthday party. >> Birthday party for who? >> For Tweety's son. >> Okay. All right. Um, and that's why you're going? >> Mhm. >> Did you have a birthday present? >> No. >> No. >> No. >> Okay. A card? >> Yes. card. Where's that at? >> Uh, that's a good question. >> In your car? >> No, I believe I put it in the card box. >> Okay. Well, you couldn't have put it in the card box cuz you weren't there. >> Cuz you drove right there, >> right? >> And you drove through the wall. >> Yes. >> So, you didn't put a card in the card box. >> There. There might have been there might have been a card box on the bar. >> You didn't go to the bar. >> I did. I did go inside the boat club. >> Before the part before what I thought the party was starting at 3:00 >> and then you went back home. >> No, the See, it's just not adding up. No, I went I went home before I went to the party or before I went to the boat club. >> So after Vernos, you stopped at home. >> Yes. >> And then you went you're you're saying you went to the boat club and had a couple glasses of wine. >> Yes. >> And then you walked from the the bar at the boat club to the party >> to the car to my car. >> To to your car. Okay. >> Did you go back home then? >> No. >> Okay. >> No. So, you walk back to your car. What What happened when you get in your car? What What do you remember that? >> That's where I don't really remember anything. >> Well, what what Sergeant Hooper is saying here is that we got the video like like we said, you didn't park and go in and then go back to your car and then drive into the into the building. Okay. You come down from where your house is going very fast and you just drove right into the building. >> See, I don't remember any of that. Marcela still can't wrap her head around the fact that she didn't casually arrive at the party as a welcome guest. She quite literally crashed the party in the worst way possible. And no, she didn't bring a birthday card. I will say that I'm surprised that um you said the car was going down the road from my house for the club at like 50 m an hour because that our road has got such huge potholes in it >> that >> well I don't I don't know the exact speed and neither does Sergeant Hoover. I believe he said that but it was it was going fast. >> Fast doesn't cut it. An analysis of her vehicle revealed that when she collided with the building, her foot was pressed on the accelerator at 96.6%. At 44 mph, she didn't hit the brake until after she burst through the exterior wall, at which point she pressed the accelerator and brake at the same time, which doesn't work too well. Her car traveled 25 ft inside the building before she came to a stop, injuring 15 people and taking two young lives in the process. Yet, she's stuck on her belief that police must have her speed wrong because of potholes. Though, when you're willing to crash through a wall at 44 mph without even tapping the brake, potholes are clearly the least of your worries. >> It's just, you know, I mean, you seem like an intelligent lady, right? Like, it we just got to figure that out. Like, what happened between those those times? Um, I know you said with the Um the doctor said you're not supposed to to to drive. Um you said that you you notice that they happen more frequently when you start drinking alcohol. >> Yes. >> Right. Okay. >> That's why I really tried to cut back and just drink free. >> Okay. But like obviously yesterday you had a glass of wine at lunch. Um do you do that often? kind of like maybe cheat a little bit and have one glass here and one glass there. >> Um >> or we try to stay >> we I on the weekends. Yeah, we try to I try to meet Peter and Brenda on Saturdays. >> So on the on the weekends typically you'll have a a glass or two. >> Yeah. >> Okay. But it it doesn't really go more than that cuz you know that by drinking it >> um alcohol free. >> Oh, okay. Um I don't I don't know if they still do or not actually. >> Okay. >> Um it was actually a pretty good wine. It was like a sparkling. >> Oh, okay. >> Yeah. >> Okay. Um they haven't carried that in a while. And >> I don't not that I can recall. >> Okay. So every every weekend you meet your friends up there and have a glass of wine or two, which is fine. >> Yeah. >> Um you give >> chair. >> Yeah. Okay. We'll hit you in the bathroom. So that way you're not sitting here. >> I'll I'll push you, too. I don't I don't need you to. >> When she returns from the bathroom, the police are ready to talk to reveal what she's really done. >> They say not to drink alcohol when you're taking these meds. >> Correct. >> Okay. So So you knew that, but you still kind of cheated and had a glass of wine yesterday and you're like, "Okay." >> Do we do we do that often? >> No. Um like if I'm going to have a glass of wine, I will wait until um after. Did Did he make you feel funny at all? Did do you notice anything like that? >> No. >> Okay. >> Just other than not remembering anything. I was just telling him when he'd stopped out that I couldn't believe that I was actually driving that fast down the road because we have another gigantic pow on that road. >> So, yeah, that was that that was a shocker to me actually. >> Okay. Um and again, we wouldn't be doing our job if we didn't ask you. Um, you're prescribed medications, but do you take any medications that aren't prescribed to you? >> No. No. Like oxycodone? >> Aderalls, anything like that? >> Nothing like that. >> No. Okay. >> What about uh again, you got to ask illegal drugs like anything like that. No hardcore drugs. No, >> no, no. [clears throat] Okay. Of >> course, I'll be willing to stand out on my porch on neighbors, you could get a pretty good. >> Yeah. Okay. [sighs and gasps] So, um again, in reviewing all this, um there's there's some questions that are unanswered. >> Okay. >> Okay. Because again, you're a 21 a 21. Okay. And one glass of wine does not do that. Two glasses of wine doesn't do that. Three glasses of wine doesn't do that. Four glasses of wine doesn't do that. >> Yeah, that surprises me. >> Five glasses of wine doesn't do that. Six glasses of wine doesn't do that. Okay. and even given your body type and you know other things I I I'll give you you know probably seven or eight could get you there. Okay. And so I want the truth from you, Marcela. I want the whole truth. Okay? Because right now we're sitting here and I need the truth from you. And let me tell you why. Okay. The truth will help you. >> Okay. >> Okay. The time of downsizing what we do is over. Okay. Minimizing what we do is over. So, we're going to start fresh. >> Okay. >> And I'm going to ask you a very blunt question. >> Okay. >> Are you an alcoholic? >> I don't believe so. Can you sit there and tell me that this I see you're getting a little emotional. I apologize. >> Well, I I think >> it's I have to ask these hard questions and you need to look into yourself, >> right? >> And answer this truthfully, >> right? And I would say I drank considerably more when I was not drinking the free. But since I started drinking the free, I'm not drinking nearly as much. >> Okay. When we talk about the free, is it like the light wine that's less calories? >> It's alcohol-f free. >> I've never seen it. >> Yeah. It's called FRE. >> Okay. So because we talked to people Mhm. >> And when we asked them about Marshall, what do you think they said? >> Probably I used to be a pretty heavy drinker. >> Try again. >> Pardon? >> Try again. >> That I'm a heavy drinker. >> Yes. that you're an alcoholic. >> Okay? >> Need to look in here right now. >> Okay? >> Because this is the time, Marcela. This is the time, okay? Where you need to dig deep. [clears throat] Do you have a problem? And you need to be honest. Do you have a problem? Are you an alcoholic? How many glasses of wine did you have yesterday? because it was excessive. >> Yeah, >> you would agree it was excessive. >> And I'm surprised by that. I really am. I didn't think that I drank that much. >> So, I'm shocked when you tell me that. That six glasses of wine, that's a lot of wine, >> right? At 3:00. >> Yeah. >> Could even be more. >> Yeah. Well, I certainly um I'm not going to be drinking anytime in the near future. That is for sure. >> Yeah, she's not going to be drinking in the future, but she doesn't seem to understand why. At this point, she seems to think she's just in trouble for drunk driving. But she's about to learn the truth. That in spite of having a good support system, ample finances, and all the opportunities in the world to get help, she decided to drink and drive [music] and traumatize a whole community in the process. But you know they all what what else they said about you. I'm I'll be bluntly honest like you was they said you were a very good person. You're a churchgoing lady and you know it wasn't just that you were an alcoholic. Okay. >> Right. >> But and I you know talking to you for we've been talking for a while now. I I I can see I can see they're talking about you know I think you are a good good person. So, I couldn't tell you if it was four or five plus the one I had at Vernis. >> Okay. Was it more than 10? >> No, I don't think so. >> No. Somewhere between five and 10, you would say? >> I don't think it got close to 10. >> Okay. >> So, 5 to eight? >> I think that's pushing it to >> 5 to six, >> maybe. >> Normal glass sizes. >> Yeah. Yeah. >> Have Chardonnay. That's the go-to. >> Yeah. >> And that's at the boat club. So, you know, I've been doing this job for 23 years, Marshall, >> specifically investigations for eight, okay? And so, I've talked to a lot of people >> and a lot of people that, you know, try to deceive me, okay? And at this point, you are trying to deceive us with how much you drank yesterday and where you were at between noon and 3. >> Yeah. I understand. >> Okay. And it's frustrating when I look to try to show you in a good light. >> Mhm. >> Because when we talk to people, we have to write a report and other people are going to look at it. >> Oh, true. So, this is your one opportunity to tell us the truth and look truthful and not deceitful because there's only going to be one of two ways that you're seen. One way, you're a liar, no good criminal. [laughter] >> Okay. >> All right. Second way, she's sorry for what happened. She wants to own up to what she did and she wants to take responsibility. >> Yes. That's why I was pretty sure Paige was in the club yesterday. >> You said Angie. >> Oh, I I did say Angie. >> Yeah, I did say Angie. >> So, yesterday was Saturday, right? Yeah. I think Angie works Saturdays. So, who is the Marshall we're talking to? Is it a liar who's not going to tell us and be truthful? Or are you going to be truthful, remorseful for what happened? >> Oh, absolutely. Only I don't remember what happened. That's the thing. >> Do you want me to tell you? >> Sure. >> Okay. You probably are the most hated person in the United States. >> Oh no. >> And many more are at the hospital in critical condition right now. >> Oh no. >> Adults as well. >> That is why I'm trying to get the truth from you, Marcela, so I can tell the prosecutor that you're not a low down dirty drunk that wants to go out there and >> Oh gosh. No. And I'm frustrated because this morning I was down at the coroner's office watching the autopsy. I'm looking for the truth. Marshala, the truth needs to come out because you are the most hated person in the whole United States right now. I guarantee this is national news. You are the most So you need to change that narrative right here. You need to change it. There's only one way you can change it, and that's by telling the truth. I've been doing this for a long time. I've sat across the table from killers before, like really, really bad killers. You're not that person. >> And I don't remember. Honestly, I do not remember. >> I would think I would remember something like that. >> Well, you're not being truthful about how much you drank. You're not. It's scientifically impossible to be the blood alcohol level you were last night with one glass of wine like you're telling us. It is impossible. Science. The world cannot have you had that level with one glass of wine. >> Again, I was pretty sure that I had a couple glasses of wine at the boat club prior to whatever happened that I don't remember. So before you keep spinning this story with us, I I just I want to leave with one thing, Marshall. >> Okay. >> Okay. When you stand before God, >> you think he's going to ask you why did you lie to those detectives? >> I'm not. Honestly, I'm not lying. I don't recall. I don't recall. >> So then you shouldn't have been driving, should you? >> No, probably not. But I'm just devastated. >> So are many people right now. >> I'm sure they are. >> Well, they're looking for answers and we're trying to help them find answers. >> I understand. >> But you're not telling us the truth. You understand? But you're not telling us the truth about how much you drank yesterday. You're not. >> I don't know how much I had at the book club. >> So, there's one thing I want to leave you with, Marshall, because I'm tired of being lied with. You did this. You did this. You see that there? You did that. You did that. No. >> You did that. And you continue to lie to me. >> I'm not lying. >> You did this. >> I'm not saying that I didn't, but I certainly don't remember. I don't recall. >> That's not going to cut it. >> Well, I don't know what is. [snorts] >> I know. It's not what you're telling us. No, I'm not going to beat my head against the table here getting the same story. So, I'll call for the CO to come down and get you. >> Okay. Thank you. >> Throughout Marcella's trial, she refused to take responsibility for her actions. She repeatedly claimed that she didn't mean to cause the accident and denied being an alcoholic or drinking more than a single glass of wine. In spite of the surveillance footage and the blood alcohol results, which proved she was under the influence, she claimed that the blood alcohol test was handled improperly, resulting in it fermenting and giving her a higher reading than what she actually had. All the while, the mother and father of the ones she killed sat in court, listening to her refusal to own up to what she did. They both spoke on the stand, trying to get the point across and to make her see what she took from the world. >> I lost my children. The loss of my children has created a void in my life that I will never be able to fill. And the grief I carry is something I will live with for the rest of my life. My children were my everything and kept me going every day. They were my joy, my hope. SHE TOOK EVERYTHING IN MY LIFE AND destroyed it. As a result of her drinking and driving, Marcela was sentenced to 25 to 50 years in prison on two counts of secondderee murder for the deaths of Zayn and Alana Phillips. For the family, it isn't enough, and nothing will ever make up for what they lost. Our thoughts go to the family of Zayn and Alana Phillips [music] and all of those injured in this act of violence.
