I mean, my dad's always a vicious. I can't even describe it. It's not a human. >> Like, I look at that. I don't see a human in there. >> This is the daughter of 52-year-old Toby Madden, currently realizing that her mother was murdered by the very man she calls her dad. And as this manchild puts on his best act, Oh, so dead. >> Detectives must figure out whether these sobs really are those of a mourning husband. >> That wouldn't hurt yourself for nothing. >> 26 years of lonely. >> Or whether there is a monster hiding underneath it all. >> My daughter said, "Who do you think hurt your mom?" You know what she told me? >> You find that killed that killed her. It was early afternoon on October 11th, 2022 when a quiet neighborhood in Butler County, Ohio, erupted with screaming and sobbs. Neighbors along a quiet residential street ran outside to find the source of the agony. And there, standing in the middle of the road, was 52-year-old Toby Madden. He begged someone, anyone, to call the police. His wife had been attacked. Calls rolled in to 911 dispatchers with Toby's pain on full display through screams in the background. >> My neighbor. >> When police arrived at Toby's house, they discovered him doing CPR on his girlfriend of 26 years, Rachel Brussaw. Paramedics told them to move aside so they could step in. But as they got closer, they came to a haunting realization. Rachel didn't need CPR. She was dead, long dead. She had clearly been lying on the floor for several hours at least. And her cause of death, well, it was hard to miss. She had been stabbed over 50 times. It was a crime of passion, of unrestrained violent emotion, and they didn't have to look far to find that emotion. Beside them, Toby Madden, her partner and the father of her child, was sobbing, wailing, and throwing himself around the room like a child. It didn't look like an act of grief. It looked like, well, an act. Police took him down to the station for questioning where the act continued. It's just so funny. Oh my god. Oh my god. >> Yeah. Here. Just have a seat there. Sorry. I I got some water. Oh my god. Oh my god. Michelle. Yeah. Just you sit right there. Okay. Go ahead. What are you doing? You're fine. Just tell I know this isn't easy. Okay. But we need to figure out what happened here. Okay. Okay. John, I just need to ask you some questions. All right. [gasps] >> Oh, Michelle's gone. >> Huh? >> Michelle's gone. >> Michelle's gone. Okay, Michelle. What's Michelle? >> She was trying to be I was trying [clears throat] for Oh my god, she's gone. Yes, sir. [panting] Oh. Oh my god. Before you feel an ounce of sadness for this man, just remember that his own daughter told police this about him. >> Um, >> I mean, my dad's always been a vicious. Like, I can't even describe it. It's not a human. In the 5 hours of interrogation footage we received, over half of it is Toby trying to squeeze a single tear out of his eyes as he throws himself around the room, wales and screams. The tears don't come. The anger, however, that's just down the line because the photos police have taken of his arms and legs, they show several wounds. Wounds that clearly came from a fight. In this case, his long-term partner fighting for her life as he took her life away from her. Oh god. Oh god. Oh god. Oh god. Oh god. Oh god. Oh god. Okay. Oh my god. Oh my god. >> Oh my god. Oh my god. [snorts] Oh my god. >> Yeah, you're obviously very upset. I can see that. >> Okay. [clears throat] Well, well, Toby, I'm trying to figure out what happened. Okay. [snorts] >> What happened? I keep shooting somebody on the ground. I moved everything up. I keep trying to get her to breathe. >> Well, well, listen. I I haven't been out there, so I'm trying to figure out what what what happened. So, [clears throat] people there were three people that were up there. >> Okay. >> Well, [snorts] I I need you to tell me who supposed to be. Try again, son. There's supposed to be there three people from the city and you're supposed to gas. >> Okay. Did Did you see Did Did you see these three people? Just I see two by the basement door. >> When was it? >> When I came in. >> So you were sleeping in the house. [gasps] >> So the spot was supposed to be there. My parents were supposed to come to the castle. One person was supposed to turn the gas on. She said there's going to be coming gas. [gasps and panting] [clears throat] >> But you saw three people. You saw >> So [clears throat] there there were two out back, right? Do do you do you know what time this was? [panting and sighs] [snorts] >> You're you're renovating that house, right? [laughter] Okay, [gasps] you [snorts] know it's not easy. I know I get you stay. [snorts] >> Yeah. Go ahead. [sighs] [gasps] Find please find that house. >> Please >> please. >> I I need more information. >> Okay. I just >> But and you saw him this morning, right? >> Find out who find out who else, please. Okay. And and I will have people do that, but I need But you said that was this morning. You were, right? [snorts] >> [sighs] >> I was thinking I was sitting in a with a chair on a chair. You're wasting time. >> Yes, we are. >> Kevin, I I had to I had to get information from you to figure this stuff out. >> Okay. Because I need to know when was the last time you saw her. So, [gasps] >> oh my god. >> When was the last time you saw Michelle? >> [sighs and gasps] >> Do you know what time it was? [snorts] >> Toby is eager to try and offer up other suspects to detectives. In this case, he wants to put a group of utility workers on the line. Now, utility workers were actually at Toby's home the day of Rachel's murder, but at the autopsy approximated time of her murder, they were long gone, and they had plenty of witnesses placing them away from the home at the time Rachel was killed. Though, as you've probably realized, no amount of logic or evidence can stop Toby from pursuing victimhood, which isn't new according to his daughter. >> And he's one of those people. He's very like I don't want to say he's intelligent >> because he's not in my life, but he is to a point where he'll make you think that he's the victim. He's very narcissistic. Um he likes to reverse the roles. You you would like it's hard like I it's hard to explain how he is >> but he definitely will try to you know make you come up with stuff like make you talk. I don't I can't explain it, but he's >> I >> That exact behavior that his daughter is describing isn't just on display in the interrogation room. It's on display in Toby's phone because conveniently he recorded an argument between himself and his wife where despite having started the argument, he tries to play the victim. >> STOP MEETING UP WITH HIM. >> THAT'S WHAT YOU DO. STOP IT. STOP IT NOW. YOU are serious. >> I've turned it into I had to post you know that I would never do that. >> I am NOT supposed to show them where you look at them. >> In his interrogation, he tries the same tactic. But there's a problem. Detectives aren't nearly as forgiving as his wife was. >> But I need to know like what what did you do? Where did you go? >> I'm sleeping. So you see down the world please. Okay. And and then what happened? >> I went back home. I was I was walking on on the house. >> Okay. >> Not by the bathroom, but by the front bedroom. >> Front bedroom. >> I laid down there. >> And then what happened? fixing fixing the gas and the hot water hot water. Okay. [panting] And and then what [gasps] I was sleep and and when you woke up, what happened? >> I don't sleep. >> You heard screaming. Okay. Okay. Then then what happened? So she was cold. She was gone this morning. There was stuff. >> Okay. Do you remember what was laying on top of her? Okay. So, there's furniture on top of her. Do you remember what it was? Was it a table or >> Okay. And then what happened after that? >> [clears throat] >> What happened? >> I guess you were supposed to be in court this morning and you didn't show up at court. >> I don't know. >> Okay. >> I don't know. >> I'm just telling you that they issued a warrant for you. So, hold on. But since you got a warrant, I got to read this to you. Okay. >> Fine. >> Yeah, that's what it says. It's for not paying. >> But but [snorts] since technically Hold on. But since technically you can't leave because you have a warrant right now. Okay. I got to [snorts] read this to you. Okay. It says, "Warning, I'm a police officer. I want you to recommend silent. Anything you say can't leave the court against you. You have the right to consult with a lawyer before and during any question if your lawyer." >> Okay, hold on. Just listen to them. You got the right to consult with the Lord before and during any questioning. You have right the lawyer present while you're being questioned. If you can't a lawyer before >> I can't believe >> you can't believe I know but listen. That's the way I I had to read this. Okay. >> Oh my god. >> Do you understand all that? >> Oh my god. >> And you want to still talk to me? I don't want to talk to you. I mean, you want to talk about you talk about I want to talk about but because you want I got to do this for a fire. You're going to be arrested. >> Okay, let's go. >> Let's go, man. Don't you want to figure out? Let's go. Let's go, man. I can't believe I can't believe you didn't even come in about five of you. I feel like we're pass [snorts] right now. I feel like we're passing >> I'm not Please. >> Okay. >> Please. Let me see your doctor. Please. >> Okay. >> Please. I'm asking you please. In the name of Jesus. Okay. I need something to drink. I need something to drink right now. [ __ ] with you. God in the name of Jesus. >> Oh my god. Get some water. All right. >> Breathe. Breathe. Listen, I I personally don't care about fire, but I'm just saying technically speaking, >> you never won. So, I got to read that to you. That's why I want to find out who did this to Michelle. >> Oh my god. >> Okay. I don't give you. Okay. So, just I'm just telling you there's something wrong with me. >> Okay. Let me let me Okay. Well, I'm going to go call squad for you. All right. You want to do something tomorrow? Okay. >> I told you that. >> Okay. All right. >> Oh my god. >> Toby was no stranger to law enforcement. At the time of his arrest, he had a bench warrant for not showing up to a court date regarding probation from a previous crime. According to his daughter, at just 15 years old, he was arrested and charged as an adult for being involved in a shooting where a man was paralyzed. When he was released, he continued to rack up charges, including felonious assault, [music] operating a vehicle under the influence, and possession of controlled substances. But behind closed doors, things were even worse. >> We're trying to figure out kind of like what's what's >> wrong with the man. Well, just what's I mean I know he lived or they lived with you in is about Land. >> Yeah. Well, he didn't really live there. He brought his junk that he likes to call that he can make money off of. Never wanted to get a job. >> Okay. >> I mean >> I mean has you been that way like your whole life or No. >> Yeah. I mean he's always alcoholic, drug user. >> Yeah. on with holidays, events, certain things would get, you know, we leave on Christmas day and not come back for a while, you know, things like that. It's always been a very abusive physically, emotionally, you know, verbally, all that. My childhood, dome, domestic violence [snorts] was a lot. >> Um, you or your mom? >> Both. >> Okay. >> Both. I've seen a lot >> like >> go around. Sorry, let me just put that super heavy. >> Um, I mean, you said nice bounce. I mean, was you putting hands on? >> Oh, yeah. >> Like Oh, yeah. >> Hitting, punching. >> Oh, yeah. I I used to have fist fights with my dad. >> Really? >> Yeah. >> I mean, I'm not letting him touch my mom, >> right? I get >> four of us. Like, you're always going to protect, >> you know, what's yours as my mom, you know? >> Yeah. >> I'm sorry. like >> listen this is >> it makes my emotions sad and angry. >> There's never a polish on high school. [snorts] I mean it's >> traumatic event. >> Remember what Toby has put his family through as he complains to paramedics who are brought in to decide if he needs to be transported to the hospital before he's put behind bars. >> Why don't you go ahead and try and sit down for me >> while we're here? Okay, take some breath. Are you having chest? >> I'm lightheaded. >> Okay. >> I'm lightheaded. Like >> you're breathing pretty quickly. >> That means you're having it right here in this room. >> Right now. >> Okay. That's cuz you were hyperventilating. Are your body still trying to dump off some of that you got? Um, >> I need to I need to go. >> I guys, I need to um I need to see I need to see the doctor. I need to call the doctor. >> Okay. >> Well, they can't help you with that, Toby. I can help you with that. >> Okay, let's let's call the doctor, please. >> Well, they need to finish doing what they're doing here. I think your daughter needs to come. >> Yeah. >> Listen, her her mother's dead. Her mother's dead. >> Please let me call the daughter. >> We got to focus on you here. >> Please let me call the daughter. Can I have something to drink? >> Yeah, that's fine. Can you? >> Yes. >> You're smart. >> What about What about Do you get from? >> No. >> Well, I would take you out. I'd put some stickers on your chest and take a look at your heart and see if you're having a heart attack. >> Okay. >> Take you out to the hospital, the doctor. Dude, run blood work. >> No, I'm done. >> I'm done. I got to call him. I got to call my family. >> Okay. >> Please. I want to leave. Please. >> I I told you you can't leave cuz you have a war on. >> Okay. Well, then let's go. I'll go pay for work. >> Well, I can't I process my family. Tell me stop. Listen. You're not going to let me go see my family at a time like this. Who killed Michelle? >> I'm talking about who killed her and you want to DO THAT. I GET IT. WE WROTE THAT BECAUSE we want and that's fine. But you said you don't want to talk to me about who killed >> you was in there. >> Toby, [snorts] I wrote you that stuff on because I have to. >> Okay. And I just want to talk to you because I need what happens. That's it. If you don't want to talk to me, that's fine. I can't talk to you anymore. just said let me talk to my family. No, I said I wasn't you didn't just let me go home. Please God, please. I know. Please let me please talk to my daughter. TELL ME I JUST SAID I WANT TO TALK to him. Okay. So, you are understanding. >> I am I can't because I got a goddamn phone. >> You're right. I'm going to go pay you right now. Let me go. I'm not working. >> I just want to know what you >> really get done. You don't have any money. >> Yes, I do. You don't have any money. >> How do you know I got no money? >> Cuz you told me you had to sell my wallet. >> Okay. Relax. I'm not going to godamn disgusting. >> What's truly disgusting is the pain that Toby put his daughter and partner through. Pain that sadly she isn't even scraping the surface of in her interrogation. >> So I I assume they're rel on and off sort of thing. >> Yeah, they were never married. It's always been an arch toxic relationship. >> He's cheated. He's lied. He's abused her. All kinds of things. You name it. He stole money out because they have a joint account with GE. >> Okay. >> Sadly, um I don't know why she did that. Um with a drug head have a joint account. He took the money or her money for a down deposit. like we paid their rent and she paid the det and half. Um but he took that money out of her account. >> Mhm. >> When we were trying to get this hotel, so me and my fiance covered it. >> I got >> um basically she was trying to get away from me. >> Okay. >> I think she's always been trying to get away from it, but he's like a straight cat. >> I got [snorts] >> I think it's hard because I feel like she feels guilty. She felt guilty if she left it because Yeah, no one just like his backer and how he was raised and all kinds of things, you know. I felt like she just felt guilty if she left him because he didn't have anyone. She was loyal. Loyal most loyal person you would ever meet. So I went to the core honest. >> Yeah. >> Just a great woman. Drugs have killed his brain cells tremendously. Like I looked at that bug shot and I don't I don't see a human in there. Is that weird to say? >> No. >> I don't see the human. I see you like and my daughter asks I see as she tells me monsters like yes they walk this earth. [snorts and sighs] How many times do you think I know this is do you think you saw >> violence >> like him putting hands on your mom? >> Too many to count. >> Okay. More. Okay. >> Too many count. I mean I'm going to be honest. >> So basically your whole life I guess. >> My whole life. Um I'm going to be honest with you. Um, my mom never really uh I mean she would fight back, but it was mostly me being the bodyguard, being a protector. >> I mean, I I I used to fist fight a grown man that went to prison other than my mom. Like, you're not touching my mom. >> Tragically, Rachel was caught in a cycle of violence with Toby. And by all accounts, he wasn't just violent with her, he was violent with everybody. As he was taken behind bars following his clearance by EMTs, detectives questioned his other family members about his mental state. His cousin, who was raised alongside him, told investigators that she always knew he would do something and that every time she saw him, he was threatening to kill or beat up someone. Armed with this and more DNA evidence pouring in, detectives bring Toby back for more questioning. Toby, the reason why I brushed back in here is because like [snorts] I said, I need to find out what happened to Michelle. >> Okay. Cuz I talked to Michaela earlier. She's very upset, you know. >> No, you didn't let me talk to her. >> Well, she showed up. I I didn't go looking for her. >> Okay. But she's upset. She wants to know what happened to her mom. >> Well, why wouldn't she? >> Yeah. >> Why wouldn't she? >> Yeah. So, so can we can we talk about this again? I need more information about what happened. >> Um, >> no. I don't I don't want I don't want to discuss anything with you right now. >> Okay. >> I'm um I um I'd like to find out too myself, >> right? You know, do you know I got some people asking me? >> You probably the only ones in Hamilton that don't know that. >> You probably the only one in Hamilton that don't know that um there's some um >> Well, who's after? >> Well, you know, I um back I um I trust um I turned into the public county um sheriff's department. Did you know that? >> No. Who who did you turn that into? >> Um the guy that catched the dog. >> Oh, roads. >> Yeah. >> Okay. >> Okay. When was that? Do you remember? >> Last year. >> Was last year. >> Okay. So, you think people were after you because of >> I think so. Do I think? >> Yeah. Um well um I could um I could um >> as a matter of fact um the group the group that's the group in their afternoon there's they're really really good people man. I mean, they're known for their um for the terrible cruelty in the way they um >> they handle things in my head. >> Yeah. >> What's the battle in your head? >> The battle? Oh, there's a bounty on your head. Okay. Um who are these people? um the people that um I guess belong to that belong to some um people they were on you last night. >> Yeah. >> Yeah. >> But but what happened? You obviously didn't get snatched up. >> Yeah. You could see the um you can feel me being on the door. I had to go in the door. >> Okay. >> Do you remember what time that was? It was getting dark. Getting dark. Okay. Yeah. Yeah. If you put a GoPro on put on there, you'll see you see you'll see the um people. >> Did Okay. So, did you walk home from you? I can now come walk there. >> Right. >> Um there was some friend of my brothers who had just happened to go by. >> Mhm. >> The um ride where up to um house. >> Okay. So he took you home. >> Okay. Firstly, that there are cameras everywhere and the footage of him at Kroger that night shows absolutely no one following him and he doesn't look nervous or concerned whatsoever. Secondly, that when you're doing the Walter White drug, stupid insane stories always make sense. When you're the rest of the world, they don't. The idea that anyone would be pursuing Toby or Rachel over drugs he was caught with over a year ago is absurd. Almost as absurd as his claim that the utility workers were behind it. Toby, did you or Michelle ever get in any fights? >> Um, not any more than anybody else. >> The reason why I asked cuz I guess Muel said that you guys used to stay with her and her face or boyfriend or something. >> I didn't stay with her and boyfriend. >> You didn't say love with >> No, it was Michelle's place and um Oh, is that what it was? Okay. >> Michelle's place. They got they got um they got kicked out of them because they had too many they had too many visitors. >> Yeah. When Michael told me that you guys were always getting fights because you were I guess Michelle you would said you would get paranoid get upset and then always start accusing yourself and stuff >> like talking to other guys and stuff like that. >> Yeah. What was that? >> Your daughter. >> Um >> that's that's why I'm asking. No, we we didn't have any um discussion about finances enough money. >> Is that what happened this morning? >> No. Never told you that. >> I'm not here. I'm asking you what happened cuz here's >> why why don't you because told you that me and her argument before. >> She she says when you that you get paranoid and then you you would guys were getting fights because you would get paranoid about things. >> Toby's paranoia isn't just a rumor that's floating around. It's something he videotaped himself. For years leading up to Rachel's murder, Toby accused her of cheating on him and seeing other men. According to those close to her, she never did. She was loyal to Toby. Loyal to a fault. >> Toby, did you clean up after you >> after what? >> After you were there. >> At the house. Where? >> At the house. I mean, you said you did CPR on it. Did you clean up or did you go outside with your neighbors? >> I clean up I asked if you washed your hands if you scrub the floors. If you did like >> No. >> Okay. >> No, I didn't I didn't um scrub the floors or nothing like that. >> Did you wash your hands? >> Um I I don't recall if I did or not, but um um Why did I clean up the house? >> Well, and that's this is the part that's confusing to me. Okay. I don't think what happened today necessarily was this. I don't think you mean to hurt Michelle. You guys wouldn't hurt Michelle for nothing. >> 26 years I've known this woman. I told you I wouldn't hurt Michelle. >> I know. But you also said you you keep telling me that you guys didn't get in a fight and there was nothing physical physicalification. Okay. You told me that you guys didn't get any physical altercation that day. >> I'm talking about today this morning. >> Okay. So, you know, we took your nail scrapings and we took hers. Do you think we're going to find >> like do you think her under her nails? You think we're going to find your skin, your blood? From where? >> From you. You got scratches on your arm. >> What? Show me. >> Right there. >> It's right there. >> What? >> Right there. >> That's That's a scratch right there. >> That's a scratch right there. >> Yeah. >> There's two There's two lines right there. >> So, what I'm asking is, do you think we're going to find your your skin cells under her nails? >> I I don't believe that you would find them there. I don't have any scratches. You have scratches [clears throat] on your chest, too. Watch out. >> Yeah. I don't know if you [snorts] can see them. It's the ones I took pictures of earlier. They're right there. >> So, how would somebody scratch you to your shirt? >> You guys were in a fight. >> No. How would somebody scratch you on top of your shirt? How could >> your shirt hang out like this? If you're in a fight, your hands end up all switch. But listen, you were looking at you were trying to to see me and Michelle. >> Okay. >> The only thing we've done is move furniture. We we've been we've had arguments in um in the past. We we even shot each other before. I had to get off from me um because she she thought that I was um was another woman um but that doesn't have anything to to do with that. >> But you didn't claim to yourself. You asked me if I scrubs. I asked you if you wash I ask you if you wash your hands before you scrub the floors or clean the floor. >> Yeah, I never I never Why would I do that? >> Oh, listen. This is This is what I'm thinking. >> I'm sorry. Somebody for us. >> Well, Toby, just just listen. Okay. I'm thinking that you guys got into an argument this morning. >> I think that you're I think that what you're doing was um you're you're summizing your to set up a um scenario that that didn't take place, right? Because because I mean what would I clean up with? What would I have no time to clean up? Um >> well, that's why I'm asking. >> I didn't scrub any floors. >> Why do I do that? >> Okay. Because the evidence that we found, that's why I'm asking. >> No, what's the evidence that you found that show up with any flaws? >> Okay. >> But there's no evidence that show up with any flaws. But what you're saying, we're not going to find your DNA under her skin cells >> or under her fingernails. >> From from what? >> From I'm assuming the fight you guys were in inside the living room. >> Why? Who told you that we had a fight? >> I'm asking if you had a fight. >> I told you we didn't have a fight. >> Okay, cuz here's the here's I talk to you. >> Because you're not you're trying to say we had a fight. >> Okay. Well, I'm just asking if the evidence comes back that way, there's a reason why it would be that way. That's what I'm asking. What reason? >> That's what I'm asking. What other reason could there be that her she has defensive wounds on her? Okay. Which means she was fighting with the person that attacked her. Okay. So, she's going to have their DNA underneath her fingernails. I'm asking why she >> because she scratched them. >> How do you know she? >> Cuz I can we can tell the evidence on her. >> On her. You can tell that she scratched somebody that she she has defensive wounds. Yes, defensive wounds like what? Oh, what do you mean? Scratches. Someone scratched her. >> She has cuts and scratches. Yeah. >> Well, I I swear that um cuz here I'm asking you had a fight. You know, I'm asking you. I said no. Okay. Well, and this is the reason why I ask Okay, just listen because this is the reason why I ask because if that hold on just just please let me talk if the DNA if the evidence shows that she has your DNA as it means that you guys were in a fight in an altercation and you're telling me there is none which means that you're lying to me which means that your story about not knowing what happened is less credible. Okay. It also some of the other evidence looks like you panicked and cleaned up. Clean up what? Clean up what? You know what? So you making that up right there, brother. Cuz I never tried to clean up any blood, man. That's a rhyme from the pill. >> Okay. >> You wash her blood off your hands. My blood off my hands. You didn't wash her blood off of your hands. I I was doing CPR. >> I assume you had her blood on your hands. You didn't do that. >> I I was doing CPR. Um I I don't know if I um cuz that was it was around too. Um so >> what's that? Um what's that saying that I tried to do CPR? >> No, I mean it sounds like you tried to cover it up. The evidence at the scene linking Toby to the crime was overwhelming. Blood in the sink proved that Toby had tried to wash Rachel's blood from his hands. Police also discovered the weapon, a pocketk knife, with the knife tip broken off from the repeated impact of the blows that took Rachel's life. Police have absolutely every >> Why does your jacket have a knife cut in it? >> A knife cut? >> Yeah, it's got a hole in it from a knife. We found it. We found it along with your phone and your wallet. Where at down in the basement when you said you didn't go in the basement. [snorts] What was my step in the basement? Well, I think you panicked and you ran downstairs trying to figure out what to do because you didn't mean to kill Michelle, which you did. No. Well, so that was at night and Yeah. I never got I never got stabbed by the device. >> Then why would you have a knife? >> I never kn my jacket. He showed me where I had a knife in my jacket. Nobody stabbed me with a knife. You know this. >> I heard that. >> So why don't you say you guys? >> Oh, cuz I think you were upset. I think you were meed out and probably paranoid and probably geeking and really upset. >> Wow. >> And then you got mad about something you pulled out. >> I don't know. That's what I'm asking. that otherwise it just seems like you did this and then try to cover it up otherwise you know there's there's a big difference between you were messed up you got upset and you you basically you out of your mind that you did something so so did I see my daughter when you were here earlier yes [snorts] because you wouldn't let me because you wouldn't let me call my daughter I helped your daughter you know when I said who do you think hurt your mom you know who she told me who >> you your own told me that she said I would never hurt my little Relle. She knows I wouldn't hurt Michelle. I don't think you did it on purpose. Professor, your DNA is going to end up on her under her nail. Yeah. From where you guys were in a fight. >> Who told you that we were in a fight? Who told you that you were that we were in a fight? Cuz she wasn't. I never told you that she was in a fight. Why do you say that? There's nobody else in my house. [screaming] >> I left nobody else saw anybody else coming to your house. >> Why would you Why does that door open? Why does the door open? I don't believe it was I don't care if you believe what it was. >> Okay. Why Why wouldn't you Why would you want to let this fight? Because it's the only thing that makes sense. because she's dead ON THE GROUND. MICHELLE'S NOT HERE ANYMORE cuz somebody stabbed her. I tried to find out who it was. I think you did. I don't think you did. Michelle, I don't think you stab Michelle. I've been your own daughter says you you've hurt her like what physically you've hurt Michelle. >> I didn't get it. No, your hands. What kind? A punch. I punched myself. You put your hands on it like >> I didn't get to the specifics of it, Cody. >> We have against what? We've never gotten to a a No, it's not. >> No, it's me. It's getting off. Um, but we've never punched each other. We never hit each other with weapons. We've never pulled a knife on each other. We've never done none of that [ __ ] What I'm saying is you're telling me that you're listening in a fight for her. She's in a fight for her like furniture getting knocked over. There's blood everywhere. She's crying out for you and you won't wake up. But I'm sleeping through the trouble that you keep telling these Mr. People are out after you and you're sleeping in this other room and they're going to come killing you in your sleep. Come on, MAN. WHO'S GOING TO BELIEVE THAT? They're talking all the back doors open. So, they are they didn't find I didn't say that that was them that was down that I said that. I said whoever this person is, whoever this mystery person is, I don't know. I don't know who who I know. I just I tell me that Michelle's a good woman. She's a good woman. She stuck by you this whole time. She doesn't have that. That's why. >> And when you get on Wow. >> Yeah. Wow. [ __ ] That's [ __ ] I didn't tell you. You told I told you that I was in the morning that um we had a fight because I was like I didn't ask you about it and I said no. >> Right. So why keep >> you probably there? >> Totally. >> We never had an argument. So I See that line trying to go man by what the evidence show her whole life. She was trying to defend herself against somebody because you panic. You didn't know what to do when you covered in blood. You went downstairs. Yeah. I'm covered in blood and I hit. Yeah. You You went downstairs trying to figure out what to do. That's why all your stuff's downstairs cuz you were trying to figure out what to do. The saddest part of the senseless murder of Rachel is just how close she was to finally escaping Toby. In the months prior to her murder, she had officially separated from him and was living with her daughter, who was desperate for her mom to leave Toby for good. >> So, your mom was staying with you? Is that what it was? >> My mom and I both got a town home in LA. >> Okay. >> We were both on um the lease. >> Okay. Do you remember about when that was? >> It was like I remember around October when we met like LA of October of last year. >> Okay. >> Um we were kicked out because of my dad. >> Me. So that's eviction on both. >> Okay. Let me ask you this. Um so so why was it you and your mom living together? [snorts] >> Why? Um, >> I mean, what was I guess what I'm asking is was she trying to get away from him or was she just >> It was supposed to be kind of a fresh start. But my mom had a um what's it called? A codependency problem where I feel like she wanted to help him. >> Mhm. >> And you know, help him through everything, be there for him. Um, she had a problem being by herself, I feel like, and I think he manipulated her so much over the years of like staying with him or, you know, like he's going to hurt her if she leaves, things like that. So, I feel like it's kind of like a stray cat. You always feed it, it's going to come back. >> You know what I mean? >> So, the And they've been together for 26 years, I guess. >> Yeah. >> Okay. >> Sadly. Okay. So, um, >> cuz she hit a different way better. >> Do you know when Toby started coming back around? >> I have no idea. >> No, >> not really. I mean, >> I don't know. She >> He went missing for a while, >> right? I remember I saw the report like in August. >> Yeah, he went missing for a while. I mean, my mom hid secrets from us cuz I felt like a lot of people cuz I felt like she just didn't want people to tell her something or you know or just be like you need to stop or you know I felt I don't know like people were going to be disappointed, >> right? >> Um I don't know agree with her decision. >> Oh, I never did. I we would get I hate to say that like we would get in arguments because I'm like, "Mom, like just you don't know how many times I've told her like to just get away from him. Like he's no good. Like you could do so much better. Like you're a beautiful individual. Like you're so beautiful. Like you have so much love in you." And this happened. I always thought something, you know, I hate to say this. I always thought something bad would happen. >> Yeah. >> Not like this though, like like you would hurt her. >> Yeah. >> But not kill her. >> No, I know you said that he's put hands. >> Oh, he's put hands. I mean, I've been rocks have been thrown at me. Shoes. Uh, a cosmic crowd he's been thrown at me. >> He's always been >> Anything he grabs >> Yeah. >> he'll throw. >> I mean, he's physically got altercation with my fiancé. >> He He literally hit him with a vacuum over the top of his head. He had to go get stitches. >> Despite the horrible history his daughter is laying out for detectives. Back in his interrogation, Toby makes one last ditch effort to place the blame on someone else. Two people in the house. You and her daughter was still angry inside that house. Yes, there was. You know what? I know they do. They have other jobs to do. They want extra place. I know in the basement to go check and see what kind of work they did. >> Yeah. >> I never did that. >> I know. I know. They said they said they said, "Hey, how you doing on the suddenly you know they said you were in the chair when they left. >> Yeah. What chair? [snorts] >> The chair in the front room when they left. >> Yeah. >> No tell that. >> Yeah. >> Okay. >> They were doing other guys if you keep Did they tell you that? How come in the chair? Was that you woke up when they left? And they said, "Hey, I woke up when they left." Yes. And they said, "Hey, how you doing?" I didn't say much. And they left. And I know that I said listen. Is that what it was? Yeah. Okay. So, but left and they went and did other jobs. So they didn't come back. All right. So that means the only people in that house are you and her. >> Does it? Yeah. >> Yeah. >> I I didn't know who was in the house. I didn't tell you this, but I went down and I was in the other room. >> I was exhausted. I was tired. I was tired. I told you that when I got up, she was out there. And Michelle and I, we've never had a fight like you're you're trying to explain. Why? Why don't you even say that I would that you stab her and then I'm trying to show up. So I spent time to do all that. Yes, that's my span. >> I think you panic. that you don't you off of you. You cleaned your hand. Listen to you clean the blood off of you and you keep telling me no you didn't. I know you did. How did you in the sink? My blood. >> No, there's blood in the sink. >> No. We are okay. It's not instantaneous, man. Turn it off to the lab. >> Don't do that. >> Okay. But it's my blood. >> I didn't say it was your blood. I said there's blood in the sink. >> Okay. There's blood in the sink. The mother telling me you didn't clean your clean up. Okay. No, I never cleaned up. No. Okay. So, what I'm saying is So, what that means is that whoever this mystery person or person Why is a mystery person? Because I know that you keep telling me cuz it wasn't these three guys that came in [screaming] there. I got But you said that you did. >> No, you didn't. The only two people in there were you. >> No, you said that these three people anybody run from the house. >> I I don't I don't I don't know that. I telling you that. >> Okay. That that there wasn't three people in there. >> No, I know there three people in there, but they left. I [snorts] know who the three people are and they left and they were at other jobs who were the gas stuff. >> Yes. >> Right. And I'm not I'm not disputing that at all. I'm disputing the fact that you keep saying it. It must have been them. >> I remember the earlier talent. You told me I need to go find out who they were. Of course. And I just Why would I say that? But I don't they did it. But you I never said you see that's kind of like what you did to me. You never said that they did it. You told me Hold on. You told me I need to find out who they were. Okay. Yeah. I said that was I don't know who they were and I didn't. Okay. And then Hold on. And they came in and you guys were both alive and and well and they left. You guys were both alive and well. Okay. I I don't know that. I don't know that. I was that was so Okay. I never I never um well seen these guys. So I I um I assume you said you talk to them, right? Okay. Okay. So So I wasn't I wasn't supposed to tell you about three people that was inside. No, no, no. You're missing the point. You That's what you kept talking about earlier when we were talking. Okay. And and so I didn't go look into that. Okay. So, you know what I'm what I'm saying is after that point, was there anybody else in the house? I I I don't I don't know. I don't I don't know. Um well anybody there supposed to be people that were um doing the um um hot water was supposed to come look at steps >> for the 5-hour interrogation. Toby's list of suspects grows, shrinks, and grows again. Ultimately, however, he couldn't escape the evidence. He was charged with murder, felonious murder, and felonious assault for taking the life of Rachel. However, he decided not to go through trial quietly. He had repeated outbursts that halted or delayed his trial, including one incident where when he saw his daughter in the crowd, he began to sob and called out to her, "I'm responsible. I didn't mean for it to happen." As he made a stabbing motion. Unsurprisingly, he was found guilty on all counts and sentenced to 25 years to life behind bars. The murder of Rachel is a reminder of just how dangerous toxic relationships can be. As much as you want someone to get better, and no matter how much love you shower them in, ultimately you cannot change someone who doesn't want to change. Our thoughts are with Rachel and her family who suffered an unimaginable loss. Thank you for watching today's video.
